Why Hasn’t Joe Biden Resigned His Senate Seat?

In our exclusive interview airing this Sunday morning, I asked Vice President-Elect Joe Biden why he hasn’t resigned the Senate seat he’s held for almost 40 years.

Here’s what he said:

GEORGE: "President-elect Obama resigned from the Senate. Why haven’t you?"

VP-ELECT JOE BIDEN: "Two reasons. One is that, from my perspective, I shouldn’t acknowledge it, but being sworn in for the seventh time as a United States senator from Delaware, the greatest honor I’ve ever had is the people of Delaware electing me. And ,  and it will in no way effect the seniority of the person who will follow me, number one. Number two, there was a period there when it was thought that it may be useful for me to be in the Senate, in terms of some of the votes that were going to be cast in the Senate that may have been very close, that would have been consistent with our incoming administration’s position that I could have been voting on those. It turned out that did not occur. So they’re the two reasons why I didn’t…"

GEORGE: "But you’re not going to stay on and try to preside… "

BIDEN: " No, no, no, no, no, absolutely not. I’ve already — if I haven’t done it — to be honest with you, I think I’ve done it, but if I haven’t done it, I’ve signed a letter, will sign a letter saying, notwithstanding the fact I’ll be sworn in the first day, I have no intention of staying up until the day that I am sworn in as vice president. Secondly, I yield responsibility to the Senate Foreign Relations  Committee to John Kerry. No, I have,  no. "

Does he have some fear of not being sworn in as VP? Is that why he hasn’t resigned? Is that what he said…I was going to say that it is kind of hard to read between the lines, but it’s kind of hard to read the lines, maybe if I go spin in circles for a while and then read it….

No, he said that his vote might have been needed in THIS session of the Senate. That’s all. Why does everyone try to parse every word anyone says to the media. Sometimes a word is just a word.

OMG! George….what are we watching here? An interview with the next VPOTUS or a softball tournament? 2 puppies????
Why don’t you ask some real questions of this guy? Like how come he can put his foot in his mouth and get away with it but Palin get’s a body cavity search when she lets out a doozy? How can Obama be considered an agent of change when he hooks up with one of the oldest most ingrown members of the DC political machine? Where was Biden when everything we hate about DC was going on…..right in the middle of it….
George you never have been a journalist. You are an advocate for a position……RESIGN!!!!
for the record: I am not a republican. I am not a right wing nut. I hate GW and I did not vote for McCain/Palin….so relax Obama-bots….this is not the Cultural Revolution as per China 1969!!! Go wave you little Red Obama Party Books at someone else…..

Relax Obama-bots….I am Not a Republican or a Palin supporter…..just someone who is shocked at the lack of objectivity in the media when it comes to Obama…..

He wants to talk out of both sides of his mouth!

Posted by: SureEnough08 | December 20, 2008, 11:06 am 11:06 am

He did not want to be out of government officially since Barack was no longer a Senator and was afraid the Repubs would do some last minute “bad things” he could stop foreign policywise if needed. Barack needed intel on the Congress till the last minute he could not get otherwise, and he needed someone also to make sure Senator Shelby did not move Detroit to Shanghai. Other than that, no reason.

Posted by: Bonzai | December 20, 2008, 11:08 am 11:08 am

Isn’t the question why did Obama resign as soon as he did? Did anyone ever ask him that? After all, he didn’t have to and he left the people of Illinois with only one Senator-not that the people of Illinois have ever been a concern for him. Did he want to avoid having to cast a vote? That would be so out-of-character! LOL!
Biden is simply doing what most VP-elects and president-selects have done in the past.

Posted by: Keith | December 20, 2008, 11:13 am 11:13 am

Governor Minner has already named Ted Kaufman as his successor. Ted works for Biden(19years) so the horsecrap about votes is nonsense. He is horsetrading to leave the possibility of his son running for the seat in 2010.
What is with the dynasty stuff coming out of the Democratic party? Caroline Kennedy does not deserve the seat just because she is a Kennedy. There has been a Kennedy in the Senate since 1952. Enough is enough. Between the Bushs, Clintons, and Kennedys they have fostered this air of entitlement to office. Now Biden wants to jump in.

