Closing Arguments: Newt vs. Rush on Sotomayor
Both former Republican House speaker Newt Gingrich and conservative talk show host Rush Limbaugh called Supreme Court justice nominee Sonia Sotomayor a "racist" last week for remarks she made in 2001. Sotomayor said she hoped a wise Latina woman who reach a better conclusion than a white male. Today, Gingrich said he should not have used the word "racist" in referring to Judge Sotomayor. And that earned him a tongue-lashing from Limbaugh, who said he's standing by the "racist" label. So tonight, we ask: What do you think of the statement? I think her comments were racist.
If I, a white man, said similar comments about myself everyone would believe I was being racist.
She should only come to decisions using relavent aruguments of both sides and not even consider race or gender a factor.
We are all equal under the law.

Absolutely believe the comments made by Soto, were completely racist. It is comments like these, that keep racial tension alive.
I completely agree that if this had been a “white male” who had made this statement, he would have been practically tarred and feathered , then publicly hung.If it is not right for one group to say things of this nature, then it should not be right for ANY group to say these things.
OR perhaps its just time to get over it and just accept that we’re all living in the same country, no matter what, we are all americans, and start worrying about more important issues…

Yes, her statement was racist, and no the GOP is not having problems because only 2 people disagree on one subject. But I do know for a fact that if anyone is worried about someones race and points it out, is really the racist, so the demo’s are the most racist of both groups, they are always whinning about it, good and/or bad. Her race is why she has been apointed.

As a Latina, I just feel she’s really going to have to tread her waters very very carefully. She will be under a microscope.
The comment was uncalled for, if that. And yes racist especially to anyone outside the Hispanic race. But I feel that she shouldn’t of said it because let’s be honest if a Caucasian man/woman said something reverse to that we would give them hell. But I would say this to the Obama camp, as a fellow Democrat I hope you’re not just trying to push the multi-cultural line and instead are picking people based up their virtue & experience.

What a ridiculous question…of course they were racist! She sure as heck wasn’t talking about the color of somebody’s tie! When you imply that worth, quality, character of judgement is dependant on race that is “racist”. Why is it always assumed that only caucasions make racist statements? No one seems to mind attaching that label to them. When a minority makes such an obvious and undeniably racist statement it should fall under exactly the same scrunity and condemnation.
This lady is totally unsuitable for the highest court in the land. She’s already openly shown herself to be a social activitist not a CONSTITUTIONAL scholar!
Newt’s being a very disappointing whimp with an eye for his own political future rather than being just plain honest!

Newt was correct to apologize for his comments calling the judge a racist. Limbaugh is not and never will hold public office. Newt is considering running for President and realizes he must act in a more sophisticated or civil manner. Limbaugh can make offensive and ridiculous statements because he is just concerned with ratings. It is a sad that he has any affect on the Republican party.

Did anybody miss the fact that she said, “I would hope…”, not “I believe” or “I’m sure”. How is hope racist? Haven’t old, fat white guys been saying that they knew more than anybody else for well over the last thousand years? If all these egg-walking Republicans would just take a real look at her judicial record, they just might recognize how fair and reasonable she has always been.

Sotomayor’s comment was not racist. First, the statement was only an excerpt and you cannot build a case on an excerpt, it only leads to speculation and it only strengthens the validity of her statement. Second, the statement Sotomayor made is true if you think about it. Most white males have not lived the lives that many poor individuals have and only see the world from their perspective. Take a look at history. Our country was claimed through the bloodshed of the Indians, Africans were forced to be slaves in order to become cheap labor and to build America while the government would not get involved or just wanted to keep things the way they were, plus women had no rights. Also, the early settler who moved from Europe to settle her in America moved because of the white man’s unjust laws but we cannot forget how many African Americans for decades were sentenced and jailed for longer periods of time compared to a white individual for the same crime just because of their skin color. Now I’m not saying that all white men make bad decisions, there are other races that made bad decisions but history has shown that many of our issues have been because of the white male views.

