Black Youth Facing 22 Years for Schoolyard Fight
The FBI, Justice Department, and the U.S. attorney’s office are set to meet in Jena, La., today to discuss possible civil rights violations revolving around a racially-charged schoolyard beating. The case involves the assault of a white student, Justin Barker, at Jena High School by six black schoolmates. Mychal Bell, the first of the six students to be tried in court, was convicted of aggravated second-degree battery and faces up to 22 years and six months in prison. The remaining five students have not yet faced trial. Critics have called the charges outrageous, citing the facts that Barker only received minor injuries and was released from the hospital that same day so he could attend a school ceremony. Civil rights leaders say the black defendants, now known as the "Jena 6," have received unequal treatment compared to white defendants charged with similar crimes. "Justice in La Salle Parish is not meted out equally," said Tory Pegram, development and public education associate for the Louisiana chapter of the American Civil Liberties Union.
The attack on Barker was the latest incident in a series of conflicts between white and black students sparked when black students found three hangman’s nooses dangling from a tree on school property. Robert Bailey, one of the Jena 6, was assaulted at a local party by white students using bottles and fists. Those who assaulted Bailey were only charged with simple battery by the district attorney in La Salle Parish, the district in which Jena lies. Bell’s attorney, Louis Scott, said, "Actions by black students were treated more harshly than actions by white students." Click Here for Full Blotter Coverage. Unable to post the $90,000 bond, Bell has remained in prison since his arrest. His attorney has delayed sentencing from the scheduled July 31 court date until September 20 to exercise all available legal options. The Justice Department would not comment on the meeting because it is part of "ongoing casework." The district attorney could not be reached for comment. Well, of course “Actions by black students were treated more harshly than actions by white students.” It’s Louisiana for God’s sake, and “Bubba” rules. Integration may have been mandated years ago but the prejudice still stands in lots of places in the South. So it cuts both ways, sometimes, like the charges against the LaCross players (white boys) accused of raping a black girl. Race should NOT be an issue but I don’t see that happening anytime soon. Until people get over the “color” thing (both ways) injustice will prevail.

“The attack on Barker was the latest incident in a series of conflicts between white and black students sparked when black students found three hangman’s nooses dangling from a tree on school property.”
That, by definition, is a hate crime (and the definition can be found on the FBI website). The FBI is charged with investigating hate crimes. Why are they not investigating this one? Why have the perpetrators not been brought to justice?

So called civil rights leaders excusing criminal behaviors by individuals just because those individuals are black? Umm, how shocking. If these “leaders” really wanted to help the black community (and all society in general), they would condemn criminal actions perpetrated by anyone, regardless of skin color. Those six criminal thugs should be imprisoned for a long time for gang assaulting an innocent person. Notice I didn’t say “black thugs” and “innocent white person.” I’m color blind when it comes to crime and punishment, unlike the pathetic “leaders” in your article.

Some white guys beat up Mexicans for no reason in San Diego. They go prison time. 6 blacks against 1 white. Sounds about right. They should do some time.

Any action such as this one is a hate crime.Just because the bad actors were black does not make this kind of action any thing less. so yes LetsKeepItReal you are not correct.

Okay, but should these kids be getting charged with aggravated battery, landing them in serious prison time even though this was a school-yard jumping, basically.
We all know what high school was like. There were fights, kids got beat up. That’s what happened here.

GET SOME JUSTICE! WHAT IN THE SAM HENRY “HADES” IS THE DOJ DOING? THIS IS UNCONSCIONABLE.
Posted by: NEICIE | July 27, 2007, 12:04 am 12:04 am
No one is condoning what happened. A crime was committed. What IS being questioned, though, is the disparity of punishment. Aggravated Assault? When the victim was basically uninjured beyond the usual bumps and bruises. That is a problem. Justice has to be equal if it is to be respected. Prior to the assault by the black kids, some white kids assualted a black kid at a party. The white kids were tried, convicted and given probation. Now that is a disparity of justice. So now it’s out there for all the world to see. Truth, justive and the America Way? not if you’re black and living in Jena, Louisanna…

These kids are all still young enough that they must be living at home. Therefore they have not ventured out into the real work-a-day world where responsible/civil behaviour is very important. If this is the case, maybe some time with a “scared stiff” program, and community service working as assistants to adult leaders with a youth counseling program might be a better idea. If behaviour like this happens again, then give them some jail time if the crime is serious enough.

A noose hanging from a tree. Retaliation. If they stop provoking it, the violence will stop.
Posted by: Gerald | July 27, 2007, 11:26 am 11:26 am
You have a way with words, Dougster58.
The fact is that no one should be allowed to committ a crime and get away with it.
But, when a disparity of justice occurs respect for real justice diminishes because of what is percieved as an inability to obtain justice in the system.
Justice must be meted out without the issue of color being a determinig factor.
The DA office of LaSalle county made race an issue when the office choose to prosecutute the white perpetrators of a white on black assault with a lesser charge then the one choosen to be used against the black perpetrators of a black on white assualt.
Race has been and will always remain an issue for some in this country because they only see the superficial and not the beautiful heart and soul that dwells beneath.

I feel that the school should get in trouble for keeping campus security on sit and if they did have security where they close by to see this issue heat up slowy before it truned into this a violent act this could have been provent had the check the campess for thing that dont belong on campus could have been removed so that this young men would have got hurt.

I know I’m ignorant about this, but what does a noose hanging from a tree signify? It evidently means some racial slur? I agree with Mitch about the punishment, high schoolers are sometimes immature and don’t always make the right decision, but to send him to prison for 22 years when the victim was not severely injured does not make sense.
Posted by: Deb | July 27, 2007, 1:38 pm 1:38 pm
It must be nice to be white in AMERICA. Because in America as a white person you are given mulligans, do overs and the benefit of the doubt. But as any person of color you are treated with disrespect , coldness and no sympathy or empathy. I see a double standard of justice as a Police officer, it is aggravated assault when a weapon of any type is used during a fight. I feel that if one party was treated as children, with the benefit of the doubt, then so should the other. I guess that only happens if you are white in AMERICA. Also if things pan out as they should , just like the Duke Prosecuter, This joker should be disbarred as well. Its only fair. oops I forgot, these “KIDS” are not white in AMERICA.

I love the people that are diminishing this crime. So Finch, 3 nooses hanging in a tree is, by definition, a hate crime huh? I took your suggestion and went to the FBI website. Absolutely nowhere did I find any definition whatsoever that even remotely said anything like that. If I ever saw 3 nooses in a tree, I certainly wouldn’t automatically assume that it must be some sort of a heinous conspiracy to threaten or intimate an African American or deprive him of his rights. What high school did you go to Uncle Same where it was OK to beat people up? Because in the town I grew up in, that kind of thing was sort of looked down upon and any perpetrator was punished. If I were you, I’d move. And Mitch, I guess we should go easy on someone if he gang assaults an innocent victim once, but hey, if he does it twice we’ll just be a little more strict then huh? Because the first victim for some reason is somehow less a human being then the second victim. In high school I still lived at home, but I still had the morals to know it wasn’t OK to violently assault someone because of their race. And RNKay, if the white students were charged with a lesser crime, maybe the FACTS of that case bore out the decision to charge them with a lesser crime. That’s how a crime gets charged: by whatever facts support that particular charge. To say that in every instance where two people get different charges brought against them, and they happen to be different races, is due to racism, is shear stupidity. And how do you know how hurt the victim was Deb? Because the “critics” say he only received minor injuries? Gee, I’m sure they wouldn’t try at all to trivialize the injuries caused by the people they’re defending. Let’s have you be viciously attacked by 6 thugs for no reason and let’s see how physically and psychologically hurt you are. Then let’s see what sentence you think is appropriate.
Posted by: informedone | July 27, 2007, 3:18 pm 3:18 pm
Gee Kommisar, you are definitely right. It is absolutely not possible that more black people are in jail because they are guilty of more crimes. The explanation can not possibly be that simple. Instead the reason MUST be that there is a vast conspiracy in which tens of millions of racist people, including police officers, investigators, technicians, witnesses, lawyers, paralegals, prosecutors, court personnel, judges, and jurors, are all working closely together to persecute people based on their race. Of course, why didn’t I see that before?
Posted by: informedone | July 27, 2007, 3:36 pm 3:36 pm
Do pay attention, informedone (sic).
Perhaps studying some history would help you understand why three nooses dangling from a tree on school property might intimidate black students. What *would* you assume about the purpose of those nooses?
My post was about the FBI not doing its job. Nowhere did I say it’s all right to beat people up. It is not. That statement applies equally to people of different races, which means it was not all right for white students to beat black students with bottles and fists. Why are you trying to diminish *that* crime?

