Cheney Power Grab: Says White House Rules Don’t Apply to Him

Vice President Dick Cheney has asserted his office is not a part of the executive branch of the U.S. government, and therefore not bound by a presidential order governing the protection of classified information by government agencies, according to a new letter from Rep. Henry Waxman, D-Calif., to Cheney. Bill Leonard, head of the government’s Information Security Oversight Office (ISOO), told Waxman’s staff that Cheney’s office has refused to provide his staff with details regarding classified documents or submit to a routine inspection as required by presidential order, according to Waxman. In pointed letters released today by Waxman, ISOO’s Leonard twice questioned Cheney’s office on its assertion it was exempt from the rules. He received no reply, but the vice president later tried to get rid of Leonard’s office entirely, according to Waxman. Leonard did not immediately respond to requests for comment. In a statement e-mailed to the Blotter on ABCNews.com, Cheney spokeswoman Megan McGinn said, "We are confident that we are conducting the office properly under the law.” As director of the tiny, 25-person Information Security Oversight Office, Leonard is responsible for keeping track of the nation’s secrets and making sure they are properly protected. For the first two years of the George W. Bush administration, Cheney’s office complied with a presidential order that requires officials to report statistics on the number of documents it classifies and declassifies. Since 2003, however, Cheney’s office has refused to submit the data to ISOO. And when ISOO inspectors tried in 2004 to schedule a routine inspection of the vice president’s offices, they were rebuffed, Waxman’s letter claims. Other White House offices, including the National Security Council, did not object to similar inspections, according to Waxman. "Serious questions can be raised about both the legality and advisability of exempting your office from the rules that apply to all other executive branch officials," Waxman said in his letter to the vice president, and asked him to explain why he felt the rules didn’t apply to him and his staff and how he was protecting classified information in his office. Former Cheney aide I. Lewis "Scooter" Libby was recently convicted on several counts of perjury and obstruction of justice stemming from the leak of the identity of former covert CIA officer Valerie Plame, Waxman noted, and in 2006, former Cheney aide Leandro Aragoncillo pleaded guilty to sharing classified U.S. documents with foreign nationals. Aragoncillo also worked under former Democratic Vice President Al Gore, who complied with ISOO’s requests. Do you have a tip for Brian Ross and the Investigative Team?

According to the Constitution the duties of the Vice President are defined within Article I (which defines the Legislative branch) Section 3. Doesn’t this make the office part of the Legislative branch, as the office has no Executive function or duties?

Vice Presidents, up until Mondale, held the view that they were more a part of the legislative branch, since their only real job is to preside over the Senate.
So technically, Cheney is correct…he’s not really a part of the executive branch, but on the other hand, he’s not really a part of the legislative branch, either. The one office in the country where the framers really didn’t think it over too much.

This is unbelievable! Seriously, did anyone think this could even happen under our Constitution? Aren’t there THREE branches listed, none of them named “Dick Cheney’s Branch”?
Question for Brian Ross:
So… If Cheney is not under the Executive Branch, can he still claim “executive priviledge” when he doesn’t want to testify before Congress?

Dick Cheney is listed on the White House Web site as part of the Presidents Cabinet, Is the Presidents Cabinet not part of the Executive branch?
Why does he have a National Security Advisor?
Why does he have access to classified info to which Senate does not have access?
Why is he allowed to visit CIA and harangue them about yellowcake?
Dick is trying to have it both ways.

Cheney can argue that he is part of the legislative branch, as his only Constitutionally designated role ties him to the United States Senate. Such argument could be quite legitimate. However, if that is the case, he can’t claim executive privilige any more and the rules that apply to the legislative branch will apply to him.
The VP is either in the executive or legislative branch. We’d better figure out which one the VP is in, so that we know how to properly apply the laws to his office.