I do think that Sotomayor’s remarks were racist. I don’t think Rush and Gingrich’s slight difference here has anything to do with a rift in the Republican party.
Obama is picking a left wing judge who believes, as he does, that the Constitution is passe’ because it limits the power of the government. He wants to expand government control as much as possible. Sotomayor will decide by empathy (for her side) and not by constitutional law.
Decisions based on whim are dangerous. Lawlessness is the result.

If what she said wasn’t meant to be racist then her remarks came from an unwise heart and mind. And this shakey country CAN NOT AFFORD another unwise judge on the supreme court.
A wise judge would interpret our constitution in light of what the founding fathers wrote as they prayed for God’s guidance to lead them.
That is what our judges (and country) need to do to get back to the basics, pray for God’s guidance, and NOT LEGISLATE FROM THE BENCH.
And, I think I heard that she made some small remark about, judges make policy. If I’m wrong, please correct me.

I don’t think Judge Sotomayor’s remarks were racist. She was simply stating that someone Latino/a background has different, perhaps more diverse experiences than those of a white male. Furthermore, the comment is most definitely taken out of context. Limbaugh and Gingrich made her one comment a race issue by calling HER a racist when they are the real racists, I believe, in this case. One single comment has been blown out of proportion, and the Republicans are just squawking because they lost the election and are not able to appoint a conservative judge to shift and control judicial policy for the next 40 years. In my opinion, Sotomayor will do a wonderful job as a Supreme Court Justice, no matter what race she is. If Obama has confidence in her, we all should too.

The distinction that was made here was one of a culture different from another. A culture that can only be understood by those who have lived in it by it because of it and even in spite of it. And the courts of this great country is faced with so many diverse cultures that the people who are being tried need all the help they can get.
My father always told me that it is the liar who accuses everyone of lying to him and the thief who thinks everyone is stealing from him. Using that rule of thumb, who is the one crying racist?
Look at the words that she has spoken and do not listen to the sounds of a lunatic,
Sotomayor’s experiences are uniquely rich and uniquely her own. They are uniquely South Bronx and they are uniquely Puerto Rican and female no less. She is my sister’s age and I am only 3 years younger. So I know the pride and culture with which she was raised because I was raised with the same. The Law is the Law! And it is plainly stated in the books of law.
But if He who established the first law was able to now and then remind Himself “they are only flesh”, who are we not to realize that a human being is not just a 000-00-000 #. The Law is The Law. But people are molded by cultures, feelings and traditions. Acts of desperations and a host of other human failures for lack of a better word.
Or, can it be that Rush Limbaugh is afraid of losing an all white world.

Sotomayor’s comments were not racist, especially in light of the audience the remarks were made to. Prejudiced with a message toward the latino audience she was addressing at the time, yes; racist, no.
Rush and Gingrich are only looking for airtime, especially since Gingrich is really a nobody right now (that what he should get for being “faithless”). The repubs supported her in her nomination to the Federal bench. After all the chest beating, they will not stand in her way for the supreme court. With her education and and long term experience on the judges bench, Sotomayor may be more qualified than Justice Roberts… and he is the current Chief Justice (who only became a Federal judge in 2001 – though Bush V1 nominated him in 1992). Her judicial decisions and record show no bias.

The fact that someone of a different race can make a statement like that and have a majority of the white people on this blog call it racist makes the people who call it racist “racists”. When you have 7 white men, one black man, and one white woman on a court that supposed to be representative of the total population of this country means that a majority of the people who selected and appointed them have a similar and relative basis for their decision, “a white male background”. Judge Sotomayor was absolutely correct. The people who appointed them could only pick them relative to their personal life experiences (a white male background). That is why we have never had a female hispanic Supreme Court Justice nominee and only three black nominees and three white female nominees in the 200 year history of this great country until now. I’m a white male, 44 years old. I’ve never lived the life of a Latino Woman or had the experiences of a Latino Woman.
In my 44 years I have never even contemplated needing to understand the experiences of a Latino Woman. It’s not that I don’t want to, I’ve just never thought about it.
I do know how to read and how to comprehend Sotomayor’s speech and I can see she was only talking about her experience in her life.
The Supreme Court has had 110 Justices in our history. Of those, 106 have been White Males.
I think it is way past time for America and her Constitution to be fairly represented in the make up of our Supreme Court.
I’m glad Sotomayor has the educational and judicial experience we need.
You folks that are tools for right wing extremes need to research, read and learn before you jump to wrong conclusions. You are not helping America when you spew right wing nut bs.

