Just think of all subcontractors like Haliburton as well as Kellog&Root not to mention all the plane-building, weapon-building and ship building companies that employ people to fill government orders. Regarding the news articles’ statement: “…to pay for education, debt service, and other payments that legally have first claim to state funds.” Isn’t the taxpayer overpaying their taxes the first claim? The state has no right to use taxpayer’s money that is not earned by the government for it’s own purpose.

Glad I left California in 05. They did try to screw me after I left though. I waited and waited for my state tax refund for the six months that I lived there and when I finally got it I found that the wonderful DMV had attached it for my 2006 fees. They made the assumption that since I didn’t pay the fees they were getting cheated of them and attached my refund. Nobody told me that the state had a checkout sheet like the military and you had to checkout with the DMV so that they would be smart enough to figure out that if you didn’t pay the fees you might not be in the state. Finally got my money but it wasn’t easy. So all of you still there just realize how screwed up your state is and change your deductions to 20 so that they get nothing until you file your taxes. They say that they can’t pay it because it is not a priority in the state coffers, hell it’s not really their money, its yours.

These monies are not ‘state funds’ that the schools have first claim to, they are monies already owned by the taxpayers, and need to be returned to them, the state has no claim on these monies or ability to spend what does not belong to the state. The state funds that the schools, etc have first claim to are the tax monies that the state gets to collect and keep to pay bills.

Well everyone needs to stop paying state tax. Change your W4 to stop state withholding until they send you yours. Tell them you need your money freed up to pay other debt caused by them paying other debt with your money. Its all the same money, right?

This should be considered illegal for CA to not refund your overpayment of state taxes as soon after one files as possible. To put the refunds on “hold” does not give any specific time for the refund check to be mailed. This is wrong! Just try to delay paying taxes and see how the penalties pile up.
Other states may do the same if CA gets by with this.

As was posted already, NEVER NEVER NEVER overpay your taxes! Adjust your deductions so that you owe a little at the end of the year…just don’t owe too much. It’s a balancing act, but it’s better than giving the state or fed gov’t interest-free use of your money for a year, money that you may not ever see. Just plan and save for the tax bill, that’s all.

The answer is simple Californians. If refunds are suspended, then you should suspend PAYMENT. Do your taxes as you normally would. If you are owed money by the state of California, take that amount out of how much you would pay them. Go to your employer and change your W4 to pay no tax to California until the amount you are owed is collected. Then if California ever gets around to giving you your refund, just send it back in as taxes paid in 2009.

Google the California State Budget Summary and look for yourself where the money is going (the airheads on the local news networks will NEVER show you this, because if you knew how much went where, you’d flip out). While you’re at it, look at the Census Data for 2000 too.
Here is the analysis:
Let’s face it, the State Of California is broke. Have you ever seen what the state budget is composed of? About a third of it goes to K-12 Education, about 25% goes to Health and Welfare (Medi-Cal and Welfare) and a little over 7% goes to prisons. That’s 66% of the Taxpayer dollars going to ‘Pregnancy-to-Prisons Programs’.
15% of the Taxpayers, pay 85% of the taxes in California and they are leaving the state in droves. It cost over $8,600 a year to educate each child. Add free pre-school care, after-school care, free lunches and the cost to the taxpayer is huge.
The LA Unified School District is 78% Hispanic. According to the Census Data, 19% are under the Poverty level. If you look at the statistics, 24% of the Hispanics in California make less than $20K a year. A full 41% make less than 30K a year. Here in California you don’t even pay taxes, yet the average child-per-household for Hispanics is higher than other races at 2.3 children per family unit. So the average cost for the taxpayer for each family (and there are many) is $19,780 a year! And that’s just for the K-12 education part of it.
This class of people also gets free birthing at any County Medical Hospital, courtesy of the taxpayer. Whether legal or not, they are immediately subsidized for housing (Section 8) and also Welfare. They can have their children watched for free under the CalWorks Stage 2 and Stage 3 programs. In fact, the State now has to develop a database as families often trade kids for the income stream from the state for babysitting each others kids!
We are actually subsidizing a violent, illiterate underclass. This underclass uses the Fire, Police and Ambulance services at rates that are far higher than anybody else.
Manifest Destiny is done. We have populated the Southwest. We don’t need any more people. The State of California is going to be facing a serious drought this year. Our Freeways are packed to capacity, our infrastructure is crumbling and life is just not like what it was thirty years ago.
California will be $40 Billion dollars in the hole this upcoming February. That is because there are far too many people taking out of the system and not enough putting in. I’m no fan of Nancy Pelosi, but I actually agree with her. Bottom Line: If you can’t feed em, don’t breed em.
We must look at a sustainable growth model and not endless population growth.