Robert…it is true that the VP’s duties are enumerated under Article 1, which is the article laying out the legislative branch. However, the only mention of the VP is in Section 3 (“The Vice President of the United States shall be President of the Senate, but shall have no vote, unless they be equally divided…”) and Section 4 (“The Senate shall choose their other Officers, and also a President pro tempore, in the absence of the Vice President, or when he shall exercise the Office of the President of the United States…”). In other words, he is only mentioned when identifying his one constitutional duty…to preside over the Senate.
Article 2, which lays out the executive branch begins with “The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice-President chosen for the same Term, be elected, as follows…” He is mentioned throughout Article 2, vis-a-vis the qualifications for the office, his role in a vacancy of the office of President, etc. So while your point is true, the VP has always been considered a member of the executive branch, even though he has legislative duties.

Executive branch is the president. The Vice President is a cabinet member and president of the house. This is what we call the le-gi-sla-tive branch. It’s a big word can you say it. This belongs as lead story. Again, Cheney shows his disdain for the rule of law and for basic American values. He can’t claim executive privilege to bar disclosure of the visitor logs to his residence and then claim that he’s not part of the executive branch when it suits his purposes.

OK as a member of of the legislative branch does anyone remember when they found out Jefferson had 90K in his freezer. Congress was outraged because many thought he should be exempt from the search because of Legislative privlidges. So Cheney would be entitled to these not Executive. It’s pretty simple really.

Ryan’s comment above summarizes it best … The VP is part of the Executive Branch and thus subject to all rules applying to that branch. His only legislative duty is as President of the Senate, to preside and vote in the case of a tie. But I’m sure Cheney would love to have it both ways to try to avoid any accountability. The issue of what branch he belongs do is a red herring, and we news-hounds should not follow it through the snow.

LOL, thanks Larry! Yes, Jay’s comment is inaccurate. I taught American Government for a decade and, having read all of the Federalist Papers, I would hope I know what the Founding Fathers were thinking about the office of Vice President. Many people forget that the Founding Fathers were used to a parliamentary system of government, not a presidential system. So when Brian said the founders didn’t think about the office of VP too much, he was really correct. They only wanted to establish an order of succession in case something happened to the President. Other than that, the VP was considered like the heir to the British throne…he/she has to depend on death to amount to anything!
Other than that, I think Cheney is silly doing this. Everyone who knew him back during his Ford/Bush 41 days says he has changed and not for the better. Like Dubya, I think 9/11 turned him into a zealot, thinking he had a divine mission to save the country. Like Dubya, I think history won’t look kindly on him.

So, Dick Cheney believes he’s not part of the Executive Branch?? If so, he has NO immunity from criminal charges. He can be thus tried for HIGH TREASON with-out any impeachment proceedings, and be executed upon conviction. Therefore, Mr. Cheney, by cutting yourself off from the Executive Branch, you’ve just sealed your DEATH WARRANT for TREASON. In case you haven’t learned, the Vice President has NO immunity from prosecu-tion for any crimes he may commit; and, you’ve committed many serious ones – among them, high treason and mass murder.

The Chief Justice of the Supreme Court presiding over the senate during an impeachment trial doesn’t make him a member of the legislative branch of government any more than when the VP presides over the same. First Mr. Cheney gets it into his mind to put the U.S. and Israeli “boot” across the Arabs’ necks, now, he wants to put it across ours as well. I say impeach the BUM!

If You Have Nothing To Hide, What Are You Worried About?
How many times have we heard that about bank reconds, medical records, phone calls and emails, etc. This is done without our prior knowledge.
Cheney knew this was coming, and he works for us (at least gets somne of his pay from us) and we have the right to know what is going on. The agency needing the information is not a public clearing house, SO WHAT DOES CHENEY HAVE TO HIDE AND WHY. FIRE THEM ALL AND LET THEM COLLECT UNEMPLOYMENT, NOT PENSIONS.

If the office is executive in any context then it needs to be bound by executive rules. Being legislative does not preclude being bound by executive rules in the same manner that being executive does not preclude being bound by legislative rules. If it were so, then all branches of government could conceivably do a part of everyone else’s job and claim to be bound by no rules at all. If anything, Cheney’s office should be held to an even higher level of accountability than either branch alone because he is working within more than one context. Hands in more than one cookie jar equals more accountability.
Apparently Megan McGinn doesn’t believe in basic math. She’s added 1+1 and come up with zero. But I think she and the rest of the criminals she works with know exactly what they’re doing, which is attempting to pull the wool over Americans’ eyes with a flimsy sophist argument– suitable, perhaps, for fooling a third or fourth grader.

