Ill. Supreme Court Takes a Pass on Blago’s Fitness to Serve

ABC News’ Matthew Jaffe Reports from Chicago: As Gov. Rod Blagojevich’s attorney was arguing with lawmakers in Springfield, the Illinois Supreme Court rejected Attorney General Lisa Madigan’s attempt to oust Blagojevich from office, announcing that it had refused to hear a motion that deemed the governor "unfit to serve."

Madigan said she was "disappointed" in the decision.

"Because of Governor Blagojevich’s refusal to resign, the State of Illinois is in an unsustainable situation," she said in a written statement. "The serious criminal charges against Governor Blagojevich strike directly at the heart of his decision-making process and seriously impede his ability to legitimately exercise the powers of his office. Thus, while the U.S. Attorney’s Office and the impeachment process move forward, the State is left with a Governor who cannot make effective decisions on critical and time-sensitive issues."

At a press conference in Springfield following a hearing of a special investigative committee looking into a possible impeachment, Blagojevich’s attorney Ed Genson said, "I didn’t think she should have filed there and I guess I was right."

When asked by a reporter why not, he responded: "Because we have an impeachment proceeding that they’re trying to do down here. The Supreme Court is not trying, doesn’t want to, take over what the legislature is going to do or not going to do."

Genson also added that the governor will not appoint anyone to fill Barack Obama’s vacant Senate seat.

"Harry Reid said that they’re not going to accept anybody, so why would he do that?" Genson responded. 

During his meeting with the panel earlier today, Genson requested that a number of lawmakers be removed from the investigative committee that is preparing to make a recommendation on whether to impeach the governor.

"A number of the people who are on this committee expressed views that made it perfectly clear that they’d already made up their minds in this case," attorney Ed Genson said to a special investigative committee of the Illinois legislature meeting today in Springfield.

Genson specifically asked that Rep. William Black, Rep. Jil Tracy, and Rep. Jack Franks not be permitted to participate in the hearings of the 21-member bipartisan panel formed this week by House Speaker Michael Madigan.

"The fact of the matter is they made comments which shows they can’t be fair," stated Genson. "They made comments which shows Rod Blagojevich cannot get a fair and impartial hearing of this committee."

Committee chair Rep. Barbara Flynn Currie of Chicago had adjourned the panel’s first meeting yesterday to give Genson time to come to Springfield for today’s session. She immediately shot down the attorney’s request. 

"This committee is not in a position to expel or recuse members of the committee, so I think that we would not accept your proposal at this time," Currie told the lawyer.

In fact, she said she was "pleased with the opening statements of the members yesterday" because they showed that "they were going to undertake this effort in a spirit of due process and fair play".

Blagojevich, arrested last Tuesday on charges that included trying to sell President-elect Barack Obama’s former Senate seat, hired Genson on Monday to represent him. Genson has said the governor is not guilty and will fight the charges.

Today the high-profile Chicago defense attorney asked the hearings be adjourned to give the defense "appropriate time to prepare," citing that Blagojevich’s team had only been given one day’s notice about their chance to speak before the Springfield panel.

This request, too, was promptly dismissed by Currie.

"I don’t think we can wait around and put this off for another six months or another year," she responded.

Also today, Genson said it would be illegal for the committee to use recordings from government wiretaps and he questioned the rules that the panel would implement as they assess the governor’s possible impeachment. The attorney said he had looked through the laws and the state constitution and found "nothing" about the basis for impeachment.

"I find nothing, nothing in any of those places that talks about what is the basis and what the basis for impeachment can be," Genson said. "I find nothing in any of those places regarding the standard of proof."

Replied Currie, "Impeachment is appropriate if there is cause for impeachment."

Blagojevich will likely hold a news conference later this week to state his case.