The state is bankrupt and will formally declare it within the next 6 months. You cannot continue to spend money you do not have, especially in this financial situation. Socialism does not work – get over it.

It’s not the Governor or President’s fault. I live in Los Angeles and can attest to our state’s bad policies. You can’t survive when you have a majority population of Hispanics whereby a large percentage does not pay any taxes. CA is the only State in the Nation that ignored welfare reform. We spend 10 billion a year on services for non documented aliens including medical and food. We have local politician, like the LA Mayor, who spend like a drunken sailor. This is simply cause and effect. The bigger issue is that those who do pay are beginning to leave the State. Can’t fix that by taxing us more because it will push us out faster.

I was gonna use my California State refund to pay my Federal taxes ($487 State refund/ $512 Federal taxes owed).

Get rid of the illegals bleeding the system, cut services, and fire 10% of those state mid-level management and senior employees retired in their offices. Your problems will go away then!!

The solution is simple. When California sends you an IOU for your tax refund, simply reduce the state tax withholding on your paycheck to 0 for just long enough to match the value of the IOU. So in other words if you are withholding $500/month for state taxes and your refund IOU is for $1500, simply contribute $0 for state withholding for 3 paychecks.
Then when you owe state taxes on next year’s return to the tune of $1500, simply send their own $1500 IOU right back to them. Can you say unstoppable spiral into bankruptcy for California? Reap the whirlwind Arnie…

According to data from the State’s Financial Department, California had 205 companies that employed 1000+ employees, back in 1990. Within 15 years, nearly 50% of them were GONE! The figure in 2005 was 106 companies.
The only growth was in companies with less than 10 employees; poodle groomers, lawn-mowers, hair salons, etc. In other words, our wonderful ‘Service Economy’, where we all ‘service’ each other, but create nothing. Much unlike a Manufacturing Economy, with associated Capex (that’s Capital Expenditure, for the unknowing), money that goes for machinery, facilities, etc.
Our last real industry, Aerospace, realized a 66% drop in the number of companies here. This used to be the Aerospace capitol of the world and it’s barely hanging on now.

The total 2008-2009 expenditures budget was $144 billion (http://www.ebudget.ca.gov/Enacted/agencies.html). Education spending alone was just under $60 billion.

Im a 4th Generation Californian but moved to Florida five years ago. Florida has no income tax. Property taxes are about same as California. Public schools are the same. Florida highways are modern, well maintained and uncongested in most areas. State government services, including hurricane relief, are efficient. California, on the other hand, with all its income taxes cant balance a budget. One answer is obvious. California’s public school system, controlled by the liberal CA Teachers Assoc, has created an electorate mind- numbingly ignorant of economics and history, and steeped in emotional fantasies about the world, the perfect liberal voting block. Okay by making the deduction changes on Fed as well as state. My paycheck increased by 189.18. I few months of this set up I will have what they usually have to pay me back each year.

The top 15% of wage earners here in California pay 85% of the taxes. 50-100K pays 15% and 100K and up pays 80% OF THE TAXES. It ain’t about the ‘rich whiners’, it’s about the overload of the system. We’ve got a huge population of illegals and other low-wage earners that take WAA-AAY more out of the system than they’ll ever, ever put in, in return (via their taxes). Get educated.