We can’t understand why Bush hasn’t had Cheney removed from office. His office has not complied to anything that concerns Federal ethic checks or for audits to ensure that he is not in violations of national security. Him removing the entrance log so that the Feds can monitor his activity, I believe, is enought for him to be brought under investigation. He has isolated his office from all access from Federal agencies that should be able to monitor his illegal activitys.
Bush hasn’t been able to control Cheney’s illegal activities. The third in command should mave a meeting with the directors of the FBI and the CIA and secretly raid his office in the middle of the night. Evidence should be evaluated and appropiate charges should be filed accordingly on him and his staff. I recommended the rade to be in the middle of the night so that there would be less employees working to destroy evidence. I have a feel that Karl and he both will be spending time in Federal prisons fo treason.

This is a sign of resignation for Cheney, more than a power grab. Waxman is persistent and will get what he wants. Cheney has just calculated that he can stall long enough that it won’t matter. He and Bush will be out in 2009, that doesn’t give much time for investigations and Congressional Hearings needed to put teeth into any demands for information. Cheney knows this. Waxman is no showman. He will leverage the powers of his institution to put pressure on Cheney, but nothing Waxman does makes front page news. If Chuck Shumer is smart, he will stop beating the dead horse that is Alberto Gonzalez and start shining a light on Cheney who will squirm his way out of office. Cheney is the perfect villain for this political theatre. The only question is will the show open on Broadway or remain dinner theatre?

Now, I don’t know the specifics of this Presidential Order/Executive Order, that directs the ISOO to keep track of information, but the Vice President is technically correct in his claim that his office isn’t a part of the President’s Branch (the executive branch); his true role in government is President of the Senate which makes him de facto Vice President. The Vice President–the President of the Senate–is constitutionally a product of the Legislative Branch…he is an officer of the Congress, (the highest ranking officer in the Congress), and as such, there are no rules that I am aware of, that require members of Congress (House or Senate) to disclose documents to the ISOO. But, precedence dictates.

While the office of the VP may, in fact, NOT be a part of the executive branch, this administration has regularly used the claim of “executive privilege” to prevent the release of information (including information related to Scooter’s case). If the VP is part of the legislative branch, then the office is subject to the rules governing that branch (e.g. Senate investigative commitees) and there can be no claim of executive privilege.

If he is a part of the executive branch then he needs to turn over the information. If he isn’t a part of the executive branch then he needs to be forced to turn over anything and everything, plus testify, about all items he’s ever claimed executive priviledge on.
He also needs to be impeached and immediately behind him, George Bush. Then both should be tried for treason when the true extent of their crimes against this country are revealed. It’s a shame the democrats don’t have any guts.

What exactly are the “legislative duties” of the OVP, other than breaking ties in the Senate? If that’s it and the VP has no executive duties, then I vote we abolish the role and quit using taxpayer money to support it. Clearly, this VP has been closely involved with and, some suggest, even directing executive activities. These guys–why do they think that they alone should be exempt from oversight? Can’t wait to find out what they’ve actually been up to once they leave office.

Cheney? Why should I care about this guy? I have food on the table, bought with my maxed credit card. Two cars in the garage, I ride my bicycle to my job at McDonald’s cause I can’t afford gas and a house that gets foreclosed next month cause I work 15 hours a week at $7.00hr…..but who’s complaining, I live the American dream. The Speaker of the House would become president if the President and Vice President were killed. That doesn’t make her part of the executive branch, does it? The VP could only claim to be part of the legislative branch when fulfilling duties related to it. Cheney just wants to have his cake and eat it, too. And everybody else’s…

Why are we supprised by this? This is a man who, as an advisor to Goerge W. was given the task of finding the best running mate possible in 2000 and after months of work and research, picked himself! The one thing positive (and I use that term very loosely) that he did with this pick is to make W. unimpeachable. If we impeach W. for lying to congress, not following the will of the people, or not preserving, protecting, and defending the constitution of the United States, we end up with President Cheney. Brilliant Dick! Just brilliant!

