Next tonight here to some of the first pictures of actor Tracy Morgan since the deadly truck accident that left him critically hurt, out of the hospital after more than a month and tonight what he's saying about his recovery and why he's N suing Walmart for what happened on the turnpike. Here's ABC's -- Reporter: Though visibly weak while leaving his New Jersey home today, Tracy Morgan's spirits seem strong. Flashing a peace sign in this image captured by the New York daily news in one of his first appearances since being critically injured in a car accident last month -- telling photographers -- I'm okay. Reporter: The 45-year-old comedian continues recovering after spending five weeks in the hospital with a broken leg, nose and several ribs. Morgan was injured when Wal-Mart truck driver Kevin roper allegedly fell asleep behind the wheel, crashing into the van the actor was riding in. Now, Morgan is suing, claiming, quote, Walmart knew or should have known that Mr. Roper was awake for more than 24 consecutive hours immediately before the subject accident. Experts say drivers. Falling asleep is one reason accidents involving large trucks are so common on America's highways. In fact, recent Numbers show an average of people were injured and 11 killed each day in large truck crashes. These individuals are overworked and if they take their eye off the road for a nano second, they can have a horrific crash. Reporter: In response to the lawsuit Walmart says, quote, we are deeply sorry that one of our trucks was involved and we are cooperating fully in the investigation.
