Amanda Knox Legal Drama Not Quite Over

By ABC News

Mar 22, 2013 11:04am

It has been more than a year since Amanda Knox was cleared of murder charges in an Italian court, but the legal drama for the Seattle woman is not yet over.

Italian prosecutors appealing Knox’s release from prison are due to appear in court Monday in Rome, where they will argue to have her murder conviction reinstated.

WATCH: The Amanda Knox Story

Knox, 25, was convicted in December 2009 for the 2007 murder of her British roommate Meredith Kercher in the Italian city of Perugia. Knox’s Italian boyfriend at the time, Raffaele Sollecito, was also convicted.

The pair was freed from prison four years later in October 2011 when an Italian appeals court threw out the guilty verdict and criticized the prosecution’s case.

FULL COVERAGE: The Amanda Knox Trial

A third person, Rudy Guede, was convicted in a separate trial and is serving a 16 year prison sentence. Guede’s DNA was found on Kercher’s body, clothing and purse, and his bloody shoeprints and handprints were left in her bedroom.

There was no DNA of Knox in the bedroom where her roommate was murdered.

Knox, now a student at the University of Washington, will not be present for Monday’s hearing.  If prosecutors are successful, Knox and Sollecito will face a re-trial.

If the Supreme Court upholds Knox and Sollecito’s acquittal, their legal battle is officially over.  The Supreme Court is the third – and final – step in the Italian judicial process.

Knox’s defense team has also appealed the slander conviction she received for accusing her former boss, Patrick Lumumba, of Kercher’s murder.  Knox testified in 2009 that she accused Lumumba only after she was hit in the head and yelled at during a nearly 50-hour long interrogation.

Knox served her three-year sentence for the slander conviction during the four years she spent in prison.

If her slander conviction is overturned, Knox can seek compensation for false imprisonment.

Since her 2011 release from prison, Knox has resumed her life in Seattle, taking classes and spending time with her family and boyfriend, James Terrano.

Her memoir,”Waiting to Be Heard,” published by HarperCollins, will be released April 30.  She reportedly received an advance of $4 million for the book.

Knox’s first interview since she was freed will air during a primetime special on Tuesday, April 30 at 10 p.m., ET on the ABC Television Network.

Do the Italians have nothing better to do than to keep trying to put this girl in jail? If there was no DNA evidence in the room linking to Knox, how can the Italians keep pointing the finger at Knox? Besides, even if the IItalian DA gets a new trial, I doubt Knox will return to Italy. Who would be foolish to go through that all over again? Note to Italy: Let this go, will ya?

I’m just about the most skeptical person I know, but after following this trial, and retrial in the Italian courts, I am convinced that Amanda Knox is innocent of all charges. All the political grand-standing, coupled with the lack of evidence made me think that she was just a pawn to further the political career of the prosecuter.

Posted by: Buck | March 22, 2013, 11:20 am 11:20 am

She’s a manipulative, self centered drama queen. At the very minimum she set a chain of events in motion that led to her roommate’s murder. She was jealous of the attention her roommate was getting at the place they worked together, angry at her boss for firing her for poor performance, recruited some poor sap, whose taking the rap for her, to harm her roommate and led her former boyfriend into trouble he wasn’t looking for. The best way to predict future behavior is past behavior and don’t be surprised to see something like this happening again when she doesn’t get what she wants. And the Italian courts are not used to the American phenomenon that women can do no wrong, as is the case in American, liberal influenced society, and weren’t prepared for the onslaught brought on by the American, corrupt media.

Why would anyone pay hard-earned money to read a book written by a promiscuous college student at best and a murderer, at worst. What is to be learned from her story that hasn’t already been told in the press? If she were half as decent a soul as she claims to be, she would donate the $ 4 million to a charity of the Kercher family’s choice.

@Buck/JohnGalT115:
Amanda Knox had nothing whatsoever to do with the sexual assault and brutal murder of Meredith Kercher…period…end of story!