I think people are missing one key point here. Cheney is saying NO to an Executive Order, not a law. Only Congress can enact a law. The President can issue Executive Orders, but there is no penalty attached to not following them except the President asking for one’s resignation if he desires.

The Vice Preisident is one of the few that are in the Cabinet, but not officially part of the Executive branch, he falls within a gray zone.
And, as stated, he falls under Article I; the legislative branch, but is very much free of all branches…as Im sure he feels in his mind, and is…

I wish we knew what country that Cheney and Bush have committed treason with. It would be a whole lot easier for all of us; so that we could start learning the language. When they announced that the U.S. mint just issued the second batch of money without God’s name on it, I told my church that it won’t be long..
I believe that Cheney is the fore runner of the anti-christ.
I believe our ground troops were purposely lured over seas while 12 million aliens invaded our borders from who knows where and a new series of gun laws were passed.
With the FBI’s 20 new databases on all us US citizens at their disposal which include all guns and ammunition we have purchased, the names, ages and sex of residence in all our households.
When they come all we can do is give them the key to our houses and to our cars and ask that they be good to our wives and daughters and that they not kill our sons and grandsons.

IMPEACHMENT seems to be a commonly used word in this comment section. I totally agree that it should be implemented immediately. Remember when “they” wanted to impeach Bill Clinton for having an extra marital affair? It was his personal life and had nothing to do with how he was running the country. (Think good foreign relations, good gas prices,no soldiers dying daily,economy sailing along nicely.) The Bush administration has been blatantly committing treason for nearly 8 years and no one can seem to do anything about it. Hmmmm…. Wonder what types of investigations will come out after they leave office.

Cheney is, in fact, subject to the constitutional rules governing the executive branch. Under Article II, sectio 4 of the constitution he may be removed from office via impeachment. Members of the legislative branch cannot be impeached. So let’s impeach Cheney now and prove to him he’s part of the executive branch.

I agree with those who are dumbfounded and flabergasted about why this issue doesn’t receive the attention it deserves. I have watched in utter disbelief for 6 and a half years as this president and vp have created a government of their own…a blatent good ol boy club (“Skull and Bones”?) that has repeatedly acted with arrogance and self-righteous pride. This latest travesty comes as no surprise…just another disappointment. I truly do not understand how this administration has gotten away with being so smug and abusive of the Consitution and governmental processes. You have less rights at a Driving While Intoxicated check point by your local police.
We live in the greatest country in the world and you libs can’t seem to appreciate it. All you libs see is threats to your personal privacy. Dick Cheney needs to be careful. If he is not part of the executive branch then he does not have the protection that the executive branch offers. If he is part of the legislative branch then he is subject to their review. You can’t pick and choose the protections of each branch you want.

Bush senior realized Jr had a major handicap to overcome as president, mainly he was functionally illiterate, and ordered Jr to hire Cheney to run things. Even before being elected, Cheney was busy setting up a shadow government, complete with his own cabinet, to run things out of site of any media, any legislative oversite, without even the henderence of his incompitent boss, the President.

The Vice President is PRESIDENT of the SENATE. The Senate is trhe Legislative branch. The Vice President of the United States has NO Presidential power. He does have Senate duties. The VP is only there to take over if the Pres is incapacitated.

The president has a legislative function, too: to sign legislation or veto it. That doesn’t make him part of the legislative branch. The Chief Justice has a legislative function: to preside at the impeachment of a president. That doesn’t make him part of the legislative branch, either. The vice-president has a legislative function: to preside over the Senate and to break ties there. See where I’m going with this? He’s part of the executive, and is breaking the rules established for that branch.
(Being part of the Cabinet, a body not mentioned in the Constitution, has nothing to with it; most presidents haven’t chosen to include the v-p in their Cabinets. Often, presidents and v-p’s barely spoke after the election.)