The charges against IL governor appeared to be shallow, flimsy and a set up at best. I suspect some kind of collusion by Chicago Tribune and other enemies of the governor having some hands directly or indirectly in his predicament. Vengeance and vicious politics begets vengeance and vicious politics. This cut-throat dance of the swords is commonplace in Chicago and this governor is a victim of his own messy environment.
Rarely do you see a newspaper so embroiled with the state chief executive and at the same time negotiating with US Attorney’s office on when to publish a “secret” wiretap on their front page. This case is kind of bizarre. From many newspaper accounts, I see some joint coordination between Chicago Tribune and US Attorney’s office, even though this IL governor is no angel by any stretch of your imagination.
What the governor is being accused of doing is not an abrasion; it is neither unusual nor extra-ordinary especially in US politics. In all state capitals and corridors of power in this nation, similar deals are cut daily and virtually on all issues. It is called lobbying, fundraising and interest peddling. Apart from political damage, getting a conviction here is even harder without actual funds exchanging hands. Merely discussing these things does not constitute commission of the actual crime.
To add salt to injury, as the bad press makes the governor radioactive, it is a full season for those that want to be declared saints overnight from the filth called Chicago. It is shameful for State assembly to jump to conclusion before the investigation is even concluded. It is even crazy for the stat AG to invoke unrelated constitutional power in declaring the governor persona non-grata. All these bizarre actions are self centered, self serving and self promotion that have politics written all over it instead of the rule of law.
Unfortunately, our laws allow these shenanigans that IL governor is accused of and have very few gray areas which any defendant can work gingerly. It is just that there is too much bad blood in Chicago and corrupt reputation of its politicians, if not no one will hear about this. Sadly, Chicago does not possess the exclusive monopoly to this kind of shady deals and pay to play schemes. To claim surprise is disingenuous and dishonesty at best. In the same vein, to exaggerate and make a huge mountain out of this ant-hill is stupid. Well, except to score political points and settle old scores.
I suggest, we let the investigation run its course and the man his day in court. No one should be foolish enough to throw the first stone at this man no matter how blatant his accusers want a pound of his flesh. He is not a saint neither are the AG’s office and the State Assembly. Gov. Roy did what comes natural in the dirty profession aka politics.

While the sentiment above of due process is laudable, the governor appears to have little or no shame and is certainly in no position to exercise his duties considering the allegations. I’ll let the people of Illinois solve this problem, but it would seem best if the governor temporarily recuse himself from his duties until the matter is settled in an expedited fashion.

I agree with the attorney. Our lawmakers are just idiots. They rush to judgment without having all the facts, like they did on the invasion of Iraq. Yes, I know this is just the Illinois government, but their prejudgment is reflective of the same attitudes in our federal government. This guy deserves his day in court. And the lawmakers that have already stated their opinion absolutely should be removed. Their unfit to sit on a school board!

Rep. Barbara Flynn Currie is off to a good start. She should not play Genson’s trial lawyer’s game.
Impeechment is a political remedy. It is not a judicial proceeding. There are no rules of evidence and not “standard of proof.” The bottom line is that if 3/5 of your legislators say you should go, then you are out. They can impeech you for any reason and that’s the way it should be. It’s political process.
The Governor has failed as a leader to command the respect and trust that is necessary for a political leader to execute his reponsibilities. he can no longer get any real work done for the people and he must now go….period.
I hope this committee keeps its spine. Don’t play this lawyer’s game!

This guy is not a servant leader. He has been under investigation since 2006. He has ties to the mob even before that time. It goes on and on. When will it stop.?

Blago has way too many charges and building evidence against him.
Every day longer he stays as Illinois Gov. the more he embarrasses Illinois.
It’s not like he is a CEO of some business; he is a freaken Governor of a state who no longer has the trust of the people. State employees need a leader they can at least trust at this point. The salt trucks are not even doing a good job right now; I wonder why.?

This woman’s replies to questions by Blagojevich’s attorney, particularly one’s regarding the legal requirements and due process of impeachment, imply the COMPLETE AND UTTER ANTITHESIS of “spirit of due process and fair play”, begining with, but certainly not limited to her fundamental understanding of the law. It is absolutely frightening in this day and age, that when someone is being subject to due process, they receive a completely circular and unsophistically reply like “”Impeachment is appropriate if there is cause for impeachment” when asked about a standard of proof.
Even Salem witch hunters had something like “if you sink, you’re guilty”.
Wow. “Railroad” seems like a bit of an understandment when describing this process.