There were 100 murders in LA last year, I think that shows that the punishment of crimes is not strict enough there. Finally there is a judge willing to try and put a stop to the violence. There is no way I would visit that state as long as the crime rate is so incredibly high. Come on people, take some pride in our justice system and applaud those willing to put an end to this madness. Nobody should be afraid to visit any state in OUR great nation and people who live there should not do so in FEAR!

Informedone, I see where you are coming from. My thoughts are about justice being blind and not having an agenda. The DA threatened these kids prior to the incident. also one of the “witnesses was involved with an incident by brandishing a weapon. Also one of the black kids , during a fracas, was struck in the head with a bottle and his attackers only received probation…So I guess the bottle was not considered a weapon and the kids fractured skull was an accident … I know, I know , the kids head struck the bottle, thus making it his fault…What was I thinking. I guess your right , Its all paranoia because racism does not exist…

I think the democrats have taken this way way out of proportion into a battle of there stupidity. Alberto is odne a good job.
Example here just learned this one since black american get jobs in HR and in managemnt they will not hire no one else but black now so I hope well find out who will take over the democatic parties here soon will come to what is needed now.
You could be next no job no stock do background check on the criminals who can be shoplifters on the job as well.

The student attacked by the 6 had nothing to do with the noose or any other transgressions… He just happened to be white. In the attack on him the 6 used racial epitaths. Sounds like a hate crime, smells like a hate crime, looks like a hate crime. If the rolls were reversed I’m sure Jesse Jackson would be making a beeline for the nearest camera.

Some of you people say your blind to color.Well you aren’t some of the commencts you make are those of a person who is prejudice and doesn’t even know it . Yes the 6 boys should be charged with simple battery just like those who assaulted robert bailey(african american). There were 2 crimes in this article remember? Assault on a caucasian boy in the school yard by 6 african american boys AND an assault on a african amercian boy by caucasian boys (unspecified number) using not only there fist but beer bottles as well.Keep in mind that the attack on the caucasian child was in a school yard where adults are near by they were able to stop th efight and get the child medical help the enable him to return to school the same day! When the african american child was assault it was at a party probably with no adults around not to mention they were using BEER BOTTLES!!!!could you imagine what might have happened if no one had intervened? The point is BOTH sides did wrong BOTH side committed assault, and if you ask me the assualt against the african american was more serious since it could have been labelled assault witha deadly weapon.no major injuries were incured so tell me why and adolescent who has his whole life ahead of him would have to spen 22 year of his life in jail.If the justice system wants to play it like that then all the boys black and white should go to jail for that long that way they both pay for there actions and families on both sides feel the pain.I guess americians are so ani-terror the forgot how to run an equal and just society!
Posted by: bumblebee | July 29, 2007, 1:43 pm 1:43 pm
Excuse me….there is a zero tolerance on school grounds now for any form of violence!!! Just the fact that the second attack took place on school grounds give cause for different actions by the law. This is the direct result of all the school shootings. I will tell you that there is very little that can be done about attacks or fights off school grounds. My son was attached by a group of kids ‘same skin color btw’ but different nationalities. The injuries were very serious. The police were called, a report filed, nothing done. The other parents were not even spoken to by the police. The school would not get involved, I beleive because my son is blonde with blue eyes. Very sad, a kid is a kid. The threats carried over to the school, he was chased through the school being called a Nazi, be cause over 200 years ago his ancestors came from Germany.
Pay attention people…Hate is everywhere, and no one is really trying to stop it. And only is it a hate crime if a person of color is hurt in the eyes of the public and the law.

Face it ppl! Until we get past this white vs black vs yellow vs brown vs red vs etc etc, we as a ppl will never make any real progress. We are lucky to have gotten this far given the nature of the ACLU and its pentient for unrealistic goals, screwing up religion, and generally trying to control our lives worse then the Dems!

I don’t see color either but if a crime committed then he/she should be punished equally. Race is an issue because of the sentence the white kids were given. 22 yrs is along time to be given to a kid, especially since this is an on going problem. Right is Right. If one gets probation then so should everyone else! Honestly I feel they should all do time because this should not be accepted in a community period.

There is so much info missing from this article its ridiculous. The kid who was “beaten” actually attended a social function later on that same day… not to mention that it was provoked in part by racial slurs from the white student involved.
In other words, there are mitigating circumstances that any rational person would take into consideration before thinking 22 years for a schoolyard fight that did not result any serious or lasting injuries is a fair judgment. This would be true even if race were not a factor.

I think that racism can go both ways. Maybe in this case they are being treated unfairly…but we don’t have all the facts…the media only tells readers what they want them to think. There is racism everywhere in this country.

The article said this victim was able to attend a school function the same day, so I assumed the injuries would not have been life threatening. I use to play with Atty: Gravel kids in Alex,.LA. We had no problems..Read Proverbs 30th Chap and 11th verse -15th..you’ll know why this is happening today in this Generation.
It’s because of the Parent’s that dislike the Negro Race that these kids get this from.not all Caucasions are like that, tho.but the HATE is there..

Although i have no criminal record whatsoever to think that if i ever got into a fight i might get 22 YEARS IN PRISON plus whatever the U.S NAVY gives me!It’s unreal.I’m from texas i’ve seen racism in many ways directed from one ethnicity to another and as far as i’m concerned this case is just another case of what i call “American Teenage Stupidity”, but of course it’s going to be blown out of proportion. Now in days you can’t go one day with out hearing a racist slur. As parents we should teach or kids what is wrong and that is right , 6 kid betting up 1 kid is wrong, betting him up because he is of another color , even worse. We should all take a good look around and see what is it that we are teching our children, and maybe we should not belive avething that the media says, because they always make evrthing sound worse than it is.

I don’t know about racial motivation and that white and black are treated different other than what I see on the news. I think they are taking all forms of punishment for normal childish school behavior to the extreme. Here in the Pacific NW we have to middle school boys that are facing prison time and a lifetime of registering as sex offenders for slapping someone on the behind. I think it is time we say enough is enough and start punishing real crimes. Let the punishment match the crime. Why should a parent who murders a child get less time in prison than some boys that jumped a fellow student.

Why is it every time a black is charged with assaulting a white person, they pull the race card. If the situation were reversed, Al Sharpton, Jessie Jackson et al will be screaming bloody murder, but when it is a white person who is assaulted by blacks, it’s swept under the carpet. I hope these black racists get the harshest penalty under the law.

I have been very upset about how these high school age black students have been treated. They are facing the outrageous charge of attempted murder. The district attorney reduced the charge for the one who was tried, and since the young man was 16 at the time it should have been handled in juvenile court. Racial hate is evil and does not reflect well on christian values in Jena, La.

I live in Louisiana and I know first hand how racism affects all of us. Yes there are more black people that commit crimes than whites, but has anyone ever examined why? Poverty, unequal education and I can definitely prove that here in Louisiana, and unequal opportunities. Down here if you are white, you are always right. I have white female counterparts that don’t have to know nearly as much as I do. I have to prove myself on a daily basis and that is only because I am black.
This case of the Jena Six is ridiculous! Nooses hung from any tree is a direct threat to a life (remember the KKK?).The only thing missing was the burning cross and someone probably did that but instead burned the school down. That was a hate crime. I have never known anyone to get into a school yard fight, even gang members, and get charged with attempted murder (the charges now dropped to assault). 25 years to life? For a student that has scholarships to LSU and other prestigious universities and that has never been in any trouble before?
And about the crime in Louisiana,(I’m in New Orleans) what some people fail to realize is that decent African Americans are just as scared of the criminal element as they are. The difference is we have to live next door to the thugs and they are from our neighborhoods. You think we like hearing of gang shootings and murders? And don’t dare tell because you’ll be next. Who can trust a police force that will tell the criminals who you are for the right price. White people move away, ever heard of white flight? Well it’s prevalent here – Northshore Louisiana. But those of us that have to stick around have to deal with it the best way we know how. We were only awarded civil right less than 70 years ago- that is not enough time for all the wounds to heal but this case of the Jena Six is like putting salt on the cut!