JDUB and so many others here make very valid points. Nixon was investigated. The Clinton/Lewinski affair was investigated to a tune of almost 10 times the amount of money that was spent on 9/11 was. Couple that with White Water and Vince Foster which were both proved to be no more than neo-con fabrications.
Yet our illustrious legislators have yet to open any investigations what so ever into any of the questionable practices and policies in play for 6 years by the Bush and Cheney administration. Not the least of which, this current fiasco.
What is wrong with us as a nation to claim that ours is a form of government built on justice for all to allow this railroading of the executive branch?
How do we push democracy with the blood of our troops and civilians elsewhere when we set this kind of an example for how a democracy is run…(into the ground) for the rest of the world?

Enough. We are not the greatest country in the world.
We rank far below many others in health care, education, personal freedom, return on taxes paid in, highways, energy independence and lots more if you care to do a little research.
We do however rank as number one for wars and proxy wars in the last century, Arms dealing, prisons and prisoners, energy consumption, consumerism and lots more if you care to again do a little research.
Give up the ghost of what we once were and take a look at us as we are. We will never regain our “greatest nation” status as long as people refuse to look at our country, warts and all and begin to genuinely work on it.

Guys what have you been smoking. The VP is absolutely a part of the executive branch. He is elected on the same ticket and the same term as president. That is proof enough. Just because he can break ties and preside over the senate does not mean anything. Chief Justice can also preside over presidential removal proceedings. He can sit on cabinet meetings a privilige NOT afforded to anyone in the legislative branch.

Skip the long drawn out impeachment proceedings. if Cheney is not part of the Exec branch then he is not eligible for certain immunity from prosecution. Outside of the Exec branch he is fully exposed. I’d take him up on his offer and just arrest him outright and begin proceedings on various crimes which may include treason.

The VP is definitely part of the Executive branch as defined under Article 2 of the Constitution. Article 1 only states that the VP is President of the Senate and his only purpose is break a tie vote.
Cheney needs to read the Constitution and get with the plan or be fired or impeached.

Please understand how bad violating this amendment can be as it is fundemental to the American life you so enjoy Andy. I can’t believe my eyes. People are actually claiming that the Vice President’s office is a part of the legislative branch?! You gotta be kidding me. First of all, the Vice President is considered part of the executive branch… the fact that he is also president of the Senate and casts the deciding vote in the Senate in the event of a tie is part of the checks and balances of the Constitution… it is a way for the Executive Branch to have some swing over what bills pass the Senate. Second, Dick Cheney has already stated that he wouldn’t testify under oath because of executive privilege. He can’t have it both ways. He is either a part of the executive branch and entitled to executive privileges, or he’s not. Which one is it?

My God, can ABC lie anymore than they do? It states this Cheney story was a top story on ABC World News, that’s where it’s listed, yet I’ve NEVER seen it on the broadcast news!
And I cannot find the story at all where Jeff Greenfield lied tonight, 6/22/2008, regarding the movie Sicko. Greenfield said there were no politicians on the left or the right advocating a health plan for America like that of Michael Moore, as Michael Moore stands in the background with Presidential Candidate Dennis Kucinich and Rep. John Conyers, who BOTH advocate a health plan just like that Michael Moore talks about in his film SICKO. Now, what that tells me is either Jeff Greenfield outright lied, or he’s not intelligent enough to be on the evening news.

I am not a constitutional lawyer either and do not believe Dick Cheney is eligible for congressional protections when he was selected to the to the Executive branch in 2000 and 2004. Did he claim these same protections when he was trying to hide the content and participants of his secret energy task force in 2001? Did the Supreme Court rule for a legislator or executive? In the CIA Leak case, was any of Mr Cheney’s political posturing during the investigation and trial that of a legislative branch member? Didn’t he make a public disclosure that as a member of the Executive Branch, he could unilaterally declassify Top Secret information? I think great Constitutional legal minds should be able to find legal precedent argued by and for Executive status on behalf Mr Cheney. The problem for America is the alignment of Supreme Court in favor of the tyranny this scumbag has perpetrated on our system.

Ideally, my belief is that both Bush and Cheney should be impeached. Practically, probably not. Look at the line of succession.
It makes more sense to impeach Cheney, effectively decapitating Bush. Just hearings would be enough to distract them both. Pelosi as VP would be a great discomfort for Bush, to say the least.
People should be shouting this news to the rooftops and screaming for blood.

