Obama Campaign Pushes Back Against Possible Voter Suppression
ABC News’ Karen Travers and Arnab Datta report: The Obama campaign and DNC have filed an injunction in federal court as an effort to challenge what they deem as illegal voter suppression of people whose houses are in foreclosure.
The injunction is in response to the comments last week from the Macomb County (MI) Republican Party chairman, James Carabelli, who allegedly said: "We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses."
On a conference call with reporters, Bob Bauer, general counsel for the Obama campaign, said this practice is illegal and would be used to intimidate and prevent people from going to the polls.
Bauer said that one out of every 285 households in Macomb County have been foreclosed on and MI Democratic Party Chair Mark Brewer said that in July 2008 alone, over 11,000 households in Michigan received foreclosures notices.
Bauer and Brewer could not cite specific examples of this already happening in Michigan this cycle. ABC News’ Chris Bury reports that Carabelli denies ever saying the statements that were attributed to him in the Michigan Messenger.
Joe Biden addressed this yesterday at an event in Michigan, stating "ladies and gentlemen, I heard, I was told yesterday that there’s a Republican County Chairman right here in your state, in Michigan, that said that they’re keeping a list of foreclosed homes, suggesting that anyone who lost their home in foreclosure should also lose their right to vote." He added, "if you’re worried about losing your home, you should vote, you should vote for the guys who are going to help you keep your home, not those who take it away."
UPDATE: In a paper statement today, Carabelli pushes back hard against the Messenger’s reporting.
“This story is not true. The Michigan Messenger made it up,” Carabelli said. “Because of reckless and fabricated reporting by the Michigan Messenger, my good name has been besmirched on the Internet and across the mainstream media and my reputation irrevocably harmed. I never said what the Michigan Messenger quoted me as saying. It’s not true, and I want a full and complete retraction of the quote, and I am taking legal action to get it. Let me state, again and unequivocally, there is no such plan to use foreclosure lists to challenger voters, and I never said there was. This is a story line being pushed by one liberal blog, the Obama campaign, and their friends and operatives on the Left.”

OK correct me if I am wrong, if your home is forclosed on you cannot be living there right? If your home is in the processes of being foreclosed on you can be living there? If you are still in you home, you should still be able to use that address to vote. Good thing Obama was a constitunal law professor. So it begins. The Republican campaign begins in earnest.

Senior Deputy Prosecuting Attorney Stephen Hobbs told the board that six ACORN workers had admitted filling out registration forms with names they found in phone books last October. The canvassers filled out the forms while sitting around a table at the downtown Seattle Public Library

David Brooks writes in the New York Times that Sarah Palin is unqualified:

I would have more sympathy for this view if I hadn’t just lived through the last eight years. For if the Bush administration was anything, it was the anti-establishment attitude put into executive practice.
And the problem with this attitude is that, especially in his first term, it made Bush inept at governance. It turns out that governance, the creation and execution of policy, is hard. It requires acquired skills. Most of all, it requires prudence.

And in the Washington Post, Richard Cohen goes off on McCain, seizing on the Palin pick as a sign of how far gone the candidate is:
McCain has turned ugly. His dishonesty would be unacceptable in any politician, but McCain has always set his own bar higher than most. He has contempt for most of his colleagues for that very reason: They lie. He tells the truth. He internalizes the code of the McCains — his grandfather, his father: both admirals of the shining sea. He serves his country differently, that’s all — but just as honorably. No more, though.

His opportunistic and irresponsible choice of Sarah Palin as his political heir — the person in whose hands he would leave the country — is a form of personal treason, a betrayal of all he once stood for. Palin, no matter what her other attributes, is shockingly unprepared to become president. McCain knows that. He means to win, which is all right; he means to win at all costs, which is not.

We have had that in Missouri. Many blacks in St. Louis were “too late to vote” in 2004. The polls closed with people in line. And now an attempt to make the ID laws so strict people will be discouraged. The Obama campaign should be looking at every state because the Republicans will suppress votes wherever they can. If you face home foreclosure, they’ll try to keep you from voting, but if you live in Texas in a wealthy area and are out of your home because of storm damage, they’ll find a way for you to vote.