Ed Banks – I am no lawyer, but I can tell right from wrong. I don’t accept that its just political business as usual. If we can’t get rid of bad apples who try to sell senate seats, and just accept it and say, “Hey – it’s legal.”, then we deserve what we get. Politics has gone downhill from public service to sleazy self serving. We need to raise the bar – and start holding our leaders accountable to doing what is right. I know you’ll say we hold them accountable at election time, but I want to be able to get them for stuff like this between elections – that’s what impeachment is for and this guy deserves it now.
Chicago Bob – I don’t care to know if this guy is a democrat or republican. I don’t care what party a man is from – though I prefer independents. But I have seen many republicans that did things that I wanted them out for – and most of them didn’t want to go – as reluctantly as this governor – one guy sexually harassing pages and old Mr. Wide Stance come to mind almost immediately. I won’t judge other republicans by their actions any more than I will judge other democrats by this governor’s actions. People need to be judged on their own merit – I wish we didn’t have parties – just independents.

Fitzgerald couldn’t find anything on Cheney! Barely got Scooter Libby, who was pardoned. Clearly, Fitzgerald jumped the gun on Blago with flimsy, political charges, that appear to have broken no law. He should have waited until money changed hands… Duh! It would then have been slam dunk. Hence, why would Fitzgerald botch the so-called “crime spree” right before the real crime happened? Since when did it become illegal for a governor or anyone else to wish for financial gain? Fitzgerald’s investigation and methodology is very suspect in my book!

I guess you don’t get around to following too many Republican’s who are not only arrested, but also indicted on specific charges vetted through a grand jury AND in court to have those charges proven AND found guilty but haven’t received sentencing AND running for re-election to be a Senator for the U.S. Congress. Ted Stevens… Tom Delay… Larry Craig …. and many, many more!

Please tell me what is the difference from what the Ill. Governor did and what the politicians in the US Congress do every day? It’s “Pay to Play” in many states; that’s the way politics work. Just look at the money donated to Schumer, Frank, and Dodd from the financial lobbyists to have them introduce bills that fit the financial industry’s interest.

BETH – You need to come to Chicago. There is a State of Illinois building in downtown Chicago. The governor does the majority of his business there and goes to Springfield for votes or when special sessions are called.
I am not for this governor, but to me, the case against him is weak. This has been tried in the court of public opinion. Years of wiretaps and of the only 2 counts he is charged with, one is that he planned to sell the senate seat?
This is almost like the movie Minority Report where people are arrested before the crimes are committed because of the use of clairvoyants. The language was harsh by the governor, perhaps they will argue intent, but I thinks this one is shakey. Let’s see what they have relative to the Children’s hospital and the Tribune.

I believed that they would do the RIGHT THING FOR THE PEOPLE THAT ELECTED THEM and appoint people that are ETHICALLY, have INTEGRITY and QUALIFIED for the JOB!!
But for DUMB A@@ to even think/conspire about it OUT LOUD and being TAPED talking about it, IS GUILTY!!!

Gary Bonner— I agree with your point. This is not a legal proceeding to be determined in the courts and does not require any “standard of proof”. This is an impeachment proceeding within the state legislature. It is a totally separate and unique process. If the required number of legislators vote for impeachment then — you’re out. It simply does not matter one bit on the reason—- they could impeach him for having sex in the Governor’s office if they so chose! Anf if they decide you need to go, you need to go! So, the bottom line is— he very well could be impeached and removed from office and never be convicted in Federal or State Court of a crime!

Most reporter are missing the real BIG story behind Blago current perils, and it is the age old system of campaign contribution that year after year promotes the pay-to-play Chicago way of business.
While we are all drawn to see the blood in the fresh wreck, reporters in particular to sell more, we are missing a GRAND opportunity to pin down those enraged ,holier-than-thou, grandstanding Illinois house and senate members to pass effective campaign contribution reform that actually give us the best use of taxpayer money, and no more of the substandard work from all the usual patronage business.

Art In Chicago — i rhink we are yet to see all the evidence snd all of the charges. All that has been disclosed are the documents supporting and arrest on suspicion. Additionally, between Hot Rod and his assisant being arrested last week, they are #14 and #15 of the ongoing Federal investigation identified by the code name “Board Game”, which has been going on since 2003! This is simply a continuation of the same investigation that nailed Rezcko and 12 or 13 others. So, we’re still waiting on the rest of the story!