Posted by: John | December 20, 2008, 11:16 am 11:16 am

Hillary hasn’t resigned her seat either. Maybe they are not confident their new offices will materialize.

Posted by: creeper | December 20, 2008, 11:25 am 11:25 am

So if his voted might be needed – then Senator Obama’s vote is not needed – since Obama resigned his Senate seat.
So Biden’s vote is more important than Obama’s vote?

Posted by: Will Stanton | December 20, 2008, 11:36 am 11:36 am

Anyone in Biden’s position, with the potentially key legislation that recently came before the Senate would have done the same thing.
Obama is in a different position because he has to select members of his administration and Senatorial duties would have been too distracting.
But that’s not the vice president’s job except when the president is a “manufactured personality” and a figurehead for special interests. Then you get a behind the scenes handler like Cheney. As Robert Draper, author of the insider book “Dead Certain” said on the Charlie Rose show: “Bush is ‘the decider’, but Cheney provides the menu from which he decides.”

Posted by: The_Mick | December 20, 2008, 11:42 am 11:42 am

I do believe that Senator Biden was simply following the standard tradition of waiting for the electoral college confirmation. Is there anything wrong with that?

Posted by: clancy49 | December 20, 2008, 11:51 am 11:51 am

Duh! Because the days of the public service when officials voluntarily relinquishing power are long over and the days of self service are here to stay. People gripe about corporate CEOs and executives but the professional politicians are just as bad, if not worse.

Posted by: Publius | December 20, 2008, 11:52 am 11:52 am

Who freakin’ cares –Biden is the VP, he’ll resign his seat when he thinks it’s appropriate.
Geez, the nation’s financial system in near collapse; major sectors of the economy are begging for bailouts; we have the highest national debt in history; the next administration will inherit two wars; the deficit is a trillion dollars; unemployment is skyrocketing; about a third of people in the country owe more on their houses than they are worth…and we’re asking why a guy hasn’t resigned from the senate yet?
Pespective folks, perspective!

Joe Biden is the first insane VP we have elected!!! Yes, Cheney is a raving war hawk but Biden belongs in the nut house! Then again, maybe straight shooter Joe is positioning his son to take over his seat-if Kennedy is entitled to New York, isn’t a Biden entitled to Delaware or a Bush entitled to Washington. Come on Dems, stop lying your behinds off and expose the corruption in your party as well as the republicans because America is teetering on the brink of collapse due to the corruption in both parties and Wall Street! The good innocent Americans deserve better than democratic or republican slime!!!!!

24/7 news media has too much space with too few stories. In the last decade they’ve bcom masters at making stories out of non-stories. Hey, how about another 1000 hours on that little Caylee girl? The funny thing is when folks in the ‘legitimate’ think they ‘better’ than Joe Sixpack’s blog.

Obvious he’s been there for 40 Years? and he is change??We need a revolution to throw bumbs like him out of the government, he only has his own interest and the people are not a distant thought. Give me a straight answer from anyone in authority. They are as rare as the Virgin Mary! More bad examples for the younger generation. The intellectual dishonest and downright stupidity of the posted comments to this story is shocking. First, the votes of Biden, Clinton, and Salazar may be needed to pass important legislation in the three weeks between the start of the new session and inauguration day. Second, The electoral college voted on Dec. 9. Should something happen to Obama, Biden will be the next president. (Not-McPoopy Pants and Witless from Wasilla)

George is not really a good interviewer.
Up to now we don’t know if Obama is baptized Christian or a closet Muslem.
Perhaps he should swear his oath on the Q’uran.
Biden is not really sure of being a sidekick for Obama. He might just quit as VP and keep his job as senator.

Go back and read Biden’s two reasons, they seem simple enough. Are most of the negative commentaries here on Joe a matter of disagreement in style of communication? If you try to understand the essence of Joe Biden’s messages, he seems to present a pragmatic approach. Apparently, most of the state of Delaware thinks so, too!

