Gun Owners Applaud Supreme Court: Do You?

Supporters of gun rights are applauding today's Supreme Court ruling that Americans have the right to own a gun for self-defense anywhere they live, expanding the conservative court's embrace of gun rights under Chief Justice John Roberts. The 5-4 ruling cast doubt on handgun bans in the Chicago area but signaled that some limitations on the Constitution's "right to keep and bear arms" could survive. Tonight, we ask: Do you side with the court? Or should states and cities be able to restrict firearms as they see fit? Tell us what you think. Embedded below is tonight's "World News" segment, as reported by "Nightline" anchor Terry Moran.

What I find amazing is that 4 judges ruled against our 2nd Amendment rights.

Of course I agree with the decision that Americans have a right to own a gun for self defense. Why should only the criminals get the guns? The criminals will have weapons no matter what the law states. Law abiding citizens should be able to fight the criminals when necessary.

The supreme court is wrong. States and cities should absolutely be able to restrict firearms as they see fit.

Defending one’s self is a fundamental, natural, and instinctive right. No one should be rendered helpless by the force of a government.

The 2nd Amendment give us the right to bear arms….it says nothing about ‘unless some future politician decides only the criminals can have them’! What’s next? Are they going to take away free speech?

Posted by: Sandi | June 29, 2010, 12:15 am 12:15 am

I can’t believe it took so long for the 2nd amendment to be affirmed…it’s a Constitutional right, period. Aren’t there more pressing issues in our society than that?

Posted by: Chris | June 29, 2010, 12:17 am 12:17 am

I absolutely do not believe that individuals should have unlimited rights to carry firearms. States and cities should have the right to place limitations, especially on assault weapons.
I believe the constitution referred to the right to have an armed military force.

Posted by: Marilyn Turner | June 29, 2010, 12:17 am 12:17 am

The activist Roberts court got it wrong the first time in discovering an individual right to own guns. This ruling is more of the same.
But even accepting an individual “right” to gun ownership, it would seem that states, and by delegation, municipalities, have broad latitude to regulate access to weapons. The right to bear arms is not the right to be armed to the teeth, not the right to own many guns, not the right to avoid registration, licensing, and other reasonable qualifications aimed at ensuring the use of guns is for the Constitutionally-defined purpose: the security of a free State.

Posted by: JCNJ | June 29, 2010, 12:20 am 12:20 am

I am ready to purchase a gun, take shooting lessons and be ready to defend myself in my own home. It’s about time! How dare the criminals think they have the upper hand since they don’t follow the law and possess unregistered illegal guns. Now the tables will be turned. We finally have our constitutional gun rights back after a fight which is similiar to having civil rights we also had to fight for. Strange politics.

Would we be as accepting of limits to the first amendment? Would we allow the government decide who is allowed to speak freely?

Posted by: John | June 29, 2010, 12:22 am 12:22 am

I agree and am surprised it was such a close vote. It is and always should be our right to defend ourselves. I dont own a gun, and dont feel i need one to protect myself. Guns dont kill people.
People kill people. If Suv’s were in the majority of fatal hit and runs should we than restrict SUV sales? Suv’s and cars dont run people over. The person driving runs people over.Personal responsibilty and accountability is the real issue.

I only regret that it was not a unanimous decision. Shows how fragile our rights are and the very thin line defending them. I beleive, this right is one of the cornerstones of the free society we ALL enjoy. A lot of people will and do say, that we live in a civilized society now and there is no need for gun ownership. Ha, this society is no more civilized that it ever was, we just have more toys and our horses are airconditioned.

Libs always want to pick and choose our rights. Maybe they should pick and choose some other country to ruin. This country didn’t fight a war for independence so 200 yrs. later we can become slaves to socialists who want to take away our rights because they think they know what’s best. Not a chance. For once the founding fathers can be happy with a supreme court decision. Thank God we still have a little common sense left on the bench. Get these stinking socialist liberals out of office now! Reject these crummy liberal supreme court justices.

