montana judge who made comments about a victim in a rape case that sparked national outrage. And then, sentenced her attacker to only one month in prison. Well, today, that month is up. And now, there's mounting pressure to get the judge kicked off the bench. Abc's clayton sandell has the story. Reporter: This morning, former teacher, stacy rambold, will walk out of a montana jail, after serving just one month for raping a student. What do we want? Justice. When do we want it? Now. Reporter: Now, activists are filing a state ethics complaint against the judge who handed out that sentence, hoping to get him thrown off the bench. If we can't get him removed for this, there's something wrong with the system. Reporter: Rambold was sentenced in august, convicted of raping charisse morales in 2007. Morales committed suicide. Rambold got just 31 days. The judge calling morales, older than her chronological age and in control of her situation. That sparked international outrage. The judge quickly apologized. What I said was demeaning to all women. Not what I believe in. Reporter: He backtracked, even trying to change the sentence he had imposed. But -- you don't get do-overs in this way if you're a judge. Reporter: Prosecutors will argue rambold's sentence was illegal. They're appealing to the montana supreme court. If the judgment is that he needs to serve more time, he'll have to serve more time. Reporter: Judge baugh is still on the bench. Rambold goes free for now.