Posted by: simple | December 20, 2008, 3:42 pm 3:42 pm

I recently learned from sources close to Mr. Biden — I mean, from friends with whom I attended college that now work in the capital and for Biden — that he is going to resign from the VP position some days before the Obama takes the oath of office. He is very hesitant about the whole Obama vision and team, and he feels more comfortable near his home and his children and his constituents.
I do not blame him; he would embark on a journey replete with challenges both global and domestic.

I don’t know why anyone would consider StuffinEnvelopes to be a journalist. Remember the David Aldritch “Unlimited Access” book event? George went around threatening the Sunday TV shows with law suits if they put this guy on the air, even pulling out a stack of papers from his briefcase calling them “sworn affidavits” contradicting Aldritch’s claims in his book. That was enough to get at least one show to cancel Aldritch’s appearance.
Problem was (1) there were no affidavits, they were just papers that happened to be in his brief case, and no one double-checked his claim, and (2) the claims in Aldritch’s book were shown to be true.
So Georgie Porgie is a proven liar (and actually admitted to this in his own book). Why should we ever believe anything he says again?

With the changes in US law and disregard for the Constitution over the last 8 years, it may be legally possible even though it is extremely unlikely.
How about it legal eagles? Would the Presidential Directives giving the POTUS dictatorial powers in conjunction with the Patriot Act and other criminally unconstitutional laws stand up in court, or would it even matter since the lemmings would fall in line to march over the cliff anyway?
I’m giving 20 to 1 that Obama doesn’t rescinde these powers BTW.

Blago ruined the Dems plans by being hopelessly open about their intentions. Joe Biden wants to secure the Senate seat for son Beau when he returns in two years from Iraq, Caroline Kennedy is suppose to get New York after Hillary Clinton. Two hopeless candidates, with no political experience – only their names. Ugly nepotism who understandably meet local opposition in Delaware and New York. If Biden gets what he wants by holding resignation, America looses again.

Uh, B. Bear — the electoral college voted on December 15th.

What is it with these Democrats who preface their remarks with “I probably shouldn’t say this …” (Harry Reid when he said he could smell the visitors to the Capitol — you know, taxpayers) or “I shouldn’t acknowledge it” — Joe Biden on his frisson that Delaware keeps electing him for some reason.

Obama and McCain will both be declared NOT eligible to be President. The election might be declared null and void and a new election might come. He better hang on to his seat because he will not get elected over Hillary if there is a new election.
But it might also happen that Biden will be declared President. This is probably more likely. But it is a difficult call right now.
The Supreme Court will not allow Obama to take office. Remember the Chief Justice of the Supreme Court would have to swear him in and I dont think he will do that with a non Natural Born Citizen.
Obama’s father was British and Obama was born with dual citizenship as British and American. That is NOT allowed for President and Vice President. Obama has known all his life he is not eligible to be President. His entire candidacy is a huge fraud.
Main Stream Media is just trying to ignore the story. Obama has no chance to be President.

There is a possibility that the Supreme Court might hear Phil Berg’s Writ of Certiori on January 9, 2009 and declare Obama’s election as POTUS void for lacking eligibility.
Those who resigned their seats to take up cabinet positions will be out of jobs. Joe Bidens who hasn’t resigned keeps his job.
Obama might be arrested for running for the position of president when he know darned well he was not natural born citizen, a requirement of the constitution.

What is wrong with all the people on this web site, have you been asleep for the last eight years? Bush lied every time he opened his mouth, lied about weapons of mass destruction, lied about why we went to Iraq, lied about exposing one of our own CIA agents to the press, lied about firing Federal Attorneys for political reasons and on and on. His Administration gave tax cuts to the wealthy while his economic team got rid of every banking regulation so that wall street CEO’s could rob the middle class of all their pension and college fund money. Not only was the Bush/Cheney Administration corrupt – they are stupid and incompetent. Obama had nothing to do with the scandal in the Illinios Governor’s office – why would he. It is not like Blago was going to appoint a Republican. Obama didn’t care a rats butt who Blago appointed that is why all he was willing to give Blago was his appreciation and why Blago is under inditement and not anyone ont he Obama team. The Republicans are a bunch of losing, no idea, theives and it is time to throw them all out of office. January 20 the can’t come soon enough for the 80% of the Country who disaprove of George Bush and the Republicans in Congess. America voted you out – no go and don’t come back!