How hard is it to understand the Second Amendment of The Constitution of The United States of America! It plainly states, “The Right To KEEP And BEAR Arms”!

Posted by: Stan Mitchell | June 29, 2010, 12:29 am 12:29 am

One of the things that’s nice about freedom is that you don’t have partake in all aspects if you don’t want to… but if you change your mind, you can! For example, just because we have free speech, it does’t mean you have to say anything if you don’t want to. Same with firearms, if you don’t like them then don’t own one – it’s a matter of personal choice.

It is about time that hear something went in the right way to proserve the american way of life. I believe that the 2nd admendment gives anyone in any state the right to carry a concealed weapon, and that chicago should be punished for their wrong doing. It upsets me that I get pulled over and cop says do you have a permit for that and I say I don’t need to have a permit(harrassment). But I call them about people smoking METH on public property and they say “I’ll pass it along”.

Posted by: Matt | June 29, 2010, 12:33 am 12:33 am

When seconds matter police are minutes away, that’s why I can’t believe 4 of 9 learned jurists think I, my family and property should be vulnerable to the whims of thugs, gang members and crazies.
These four black robed freedom robbers should be impeached.

Posted by: Arkie | June 29, 2010, 12:34 am 12:34 am

The Second Amendment is as important as the First Amendment. Of course a law-abiding citizen should have the right to own a weapon for the purpose of defending one’s self against armed criminals and rapists that break into your home.
Even if you could call the police about a break-in to your home….you could be dead or worse by the time they are able to respond.
How can this even be a question?

Posted by: Warren | June 29, 2010, 12:34 am 12:34 am

This decision is absolutely correct except that 4 Justices voted against it. Our Second Amendment IS a fundamental right and clearly the founding fathers thought so as it was the 2nd amendment. Those who study history and the history of the 2nd amendment know that the founders wanted to ensure that the PEOPLE had access to firearms so as to be able to defend themselves not only from criminals, but from a tyrannical government. One only needs to look at facts; In Australia and Canada who have in recent history banned all or some firearm and / or handgun ownership, have experienced exponential increases in crime, particularly violent crime. On the other hand in the last 25 years, not only has gun ownership increased, persons with Concealed Carry Permits have increased with 44 or 46 of 50 States Passing Shall Issue Concealed carry laws, the violent crime rates have dropped as much as 35 % in those 25 years. This was a great decision, but shame on the 4 justices that voted against it. Finally common sense prevailed. Criminals will have guns whether or not law abiding citizens are banned or not. More guns reduce crime, not the other way around. Better for criminals to NOT know who is armed and who isn’t rather that knowing that nobody is?

Posted by: Ben | June 29, 2010, 12:45 am 12:45 am

Of course I agree with the ruling! I am aghast that there was ever any question about our 2nd Amendment rights. It’s downright SCARY that 4 of the justices voted against the ruling.

If Daley carries out his threat to make the pathway to gun ownership a difficult and expensive one to negotiate in Chicago, he will be in defiance of the spirit and possibly the letter of today’s Supreme Court ruling. An appropriate response for Chicagoans who have to live unarmed, in or near high crime areas might be to call 911 very liberally, whenever a sound in the night or a sight in the street suggests the possibility of a threat to ones person or possessions. You people are paying for Daley’s 24/7 police contingent with your hard earned tax dollars. You deserve police protection yourselves. Dial 911!!

Posted by: Woodpiggie | June 29, 2010, 12:51 am 12:51 am

Absolutely. The restrictive laws were insulting to the intelligence of any citizen of even a moderate degree of appreciation of the inequities of the armed versus the unarmed especially when only the unarmed are the law abiding citizens that are the victims. What is so astounding to me is how people truly believe that if having these laws in place will really prohibit crimes being committed with firearms since they are illegal. What a completely simple ignorant statement. But it makes as much sense to some as saying “guns kill.”

Posted by: MARIE | June 29, 2010, 12:57 am 12:57 am

Posted by: Denis | June 29, 2010, 12:59 am 12:59 am

I have been a gun owner every since I was 18. The only ones that I would be a threat to is the criminal’s no one else.
so the answer to the question is yes I
agree with the courts decision strongly.

