Now, we move to the latest on kennedy cousin and convicted murderer, michael skakel. Attempting to get out on bail after more than a decade in prison. He was in court wednesday, for the chance he'd been waiting for for 11 years. Abc's dan abrams has the story. I believe mr. Skakel cannot be released, pursuant to the court's inherent authority. Reporter: This morning, michael skakel is waking up behind bars again. Denied bail, by the same judge, who last month, overturned his 2002 murder conviction, for the 1975 murder of neighbor martha moxley. Skakel's new attorney sought the release of the 52-year-old nephew of rfk. He found that his original attorney, was so ineffective, it looks responsibility. He should not be required to spend one more day in custody. Reporter: Prosecutors argued they have a good chance of getting the court's ruling overturned by a higher court. And while the appeal is ongoing, they say, he should remain behind bars. You have the defendant changing his story three different times about what he did during the relate relevant time periods during the murder. Reporter: And dorothy moxley, the mother of 15-year-old victim, martha, told abc news in a statement, he's still in jail. And that's the best I can hope for. And while the judge didn't release skakel, he did open a legal door, which could allow him to seek bail again, as early as next week. Many lawyers, including me, believe there's a pretty good chance an appellate court will reinstate skakel's conviction. Another problem for the skakel and kennedy families, one of the judge's primary gripes with the trial, is that the defense didn't point the finger at the defendant's own brother, tommy skakel.