This is very simple folks. The rules,also the supreme law of the land can be found in article 1 section 3 of the Constitution. The Vice President is the President of the senate,however he is only allowed to vote when there is a tie. He is not part of the Executive branch until the President is removed or dies,then and only then is he sworn in as the Executive (President). BTW in a Presidential election if the person running for Vice Pres has the same number of votes as another Vice Pres candidate the senate will elect the Vice Pres by vote.

Cheney is right. He is a member of the legislative branch of the government, and an elected official (specifically, he is the presider of the US Senate). As such, he can’t be fired by the President. Anyone in the executive branch can.
He is next in line for being the chief executive, but he has no legislative duties.
It’s kindof like the difference between a production manager, and a QC manager at a company. If there is a company directive for all production people to keep certain records, the QC people need not.

Henry Waxman has been a pathological liar and partisan demagogue for most of his Congressional career. Ask me whether I trust him or Cheney, I’d have to go with Cheney every time. Waxman has just told too many whoppers during his over-long career for me to ever trust him again.

The Information Security Oversight Office was established in 1978, by President Carter. It is an entity of the National Archives and Records Administration. Under executive orders, given by the President, the ISOO is responsible to monitor federal agencies and The White House to ensure compliance with security procedures concerning classified documents. This serves the best interests of our National Security, by making sure that classified information does not reach the hands of those who wish to harm us.
For 29 years, the Executive Branch has been one of the many federal agencies required to report to the ISOO. Cheney and his office staff did comply in 2001 and 2002. Starting in 2003, he and his office became the only ones in the 29 year history of the ISOO to refuse to comply. Why? It is my opinion that it is because President Bush amended the executive orders, in 2003. One clause in the orders now reads: Sec. 1.3. Classification Authority. (a) The authority to classify information originally may be exercised only by:
(1) the President AND, IN THE PERFORMANCE OF EXECUTIVE DUTIES, THE VICE PRESIDENT. In other words, Cheney can twist this to mean that he is exempt from the executive branch unless he becomes the acting President or a White House staffer/aide. We know that he is not a member of the Judicial Branch. He would like us to believe that he is a member of the Legislative Branch, in order to skirt the issue. Arguing that Cheney is part of the Legislative Branch, because he breaks ties as the President of the Senate is about the same as arguing that GWB is part of the Legislative Branch since he implements vetoes.
The ISOO often makes visits to the federal agencies to monitor compliance. They have visited Cheney’s office, only to be refused entry. In 2006, the ISOO wrote to Cheney to encourage him to comply. They never received an answer. They have written to Attorney General Gonzales, in order to receive resolution in the matter. Go figure, Gonzales has taken no action. In retaliation, Cheney has set about to abolish the ISOO.
With no ISOO, no one would be monitoring the proper handling of classified documents. This would be a terrible blow to national security. It could encourage some individuals within these agencies to run amuck, shred documents, leak documents, and engage in an array of secretive illegal activities, without fear of accountability. Do we need more corruption that we already have? What has Cheney been up to?
Waxman is the chairman of the House Oversight Committee. It is the main investigative committee of the U.S. House and has jurisdiction to investigate any federal program and any matter with federal policy implications.
The committee has learned of the objections made by the OSOO concerning Cheney. We must demand that they go forward and force him to comply. We cannot allow any Vice President, Democrat or Republican, to pick and choose which laws they are above. That’s a blank check for unlimited corruption and power.
Better yet, let’s try to impeach Cheney.
Tell Pelosi and Reid that we that we want Kucinich’s House Resolution 333, presented to Congress.