You guilters need to find something else to obsess about and someone else to post lies about. You need to cease the public display of your bizarre bile against an innocent woman you do not know and of whom you have absolutely no knowledge…and if you simply cannot survive without something to fixate on, how about Rudy Guede, the SOLE perpetrator of this crime. Thanks to the Italian Court, his sentence was cut in half and he will be out in just a few years to potentially rape and murder someone else’s daughter. The fact that you guilters never seem concerned about this fact speaks volumes about who you are.

PLEASE go find something more constructive do with your lives.

So through her memoirs, she’s going to make a buttload of money, while Meredith is in a grave? Even if she’s innocent, she behaved badly, and while that doesn’t justify incarceration, why does that justify making her rich out of Meredith’s misfortune? Is she a poster child of decency that justifies her these rewards?

I want to see Amanda Knox, Casey Anthony and Jodi Arias in a real life version of the Hunger Games. My money would be on Jodi.

Johngalt115… You act like judge and jury. Obviously you did not follow this trial. If you had, you would see there was no evidence against Knox. Your comments are ridiculous… do you know her personally to be able to make all those assumptions about her character? Pathetic!

Attention all college students: STAY IN THE USA AND DON’T EVEN THINK ABOUT GOING TO COLLEGE IN A FOREIGN PRIMITIVE COUNTRY. They still believe in witch craft and spells and curses. Go to college in a modern, non schizophrenic country like home in the United States of America.

The United States is the very definition of schizophrenia.

There is NO evidence of her guilt there is just a very corrupt system that pinned it on the first person they thought of. I am sure most of the money will go to her parents who went into serious debt during her trial.

Knox was convicted of calunnia, not slander. Calunnia is a felony with a maximum sentence of 7 years and is comparable to ‘obstruction of justice’ in the US. This conviction was for claiming that she observed her innocent black boss rape and murder Meredith Kercher. Her boss was arrested based on Knox’s statement and he remained in prison for three weeks until police were able to confirm his alibi. During this time, Knox didn’t come forward on his behalf because she was happy to have a black man on the hook for this murder. Would an innocent woman behave this way?

No. Knox is no innocent.

Posted by: anna | March 22, 2013, 2:48 pm 2:48 pm

Her ex-boyfriend wrote a book saying that he only agreed to stand trial with her so she wouldn’t have to go to jail by herself. He said his own lawyers told him that was a dumb thing to do.

Donte,
why would anyone pay to read a Book from Amanda knox? Not everything was played out in the press. I didn’t follow this very well but what happened behind the scenes while she was questioned, any details in pretrial, trial that happened. her thoughts about what happened. There are things to learn. Maybe the inner workings of the Italian justice system. The article mentions only DNA, what about other evidence. How much of this was created by the Italian police/prosecutor.
Why wouldn’t she give the money to Kirchner? We don’t know that. Her parents incurred a lot of debt trying to free her.

Posted by: drmayeda | March 22, 2013, 4:27 pm 4:27 pm

Why would she give any money from her book to Kercher’s family if she didn’t murder Kercher? And yes, I’d have to agree that I would be afraid to go to Italy at this point. The overdrive and what appears to be hyper-emotional attempts to try to drag Knox back to Italy and put her in prison after she was acquitted. I’m not really up on legal matters but it would appear to be double jeopardy.

Posted by: whatever | March 22, 2013, 4:29 pm 4:29 pm

It’s not double jeopardy because Italy has a three step legal process. If they didn’t have a three step legal process Knox would be serving 26 years right now. The fact of the matter is there is A LOT of evidence against Knox and Sollecito, as well as Guede. Read the Massei report or watch my 12 minute youtube video “snarky bear interviews amanda knox” to learn more about the evidence that convicted them in the first place. John Follain’s book is also highly recommended. Knox’s blood-money book and interview are not recommended, nor are reports produced by her various acolytes and hangers-on who have come to dominate the U.S. media.