Ok….I’ve been out of high school for a long time and I am not condoning what the young black men did, but give me a break sentencing high school kids for poor judgment for fighting on school grounds to 22 years. Come on, it just shows how ignorant and racist Jena, LA is. As for the Infoderme, you need to get real. Hanging nooses from a tree is definitely threatening and hateful to African Americans and as far as I am concerned it is a HATE CRIME. The KKK made sure to intimidate blacks in the south and they did there fair share of hanging blacks from trees (men and women). If you don’t know this you don’t know anything about slavery and blacks in America. I’m sure you are to young to remember how they hung Emmet Till (a young black man from Chicago visiting family in the south because he looked and whistled at a white woman). Every black person in America knows how some whites (notice I’m not saying all) look and treat us. Sure we may be a little sensitive but until you have walked in our shoes you really don’t know how we feel. As far as justice in this country…it has been historically harsher sentences for blacks. True, we don’t know all the facts but how would you feel if some black called you “out” and you and all your friends jumped him. You really expect me to believe that you would expect and be willing to serve 22 years. If you say yes, I don’t believe you. Race is and will always be a problem in this country. I moved to the new South (what a laugh) from California. Nothing has changed. They just sugar coat racism with a southern drawl.

racecard is right…imagine a black kid being attacked by six white kids. Those morons sharpton and jackson would never shut up about it. Oh, but the victim is white so it’s ok.
six on one, that’s about what i’d expect.
Why can’t hate crime laws be applied to crimes comitted by blacks? or was this a love crime? because we all know that all black people really, really love white people, right? only white people are capable of hate, right?

well maybe 22 years is a bit much? so just cut it back to 21. with out all the details, what is the sense in all of this anyway. if the attack on the white kid is truly a hate crime, then he gets what the law says he gets. certainly there must of been some logical difference between the two cases. there must be some reason for discrepancy, and i don’t believe it is race.

Blacks and hispanics cause much more crime according to US Gov’t sttistics – not racial propaganda! Actually the Gov’t tries to cover up the criminality of blacks and hispanics by counting many non-white hispanics as white.

“Racecard” and “Surrounded by Idiocy” are NOT right, as other commenters (not enough, apparently) have noted. The “beating” of the white child by the six accused was not an isolated, six-on-one, hate-crime incident: it was the culmination of a series of racially charged incidents initiated and perpetuated by white students.
Incident 1: Black adolescent tries to stand under “white kids’” tree. (Some of you probably think he was “asking for it.”)
Incident 2: Nooses, clearly suggesting lynching for those with any sense of history, appear in tree. Perpetrators are located; they’re given in-school suspension, and they are not accused of hate speech.
Incident 3: Black students organize silent, civil protest under tree. School calls assemby at which local D.A. makes statements that are read as threatening protestors with legal action. Whether statements really are threatening remains unclear.

When are we as adults going to truly step up to the plate. I am surrounded daily by America’s troubled youth. Motherless daughters, fatherless sons, motherless sons, fatherless daughters. When was the last time you checked on the single mom up the street. Does her babies have milk to drink, food to eat. Oh! I forgot that not your problem. Your son plays football how about your neighbors son? Can you afford to donate his player fee? If so, why not? You drive your son can he get a ride? What would it really cost you? Ladies, when was the last time you complemented the little girl up the street. You know how much we need that reassurance, self esteem boost. When you passed her did she look like she needed a hug? Why not give it. I could go on which i’m sure you notice. All i’m trying to say is that we have to do more to get more. It is our problem! Show our children that life can be so much more than a music video.
I know I can’t carpet the would but I can’t find my comfortable slippers either. Please, give a child (boys, girls, teens) a smile and a hug you’ll be suprised what it can do.
Injustice anywhere is a threat to justice everywhere. Martin Luther King Jr., Letter from Birmingham Jail, April 16, 1963

No one here has mentioned the fact that a white boy pulled a gun on 3 black kids and received no punishment. The boys wrestled the gun away from the white boy and ran home, the black boys were charged with theft. Does that sound fair? Also what about the black boy that was beat up at the white party, or it doesn’t matter because he was black. Why are the black boy’s bails set so high? The white boy/boys that was charged with beating up the one black boy, his bail was set at $5000.00. Does that seem fair? Walk in our shoes and see what we see, when we walk in to a store and the owner follows us around, when we walk on the street and are asked by police what we are doing, ride in my car when I am pulled over and asked can I please step out of the car, when I ask the officer why am I being pulled over and get no answer. Some of you all will never encounter this so I don’t expect you to feel as I feel when I see a noose, because you have never went though some of the things that I have went through. Some of you don’t know of racism like I know of racism. Someone mentioned that there are no white only scholarship’s at historically black colleges they do have a minority scholarship’s, because at a historically black college guess who is the minority. The reason I know this is because my friend attended a historically black college on one.

First off I must say that it is very disturbing to see many of these comments posted here. Its obvious that many of these people posting comments on here are nothing but racists and whats even more disturbing about it is your fully aware that your a racist and your proud thats why you leave these hateful comments. But its okay we all have to meet our maker one day and well some of you I feel sorry for. But as far as the young boy looking at 22 years in prison downright outrage. I wonder what justification the courts have for this case, lol. Believe me theyll probably come up with a good one. Im gonna keep these boys in my prayers, hopefully, just maybe these racists will allow God into their hearts.

The only problem I have with the prison sentence is that he goes to an institution, for 22 years, that feeds on racial discrimination. That would mean, he would get out at, approximately, at the age of 40. This is a life sentence. Who would hire a man in his 40′s with no college education and a hate crime felony? I wouldn’t, white or black. If the lesson to teach is that racism is wrong, prison should be the last place to consider. That to me is the problem. The courts job is to judge and punish, the prison’s job to carry out the sentence and try to rehabilitate the inmate. How do we fix the problem and punish accordingly? Remember folks, there is only one way to fight hate, and its called love. Peace be to all.

Again I see a situation has brought back many hard feelings of a bad history. I feel there is injustice on all sides of the law. The laws governing each states varies as we all know. I live in St. Louis & almost lost my life to a violent crime committed against me. I am an African American & I was beat, spat on, my hair was pulled, he poured gas all over me in an attempt to set me on fire, put a gun to my head & raped me. This guy served 6 months in jail & released because the judge said statistically speaking most women go back to their abusers. I wasn’t this guys 1st victim either. To this very day he still stalks me & I live in constant fear. On ther other hand my brother who lives in In. met a girl who was white. She lied about her age & said she was 19. They dated for awhile before they were intimate. After those special times began her father found out she was dating a black man & they are charging him with sexual misconduct of a minor. On the stand the girl admitted that she lied about her age. Other white guys who dated her has testified that she told them she was 19. They are trying to give him a 20 yr sentence. I said this to say that injustice is everywhere & there should be laws that have the same penalty no matter who commit them. Each state should actually be in agreement with standards set for crimes. I believe in fairness but it takes effort on our part as Americans to get our states in order. But hey, we are to busy trying to rum other peole countries that we can’t see our own falling apart. This is what makes a vunerable as a nation. It’s called division. A house divided against itself cannot stand. We need to come into agreement as a people & let the past go before history repeats itself yet again. We are all so caught up in self righteousness & vanity that we can’t see our own flaws. Let’s agree to disagree & come to a compromise so that we can re establish a solid foundation for our future. For we know we all have some other race mixed in our blood so there is no color. It’s a moral issue.

I am a 38yr old black male serving in the US NAVY. 1st, I often believe Jackson and Sharpton often speak to further their own respective agendas vs the black cause..just wanted to put that out there. Second, I agree with all of you who focus on the facts of the crimes committed. For any crime to have been perpetrated, the elements of that crime must be met. In the military, striking someone with a beer bottle would constitute aggravated battery(AV). Six individuals on 1 would also constitute AV. Three hangman’s nooses would definately constitute a hate crime. Don’t know La’s statute language, so can’t say. But if ANY of you believe that equal and fair treatment has been applied here, you are a fool..and the only person you’re fooling is yourself. It is completely unreasonable to believe that if you go upside someone’s head with a beer bottle that it should be considered simple battery and punished with probation. A SINGLE person committing this act is guilty of AV upon conviction. Conversely, 6 people attacking 1 person COULD also be adjudicated as AV, especially dependent upon the sustained injuries. 22yrs? Too long in my opinion, but both of these groups of people committed these crimes. Both should be sent somewhere to contemplate their actions for a while. How long, I don’t know, but long enough for it to hurt, definitely.

There is so much wrong here everybody can have a big piece. Where to begin…
The draconian 22 year sentence- that is just outrageous… murderers get off with lighter sentences all the time. Yes, I do believe racism and class warfare are factors in its severity. Having the resources to hire top of the line lawyers is probably even of greater significance than race. Racism by both sides- would surprise me if it is not true. Some people are always stirring the pot, usually the innocent are the ones getting burned. Rather than send these young people to prison, society would be better served by some sort of program that would put them together to sort out their differences in a more constructive manner, help them to recognize just how amazing and valuable all people are, especially in our differences. Nooses? I dont see much difference between them and burning crosses, its a code most people would understand. But blacks can be very racist too. I’ve seen 20 blacks attack 1 white simultaneously for no better reason than he was the captain of an almost all black football team. No, it wasnt racism that put him in that top position either, he just had incredible talent. Believe, it or not he even won that fight. Saw a giant black kid (male) repeatedly ram a white girl’s head into a desk it didnt fit into. Never knew why. My husband has had 4 blacks beat the crap out of him with rubber hoses before he was able to get away. Did I raise my son to be a racist? Hell no. Racism dosnt just hurt the hated, it also hurts the hater just as much. False constructs of the mind/heart imperil one’s ability to think clearly, to see truly, to love easily…I would never want to handicap my son with racism, made a point of introducing him to other races/cultures in social situations when opportunities occured.