The Michigan branch of Association of Community Organizations for Reform Now (ACORN), located in Detroit, is being investigated after several municipal clerks reported fraudulent and duplicate voter registration applications coming through.
The majority of the fraudulent and duplicate applications are coming from the liberal ACORN group based in Detroit, Michigan, which now has ACORN investigating the problem once again as well as the Secretary of State’s Office turning over some of those applications to the U.S. Attorney’s Office.
According to the report by Freep.com, the spokeswoman for the Michigan Secretary of State’s Office, Kelly Chesney, says there is a “sizeable number of duplicate and fraudulent applications. And it appears to be widespread.”

These GOP residency challenges were apparently to be targeted only in “certain” areas. And the objective is clearly not only to disenfranchise the directly challenged voter (who may in fact still reside in the foreclosed property, may be renting from a foreclosed-upon property owner, or be the new owner of a property that had previously been subject to foreclosure); but to disenfranchise MANY OTHER VOTERS in the precinct.
That is the even bigger story. Working people who are missing work in order to vote, single parents with children at home, elderly who cannot endure long periods of standing, and so on, may not be able to wait for hours and hours to vote while the person at the top of the line faces a time-consuming residency challenge.
I am a long time poll worker, so I speak from experience. Any time there is a challenge or other voter irregularity on election day we must stop what we are doing (checking in our lined-up voters and assigning them to voting booths), calm down the affected voter to prevent an altercation, call the county for guidance, locate the provisional ballots, help the voter fill it out, and attend to the secure custody of the completed provisional ballot.
Polling places are almost always understaffed as it is. Even one challenge– targeted at the very busy beginning or ending of election day– could slow things down tremendously and force people at the back of the line to give up and go home.
That the GOP would come up with this is outrageous. Mr. “I don’t know how many houses I have” should think about how shameful this is.

actually, even if your home is foreclosed on, and sold at auction, the new owner can then rent the home back to you. Unfortunately most of these homes are not selling at auction and end up bank owned properties and empty, as the bank has no interest in renting such properties.

Many “properties” foreclosed upon are not single family dwellings. Many apartment complexes, large and small, have also entered foreclosure.
Generally, the bank and the new ownwers of the complex seek renter continuity–renters are NOT put out of a complex simply because it has changed hands.

If your home is foreclosed on that means you have already been in the home three months without making payments,and the Police or Marshall will escort you out once the bank orders it.So at that point you would not be a resident of that address.This I know from my own experience.

Why are you Obama supporters so angry? Obama has nothing in his past to indicate that he would be a good president, but yet you think that he’s going to just come into the white house and make everything perfect. Obama is no different than any other politician so don’t act like he’s going to be some kind of messiah.
Also Cafferty is trying to say that people wil not voting for Obama is only because of racism. What about the 90% black vote for Obama? Is that racism? Could it be that the voters that won’t vote for Obama think that he don’t have enough experience and nothing to show that he would make a good president. Just because Obama is black does not mean that voters should not make judgement as to whether he would make a good president or not.

Bhrandon – You’re right, Obama doesn’t support infanticide, that would be silly, but he does support denying medical treatment to infants who survive a second- or late-term abortion. He was the only member of the Illinois Senate to ask that hospitals not be required to give medical care to these infants – essentially allowing them to die. He believes in protecting the abortion rights of women at all costs – even if that aborted infant survives the abortion. The bill in question simply required that hospitals give care to these infants, Obama argued that they should not, and that is seen by many as a violation of the infant’s civil rights. They just have to update their address with their voter’s registration department and vote in the right place – everyone does this when they move. It’s a matter of where they vote, not if they vote.

shalom – If that’s their legal address, then that’s their legal address – as long as they can prove it to their voter registration district, I’m sure they’ll be fine. The bottom line is that nobody (not even Republicans) can take away your voting rights (unless you’re convicted of a felony). If the people don’t live at those addresses, they shouldn’t be voting from there – it can wreck havoc on local elections and districting. They need to vote from their new address – that’s all the quote really says. This is nothing more than much ado about nothing from the Obama camp.

