Next tonight a family is going to court with a stunning story about the life-saving gift from a brother to his sister. The brother donated one of his kidneys to save her. A nurse threw it in the trash by mistake. How could this happen at a university hospital? Abc's alex perez with our story tonight. Reporter: Waking up from surgery was supposed to be an amazing moment for sara, her chronic kidney failure had left her in desperate need of a kidney transplant. I knew something had gone wrong because I lifted up my shirt and realized I didn't have an incision. Reporter: A nurse had thrown away her donor kidney, apparently mistaking it for medical waste. Even worse, that kidney belonged to her brother paul. They were thrilled when the doctors told them he was a perfect match and he agreed to be the donor. When he said yes, it was the most amazing moment of my life. I underwent that surgery and my sister's next to me, when she's supposed to be next to me in bed. Just knowing that, yeah, it was Reporter: While this kind of mistake is not common, one report estimates there are more than 5,000 medical errors involving transplanted errors every year. In sara's case, the hospital found her another kidney in colorado and paid for her to travel there for the transplant. She and her family are suing, but the hospital is asking the judge to dismiss parts of the suit, explaining in a statement to abc news, we apologize since sincerely. We have done our best to provide remedies to help those affected move forward. She and her brother say it was a terrible ordeal. It's mainly anger, I would say.