To those who say that more blacks commit crimes than whites, that depends on the crime.
For instance, what is one of the most shocking crime rash to stun the nation in the 1990s and 2000s? Answer: school shooting sprees by students.
Since the rash started on February 2, 1996, in Moses Lake, WA, ALL BUT TWO of the perpetrators of such incidents have been young WHITE males. The ONLY two exceptions were two of the most recent: Jeff Weise, the American Indian on the reservation; and Seung-Hui_Cho of the Virginia Tech massacre. NEITHER of them, and NONE of the others, were black. NOT ONE BLACK KID has EVER preditatively shot up a school! There have been one-on-one murders by blacks that took place at a school, and at least one NON-premeditated shooting spree by a black kid, but talking here about the Columbine / Virginia Tech style PREMEDITATED shooting SPREES, no, no black kid has EVER done that.
Also, with the SOLE exception of Jeff Weiss on the reservation, these have ALWAYS taken place in “NICE, PEACEFUL” MIDDLE-CLASS and UPPER-MIDDLE-CLASS SMALL TOWNS and SUBURBS. PEARL, MS., NOT JACKSON, for instance. LITTLETON, CO., NOT DENVER. And so on, and so on, and so on. NOT ONE has taken place in an inner-city slum, nor indeed in any poor predominantly black neighborhood, or “da ’Hood.”
You’d never know that from the media coverage, though. Don’t depend on them. Check it out for yourself. Look at the lists of premeditated school shooting sprees available online. Now look up where they happened, the demographics of the area, and what race and economic class the perpetrators are. Don’t take my word for it.

I agree the punishment is to harsh. He should be punished the way the law states. You do a crime, you do the time. Not 22 years! That is a little rediculous. I am a white male and I have been jumped by three black males for being white. Police filed a report and nothing was done. Hate crime? I am sure. I could have retailiated, but chose not to because that would only continue the trend of racism. Someone, anyone should take that same approach. I don’t think that whites are the only racist. That is a bold face lie. There is equal racism in every ethnicity. I also have been harrased by cops of all ethnicities. Thats just cops. Not that your white or black. The 6 should be punished for the crime, but not 22 years.

On August 2nd, George had the temerity to ask:
“How does one know if blacks didn’t place these nooses ?
Do you know ? No…you don’t.”
Uh, yes, yes we do. You see, the ones who set the nooses were caught and punished with a slap on the wrist (in-school detention). They were, of course, white. This is a known fact.
Ask another stupid question. Come on. Ask.
Oh, by the way, not that it matters, but I’m a middle-aged Southern white man, born in Texas and raised in the Deep South.

What I don’t understand is WHY no-one is expressing HOW this all started. The school had a large tree with an unwriten rule that ONLY WHITES could sit under. Finally a group of BLACKS decided to sit under the tree. So, a group of WHITES decided to place the hangmen nooses on the tree limbs. Then the Black youth was viciously attacked at a party. Things escalated from there to the White youth being attacked later. The question comes in when the White youths are punished in a menial manner, and the Blacks in a harsher manner. It’s really funny how people cannot see anything wrong with how each group’s punishment is given. As long as we justify different treatment, racism will continue to prosper. The school was very much aware of the tree being used as a symbol of status and class. It should have dealt with this stupidity long ago. I now hear that the tree has been cut down.

The media hasn’t mentioned the total situation at the convenient store. The white guy was walking in the store when 3 black guys started running towards him and he ran back to his truck and grabbed his gun.
Also, according to witnesses the 6 did things like slam Justin Barker’s head into the concrete and kicked and stomped him. Without teacher and student intervention he probably would have died.

All of you who say this is not a hate crime on the basis of race, you are out of your mind! The simple fact is that we live in a racist society and until we open our eyes and realize that, these type of crimes and injustices will continue to occur. Why is it that it is 2007 and we haven’t as a people (black, white, yellow, brown etc. ) havent figured this out? Ponder on that?
Lets be apart of the solution and not the problem!

I just hear about this on the Michael B.radio show here in ohio 93.1fm This is crazy, it took almost a month for me to hear about this story. I am outrage about this I don’t agree with fighting I do agree that the court system should be more mature in sentencing these young boys. I can’t believe that you would report info that important as 6 young men life that would basicly it over for them because of a school yard fight. I send all my love and support to the family…

I have been listening to the news information on the six kids and the Jena 6 case. I am a grandmother and mother and quite frankly confused as to why this has not received the coverage in the same media frenzy as te Michael Vick story and follow-up conviction story. What deems a good or great story on your network–is Hurricane Dean more important than the fate of six young men whose only crime is to be born Black. I have always felt ABC had more integrity than this and doubt I will continue to watch this network as the poles of balance are definitely color blind. NBC News certainly has the right idea to bring this serious issue of justice to the forefront of the American people.
Thank you basically for nothing.

I’ve also just heard about this story from the Michael Basin show on 92.3. I think this is very a horrible and racists situation. What we should think about are these boys future that could dramatically change over a yard fight. We clearly see that racism is still well and alive. This is clearly a hate crime motivated by deep rooted racism and unequal treatment. What I can’t understand is why weren’t the white kids involved in this situation sentenced the same. I do hope this will not stand, I send my prayer’s and love to those 6 boys family’s. I have a son myself I know how hard this must be for them. I wish there was more I could do.

I heard about this on my way home. I could not beleive what I was hearing. They are trying to send these young to prison for a school yard fight….. If the justice system allows thos to happen, I can truley say they have failed everyone. Being a black person truley has its downfalls, but this is crazy. That means if, if there is another school fight on the grounds at this particular school or anywhere. The same laws should be applied, but we all know that is not going to happen. It makes me sick that LA law allows these racist people to act like this. It’s like they have permission to to treat the blacks in such a manner and provoke them to get this kind of reaction out of us. I’m not saying all white people like this but you know who you are. I will beat the brakes off anybody who tries to harm me or threaten me in any kind of whatever race you are. This is so ridiculous.

I just heard about this whole issue today, August 21, 2007. Honestly, but for the Michael Baisden Show, I wouldn’t have known anything about it. I live in the Washington, DC metro area where this story has not been covered in the print media or on the television news. After hearing it on the show today, I decided to look it up on the internet and see now that it has reached the masses via the web. On the one hand, because I am an African American female, I find it sad that the media has spent weeks, if not months, focusing on the Michael Vick story and no time whatsoever discussing the issues being faced by these young people. On the other hand, reading all of the prior comments, I can see to some extent why the television media has focused so little on the story. It is devisive. Whites seem to believe that it wasn’t a big deal that the nooses were placed under the tree. Blacks are outraged by that act. I would suggest that we be honest with ourselves. We live in a country with a long history of racial injustice starting from the fact that this nation for several hundred years legally enslaved an entire race of people and to this day, refuses to apologize for that transgression. Once slavery legally ended, our government found a way to allow the stigma of slavery to remain with the Jim Crow laws and nearly one hundred years of failing to enforce the right to vote to African Americans. I was raised in the deep south (Mississippi) and saw first hand the effects of slavery. Our country has come a long way since the passage of the Civil Rights Act, but still has so much more to do. The effects of slavery will remain as long as our children are taught to hate. Nooses are a symbol of the Ku Klux Klan. People were ACTUALLY hung with nooses for many years after the Civil War. The children who placed the nooses in the school yard KNEW exactly what message they were sending when they placed that symbol of division and hatred. The events that happened subsequent to the noose placement were BOUND to happen. The war started with the nooses. As adults, we seem to dismiss much of what has happened as kids being kids. But these kids are simply acting and reacting based on what they have been taught by their parents and the lessons of history. The kid (to me, it doesn’t matter his race) that was beat up and went to a school function that same night was hurt I’m sure. After all, he did have to seek medical treatment. But I think that if the intent was to kill him, he might have suffered a lot more than a concussion. Crimes and punishment for crimes should be balanced. Please, let us not dismiss the law of acting and reacting. It seems to me like the 6 kids who beat the other kid were reacting. The 6 kids should be punished. But they shouldn’t be facing 20 to 100 years in jail as the reports are stating. It would be good if we could have a national conversation on these issues so that MAYBE we could try to understand each other and finally see how the things we teach our children help shape the world they live in.

Like so many others, I just heard the story, and I watch and listen to national news daily. The story was no surprise to me and though it should provoke outrage, non-minority and minority families alike should set down with thier teens and discuss the story. Oops, most families do not set down to dinner or have familiar forums to discuss issues such as this.
If this story surprises many, wait 15 more years. I can only imagine the stories we will wake up to regarding race, government, ecomonics, business and the unsavory seeds of behavior which or being germinated as we speak. I see little hope for significant change in my life time
Do you?