If the situation was reversed, there would be major riots, protests, marches, ACLU involved if a white made a racist remark about a Latina. What makes another race exempt from fairness (Latina) when disparaging another race (Caucasian). The back pedaling attempted by the White House reinforces her incompetence, ineptness, & disqualification for a permanent, highest court decision. Clearly she will use her racism in the court. The firemen are just the beginning of her prejudice against other races! We need a reasonable, fair, competent judicial candidate who will exercise equality for all races. The comments were made to a group of Hispanic women and were completely taken out of context. I’m sure they were only said as a joke to get her audience to relax. I’ve been to many womens seminars etc. and remarks like this are always made by one or more of the speakers. In fact these remarks were pretty tame compared to some of the one’s I’ve heard. They are never meant to be taken very seriously. Get over it already. Sonia Sotomayor is not a racist based on this.

Judge Sotomayor’s comments were blatently racist and sexist. She is NOT a suitable person to sit on the United States Supreme Court. The US Supreme Court represents the US Constitution for ALL Americans, NOT just a single group. A judge does NOT MAKE law, a judge interprets the law. And for her, after making this comment, to have any possible say in how the law of this great land, the USA, is interpreted is scary for the future of our great country. I applaud Mr. Limbaugh in standing firm with his opinion. Unlike Newt Gingrich Mr. Limbaugh is an honest voice for the USA, who does not change his view on the whim of the political winds. It is insulting to the American people to nominate someone like her to such an important position. I pray that the American People stand up and say, “No More. We deserve better”. God Bless America!

I’m thinking that her unthinking quoting of the party line on race and sex means she is amenable to persuasion, as opposed to a independent Marxist like Ruth “Bad Girl” Ginsburg. Also she is Catholic and must be aware of the Church teachings on the right to life. I’m thinking that Mr. Roberts and Mr. Alito can persuade her to be the first liberal appointed justice to vote for life. So I am willing to take a chance. Surely she will be better than 90 percent of other possible appointees of Mr. Obams. So while I want a vigorous examination, I will not be sad if she is confirmed.

Just a bit about her statement. One should keep in mind that circumstantial evidence, which involve using life experience to get to a conclusion can send a suspect to prison. So having a different life experience can certainly bring one to a wiser or less wise conlusion. In the end the ‘Just Law’ should always appear to prevail.

No, Gingrich was right in saying that Sonia Sotomayor’s comments were not racist because Ms. Sotomayor’s race is White (Caucasian). What everyone fails to see is that Ms. Sotomayor is Hispanic, however Hispanic is NOT a race. Yes, Rush Limbaugh Hispanic/Latino(a) is not a race, but an ethnicity. Ms. Sotomayor may not be able to identify with White males because she is a White woman of Latina heritage (Puerto Rican). I think it would be a great achievement for the United States to have a more representative body in its Judicial branch to represent the millions of Hispanics who live here.

Did you hear about the abortionist doctor who was shot as he ushered in his church? I know, he was a lutheran, but most lutherans I know are pro life and wouldn’t be any other way.
In today’s world, you can’t count on much with people other than that they will sin and many times lie with no guilt feelings. So don’t count on her being pro life even if she says she is. The St. Lucie School District in Florida is now requiring African and African American Education in every class every day of the year. Where’s the European education? The Chinese education? Had a white male suggested that a white male would be more likely to reach a wise decision than a Latina female, I suspect that we would have the collective wisdom to suspect that he tended to wear his bedsheets at cross burnings. Unfortunately, people don’t notice racism when they agree with it.
I’m actually *more* concerned by the fact that she has been overturned 60% of the time on appeal, and admits to making her legal decisions based on her feelings and “empathy” instead of the law. When law becomes a matter of “feelings” and popular pressure, it is meaningless and the people are NOT protected from mob rule.