Hooray for the law abiding, self defending, and prepared (not paranoyed) members of our society. Hopefully this will open doors to greater FREEDOM to protect ourselves not just in our homes but outside of them as well. Don’t get me wrong. Having a gun and carrying one legally, where I want, is not and never should be ones only way to defend themselves. However, when the situation calls for it, don’t bring a knife to a gun fight. As a former volunteer peace officer, if I have to be “armed to the teeth” to protect myself and family from criminals that don’t care about the law, I will be.

Posted by: Tom | June 29, 2010, 1:10 am 1:10 am

Of course we have the right. Just how have we been able to retain our freedoms? The problem I have with the libs is just how could 9 of the bill of rights be for the individual and one, yes one be for something other than the individual?

Posted by: historicaltrekker | June 29, 2010, 1:13 am 1:13 am

I believe in and support the Constitution and the 2nd amendment. Citizens have the right to bear arms. What scares me is not the trained gun owner who is responsible and concerned about protection, it’s the ignorant people who won’t get a permit, won’t lock up their guns that lead to hundreds of accidental deaths per year, mostly children. With gun rights must come education and legal ownership.

Posted by: Shelly | June 29, 2010, 1:13 am 1:13 am

Liberals need to stop whining. This decision makes it easier for those of use who are law-abiding to defend ourselves, but doesn’t make felons eligible for gun ownership.

Posted by: D | June 29, 2010, 1:14 am 1:14 am

The US Constitution clearly states that citizens have the right to keep and bear arms. That’s federal. Lower levels of government cannot override with local laws which conflict with the constitution.
I am concerned about the four justices who do not seem to get that. What part of that do they fail to understand?

Posted by: Al | June 29, 2010, 1:21 am 1:21 am

I support the 2nd.

Posted by: sfgunslinger | June 29, 2010, 1:35 am 1:35 am

I agree with the supreme court ruling, gun laws only affect the law abiding citizens; so you take the right to bare arms away the criminal has all the power… You lose your guns, you lose your freedom…

Posted by: michael | June 29, 2010, 2:27 am 2:27 am

The Supreme Court only told us what we already knew. The 2nd amendment was never intended just for the “militia”. It states “, the right of the people to keep and bear Arms,” for a reason.
Dont let the scare tactics fool you, there will not be more blood in the streets because of this.
It will not turn into the “wild west”
These cries have always been made, but have never come true.
But after nothinng bad happens dont expect the chicken littles to come out and say “oh we guess it wasnt so bad after all”.

Posted by: Sean | June 29, 2010, 2:54 am 2:54 am

YES the constitution RULES. we have the right to own a gun in any of the 50 states. when we loose the guns we will loose our liberty!. it’s also what REALLY kept Russia and China from even thinking about coming over the pole to invade us. If you think Afghanistan was a pain for the USSR and Vietnam was a pain for us imagine what the USA would be like for any country trying to invade us.

What we have is yet another flaming activist ruling from the bench by this supremely biased Supreme Court judges- overturning decades of precedence and previous arguments pro and con.
These men sorely need to be impeached. They have set themselves up as the sole rulers of the nation.
AND they lied to the Senate during their confirmation hearings. They are the personification of activist judges.
The second amendment clearly links the right to bear arms with militias- not with individual households.

Posted by: SickoftheCorporatists | June 29, 2010, 3:17 am 3:17 am

I wonder if the 4 Justices that voted against the Constitution had a break in at 4 am with several armed men, if they would want to re-affirm their right to own a gun.
Nah, they probably would be thinking: See I told you that we should make guns illegal, just like burglary, rape and murder are illegal.
The problem is some people just don’t care about what is illegal; they’re called criminals and they have been around for thousands of years, and THEY don’t care if the gun they shoot you with is illegal. Because, it would be really stupid of them to use a weapon registered to their name in the commission of a crime. Almost as stupid as liberals who think that a law that disarms law obeying citizens will have ANY effect on crime.

