Skakel, the nephew of rfk widow, ethel kennedy, is serving a sentence for the murder of 15-year-old martha moxley. Reporter: In wednesday's ruling, the judge said of skakel's trial attorney, failures were significant and did not provide a constitutionally adequate defense. His only crime was having a bad lawyer. Reporter: This morning, connecticut prosecutors say they will appeal this ruling. Skakel's attorneys are reportedly filing a motion for bail. There is a distinct possibility that this week could be the last week that michael skakel does any jail time. And martha moxley's mother says the judge's ruling does nothing to change her mind about who murdered her daughter.