Used to live in California, now we moved to Idaho, a state where deficit spending is not allowed per constitution. This responsible fiscal policy still forces the governor to make tough decisions, but these decisions can be done before the hemorrhaging gets too bad. Letting debt pile up recklessly means things only get worse when the bills are due. Taking the maximum number of deductions is a good idea, since the government has shown a complete lack of responsibility with the money people have loaned it, the people shouldn’t be loaning the government money. It’s a bad investment.

Arnold Schwarzenegger won in a recall election against Governor Gray Davis (an inept, incompetant political “leader” who had driven California into financial ruin BEFORE Arnold arrived). Furthermore, various propositions supported by Arnold were not passed by the CA populace during elections, further undermining CA’s economic recovery.
Arnold is a moderate (centrist) Republican who fights against both Democratic and Republican parties who CANNOT pass responsible legislation needed to resolve CA’s budgetary crises. Everyone wants their share of the budget for programs, their districts, etc.
When Arnold was re-elected, he stayed true to most of his campaign promises. However, painful legislation needed to avert more economic woes has been IGNORED and AVOIDED by CA politicians. Now, CA pays the price… literally.
This is also Arnold’s LAST term in office. He can’t run for re-election as CA governor.
Arnold may not be a perfect Governor, nor positioned well enough to push fiscally responsible legislation. His party (Republicans) has dogged him; his efforts to get the Democrats to help has turned nightmarish. BOTTOM LINE: CA is a economic poorhouse with over-priced real estate, huge deficits, too many unsustainable programs, a biotech industry hampered by Bush Adminstration policies against stem cell research (although Arnold has tried to bolster biotech regardless), an ailing tech industry, water supply issues affecting farmers and cities, energy supply issues (which go back to Gray Davis and HUGE budgetary issues and ineptitude), immigration issues creating large financial drains on the state… the list goes on…
Arnold hasn’t turned the Golden State around, but he isn’t avoiding the issues. Californians have to accept their plight. California is the 8th largest economic power in the world, generating huge revenues for the U.S. Say what you want about throwing $$ at California. The state has thrown a LOT of $$ into the Federal government (via Fed income taxes) for many decades!

I know people who have already gotten their refunds back from the state. It is major BS that you had to have gotten your taxes done right away to get your refund.
We are supposed to have a reasonable amount of time to get it done and everyone should be treated fairly.

Easy solution … underpay this year’s taxes by the amount of the withheld refund.
Or at least see to it that you lower your withholding to the point where you have to cut a check for taxes still owed in April, instead of getting an overpayment refund, since they can’t be trusted to refund over-payments anymore.

As a Californian who lost my job in November, I was counting on my refund to cover my mortgage. The legislature have run rough-shod over the governor and any other opposition. They have been spending like drunken sailors for years on the most ludicrous projects. They have been horrible for business. This is indeed a fore-runner of what we can expect with Democrats in charge of all three branchs of government.

File your California tax return. Show the “refund” as applied against your 2009 taxes. Don’t pay any CA SIT until the amount owed for 2009 equals what they are holding in the refund. Of course, that assumes you are still employed and paying taxes.

Thank G-D I live in the Republic of Texas. Aside from the fact that we retained our own land when joining the Union (The State manages and profits from State Resources); we have historically had a tradition of conservative spending habits. (We don’t waste our money on backwards social experiments and we do not give illegal aliens better benefits than U.S. Citizens or Immigrants who came in legally). Moreover we have always had sunset legislation in effect. Every State agency must consistently prove its efficacy. If an agency is not affirmed in regular reviews, it ceases to exist and funds are freed up for other priorities. It is not unheard of for State or County officials to run for office with the promise of eliminating the position for which they are running. (And they live up to those promises.) Things in Texas are not perfect, but tight management and scrutiny has left the State in a strong position to easily weather the tough economic times we are in. California voters only have themselves to blame for the mess they are in.