So many things are said and done by this administration that would have been impeachable offenses just 10 years ago. This is a sad good-bye, although I continue to hope it’s only temporary, to a government that was the safe haven for all people who were persecuted. Here, they created a government by the people, for the people and of the people. A Dictatorship is now in place and we are all like “sheep” just playing our computer games and worrying about fashion and movie stars lives…allowing the “dumbing down” of our population. Does this remind anybody of “another famous dictator from Germany”? Cheney needs to comply with the OSOO and allow the protections established to protect our country and our citizens to work. Allowing one office to refuse to comply is like injecting cancer cells into our government that will grow and fester. As the Government sickens from the cancer more and more decisions will be made outside of the Constitution. The Cheney cancer, as well as the many other strains already eating away at the United States (many decades old) will eat away at the freedoms and structure of the United States until it becomes an Communist entity, part of the New World Order. The most recent acts underway to further this goal are the Amnesty Bill and the creation of the North American Union.
Possible solutions: write your Congress people and Senators and tell them to put an end to this or not be re-elected, change your party affiliation to anything but Republican or Democrat, do not vote for anyone that is running for election that has accumulated huge amounts of campaign funds (they are owned by their contributors), vote for condidates that are not members of the controlling parties, fight to get rid of organizations whose goals are to bring about the New World Order (such as the Council on Foreign Relations), have the Constitution amended to provide for impeachment of public officials by the citizens without involving Congress, do away with the Federal Reserve banking system, and multiple other changes that are needed to get the United States back on track.

Cheney is being, to use a phrase made famous in an Australian court, “being economical with the truth.” What he says is true, but it is not the whole truth.
Constitutionally, the office of VP is part of the legislative branch, not the executive branch. VP does not mean “assistant president” but “backup president.” Incapacity, death or resignation of the President means the VP takes over and only then is he in the executive branch. Until and unless that happens, the VP is firmly in the legislative branch because of his constitutional role (albeit a very minor one) in the Senate.
However, while the OFFICE of the VP is not part of the executive branch, because Cheney is a de facto part of the executive, as much (if not more) as any person bearing the title “Secretary” (as in Secretary of State), then Cheney the person IS part of the executive.

I knew, lots of us knew, and kept trying to warn people that these folks were trouble. All you had to do was read a little. Bush had never been a good leader in business or politics. He was just a name to represent corporate interests. Cheney was the CEO of a major defense and oil industry contractor. Did anyone really think there would not be a conflict of interest? The neo-con creedo “Project for a new American Century” said very clearly that we should seek to dramatically increase our military dominance around the world especially in the middle east, but that doing so would “require a cataclysmic event, something on the magnitude of Pearl Harbor”. Well, let’s give him the “President of the Senate” ONLY arrangement and have the Senate enact a law that says he MUST sit in his Senate chair whenever it’s in session and may NOT engage in any Executive duties, go on any trips, or attend any meetings except those authorized by the Senate until the President Is unable to be President and the VP has to take his place.
And unfund any office and staff he has not needed for his Senate duties.

Legally and Constitutionaly, Cheney is correct, but the argument may be imposible to sustain politically. He is an elected Federal officer. He does not answer to the President, the President cannot hire or fire him or his staff. His only constitutional duties are legislaive (presiding over the Senate and the Electoral College) and judicial (presiding over impeachments of anyone except the President–Including his own impeachment, BTW).

Apparently those who never made it past 5th grade learning didn’t make it to the part where they explain that the Cabinet is APPOINTED not ELECTED. Therefore he must be different. You could also consider the President to be part of the Cabinet. The VP is clearly a member of the Executive Branch. He was not elected as per the rules of the legislative branch, and his role with the branch is token in nature. Not like the country couldn’t run without a Senate President.

america has lost its fairness to its own people, if it ever really had it at all (have a conversation with someone not white male, you think you have it bad?) .
watch football or baseball or nascar or any sport. choose you side wager your heart and belief and hope and sence of pride. then watch the other cheat.

Unlike most of the people who have written here, I took a moment and searched for the phrase “Vice President” in the constitution. I found that the only mention of duties was the legislative duty of President of the Senate. Though mentioned in the same sentence as the President in Article 2, the Vice President, is not stipulated to be a member of the executive branch.
Though it seems clear to me, I’d love to hear what the courts have to say on this one!

I have a question, can anyone answer it. when The Worst of All Time, gwb and cheney leave office, can they be prosecuted. not that i think the dems. have the testical fortitude to do it of course. just wonderin?