Posted by: Gary | June 29, 2010, 3:19 am 3:19 am

of course it was the right vote, but the bastards that voted against should have their citizenship revoked. the founding fathers put that amendment in to guarantee our freedoms and to insure we could change the government if/when it got out of control. they had seen the results of too much big controlling government, they wanted us to be able to keep that in check. i’m damn tired of criminals having all the rights. i’ve fought for my country and bled in many countries, i’ve seen what happens to the unarmed, be damned if i will agree to it myself!!

Posted by: Lee | June 29, 2010, 3:29 am 3:29 am

I am thrilled that any judges today would vote in favor of the Constitution. The elimination of the Constitution is clearly the goal of liberals and immigrants (legal and illegal) alike – all of whom are determined to conform our country into that state that furthers their lifestyles and agendas. They should embrace the Constitution which is that instrument that makes America, America. In this ruling, I guess maybe they realized the truth in “If we outlaw guns, then only outlaws will have guns.” But because upholding the Constitution and its intent has become the exception rather than the norm, even though I am not a gun fanatic, I am planning to join the NRA – the one institution that is still genuinely intent on preserving our Constitution and our nation.

Posted by: William | June 29, 2010, 3:33 am 3:33 am

Finally they did something right. And for the 4 that voted against it, I hope they’ll never need one. It’s ridiculous to think that world we live in is always safe. Better prepared than sorry. If you don’t like guns then dont get one. But dont tell me what I can or cannot do.I hope I’ll never have the need to use it other than for recreational shooting. But if I have too, I will.

Militia – “a militia is a body of private persons who respond to an emergency threat to public safety, usually one that requires an armed response”.
The Second Amendment – “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.”
Individuals are the militia. All law abiding people have the right to bear arms. Pretty easy language to understand.
Good thing we have such a powerful military and the chance of a militia being called to action is unlikely, however that is no reason not to stay in practice.
The Supreme Court made the correct decision.

After serving our country for 30 years in the military service, just to ensure that these type of discussions and or disagreements can and still will occur. I ask you all, just STOP and THINK for a few seconds, if you didn’t have these freedoms and strict control of firearms of our citizens was attempted. WHO will have the guns, NOT the law abiding ones, but the criminals. OLD NEWS, BUT TRUE. Changing law wouldn’t help in cities like LA, NY, Chicago or DC.

Posted by: Sam | June 29, 2010, 3:53 am 3:53 am

Why bother even having a Constitution and a Supreme Court to uphold those Rights if any State can decide they have the authority to counter those supposed rights by creating their own restrictions. Essentially forcing a law-abiding citizen to choose to move out of that State and to another that has less restrictive gun laws. Why doesn’t each State just create their own Constitutional Laws. Better yet, let all the States become independent countries and we don’t have to call this Country the United States any longer since we are not always that united to begin with. We can call it the Fifty Separate and Individual States of America. If you don’t like a State that has restrictive gun laws or gay marriage or too many illegal aliens, then you can put in a request to move to another one and become a citizen if you meet the requirements of that individual and completely separate State of the Non-Union.

When I was a child there were debates about building home atomic bomb shelters. One of the issues revolved around whether you would shoot your neighbor, who wasn’t as thoughtful as you, when they came and pleaded to be let into your shelter. Sounded like really far fetched discussions. Hurricane Katrina reminded me of those days. Only it was not a neighbor who came for what they thought were emergency supplies thoughtful people had set aside, it was people from across town or maybe even police. And the debate was not about whether one should shoot the looters, it was about how to defend oneself from the “neighbors” who were ready to shoiot you. The “Government” cannot alwasy protect, in every circumstance. The right to bear arms is a very important right, no different from the other rights in the Constitution.

In the comments I saw a reference to “assault weapons”. It just shows the level of the debate, namely that there are people who claim they support “legitimate” gun rights, but at the same time support banning some weapons because of their cosmetics, namely how they look!

The Supreme Court was correct on this decision–for a change.
But they are just upholding the US Constitution, so I see no reason to applaud them.
They are just public servants doing their job–a job that we the taxpayers pay them massive salaries and benefits to do.