Here is the difference people between the Governor and you and me. I am almost 84 years old. Every year I have to prove my income enables me to keep my $2,600 for burial expenses set aside so they don’t raise my property tax on my meager homeplace which my deceased husband and I bought in 1953 for $5,250. Now I have no inside information or influence to sell, I just try and hold on with the help of my son, grandson and their families. I don’t want any crap (excuse my temper) from those on this board about a level playing field. I am certainly not a “peer” of the Governor nor when selecting a jury of “peers” would I come close, but believe this Grandma I have a bias right from the start and something I have told my children and grandchilren from day one: do right and you’ll coming shining through. There are TWO Americas and sadly I see both.

I would tend to agree with the Ill. Supreme Court Decision to not hear the case. The AG claims that Hot ROD is not fit to perform his assigned duty. I believe in order to make that determination, she would need to provide evidence that something has changed with respect to Hot Rod’s abilities subsequent to his election. I doubt that she can do that. I’m confident that he is the same incompetant, arrogant, ignorant, incapable and crooked politician that he was when he was elected! Case dismissed!

I know Im probably alone on this but I believe the Gov. should stay being the Gov. I feel if we wire tapped all the politicians phones we would be impeaching them all. I believe its politics at it’s worst but its still politics.

The court has set a precedent with this ruling: That if a politician wants to commit blatantly illegal acts, then all he needs do is be so blatant about such acts that the proof against him is irrefutable, enabling his defense attorneys and our system of law to rule that evidence, and all testimonies against him unimpartial and unfair, and therefor, refutable. Soldiers are dying in Iraq, people are losing their homes, their jobs, their sense of dignity, and this idiot is trying to hold onto something that should no longer rightly be his, while attempting to sell the other to the highest bidder. And the obvious in all this: On top of every other justifiable reason he’s unfit and should be removed, I can’t help thinking the most telling thing is that he was stupid enough to get caught. Now we have proof that our government is for sale. What are we going to do about it?

Saying you want illegal money and getting illegal money are 2 different things. From a legal point of view, the Feds pulled the net up too soon. There is not a crime, no money changed hands. They should have waited for the money to pass. Now demanding money, even if he did not get it, IS likely a good basis for impechment. Since impechment is political and not a legal move. Interesting stuff.

Whatever happened to innocent until proven guilty? He has not been convicted yet – only charged – and he may never be convicted. So far, I’ve only heard one side of the story. I suspect that like with any other story, there is a whole other side.

No, “Dave”, Currie is not denying Blagojevich due process. She quite rightly said — and please parse the statement — “Impeachment is appropriate IF THERE IS CAUSE.” IN other words, the committee must determine whether there is cause, and that is what due process is all about.
Barbara Flynn Currie is my own state rep in Hyde Park. She is not stupid.
As for the Supreme Court’s denial, this may hinge on the fact that Lisa Madigan made her request under a state constitional provision involving physical and mental disability — which doesn’t exist here, however intellectually challenged you and I think Blagojevich might be — or the fact that it is, as yet, unclear, whether Blagojevich broke any laws. I’m wondering whether a law against “soliciting bribes” might be invoked, but as I pointed out yesterday, we’re all concerned that Fitzgerald jumped the gun.
Given that Bill Clinton was impeached for lies about a series of outrageous sexual peccadillos with an intern, which had no material public impact on anything but general confidence, I think that Blagojevich should be subject to more severe penalties. As I said yesterday, he’s been under investigation for some time, and I suspect that what we’ve heard so far is only the tip of the iceberg. Give Fitzgerald and the House Committee a chance. Owing to the Internet, we are all too hung up on instant answers and action. That’s childish and unrealistic.

It’s good to see that there are Americans who disavow the corruption going on in US politics and business.
But I have to ask that if you represent American public opinion to a significant degree, how do your politicians and corporate rattlesnakes get away with what they’re doing.
You are supposed, according to an international survey, to be the 18th least corrupt nation of something like the 200 surveyed. My bet would be that you on a par with Zimbabwe and that the next survey will reflect that.
As I live in New Zealand (1st= least corrupt nation on the planet along with a couple of Scandinavian countries), I feel qualified to throw stones.
You are pathetic, know that you are pathetic, and do damn all about it.