America is on a slippery slop sliding down the hill equality it has been climbing for many decades now. The biggest obstacle preventing the nation from achieving racial equality is many whites do see the need to work toward it. Whites hear about a story like the Jena 6 case and think “no big deal.” Because the youth being prosecuted are black many whites feel the Jena 6 are getting what they deserve. Blinded by their prejudice they simply cannot see the injustice being done here. They forget these are just boys who beat up another boy. They want to treat them the same way they would treat a murderer or rapist. Twenty + year for a fight, ridicules. People get less time for murder everyday in courts all over this country. Shame on the DA for being so bound by his own bias that he in not capable of doing what is right. Shame on the DA his failure to see and treat all of citizens of Jena fairly and equally.

I watch GMA every morning, I haven’t heard anyting about Jena 6. This is a very important story, why isn’t there any new coverage on your show. When Ms. Hilton went to jail, GMA had something to report everyday. Now a story that should be covered is swept under the rug. Innocent children are being sent to jail, because of racism!!

The black youth in our present society often fall victim to making bad choices often due to them attempting or wanting to impress each other. Understandably there should have been some rage from any human being who felt intimidated or pain from an incident that taunted violence; i.e., the noose hanging on the tree limb. Anger is an emotion that we choose, it is not a disease, it is a decision, we have not caught anything disease that makes us angry it is a decision.

I too am upset about anyones child having to spend anytime in prison for anything that is deemed unjustified. However, our young black men need more guidance and drive in building for the future of our race as a people and their children. It is not a black or white issue as far as I am concerned. It is a human issue. We have got to start parenting again and stop allowing other children to raise our children for us. Peer pressure and encouragement from other young minds often lead to bad situations. I pray these kid get something out of this ordeal w/ little or no prison time and become better human beings and adults that we can all be proud of. Anger is an emotion that we choose. Stop getting mad about and take back control of these young mis-guided minds that breed ignorance and hurt families. Let the justice system of prayer guide them in this unfortunate ordeal and justice will prevail. God is always at the controls and there is nothing like the power of prayer. Let’s Pray people. Amen!!!!

It is suprising how the news media pick it’s venue for that day. Primetime last night displayed incest on TV like it was great to know, while six teenagers are about to lose their lives in jail through racism in Jena. Good Morning America is a great venue for this story, but we have not heard anything from any of your news affiliates. Jena 6 is not worthy making national news. The devil is rampant in our World. Incest is more important than lives. Get it together!

Wow, if this is the usual punishment for school yard fights (NO MATTER WHAT COLOR)imagine how many of US would be in prison right know. Some MURDERS do not get that much time!!! The AMERICAN justice system is a JOKE! Everyone does somethings as adolescents that when you become an adult wouldn’t dare do today. I am in aww of how a KID could loose half of his life because of a fight. What is the average sentence for a hate crime? I don’t believe it is 22 years. If they want to send a message to people about hate crimes, why start now with kids? I believe the average sentencing term is up to 5 years, 22 years and NO DEATH is ridiculous!

This case could set a ridculous precedence that will effect the future of all youth (Black/White) involved in future school yard brawl (which will occur). Something so serious and explosive should be plastered over all news media for discussion. Where is the outrage over the potential impact of this case? The national news coverage can focus several hours on stories of Paris goes to jail and of Michael Vick expected jail time. What about spending more serious hours on stories involving the youth of this country – our future. This could prompt discussions from parents with their children on the seriousness of their actions in imperfect society.

I took the time to read many of the comments here . . . some were obviously well thoughtout responses . . . some were obviously idiotic comments coated with racism. I teach high school . . . mostly young men, just like the ones we are talking about here. As an educator I work hard to encourage my students to have faith in the justice system and their community leaders. It saddens me to see these young men facing 20+ years in prison for a crime that in most instances would involve probation and community service. I believe the acts should not go unpunished but I think there is an injustice here that obviously is doing more harm than good. All the boys involved (black and white) were wrong. No doubt about that. I just don’t believe that there is anything to be gained by a punishment this harsh for what was essentially a school yard fight where there were no weapons involved. As a teacher I would much rather break up a fist fight than to be dodging bullets. I’m also disappointed that the noose hanging was not taken more seriously. Coming from Canada . . . even we know what that means and how serious it is. A gesture like that, is never a prank. Maybe if that incident had been properly addressed all of these boys would be thinking about going off to college (having learned a very important lesson in life) rather than going off to prison (having learned nothing but disgust and disappointment in the justice system). My thoughts and prayers go out the boys and their families.

I can’t explain how sad I am to say that I am growing up in a world where hate crimes still take place. I’ve learned since preschool that everyone is equal, didn’t the kids who hung the nooses learn the same things I did? If not, I am ashamed to say something is wrong with America. Maybe we should start focusing on the problems at hand because America is obviously not doing enough to teach its own country how to behave.

What is going on with the world. We are suppose to be gettin better about the hatred towards one another not worse. Yeah they may have jumped the black boy O.K. now that we got the cleared away what about the fact that the white boys jumped the black boy while using what is considerd weapons (bottles). I don’t hear anyone getting angry about that. I don’t hear anybody talking about giving then 22 years in prison. All they got was a slap on the hand (probation) and told don’t do it again. Why are the black boys being treated like the have committed the worst crime when the injuries the put on the boy was only minor bumps and bruises. Of course we all know that they should be punished for fightin but to that extent? I mean if you feel that the white boys can learn there lesson by probation why can’t the black boys. What should be persued is why the white boys got such a small punishment and the black boys are getting such a large one for a crime a little similar but with less force. We need to take a look at ourselves it is UNFAIR! THINK THEN RESPOND!

I don’t condone violence against innocent victims. Young people should be held accountable for their actions. I do believe that the punishment should fit the crime. The shocking reality is that “justice is blind” and it is evidenced in the harsh sentencing in this case. Twenty-two years for minor assault. You cannot tell me that a message is not being sent out to the Black community of Jena. It seems like they want even more Blacks in prisons and a return to “Separate But Equal Schools”. When is it going to end?

This sadden me because of all the things I went through as a young black male, growing up in the South. But, to hear that this kind of injustice is still going on in schools and some southern states makes me wonder what type of justice system do we have?
Posted by: Butch | August 26, 2007, 7:14 pm 7:14 pm
We can debate the details of this case until the end of time, but honestly none of us have that type of time. Time is running out while innocent people deteriorate behind jail. Now, let me be clear. When I say innocent, I am referring to the innumerable amount of people that are falsely imprisoned and railroaded simply because of race and a lack of money. It hurts me deeply that we, as a nation, are not progressing unity wise. It stills boils down to education and empathy. I’m concerned and really bothered that a commenter above claimed to not understand why the nooses were threatening. Black history is American history. This should be known & not ignored. We should ALL be hurt if a hate crime is committed against anyone – I am. The prosecutors in Jena had the opportunity to set a precedent of tolerance & education – to BOTH sides, but they chose to continually vilify blacks. Ask yourself why situations often seem so one-sided. (This needs to be applied to all things, even wars, etc.) My comment does not contain any cracks at Jesse Jackson or Al Sharpton for I believe that these men only want to help. For so long, blacks have been vilified – look at the comment above regarding blacks committing more crimes. Look at the statistics, that comment just ISN’T factual. Beyond that, we must independently study. We will never get all of the facts from the news or just our surroundings. EVERYONE has a steak in how situations are perceived or played out – prosecutors want promotions & judgeships; news stations only want salacious stories which to them totals ratings (because truth sometimes just doesn’t pack the viewers in the way a juicy Enquirer story would), etc. Please just step outside of yourself and look in. Stop the wisecracks & let go of the animosity, if only momentarily, & you’ll easily notice that racism is woven into the fabric of this country. People are reared to hate other people & as much as some of us would like to look at one another & say that racism no longer exits or that people are colorblind, that’s putting on blinders. Prison is NO joke. In prison, people are raped and killed! Spirits and families are broken for situations where people may have just made a mistake. Having a fight does not make you a criminal or satan himself. Rehabilitation is no longer the purpose behind jail sentencing b/c jails are now for sale. Once a person has a record, there is no second chance for them. Just understand the severity behind this situation. There should be NO disparities in sentencing or arrests and since there is, we should ALL be outraged. For all that turn their head & ignore this injustice, this same situation could be your own one day. I know it doesn’t seem like it now, but just as the fight for civil rights helped us ALL, this fight will also. At this point, I am so scared for my future children if they can just be pulled-over for the color of their skin (racial profiling) or jailed and/or killed just because ……..

Keep fueling the fire. Keep fanning the flames. When all these little embers blow up to a national event, THEN you ALL will be asking, “What the hell is THEIR problem?”