Supplemental Thoughts
Okay, so the Supreme Court made a good decision this time. However, they have made some very bad ones in the past.
To rectify this problem, a Supreme Court appointment should only last 4 years and not be renewable. That way we would get new blood on the court every 4 years, and old bad decisions could be revisited and changed.
Supreme Court seats should be filled by an election, not by a president, especially considering the kind on clowns that have been US presidents in the last 22 years.
Finally, the Supreme Court should have no more than one lawyer allowed on it. The balance of the court should come from other occupations. Lawyers are very narrow in their understanding of technology, economics, and other issues that are on the front burner in this day in age. The Supreme Court is a de-facto jury and has no separate jury, like a real court. Hence, it needs to be balanced and not a biased bunch of lawyers.

DRB is correct. Five our of nine got it right.
And that means that four out of nine got it wrong.
Why don’t we just decide these things by national referendum and abolish the supreme court altogther?

Posted by: Proud Native American and Angry Independent Voter | June 29, 2010, 2:40 pm 2:40 pm

I agree. I always wondered how Chicago and other cities could try to over-rule the 2nd Amendment. Hopefully this court ruling will now put an end to the debate as to whether law abiding citizens of this country have the right to bear arms.

Posted by: Steve | June 29, 2010, 3:46 pm 3:46 pm

Of course I support it! Have there been less shootings in Chicago or DC with their laws to prohibit owning a handgun? I think not. Too bad the decision was not unanimous

Posted by: Frances | June 29, 2010, 4:56 pm 4:56 pm

Yes. I agree with Frances. It is too bad that the decision was not unanimous in that it was a no-brainer.
We should not have to depend on the decisions of nine clowns that call themselves the supreme court. This is supposed to be a democracy. These things should be decided by national vote.
Also, I remember getting sick to my stomach watching the opening of the supreme court once on television. There was some nonsense of someone coming in and saying “Oh Yea, Oh Yea” at the start to announce the nine clowns arriving.
If the supreme court is not abolished, then this “Oh Yea” nonsense should be abolished. Nothing should be said at the start or try “Oh Boo, Oh Boo”. Or simply yell to them in the back, “Get in here and get to work and earn your lavish salary and benefits, you lazy, pompous clowns.”

I have had a license to carry a revolver since the 70′s when I was in my 20′s and carrying large amounts of money between state lines. I have had several scary moments in the middle of the night when depositing money into bank drops outside the building. I think in 20 years, I pulled my piece 3 times and every time, I felt my life was in danger or I had to scare of a threat, etc
In these cities, 14 year old are carrying guns in their belts. Something has to be done. Massachusetts has it right. Get caught with an unregistered firearm, even in the truck of your car and just driving thru from another state, go directly to jail. One year mandatory and no even the highest laywer and the biggest payoff can get you out
do this in every city and clean out all the riff raff quickly…JB

Posted by: Russian Ukraine Dating | June 29, 2010, 10:00 pm 10:00 pm

The court is right! Even if you disagree, the supreme court has the final decision.
Sorry if you feel safer “thinking” that city/state law should allow disarming their citizens.
Sorry if you feel safer “thinking” that all citizens abide by all laws all the time.
Sorry if you have the previous two beliefs…but WELCOME TO THE REAL WORLD—Americans have the right to protect themselves, and all citizens DON’T obey all laws all the time.
Now, of course it is your right to go unprotected. And yes just so you know, I would try to protect you, if possible, even when you won’t do it for yourself. You’re welcome.

That is why we need opposing attitudes in President and the Legislature. The supreme court is much less likely to be packed with liberals or conservatives.

I resent politicians that don’t honor our constitution, when they swore to uphold it. I support the right to bear arms against anyone who threatens life, including the Government. We the People will fight to uphold our Constitution, with guns if necessary. And that is exactly why liberal politicans want gun control. They want to rule over us. Abolute power corrupts. Therefore We the People will not give you absolute power. This is a Republic, not a Democracy.