FACT – this story broke on September 10th and certainly Mr. Carabelli knew of the impact it would have. You mean to tell me that you’d wait six days until you said “it ain’t so”. Mr. Carabelli is only in a pickle because a suit was filed to protect the right of a citizen to vote. Seems ironic in this taxation without representation state of mind of the GOP someone could pay property tax for perhaps years, find themselve in foreclosure and then find themself outside the polling booth. If this story proves to be true (and I believe it will – read it by clicking on the links – since Ms. Melzer does some pretty strong collaboration work) this could be a real downturn in Michigan for Republicans – well, not just Michigan – this is sleeze at it’s finest. America – the land of the free, brave and Democracy? I’m beginning to believe there are some mighty strong forces out that that do not believe that at all. When you’re powerful and have a lot to lose, you’ll do almost anything to retain that power. But the agenda to invade Iraq was in place well before 9-11. This is documented. 9-11 just gave them a way to justify invading. The ONLY intellegence we had that claimed Saddam had WMD’s was an UNSUBSTANTIATED confession from a prisoner that had been tortued for two years in an Egyptian prison. That’s it.

I’ve been blogging on this election for quite a few months now and, have steadfastly resisted using the “R” word — up to this point. Regrettably, there has been so much of it during this campaign. Now, therefore, I too, regrettably, must weigh in. I am reminded of a story told to me years ago about an old black woman walking down a country lane with he grandson. They happened upon a black man hanging in a tree. The smell of death was in the air. The old lady pretended not to see or smell the body. But the innocent boy queried, “Grandma, why do they hang black people from trees?” The old lady replied, “Shush your mouth boy. That don’t concern you. That’s white folks’ business!” So many of the people who post on these sites believe that black people need to be kept in their place, and the election of Mr. Obama will defeat this purpose. They believe that black people should not aspire to positions of leadership in this country, because that is “white folks’” business. They will use any means at their disposal to keep it so–up to and including voter intimidation. Everybody who believes in the dignity of mankind should abhor these tactics. His job can be eliminated at any time by the Governor.It is part of the rules allowed by Alaskan law. In Oregon the Governor has helped Mexicans to vote. He did so by filling out papers so they could. He did so on TV as he helped several of them fill in the voter cards. The sectary of state of Oregon was by his side doing the same. Where is the federal government when you need it?

When you receive a foreclosesure notice, you are still living there. The notice is letting you know that the procedures for foreclosesure has begun. Which normally takes up to 3 to 6 months before you have to leave. some people have been selling their homes for quick sale lowering their price of their homes as much as 200,000 causing everyone’s home going down in value.So they cannot sell their home because they cannot sell for what is owed. Others made the mistake of trying to resume payments as soon as their financial situation improved, but then they are kicked out anyway. Others just save for moving day and pack up and leave when the lenders claim the property. the value of my home dropped when others in the city I live in quick sold their homes. The homes were not in my neighborhood, but the value of my home dropped anyway. I owe more than the value of my home now because of others quickselling.

If the voter is not living in the foreclosed home, the voter cannot use that address to vote.
Voters must register in, and vote in, the precinct they reside in.
1) Michigan law states that the same address must be used for voter registration and driver’s license purposes.
2) Michigan law requires that your driver’s license address correspond to your residence and match the address on your voter identification card.
3) Your driver’s license may be suspended if you fail to change your address with the Department of State.
There is no grace period for changing voter registration or drivers license information. If you relocate, your old address cannot be used to vote.