Anybody that has read the bits and pieces of information regarding the Jena 6 has to know that this is just ridiculous. A woman (any woman) can get raped, brutally abused and her attacker and/and or abuser doesn’t get 22 years. Parents kill their kids, abuse them badly and get off very light. Drunk drivers kill people and get off very light compared to what they are trying to do to these kids. This punishment of 22 years is outrageous. Take the racial implications out of this and know that this is about what is right and what is wrong. All of us can debate until we are blue in the face. Everyone of us needs to get down there on September 20 and say to sentence those children to 22 years is ridiculous and that the adults handling this case need to be reprimaned to to full extent of the law.

It should’nt be black or white but it is, not by the leaders or the citiens, but by the justice department in Jena.
To the person that say he is color blind when it comes to justice, you may not have said black thugs, or the white innocent person, but you did say those six thugs, why do they have to be thugs. What about the people at the white party that beat up the black boy, shouldn’t they be called thugs and be sent away for a long time to. What about the kids that hung the nooses from the tree, how long should they be sent away.

IT’S A DAMN SHAME THAT IN THIS DAY AND TIME, THAT WE STILL HAVE THIS TYPE OF THINKING STILL GIONG ON. THE TIME DOES NOT FIT THE CRIME. IT’S TIME TO LET THESE YOUNG MEN MOVE ON WITH THEIR LIVES. THEY ARE FINE YOUNG MEN WHO DO NOT DESERVE THE TREATMENT THAT THEY ARE GETTING FROM A SCHOOL YARD RUMBLE. KIDS WILL BE KIDS, AND SCHOOL YARD FIGHTINGS WILL ALWAYS HAPPEN.
Posted by: kermitt | August 28, 2007, 8:36 am 8:36 am
The point in this case is that there was a simular incident were white kids beat a black kid and received the bare minimum charge. The black kids are wrong for what they did and so are the white kids. The scales of justice should be blind to this but we all know what justice means (JUST US).

I think it’s a racial issue to the initial actions that lead up to the violent altercation. I also read in the article how Robert Bailey one of the six boys was assaulted with bottles (weapon)and fist and got simple assault charges. wow! very double standard.
People have to wake up, blacks and whites are still fighting over what? When will it end. I don’t see any good coming from neither situation. People need to grow up and learn how to respect each other. Forget about race, we are human beings.
Posted by: Kripolocious | August 28, 2007, 12:15 pm 12:15 pm
I think people have to wake up and smell the coffee, EVERYONE IS NOT CREATED EQUAL IN THE EYES OF THE AMERICAN JUSTICE SYSTEM! We are talking about the SOUTH here, being born and raised in Georgia I know the situation of these young men and I am a female. We have to look at the environment in which they live. I find it hard to believe that they wake up every morning and life is just a box of chocolate, many of you couldn’t bare to walk a mile in their shoes. It is a constant struggle to deal with prejudice and walking outside to see handman’s nooses on a tree is just a reminder. These kids should only have to worry about their education, yet they are being distracted by constant hate crimes which should only be familiar to the older generations of their families. It needs to stop! The thing is that people try to ignore the fact that racism is very much existent and it is becoming less and less concealed [America is moving backwards]. If you think racism does not exist, you are as ignorant as they come, and you should probably take a trip down south to all the little segregated towns where train tracks serve as race dividers. I am not supporting violent activity, but I am not in favor of unfair treatment based on race, and I am certainly not happy with the way the rules are bent for white people in this country. If you think that is untrue, then you are ignorant as well.

I would like an update on the FBI’s investigation of the hate crime that ocurred in Jena. If the FBI is not doing anything about this case, as a tax paying American I want an explanation NOW! GMA and all the other news networks need to concentrate on these types of human atrocities and not the Micheal Vicks of the world. Maybe it’s just me but I value human lives more than dogs. Don’t get me wrong I’m not an animal hater I own 2 Boston Terriers, but lets keep life in perspective. For those of you who are living in oblivion next door to cloud 9 in La La land, until we’re all the same size, shape and color this world, especially THIS country will always be infected with racism. Unfortunately, the old antiboitics for racism (The Civil Rights Acts of 1866, 1871 and 1875) no longer work on the new mutated form of hatred, institutionalized racism.

I agree with Justkeepitreal. Why isn’t the fbi investigating this racism is still alive. For STanjay it will always be a black/white thing. Why because honey even if most wont agree we are still slaves. Read willies letter what he said in 1712 is still going on. For that teenager getting 22 years for nothing crazy. Stop saying something is wrong with them. Something is wrong with us older black because we think it’s over and it’s not. Seems that most of us don’t know so we need to be taught so we can teach them that nothing would be here I mean nothing if we was not here. Remember that for those who forgot. Again you learn then teach them I teach mine.

First of all, is sad to see how ignorant people can be . People like that is what’s wrong now. No one is saying that what the Jena 6 did was right and what the caucasian kids did was not right either, but the reality of it is that the punishment for the two are just unfair. How can they even think on giving a KID 22 years for a school fight, when there have been cases like Jennifer Porter where she killed two kids and run from the scene and basically got off on HOUSE ARREST. Are this people really serious??? I don’t think this kids should just get off, but I also don’t think the punishment fits the crime. What is this world coming to? Racism is every where is sad to say, but is the reality. Is not just African americans and caucasians is every race. It seem like instead of progressing we are moving backwards.

I was really disappointed in this article. There is so much more to this story that I’m surprised the writer was comfortable putting it out there with this little bit of information. I know the entire story but judging from many of the reactions of the people that have left comments here, they don’t. In some cases, I would say, if you don’t have the time and/or interest to report they entire story, you shouldn’t report it at all.
Posted by: rose | August 30, 2007, 9:15 am 9:15 am
I must ask how many that commented took the time to read the entire story. There were events that came out of this that shows there is a serious problem in Jena, LA. First there was the hanging of the noose. This caused a protest from additional students. Then there was the visit to the school for the DA’s office with his warning to the black students. Why was the warning not given to ALL students. That incident was followed by a Black child being beaten up by a group of whites for being at a White party. Though they were all charged with a crime they were charged as juveniles given probation for a sentence. Then there was the incident with the white teen pointing a SHOTGUN at a group of black teens. They took the shotgun and ran with it. In this case the white teen was not charged but the black teens were charged with theft. Is it theft to take a gun from someone threatening you and run away? That followed the taunting from the white students that were given probation against the black teen that THEY beat up on. Why were they allowed back in school? Finally there was the school yard fight. The six teens all were charged as adults of felonies that carry heavy sentencing. Putting this all together shows a serious problem exists in Jena. The issue is more the justice for the “Jena 6″. The issue is Justice for Blacks in that town. How many other things exist that we know nothing about. Come on America this is 2007. Something is terrible wrong here.

It’s evidences that this is concerning a hate crime which i’m not gone to cover that up or sugar coat it none. It need to be address because you put anyone in a unwelcome environment they gone to respond to conquer and survive. Look at Katrina and the responce from the people in New Orlean. So i’m not gone to dismiss the fact this is a hate crime and they were unfairly treated but on the REAL these are Kids. Prison is no place for a child. If it was your child whether they were white or black would you want your child in prison? What happen to community service, or counseling to get to the root of the problemn and come up with a solution. And we wonder why in america or kids are shooting in the school, making bombs, and killing ther parents. Wake up america if we dont teach and bring our kids up the right and proper way we fail as parents and history will repeat it self over and over again till it destroy us. Yeah it’s easy to send him to prision but where is correction and guidance. Yeah laws are pasted, blacks can vote, and go to any school they want to, but as much seem to change alot stays the same. God help us all.

I cannot believe they types of comments posted. All of you who think that the judgement for this is correct are part of the problem. Im in no way condoning beating up the white kid because we have to learn how to deal with these types of situations better but if you dont see that these chain of events would have never happened if those hangmans noose stuff wouldnt have been in that tree. There is an old saying that you can only hit a man so many times before he hits back, this happened to be one of those times. Just read further in the case, if you cant notice to inequality in it then maybe you need to take a look in the mirror. America is divided into the rich and the poor, its not even about black or white anymore and in that sense if your not rich your not important. It is sad really that in 2007 people still have this mind frame. Like Charles Murphy said “we got to do better”. If you have never been stopped because your “profile” matches that of someone the police are looking for, or even arrested for that matter then you wouldnt even begin to know what it is to be descriminated against so do your homework before posting your 2 cents.

Justice…you call this justice!! What would YOU do if it was your child Black or White, being accused and even convicted for a school fight! NOT A RIOT!!! Maybe if it was a riot it would have gotten news coverage, you think!! America open your eyes, Everyone Knows what that noose stood for, and if you say you don’t,you’re a Liar! If the situation was reversed you wouldn’t be able to watch the news or read the newspaper without hearing about what happened!!!Headlines would be ” 6 White Students Being Accused of a School Fight” Unfair Treatment!! Give me a break.. do what’s right..