As a Californian who is disgusted with our “leadership”, let me say this to all of you non-Californians:
DO NOT LET THE FEDS bail us out. Do not let them take your Federal tax dollars and send them here. We do not deserve it and a bailout will only encourage Sacramento to continue to behave the same way it has for the last decade. Call your Senator and/or Congressman and make sure they know that you are 100% against sending money to California. We do not have an income problem nor a revenue problem; we have a SPENDING problem. It isn’t just income tax in California. We were taxed to death down there (sales tax, emissions, pet licenses). A parking ticket would run $40-100! We finally started hiding our income–I was a waitress, my husband worked construction and tended bar, so it wasn’t hard. We also lived responsibly: while our neighbors tapped their home equity to buy every bit of bling imaginable, we made double payments on our mortgage and planned our escape.
Now we live in Idaho, which is run by conservatives and is prohibited from running deficits. And since our international border is with Canada, we don’t have an immigrant problem.
It seems every new program the tax and spend liberals in CA enacted was for the benefit of some special interest we didn’t belong to. The pandering to illegals really burned us. No taxation without representation!! The people need to distance themselves from a government which does not support them.

As soon as the US started accepting homosexuality as an alternative lifestyle, you’ve had the hand of God against you. Blame Republicans, blame Democrats, but you only have yourself to blame.

So what? All income belongs to the government, so its only fair that they keep what is theirs. Without the government, we are nothing. A couple month ago, the state university system anounced that they would be cutting the number of new student next year by 10,000 due to budget cuts.

California’s problem is simple, because of the restriction that the voters passed on property taxes the state is forced to rely on income taxes. Unfortunately, income taxes vary widely from year to year, so as soon as there’s any economic bust the state takes a hit to the coffers. Create a fair property tax scheme and rely less on income tax and the state would have a more reliable picture of its finances and could make better judgment calls.

If you plan on changing your witholding amount I would hurry and do it. I’m sure they will issue some emergency decree that will stop that…just temporary of course they will say.

This is exactly why I always adjust withholding allowances so that I owe money every April 15. I never get a refund and the gonvernment doesn’t get to choose whether to send me MY money back that they have NO right to take or hold because I do not owe it in taxes. If people had to right a check for the full amount of income taxes every year this unbearable tax and spend form of government would never have happened.
Everyone should immediately go to their employer and raise thier withholding exemptions to reduce the amount witheld from thier paychecks. If you want to hurt them, this will do it because it will reduce the amount of taxes witheld from your paycheck. Consider it an act of political expression. You get to take a bit more home and the government can wait until April 15 next year for the money.

This is a perfect example of why we need to rely on ourselves, NOT THE GOVERNMENT!!!

Not the first time this has happened in California. In the late 80s I got a note from California that they could not pay me my tax refund because the gov did not have enough money. It was about $500. During the year I forgot about it and about 3 years later I sent them a letter asking for it and they told me that it was too late! Anyway, I never got it.

Since the state can say that they are not going to process tax refunds without being penalized, I guess that opens the door for citizens to do the same. My father was a WWll 1st Division Marine Corp vet. He suffered the horrors of the beaches and jungles of the south Pacific. When I was a boy he was a foreman of a slaughterhouse killing floor. He was tough and trained my brothers and me up like men. One thing there on the killing floor made him smile. Sometimes when each steer was being shot in the back of the head, hung to be bled, and gutted, he’d smile and saying, “Ha! There goes Kennedy!….Then grind his teeth and shout, “There goes Nixon!”….Somehow he had great satisfaction in this hatred. He told me with stern and serious conviction when I was maybe 10 years old, “The sooner you realize the government’s your enemy, the better off you’ll be.” Most people thought he was crazy. I look back from his perspective and what I see now is a consistent progression of what was happening in the ’60s. I was too young to understand what was happening before then but he was always convinced and angry with comtempt that our politicians were sniveling gay compromisers who would destroy what real men died for.