Oh, we get it, it’s all about him. That clears up all the confusion. News flash to Biden: Get over yourself.

Sounds reasonable to me. What are all you pansies complaining about?

Well here’s some good news for Gov Blagojevich. It appears that U.S. Attorney Patrick Fitzgerald new boss is going to be Eric Holder, Obama’s choice for Attorney General. Well as luck would have it Eric Holder’s old boss was none other than Gov Blagojevich, who appointed Mr. Holder as a “special investigator to the Illinois Gaming Board” — a post that was to pay Holder and his Washington, D.C. law firm $300,000 in 2004. That’s right, our old friend Gov Blagojevich.
And guess what? Last Sunday, Eric Holder signed a Senate Judiciary Committee questionnaire — five days after Blagojevich’s arrest — omitting any connection (with Gov Blagojevich) on the questionnaire. Eric stated this was an “oversight” and guess what, I believe him!
And what’s that, a Special Prosecutor to look into any Obama involvement? You’ll have to ask our new Attorney General, Eric Holder!!

It’s surprising that there are still a lot of sour loser Republicans long after Obama had won the presidency. What would it take to convince you losers that someone smarter than Bush will be the next president of the United States?

Uhh, he hasn’t resigned because he wants to control who gets the seat after him — for instance his son….

I’ve already — if I haven’t done it — to be honest with you, I think I’ve done it, but if I haven’t done it, I’ve signed a letter, will sign a letter saying notwithstanding the fact I’ll be sworn in the first day, I have no intention of staying up until the day that I am sworn in as vice president.
Commentary :
Isn’t this guy having some problem with telling the truth ?

The real question is, why did Obama resign his, when there is important action to be done in the senate between now and the time he is sworn in. This is typical behavior for Obama– now he doesn’t have to vote “present”

Where was Biden’s frilly pink collar with the matching leash? You should have given him a little pink food bowl with his name on it that read, “bow wow” for his interview. I guess grown democrats use nerf balls and foam rubber bats nowadays instead of real baseballs. Same old little baby questions. Tell us, does Biden sit up or fetch for you yet? It’s all a joke, because you go after blood when interviewing a republican.

He hasn’t found a buyer.

Joe Biden’s refusal to vacate his senate
seat so far seems wise to me and so is
his deliberate lack of clarity on the
question of why. We should all be advised that Biden is no fool, as some would like to think. He has a high IQ and is basically very knowledgeable and politically smart. He knows the Obama will be in a world of trouble when and if the US Supremes rule Obama ineligible to be president on the natural born citizenship issue, and he knows how to double talk when he is not
ready to give a clear and cogent answer to the question of his resignation. What he doesn’t know now is what would be the consequence of Obama’s ineligibility. Would he (Biden)automatically become president elect after being selected by an ineligible president elect, would the decision be made by the democratic party, or would a new election be required?
His stance makes sense to me though I, like many others, on a personal level would like a straightforward response.

This isn’t about money. It’s about democratic power in Congress (60 votes) and about who will fill his seat. He’s trying to be too clever by half and is paranoid against republicans. He worries me. Flaky, impulsive, ego-infested. I hope I’m wrong about him.

Wrong Question!
When will Biden be declared
Mentally Incompetent and step down
as Vice President?
Oh I forgot Obama and Biden haven’t
been sworn in yet!
You could never tell considering all
of the press conferences and
interviews these two have given since
election day!
We still only have one president and
one vice president at a time!
So how soon after the inauguration will
Biden be declared mentally incompetent
and forced to resign?