Posted by: brmull | March 22, 2013, 4:47 pm 4:47 pm

Hey Dr. Mull, I was waiting for you. You KNOW you have no inside knowledge whatsoever relative to this case. There is no evidence to support the guilt of anyone but Rudy Guede. As I have continually requested, please go to injusticeinperugia.com and/or read the books I have recommended to you every time we meet on one of these boards. You have a serious psychological obsession with Amanda and obsessions are both ugly and dangerous. I repeat, folks…Amanda Knox and Raffaele Sollecito had nothing whatsoever to do with the sexual assault and murder of Meredith Kercher.

BTW, Mull, John Follain wrote a completely fictionalized and rather bizarre account of the case.

As was stated in a previous post, anyone who still believes that Amanda and Raffaele had any involvement in this case, has a very serious mental problem.

Read “Murder in Umbria: The Murder of Meredith Kercher” If you want facts that is.

Posted by: Roger | March 22, 2013, 7:09 pm 7:09 pm

It’s quite sickening the way ABC News insists on viewing the Italian legal process through Knox’s eyes, with the “worst-case scenario” described as a retrial, while the “best-case scenario” described as her false-accusation conviction overturned and compensation for her imprisonment. Shouldn’t the “best-case scenario” be that justice is served?

This segment also features one of the Zombie Lies of this case–that Knox only accused her boss of murder after “50 hours” of interrogation. The truth is that Knox went voluntarily to the police station at 10:40pm to wait for her boyfriend while he gave a statement. Soon after the boyfriend’s interview started he abruptly changed his story and told police that Knox asked him to lie and say they were both at his place the night of the murder. At about midnight an English interpreter was called, and Knox was interrogated between about 12:30am and 1:45am before she made the false accusation. That’s one hour and fifteen minutes.

Curt Knox’s claim that he believes Knox because she is “extremely honest” is laughable on its face. After all, she was convicted of making a felony false accusation. She also falsely accused a respected AP reporter of tricking her into giving a prison interview (during her imprisonment Knox was under strict orders from her publicist to avoid talking to media so she could sell her “exclusive” later on). She demonstrably lied about the condition of the house the morning after the murder (contradicted by her own email and her boyfriend’s account). She lied about the sequence of phone calls made the morning the victim was discovered (contradicted by phone records). Neither her characterization of her phone calls to her parents, nor her pot-induced blackout the night of the murder, are plausible. She lied that from her standpoint her relations with Meredith were good (contradicted by her boyfriend). She even lied about a sexual encounter that never happened (contradicted by her sister and her diary).

This case SHOULD be over, but frankly it will not or should not be over until Giuliano Mignini, Edgardo Giobbi, Patrizia Stefanoni, Manuela Comodi, et al. are all IN PRISON! This case was not merely sloppy: it was an outright criminal conspiracy to frame an American college student for a murder which not only did she NOT COMMIT, but in which she was likely the INTENDED VICTIM due to a “perfect storm” of vicious anti-American sentiment among Italian police at the time.

Posted by: JLS1950 | March 22, 2013, 8:14 pm 8:14 pm

Mull, Mull, Mull…you just can’t stop, can you? ABC News calls it as they see it…and they see it very clearly as do all of the other prime time news stations. Amanda Knox and Raffaele Sollecito had nothing whatsoever to do with the brutal sexual assault and murder of Meredith Kercher. Rudy Guede is the sole perpetrator…you know that so why do you make these insane, ugly and totally dishonest posts?