We moved our small business from southern California to Houston, Texas nine years ago – saving us about $250,000 annually in taxes. This savings allowed us to hire more people and grow the company twofold in just three years. So it is a revenue loss for Sacramento – and a revenue gain for Austin – so simple even a caveman can get it.
Sure, we loved the weather and the beach, so we kept our home in California as a vacation retreat. But in Houston, we have a much better built luxury home twice the size of our over priced California box at half the cost in the best part of town. Fact is, it’s over for California economically, and Californians only have themselves to blame, electing the same moronic legislature year after year. California, I am not feeling your pain. So please, no whining. You voted the idiots in, after all.

Just one question. Can we charge the state of CA interest and penalties like they do to those that owe them taxes?
It is ridiculous the amount of money CA takes in for taxes compared to the population and they can’t afford to pay their bills. Wouldn’t life be grand if we lived like our government? We have checks! It’s not that Americans don’t want to pay taxes (although at this point I’m ready to revolt); it’s that we’re OVERTAXED already – federal income, state income, property, sales, fishing, drivers license, car license, death tax, etc. etc. All these taxes add up to about 50% of our income. In fact, 5 months of every year’s salary goes for TAXES. A friend said, “Illegals pay taxes at Walmart.” My response: Most don’t pay FED and State INCOME TAXES. I do, which decreases my buying power by 50% “before” I go to Walmart. With 50% income left after taxes, Americans should not be burdened with SUBSIDIZING “cheap illegal labor” for corporations like Microsoft by paying their H1-B workers’ food stamps, welfare, medicaid, free hospitalization, HUD housing where Obama’s aunt lives after being ordered deported 4 yrs ago), free public schools, free college tuition, free legal defense, while they rape (1 million), rob, and murder (9,000 per yr) American citizens and form gangs with impunity.

Maybe we don’t want China or other countries buying US debt, because this means they own a chunk of us. We have come out of the last recessions and depression stronger then before and we will come out of this one. Unfortunetaly many Americans will feel the sting.

Does this mean we will receive INTEREST on our late refund payment? Remember that if we are late paying our taxes, WE ARE FORCED TO PAY INTEREST AND PENALTIES. WAKE UP FOOLS!!!

My sources come directly from Republican and Democrat friends. Illigal immigration costs California over $10.5 billion annually. California taxpayers pay approximately $9 billion to fund illegal immigrants’ education, housing, healthcare, and prison costs. Other countries are laughing at the U.S. thinking why we continue to meddle in other peoples’ wars.

The problems is not the governor’s fault. The legislature would like to raise taxes endlessly (like many other democrats) and refuse to cut spending and lay-off non-essential state workers. As voters, we can passes endless bonds, which are essentially loans our children must pay off. We need a benevolent dictator to run our government… we have all failed and have ourselves to blame.

Anyone due a refund should adjust the withholding so that there is a small amount owed next year. Why give the government an interest-free loan for a year?

Don’t forget that World War 1 is what pulled the US out of the Great Depression – suddenly people were working again.
I’m certainly not going to sit here and defend Haliburton or Cheney, I’m just saying, when there’s a war, people in those industries are employed (I was born and raised in a military ship-building town).

I don’t get it – why do we let companies that sell us inventory for a war be on foreign shores…especially if those shores are some of the ones that started us down the path of war or attacked us in the first place. We don’t need more ‘resources’ mr and mrs macroeconomists – what we need is less foreign competition for everything – our jobs, our $$$, our land…let’s ‘heavily’ tax companies and stop buying their product who offshore work so this practice is halted, let’s revoke green cards or work and study visa’s and grants by foreigners…let’s normalize our govt spending by taking all their funds away and starting from scratch (like you and I would have to do with no job or big money to back us up) and let’s start buying AMERICAN again. If it doesn’t say made in the U.S.A. (that’s United States of America) don’t buy it! Everything imported should be heavily taxed or penalized as other countries do to us. We, the American people, can make this change and it’s up to us to do so – not Obama or any of the politicians who like to think it’s up to them. What I am more upset about besides bad voters (I’m 20 years old by the way so I am part of this generation of skin deep voting) I am more upset at how these elected officials have somehow thought it was logical to ask the majority if same sex marriage is correct which is not a majority way of life so yea what do you expect but the mass of people looking up in the sky for their holy answer..
How do these officials not know how to balance their budget? It’s ridiculous when college graduates elected to serve the people of california are beat in math by elementary school students at lunch lines. “Would you like a cookie with your meal?” “No sorry, I only have enough for milk and this sandwich.” No amount of advanced economics or banking or waving of magic wands can change the rules of math and common sense.
Enough commenting, how about we submit ideas to the government, come up with solutions, O and while we are at it fire those who clearly havent done their jobs. The banks were bailed out but their management wasn’t fired and my mom was late 1 week on her credit card, called in to pay it in full and interest jumped to nearly 30% guess the bank doesn’t want to be understanding to its customers after we bailed them out with our tax money? Please hire new competent people (try your local elementary school)