I pray that these issues get the attention they deserve. This speaks of our country, pain and simply. It’s still about two things class and race. They both play a role in this society and when it comes to American Justice. We have to get back, we have to get back to standing up, we have to speak out. It’s still truth, that together we stand, divided we fall. The Truth never dies. It’s good to see people so passionate about what’s happening down there but, how many of you have written to the Prosecutors Office? How many of you have donated to the young black men legal team (I have). We have to do more the voice our opinions. We have to show face where we believe we have been wronged. We shouldnt wait until a battle is at our front door to become activist. I’m speaking of this incident and other like it that we may let slip right pass us. In this case, this is White mans justice and the only people they pay is JUST US. WORDS are still WORDS and as the old saying goes ACTION still speaks LOUDER then words. Don’t let this become your child or family member before you use more then just words, GOD bless you all.

it’s amazing that people who support this course of action by the jena courts is unaware are able to over look the fact that there was a whites only tree with 3 hangmen ropes on campus, several attacks on the black kids even involving a gun and no one faced 22yrs but a kid’s shoe is classified as a deadly weapon.(hello-the gun!)you can choose to be ignorant to the fact that justice in America is not handed out equally and be critical of those who stand up in protest. I don’t have a problem convicting white, black or whatever as long as the system is fair and this lacks fairness on every level.Kids wearing the support the jena one were allowed in the school but the kids with support the jena 6 were told they would be expelled.that’s LA justice which is a shame in America 2007.Blacks can’t move on and let race lie when stuff like this is still taking place.

What puzzles me is the fact that the school would allow the nooses to be hanging in a tree…The last time I checked hanging was considered a crime, and that is what a noose is used for. Those who feel like the 6 young men where justly charged because this happen on school grounds, should ask themselves why a no tolerance institution would allow nooses to be hung. The crime was committed before the attack; it just took the attack to bring it to light. If you think the punishment fits the crime. Ask yourself, how would I feel if it was my child getting 22 years for fighting in school?? Do you still think the punishment fits the crime???
Posted by: OnlyoneJudge | September 4, 2007, 11:12 pm 11:12 pm
I can’t believe all the comments defending this as justice. As sure as I know Michael Vick deserves jail time. these young men do not!!! What an outrage that the DA would try to charge attempted murder. The victim is not innocent in this racial tension and anyone that portrays him as that is in DENIAL! He didn’t even spend the night in the hospital. The school failed, the police failed, the DA failed… It’s time for the state leaders to get involved. You want the nation to continue to help rebuild New Orleans then you better set this straight. Why send tax dollars to a state that would allow this type of injustice!
Posted by: jewel | September 5, 2007, 1:46 am 1:46 am
if it were a Jewish person and they had Hitler and and other thing there and they felt their life was in danger. Just as I’m sure the young black boy did, noose hanging from a tree something within you tell you to fight or flight. So, they fought, We would have been outraged if it would have been any other group of individuals (jews, gays, handicapped) but because they were black sticking up for themselves because they felt threathen we blame them. It wrong we blame the victim, not the aggressor.

These six young men knocked another student unconscious, and then stomped his face until others intervened. If the tables were turned and it were six whites stomping on an unconscious black youth.. the same who now call on the six to be released would be clamoring for hate crimes convictions and life sentences.
Posted by: Scott | September 5, 2007, 5:12 pm 5:12 pm
Scott did you read the WHOLE story? He wasn’t unconscious. But you are missing the big picture. These are teenage boys that got into a fight. Why should they be charged as adults? I’m a 34 year old BLACK woman who teaches 3 and 4 years old to show and speak respect everyday. This court system is taking away 6 young men lives because of their color. No matter how you look at this, it’s always about the color. I was born and raised in the south and my husband is from the north but we decided to live in the south.Even though I only left my home town for only 1 year, many white folks here thought I was stuck up because I looked them in the eye now and spoke my opinion in an educated way. Some even talked to my mother about it. I had to laugh when I heard that. Blacks here have to prove themselves more than anybody. Before I became a teacher, I volunteered at my nephews schools and saw how many of the black students ( especially boys) were taught differently and with a lot of attitudes that it made me want to make a difference. I try to help educate my young and many times single parents on positive ways to raise their child by providing things and ways for them. Every one of my parents have my home number just in case they need help, even if it’s babysitting for them on the weekend so they can go to work. After hearing about this story on the Michael Bisdsen radio show, I have been reading what ever I can on the Jena 6. Like many of you, I like animals but to have Michael Vick, Paris, Logan or even a new network show have more coverage than these boys is inhuman. If our society keeps this up, we will not have a country with a future. Terrorist don’t have nothing over injustice like this. Terrorist wouldn’t destroy our country but we will if we don’t wake up and do something.
To the people who commented about Sharpton and Jackson, they really a lot but not everything they do makes the paper. Do not get mad at them because they force society to look at themselves in a different light. Without them, how would we find out that injustice is being served.

Some of you are really ignorant or you just can’t read…”Robert Bailey, one of the Jena 6, was assaulted at a local party by white students using bottles and fists. Those who assaulted Bailey were only charged with simple battery by the district attorney in La Salle Parish.” on the other hand…”Mychal Bell, the first of the six students to be tried in court, was convicted of aggravated second-degree battery and faces up to 22 years and six months in prison” so a bunch of white kids beat up one black kid with bottles and fists it’s simple battery, bunch of black kids beat up one white kid and it’s attempted murder. This is so ridiculous I am almost ashamed to call myself an american citizen. No wonder the world hates us. Jena, If ever I travel through I will make sure not to spend any of my hard earned dollars on your backwards, ignorant, racist town.

I do not understand the system sometimes. We try and try to be equal but it is not. I am not saying that african americans are always being treated unfaily, but in this case it clearly shows the treatment that they are recieveing. These are children and it seems to me they are trying to destroy their future. Why is THAT DA prosecuting this case when it is clear that he is racist. Yes I said it racist….Where are the leaders for our community? I am sick with this society. We accepting to everyone else except our own. Just another hard working, fed up african american………..
Posted by: Michelle B | September 6, 2007, 2:14 pm 2:14 pm
My understanding is that the school yard fight started over racial comments by the Caucasian student. However, this still does not give the African American students the right to hit/fight the Caucasian student. Since the fight was and the students were being provoked at school by racial comments, it could not have been pre-meditated.
Additionally, may understanding is that the Caucasian student attended a party some times after being released from the hospital. Which says the injuries could not have been as bad. Kids fight in school, at the school bus etc.. It happens. I just think all of the kids should have received suspension and that’s it.
Hanging a noose is a hate crime and should have been charged as one. What you do to one, you should do to all. Just implement equal justice. The way the DA charged these kids should have been treated as a hate crime because if he didn’t hate them he would have just had the school administration implement the same punishment the gave the Caucasian kids. Sounds like this is a gross case of misuse of power which is apparently condoned by the judge. They should both be disbarred because I am sure this is not the first time.

I would have been blind to all this as well if not for radio talk shows. With experience being the best teacher I can only speak from that and in the up bringing of my background years ago I would have been convicted as well, simply put there are anger issues we all must deal with. Everyone snaps in one form or another sometimes, if the kid was joking the other kid for getting jumped at a party AND he was hit with a bottle thats says you know somethin about it or you had somethin to do with it.

This is the reason why African Americans should continue to monitor and report on practices (white-only trees) that continue to taint the soul of America. Jews are still prosecuting those involved in the commission of the holocaust. The world should never forget it. The Jena 6 are heroes because they confronted an unjust practice and then defended themselves when provoked. I hope the world sees the ignorance that still plagues some of America’s institutions and public officials.

Nooses from a tree? There’s a lovely schoolyard display. Why are actions that spark hate ignored by educators? I use the term loosely. These kids learn all about racism from years of dinner talk with Mom and Dad. I’m white in the north and it’s no better here.I can’t believe the stuff my 13 year old son tells me. The hatred the comes out of the mouths of babes 2007. It’s sickening. If these situations are to stop our educators have to step up nationally to counteract this homegrown
racism. 40 years, when will Americans see our common thread. The rest of the world, enemies and allies are watching
and our weaknesses are apparent. The
problems here are bigger that a schoolyard fight for all of us. Wake up to the big picture.

Seems many of you missed the articles were it turns out a black kid was JUMPED BY SEVERAL WHITES when the black attempted to go to a party that was majority white. One white student used a beer bottle to the black kid’s head yet he was charged with only a simple assautl charge and NONE of the other white kids were charged (that way no conspiracy charges would be filed demaning lengthy sentencing).
Does the FBI also deem jumping a black student and cracking his skull with a beer bottle as a hate crime as some goober mentioned above??!??