Amanda Knox was interrogated over the period of several days for ~50 hours. She was exhausted, upset and had very little sleep. She was brutalized by the Italian police including a team called in from Rome whose expertise was breaking Mafia. The Italian police created the scenario of Patrick Lumumba based on the hair taken from Meredith’s fist (which proved to be African) and on the email Patrick sent to Amanda which closed with “see you later”, which was simply a way of saying “bye”, but which they interpreted literally. They pushed the scenario on her, hit her repeatedly on the back of the head, refused her water, food or bathroom breaks and finally she agreed that MAYBE she could imagine herself in the kitchen while Patrick was in Meredith’s bedroom and Meredith was screaming. This is a standard interrogation technique to get someone to agree to whatever story you want them to agree to. She retracted that statement the next morning.

Raffaele never told the police that Amanda asked him to lie. You are the liar. You are creating these bizarre stories and you keep spreading them everywhere. Amanda did not lie about any of those crazy items you list in the last paragraph of your post. Where do you get this garbage? Most of all, and again I ask you, why do you continue to post lies about and harass a young woman you do not know and have never met. There is nothing that I’m saying here that you do not already know and yet you and your cronies on TJMK persist in this viciousness. It’s really very scary stuff.

As I have asked you repeatedly, please find something else to do with your life… and get some help soon!

Do the Italian court system and their prosecutors really believe that if the courts reversed her court judgment that she would be sent back to Italy? Are they that stupid. This country would never agree to her being sent back to Italy to return to jail. They are just wasting their time and money. Get over it the verdict was given and its over with now, move on.

I cannot understand why so many (or even a very few) Americans are so willing to be shills for a corrupt Italian prosecutor and and equally corrupt Italian police force – including a chief investigator who literally BRAGS that he determines the question of guilt based on a ‘wiggle” and that he heard Amanda Knox being beaten and screaming from down the hall from the interrogation room. These people (guilters) simply do not DESERVE the freedoms and protections they enjoy here!

How seriously can anyone take comments by a poster who calls himself “John Galt” after the character in one of Ayn Rand’s books: all of them badly-written novels which are only given credence by college sophomores (thus the term “sophomoric”) and Paul Ryan & his ilk. Notice how Galt reveals his misogyny, as well as his right-wing extremist’s hatred of liberals and the media.

She may be an immature, even not terribly likable young girl, but the only thing that counts is this: the evidence to convict Amanda Knox did not and does not exist. While I treasure many things about Italian society & culture, this case was as much an embarrassment as Berlusconi.

If you’ve ever read British tabloids you get a sense of why there are so many knuckle-head in Great Britain. Truly disgusting. I would wager all those condemning Amanda are limeys. Bet bent. Serioulsly.

Italian jerks, let them see the mess Jodi Arias made when she slit her ex-boyfriend’s throat, blood covered everything. Funny that there was no blood on Amanda’s skin, clothes, car, hands, shoes, hair, sidewalk going to her house, NOTHING at all. Don’t the Italians know that when you cut someone’s throat blood gushes all over. Amanda is totally innocent, the real criminal is that Italian prosecutor who believes in witchcraft.

Posted by: Lou | March 23, 2013, 1:38 am 1:38 am

Yes long interrogations can make people say untrue things. BUT Amanda was lying from the first second!!! Hello, little logic here!

Posted by: GeorgeX | March 23, 2013, 7:10 am 7:10 am

The liberal news media got Amanda out of prison and they will do the same to make sure she doesn’t have to pay for murdering Merideth this time, either. Considering who we have in the White House, I doubt that he would even honor an extradition order to make her go back for another trial.

Posted by: Josh | March 23, 2013, 2:37 pm 2:37 pm

Francesca, Your evident hatred of the British is embarrassing and quite uncalled for in a member of a democracy that owes so much to ours. There are millions of Brits (the term ‘limey’ is pejorative and semi-racist) who do not read the tabloids, just as there are many Americans who do not read your even trashier popular press and watch your often moronic television, and most of us believe that Amanda Knox was and is innocent. Save your wrath for people who actually do harm, such as the Italian police who mishandled this case.

