Hendrix Family Business Wins Web Address

G E N E V A, Aug. 7 -- The family of Seattle guitar legend Jimi Hendrix has won a battle in cyberspace, the rights to the Internet domain name jimihendrix.com.

Experience Hendrix took its case against Denny Hammerton ofMinneola, Fla., to the U.N. World Intellectual PropertyOrganization, which ruled today that Hammerton should hand overthe Web address.

Hendrix died in London in 1970.

Experience Hendrix, headed by half-sister Janie L. Hendrix andbased in Tukwila, Wash., was formed in 1995 and, according to theruling, owns and administers substantially all rights relating toJimi Hendrix, including rights in his music, name, image andrecordings.

The groups official Web site is at www.jimi-hendrix.com.

Pattern of Cybersquatting

Hammerton, whose site was registered in the name of The JimiHendrix Fan Club, said he obtained his domain name before thefamily registered its trademarks, but arbitrator Marylee Jenkinsruled that he was well aware of the trademark.

She added that Hammerton had showed a pattern of such conductof registering and offering for sale domain names incorporatingwell-known names.

Experience Hendrix said Hammerton had previously offered to sellnames, including elvispresley.net, jethrotull.com,lindamccartney.com, mickjagger.com and paulmccartney.com.

The group also submitted copies of Web pages from a resale sitewhere the name jimihendrix.com was being offered for $1 million.

Jenkins said Hammerton was not operating the site as a fan clubaddress or in connection with any legitimate offer of goods orservices. She rejected his contention that the proceedings were aviolation of human rights and free speech and theft under theAmerican Constitution.

Another Bungle in the Net Jungle

Hammerton was one of the respondents in a case resolved lastmonth when an arbitrator ordered the transfer of the domain namesjethrotull.com and jethro-tull.com.

Anyone can register an Internet address for about $100.