Her comment was clearly racist and betrays racist thinking.
What is far more significant, however, is that her comments show she would not limit herself to constitutional principles and the evidence and arguments presented to her in court. Instead she would base her decisions on her personal experience, feelings, and history.
There is definitely a serious rift in the Republican Party. But it’s not Newt vs. Rush. It’s Neocons vs. the several other factions: Constitutionalist, libertarian, Conservative, and Religious Right. The bulk of the potential recruits from the new generation are Constitutionalist or libertarian. If the Republican Party is to successfully rebuild one of two things must happen: It must accept these new people, or they must overthrow the old leadership and take over.

Her statement was racist and even more important, she has backed up her opinions with her decision in the New Haven Fire Dept. case where she ruled that a group of mostly white firefighters should not be promoted. The racist controversy is not as important though as her support of the Kelo decision which gives local governments the right to take private property for virtually any reason! Republicans need to stop worrying about political correctness — I’m not a big Limbaugh fan, but now I have NO respect for Newt Gingrich.

Racism is “..a belief that race is the primary determinant of human traits and capacities and that racial differences produce an INHERENT superiority of a particular race”. Sotomayor said she “…HOPED a wise Latina woman who(would/could?) reach a better conclusion than a white male.” She didn’t say that Latin people were superior to white people. Limbaugh is always spreading disinformation because he doesn’t know what he’s talking about and likes to spread hysteria. He needs not to be taken seriously. He is the true racist.

I think people are proving what her point was when I read the comments posted by white males. It is a completely different lifestyle a minority woman lives. It is ridiculous how the basis of most of the complaints are coming from the right wing white males. I’d like to see them put themselves in a Latina’s place for a day and see if they change their tune.

Tell us “complaining right wing males” what is it like to be a Latina? Why do you consider Sotomayer a minority? I thought that her ancestors came to the western hemisphere from Spain, the same as all Latinas. They are of the human race and white just as Italians and French and Greeks and Jews and……
Why do you try to sew division in america. I always thought all legal citizens of the good old US of A were Americans just as Canadians are Americans and (I was taught) Mexicans and all people who lived in the western hemisphere were Americans, not always US citizens, but, still americans.
If life is harder for a Latina, maybe someone other than a right wing white male is making it that way.
Try living in a community of right wingers (mostly husbands and wives, living together with their 2 to 3 children, one family to a house, in prosperous neighborhoods of 3 bedroom houses with nice yards). Where we are friendly with our neighbors and have their best interest at heart. We don’t have to lock our doors against our neighbors. And we don’t teach our children to distrust other people who are different than we are. Teaching them to get to know strangers before calling them a friend.
Now, tell me Myra, can you really blame male right wingers for the plight of any one who is a Latina or a minority?
If I had to spend a day in their shoes, I would not change my tune. I would be as I have been brought up to do. I would not stand for it, I would not search for someone to blame, I would not feel sorry for myself, I would not let it continue and I would make changes in my life, just as Sonya reportedly has. Why? Because I’m a Conservative, (spelled; Right Wing Male) and we belive in making the best of everything and working hard to create the best and safest life possible for our families and to be a blessing to others.
Oh, and also, we are a very large percentage of the Christian community.

Her comment was biased but racist is too strong a word, people that have suffered racism historically knows it means lynching, jim crow, chattel slavery, beatings and maiming, denial of constitutional rights…etc

I believe that Sotomayor’s were racially biased and meant to be inflamatory. Newt is correct, if a white person had made a statement with reverse bias, the media would crucify that person relentlessly.

Judge Sotomajor is as human as anyone else and what she said was misinterpret. People are so judgemental and are so ready to criticize. Rush Limbough is just a worker at a radio station and obvious will never be a judge. And if Gringrich is not careful on what HE says he will be out of a job because nobody will vote for HIM.