The Michigan Republican Party is demanding, via press release, a retraction of the Michigan Messenger story “Lose your house, lose your vote.”
In the article, Macomb County Republican Party chairman James Carabelli was quoted as saying, “We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses.”
Carabelli contends the quotes as reported by Eartha Jane Melzer were “fabricated.” State Republican chairman Saul Anuzis charges the story is a “complete fabrication.”
The story will not be retracted because Carabelli’s and Anuzis’ claims are without merit. The quotes were accurately reported. Melzer, the Michigan Messenger and the Center for Independent Media stand behind this story 100 percent.
It is worth noting that Carabelli and Anuzis have yet to send the demand for a retraction to Melzer, the Messenger’s editors or the Center for Independent Media. To make such a far-fetched charge to other media outlets but not to us suggests that their motivation may be more political than factual.
The facts are these:
On Monday afternoon, Eartha Melzer called the Macomb County Republican Party as part of her coverage of preparations for Election Day in Michigan.
Melzer was put in touch with Carabelli and spoke with him around 4 p.m.
Her notes show that she asked him about plans to have election challengers at the polls on Election Day. As they spoke, she typed a question about Republican voter challengers: “How will they know if the addresses match? How will you know which addresses to check?”
Her notes show that Carabelli responded, “We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses.”
Melzer’s notes then show she asked a follow-up question: “How will you know people are who they say they are?”
Carabelli responded, “I would rather not tell you all the things we are doing.”
Eartha Melzer is a prize-winning journalist. Her string of investigative reports on Sovereign Deed, a private security firm whose founder faked a military record in order to get tax breaks from the state, won honorable mention for the National Press Club’s 2008 Sandy Hume award given for excellence in political journalism.
I edited Melzer’s article. I have been a Washington journalist for 28 years. From 1992 to 2007, I was an editor and reporter for the Sunday Outlook section, the Style section and the Metro Section of the Washington Post, as well as an editor and columnist for washingtonpost.com. Needless to say, I have never reported, edited or published a story that included fabricated quotes.
We are not partisans of the Democratic Party, as alleged in the press release. Case in point: When Gov. IT’S LIKE THE TITANIC. The U.S. is like that glorious, opulent, fabulous sinking ship. No one wants to believe that we could really go down. We’ve been so well off for so long. Instead of facing the terrifying reality of our plummeting economy, McCain-Palin supporters are like the Titanic guests who preferred to stay at the party, turn up the music and dance, pretending that they weren’t moments away from disaster.
We have George W. Bush’s 8 years of failed trickle-down economics to thank for our ruined economy. Though it’s not been ruined for himself and his business buddies who got what they wanted in Iraq. funny how the richer some folks got these past eight years, the poorer others got. G.W. Bush has shrunk our middle class and ballooned out the amount of poor people in the U.S. There’s been no trickle; just some super-richies who are growing their piles of $.
McCain plans to continue down Bush’s economic road. He has a record of voting with Bush on the issues–91% of the time. He has many Bush loyalists working on his campaign and waiting for their places in the McCain administration.
How can U.S. citizens allow this country to sink further down? This is the titanic, people. This is a great country that is truly going down. It takes courage to recognize a disaster coming our way. It might be easier for some to cling to old, familiar ways, but this is the time for something new, something smarter than what got us in this mess.

The combination of massive deregulation of industry, The Trillions spent on the Blood for oil war in Iraq, Bush appointing Cronies to Government Oversight Jobs who had no qualifications for what they were supposed to do. And Barowing Billions from China to give the Voters hush money rebates is what has triggered this horrific economic collapse we are now in.

This ABC report concedes there is no evidence that the GOP is now, or ever has, scrutinized voters using foreclosure as a specific criteria. As part of a general strategy of detecting voter fraud, validating votes cast from a particular address has always occurred, and should. The reason is very simple.
Vote fraud involving foreclosed property has indeed occurred in every national election since 2000. As it has where Katrina evacuees were involved, where inner city housing projects were involved, in states permitting Election day voter registration, in states allowing voting with no ID requirement, and on and on, ad nauseum. The culprit is not, however, the GOP. No, it is our old friend ACORN.
The number of ACORN larvae doing jail time is in the double digits? Railroaded by GOP scum. 200 Democratic voter registrations from a 20-unit apartment complex? No problem. Three dozen voters physically show up in one precinct, all claiming domicile in the same two-bedroom home? Shrug. Absentee ballot request from Amelia Earhart? Anti-woman sexist swine!
Yawn. Foreclosure is irrelevant, folks. Federal law assures the vote to the homeless. Would a voter in foreclosure receive any less protection? Get real.
Domicile is relevant only with respect to the type of ballot cast, not the right to vote. If a voter moves out of state, they can request an absentee ballot. If domiciled in a different precinct than the foreclosure address, a provisional ballot may be cast. If a voter is so imprudent as to make no arrangements prior to Election Day, he would still get a provisional ballot – though a case could be made that only scorn and ridicule are appropriate.
If you buy Michigan Messenger’s “story” as is, I can only ask — Do you stand on feet?

DK, The Kennedy thing wasn’t supposed it was fact. I live in Michigan and it was a made up story, no one is being kept from voting, foreclosed or other wise. I wish some people on this blog would check out the facts before spewing lies. I’m an independent and some of the crap being thrown back and forth is sickening.

