New information this evening about the driver of one of those buses, arrested and charged. Ryan smith back on the story tonight. Reporter: This is the bus driver police say threw times square into chaos tonight. The driver is charged with driving while impaired. Investigators say his red double decker tour bus traveling through times square sideswiped a blue tour bus. The collision, forcing the red bus to jump the curb and careen towards nearby tourists, striking a light pole, knocking it clear from its roots. This video capturing the moment that pole falls. A toddler still in the hospital tonight. The driver telling authorities his brakes weren't working. But inspectors say they found no mechanical problems with the bus. He passed an alcohol breathalyzer test, but allegedly failed a simple motor skill sobriety test at the deceased. Authorities awaiting results from the drug test. He has been suspended 20 times since 1993. There are 200 tour buses on the streets of New York every day.