What I dont understand is how I have not heard about this issue until just a few weeks ago on a radio station, and its now september!!! Hmm someone has definately been trying to cover this one up from the public eye. Well I am mixed with white and black and the acts that the criminals made on both sides of the issue dont add up to the punishment. If a white kid can get off with probation for hitting another kid in the head with a beer bottle and beating him with his fits, then a black kid who used nothing but fists should not get 22 years in prison. yes I understand that the white kid was hurt pretty bad so was the black kid at the party but the white kid wasnt hurt bad enough that he couldnt go back to school that same day. I understand that the people involved are teenagers but heck I’m only 18 and I know damn well what right from wrong is! I would not be caught jumping anyone for any reason. Ever heard of sticks and stones…, and even if I thought I was protected by the president’s secret service I sure wouldn’t be slinging racial slurs to anyone. Kids and teens need good home training and a spanking every now and again. I got spanked comming up and I thank my parents for it because it teaches a sense of consequences to actions.
And I am sooo sory to crumble the little happyland, fairy tail world some of you think you live in but Im young and even I know that racism still exists. so I suggest you all do some reading and educate yourselves because its not only american history its all over the world. Most black people think that hate crimes are only committed against them but its not just about blacks, its nazis and jews, its in the arabian penensula, its in africa against thier own people! what about those white men with wives and children who end up getting beat by black gangsters for being in the wrong neighborhood, I know rev. Jackson tries but you dont see him defending that guy, racism wrong both ways and all ways. And if you are blind to it you will never be apart of the solution to help it.

Why is it that a man can assult/batter his wife and only be put in jail for 14 days… yet these KIDS do it and they are charged as an adult and it is claimed to be murder?? 22 years… disgusting…
It upsets me to think that anyone, black or white can see this as equal treatment…

I also only heard about this story from radio shows. The media is saturated with unimportant things like paris hilton, & anna nicole smith, but real news, not a chance. I hold the school district responsible for even allowing a “WHITE ONLY” tree on school property. Isn’t that illegal? Then nooses are hung in the tree. Well, no threat there, let’s give them inschool suspension, cause that will teach them a lesson. And since when is it legal to pull a gun on kids, & when they take it away, THEIR THE WRONG DOERS!Then white kids beat up a black kids using bottles, and it’s simple assualt! Then the DA goes to the school and threatens the black students with the schools permission! I want to know who that school superintent is, just in case he wants a job in our school district.Don’t tell me that’s fair!

OK. Let’s talk about fair. If six white kids attacked one black kid, would Al Sharpton be concerned? Would they be charged with a “hate crime”? So called racial equality does not concern Al Sharpton. He is only interested in his own notariety.

Crime is crime I agree however if they had a simple school yard fight then I too agree race has become the bigger issue. For a simple assault they should receive some community service and /or probation. Life is too short for all races to cut it down by sending our youth to prison for simple assault. Black and white they are our future or doesn’t anyone in politics remember that slogan. Stop treating Black youth differently they too are deserving of opportunity to strive, fight and not be penalized for life. fighting after all is just that a fight, between kids its over tomorrow if knuckleheaded adults stay the hell out of it.

I would just like to say That I’m a African American woman and I’m a teacher at a high school, And I’m sick of all the race issues I’m hearing now a days. Everyone still focuses everything on Race or gender, everyone is either Racist or sexist, or prejudice. Will people stop complaining. Yes it was wrong for those white students to hang 3 nooses on the tree, However I have also heard several black students at my school, making fun of whites….many students in schools are immature, and often tease others based on their gender, race or even if they are too fat…… we should never take what anyone says seriously…. We all have different beliefs… Not everyone is going to like the same things..There are going to whites who still hate blacks, and there are going to be blacks who hate whites… I don’t mind just as long as they leave me alone… IF these white kids have attempted to try and hang a black kid, then yes… then I would say have justice for the black teens… Slavery is wrong, However violence is never the answer. People will get made fun of or teased in life, just ignore people.
IT’s just like I see people or shows on tv making fun of Jesus, I don’t like it because I’m religious, but I ignore it.. I know the most important thing is no one harmed me because of my religion and that I believe in God, and that’s all the counts….
Many people tend to forget that racism is still around today, just in a different form. When My daughter started college she was offered an African American scholarship, My daughter only got the scholarship because she is black. They don’t care if she is smart or not… This is a form of Racism…I see an all African American channel on tv, African American churches, African American funds, African American scholorships and so on…why are we still labeling ourselves… yes we may be getting special treatment, but it’s still RACISM…. Our great leaders like Martin Luther King, or Rosa Parks.. Faught for EQUAL JUSTICE, not seperate justice… They wanted to be treated the same as any white person would have been treated..

I have always supported civil rights in this country but never again. The black leadership in this country is outdated and doing more harm to race relations than anything. Black leaders only support thugs and criminals who break the law. Six boys beat up on one boy and you defend them. I hope they all go to jail.

So does this mean that anytime a white person says or does something that black people don’t like that they will gang up on and send them to the hospital? Kind of makes me want to not even be in the same area with them. This also is the reason that where I live white people move farther and farther away from the city so they won’t have to be near blacks and worry about increased crime and poverty stricken neighborhoods with government housing-because as long as someone will pay you to do nothing but sit around, why would you want to do anything else except find new ways to make trouble.

Mr. Bell was never sentenced to 22 years. The sentencing would have been today 9-20-07…IF his conviction in adult court had not been vacated on appeal and the case remanded back to juvenile court. <– This was destined to happen from the start, and I suspect his original defense attorney (a slick old dude) figured that from the start!
Mr. Bell is very familiar with juvenile court, as he is currently on probation for priors that include battery and theft. The attack Barker was one of a series of violations of the law for anti-social behavior, including battery and theft. Some of the "crew" in that school yard "attack" also have prior juvenile records. It is well known in the Jena community (among both black and white) that that crew is no angels.
Mr. Barker, had absolutely nothing to do with the nooses, absolutely nothing to do the ejection of the uninvited and physically persistent party crashers (who also happened to be black) from a racially integrated private party, or absolutely nothing to do with the altercation at the convenience store…although I do suspect Mr. Barker may have run his lil' smart mouth with some racial slurs. Not very intelligent…but then attacking him at school, while your friends hold the doors shut so teachers cannot get in to stop the attack was even less intelligent…tends to majorly piss-off school personnel, school boards, and the law.
Use some common sense. If somebody offends you with words or actions, you cannot later go and legally beat that person or anyone else. That is called taking the law into your own hands.
Such perverted logic is contrary to the laws of civilized society. If you are white and have a family member or friend that was, maimed or killed by a black person, you and a group of your friends CANNOT go days later and pick out a random Black person and beat the Hell out of him. Why should it be different if the skin color is reversed?
150 jury summonses were sent out to people of ALL races in LaSalle Parish for the Bell trial. Only 50 showed up and none were black. Any person of color who boycotted that jury summons has not the remotest bit of a right to complain about that verdict because he or she did not discharge his or her civic duty.
The honest truth and facts of this case have been distorted and "tweaked" by people with agendas other than true and racial harmony in Jena.
Personally, I think the DA is an idiot. Not because Bell is an innocent choirboy but because the DA should have gone ahead and ajudicated Bell in juvenile court, where a judge would probably have ended up putting Bells' mean and aggressive little hindparts in juvenile lock up until age 21 or so…..four good solid years to reflect on the error of taking the law into his own hands and possibly nearly killing someone.
Bill Cosby has made some very intelligent and reasoned discourses on what is plaguing the black community in this country, and as a group it has refused to acknowledge just how correct he is. No one can change a community except that community, and it cannot be changed successfully outside the existing system of law.
Equality and parity are never "given" to anyone, they are earned (regardless of race or class) by those who educate and civilize their children…those who teach their children to work within a system to change it, not to take pride in becoming outlaws.
Would you want your children hanging with M. Bell?

First off if the kid was black and attacked by 6 white, asian or hispanic students they would be in jail. Lets get some things straight the United States places all non-black people in the same group. Think about it have you ever heard of a hispanic, white or asian kid jumping someone and then giving out an award. BET let the kids give out awards at the Hip-Hop awards and they were heros. I do not think any white kids would be asked to do the same at the CMA awards. No one would look at these people as heros if they were white, asian or hispanic. We would say no matter what they were to put them in jail. On the other hand blacks in America seem to think the JENA 6 are heros when really they are scum

A noose is what white men used to hang blacks on a tree and then burn their bodies. This type of behavior is unacceptable as well as violence.
The three noose that were there should not have been ignored because it is a threat of bodily harm to all blacks.
I believe the black boys acted in a wrong way but they should have gotten probation and community service not 22 years in prison. The crime don’t fit the punishment. I would say injustice in this case. Do a study on jim crow laws, and black history you will better understand the fight in this country to be treated equal as a black person.