I will be fine either way, but I am guessing that some that will vote for MCSAME will be really upset if he gets in office…His top Economic advisor said of her job at HP “the problem was, I didn’t fire enough people FAST enough” and she referred to offshoring jobs as “rightshoring jobs” hopefully you aren’t part of a Union, work at a job that can be shipped or compete with China in your product…Because if you do McCain is going to make your life REALLY DIFFICULT…Job losses will continue to rise, the stock market will continue to crumble (for those with a 401K, there goes your retirement) all because you couldn’t see past your hate…

Kevin needs to get himself a FACT CHECKER…It was determined by 8 REPUBLICANS and 4 Democrats that an investigation would be launched…This probably would have “gone away” had she stayed in Alaska to “oversea” the investigation BUT alas she didn’t, so EVERYTHING is comming out…Can you be VP from a prison cell? hmmmmm….Not only did she fire Monegan, she went after a Workmans comp officer in charge of the case for her former brother-in-law this person says that they recieved dozens of calls to deny his benefit…What is truly funny about this case is that the Ice Queen had turned in a fellow Republican for doing in essence the SAME THING…If I were McCain I would be wearing a “knife proof vest” with her as VP…She rides their coat tails until they stop, and then she knife’s them in the back… How long does anyone think it will be before she reports McCain and calls for his impeachment? EVERYONE has the right to vote (excluding felons and dead people). In Georgia we even have several days of EARLY voting to make sure everyone gets a chance to vote WITHOUT the long lines. The only catch is you have to show valid ID – this is standard people. OBAMA HAS COMMITTED VOTER FRAUD IN THE PRIMARY – i.e. TEXAS CAUCUSES (lawsuit pending)!! OBAMA WILL DO IT AGAIN IN THE GE IF NOT MONITORED WITH A RECOUNT!!!

Uhhh, the point is to prevent a person from voting in two districts which is easy to manipulate. Just like getting dead people. It’s happening all over the place. Seattle, Kansas City, Roanoke, etc. It sounds to me like the mafia is still at work. How about instead of dividing the country we all just vote for an Independant. Ohhh, I could see it now…The Supreme Court has decided to divide the votes equally to each candidate unless it determines the outcome. It really fascinates me that most of these blogs are filled with such far-leaning ideologies from both side. Problem is neither side determines the winner. How about taliking about the real issues.

the residents must be living somewhere else! They are allowed to vote from their new residence!
Keeping track of the foreclosures will

I sit here in my house trying to get a job because my annuity is no longer enough to pay my bills. I am tired of the last 8 years of an administration that did not have a care for my welfare and well being. I want a new president that cares about the middle class and is an honorable and fair person. OBAMA is the person that fits that bill. Not McCain whose record I have read from congress and know that he stands for no regulation and support for big business.
McCain wants all to think he is a man of honor and integrity but his recent ads and statements are just shaemful and lies. His irresponsible selection of Palin brings his thought processes into question. He is old and thinks we are in the society of “good ol boys”. He promises more ineffectual leadership for our future. He must be stopped at all costs. I will walk the streets to get out the vote in VA and do my part to help OBAMA become my next President. I have not had a president for the last 8 years, rather a cowboy loose on the range!!!!!

I’m not going to bother to point out aht all of the actual EVIDENCE (you know, things like numbers, original documents, memos, etc.) shows that the Republicans rigged the “battleground” states in the last two presidential elections. That would go way, way, over your closed minds.
I will simply remind everyone that there is NO requirement to own property to vote in the USA. That includes homes. Conservative “strict constructionists” need to remind themselves of that. Guess what? EVEN HOMELESS PEOPLE HAVE THE RIGHT TO VOTE. If you’re worried about people voting twice (something that is historically FAR less likely than people being illegally prevented from voting ONCE, and something that is, frankly, impractical in a Presidential election because of the sheer scale of the operation (in order to make any impact at all, you need a LOT of people willing to illegally vote A LOT of times, when voting just ONCE takes the better part of an hour in most precincts)), then you should be fighting for better technology to track votes cast. But then, that would stop your devious little plans, wouldn’t it?