Posted by: Dr. Denis MacEoin | March 23, 2013, 7:09 pm 7:09 pm

“The Monster of Florence” ——- the genius of Benito Mussolini all over again. Italians are good in the arts but for brains they are void. They already have the confessed killer. Now who is grandstanding except the Wops looking for publicity and venting their hatred for Americans.

The woman : Angie Alexis who said that Italy is a 3rd world country is beyond ignorant!! The facts that evolved with this case were not made known to the US and before you criticize the Italian Judicial System you need to hear the TRUTH!! If you get the Italian News Channel you would have the REAL facts with this case and it is overwhelming proof that she was manipulating the whole situation

Posted by: Cinzia | March 23, 2013, 9:03 pm 9:03 pm

Ultimately only 2 things matter here. 1 – there is no hard physical evidence tying Knox to the crime, and 2 – whenever the theorized motive behind a murder includes witchcraft, devil worship, or some other occult-like theme, it’s probably false. It really doesn’t matter if she lied; in fact, lying can sometimes be a good strategy (or the only apparent strategy) if you’re accused of something you didn’t do. Innocent people lie all the time, sometimes for no good reason at all. Being a liar doesn’t make you culpable for homicide

Posted by: Steve | March 24, 2013, 12:41 am 12:41 am

I don’t understand why her troubles wouldn’t be over…..If she stay in the U.S., how would she be unsafe? How could Italy force her to go to trial in their country if she stays here?

Posted by: Anne | March 24, 2013, 11:41 am 11:41 am

I fully agree with Cinzia above about whenever “evidence” is based on
witchcraft, devil worship, etc., the charges are in all liklelihood false to begin with.

She was acquitted of the crime in Italy; she is now in the United States.
Italian law does not recognize “double jeopardy, i.e. being tried for the same crime twice. I, therefore, can’t imagine that the United States would extradite Amanda to Italy for retrial. Doesn’t the Italian government have enough serious issues to deal with such as lack of a national government, and being on the verge of bankruptcy to re-open the Knox case? Move on, already !

Posted by: Alan | March 24, 2013, 3:20 pm 3:20 pm

It frankly amazes me that some AMERICANS even continue to “believe”:

* That Amanda Knox has “told so many lies”. (Except in two typewritten “statements” written FOR HER in a language she could then neither read, write nor speak comprehensibly, she has always told and insisted upon the very same thing: that she was not at home at all on the evening of the crime and had nothing whatsoever to do with the murder of her roommate.)

* That Amanda Knox could in any way be extradited back to Italy. (She was acquitted at trial, and as a citizen or resident of the United States she comes under the Constitutional prohibition: “nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb.” That is VERY definitive and overriding.)

The truth is that many Americans’ beliefs about this case are equivalent to the “beliefs” of some very simple people that Peter, James, John and Paul read the Bible in the King James Version!

Posted by: JLS1950 | March 24, 2013, 7:16 pm 7:16 pm

Any sane person who has followed these trials and not relied on tabloids or horrendously hate-filled guilt sites like TJMK or PMF for their information must come to the same conclusion that the second trial court came to: Knox and Sollecito had nothing to do with the murder of Kercher.

Colpevisti like BRMULL continue to spout proven lies and venom on any forum they can find. Others, like John Galt and
Anna, simply show their ignorance of the facts when they post such nonsense.

Space Cowboy isn’t worth taking seriously on any subject when his agenda is nothing but
Obama bashing.

NO evidence tied either Knox or Sollecito to the murder while there was overwhelming evidence showing Rudy Guede’s guilt. He, and he alone, murdered Meredith.

Amanda Knox couldn’t possibly be guilty. She’s a white female.
Haven’t you heard? According to the American media and American pop culture, white females are perpetual victims who are never, ever, ever guilty of anything.
All of you who think Knox should pay for her sins need to get with the program and bow at the alter of the feminist establishment which preaches that females are just precious pillars of purity and innocence who should never be held accountable for anything they do.