In 2008 Iraq had a surplus of almost $80 billion, mid 2008 U.S had a deficit of like 350 billion, (tack on another $170 billion for the war in iraq in supplemental funds, and all those crazy bailouts, we will undoubtedly reach a 1 TRILLION dollar deficit in 2009). The longer we stay in Iraq, the longer we have a hold on oil, the more it is costing us. California is just one of many states out of money. We need to either move to other fuel sources, or drill the $hiz out of the U.S for oil. However, by the time either of these things happen it will be too late. It is a shame that CA taxpayers will have a delay on their state refunds that we all know are of critical importance. However, I think that people arent looking at the big picture, and how this is just 1 of the many disasters that will lead to the U.S losing its superpower status. China will surely surpass the U.S, and when they do they will have such a big stake in the U.S that communism will again be a huge threat, more so then in the cold war.

Our legislature needs to reign in their spending and pet projects. The Controller started holding payments sometime around 1/24/09. They won’t be paying my refund for AT LEAST 30 days per the FTB when I called them. Funny, this guy had no problem spending $2 Million to redecorate his offices. What a lot of people don’t seem to realize is that our legislature just like Congress holds the Governor hostage each time a budget comes up so that they can get their special interest spending projects through. They need to cut spending and pass a balanced budget that the Governator will sign.

I got this when finding out the status of my refund:

This is like telling my mortgage company I’m having personal financial problem so my mortgage payments will be delayed but i will continue to live in my house and don’t bother me. Ridiculous?

Those of you crying about not getting your state refund NOW, will also be the first and loudest people at a state agency for aide when they are in need! Well Hell, our state is in need NOW, and if you people can’t allow the state to have your tax refund, this one time in it’s history of collecting taxes, then your not trying to find a solution, your just part of the problem. Even though we are struggling in our own home, I know we’ll never get on our feet if we let California fall to her knees! I filed my taxes via turbo tax, and they were accepted before Janurary 30th. I got my federal refund on February 13th. I have not gotten my California return as of today(March 6, 2009) I’m setup for direct deposit.

I’ve lived in California long enough (26yrs) to see it grow from the 4th largest economic power in the world to what it has become today…an object of ridicule that may be circling the drain.
While people are busy pointing fingers at politicians, or specific groups of people, we must face up to the fact that we are the people who put(and kept) the politicians in office–the same politicians who have allowed the hordes of illegal aliens into the state that have drained the medical, educational and jobs that rightfully belong to citizens of California.
My neighbors, the Gonzales’ moved to this country 40 years ago and did what they had to do to become American Citizens. The both held jobs, payed taxes and never once were unemployed. They are as insensed as I am about the illegal alien issue and their ideas about what must be done are far harsher than mine. We both agree, however, that this insanity must stop before we lose everything.
Mrs. Gonzalez wondered when people stopped writing to their representatives? With the internet so readily available and that fact the Postal Service still works, WHY don’t people let their representatives know what they want and don’t want done?
This can be the only reason for the decisions that are coming our of Sacramento…we’re all here, but we ain’t talking.
This has given our Governer and elected representatives the time to divert attention from the real issues. We allowed issues on the ballot like prop 8 which created a “holy” frenzy and acomplished nothing positive.
If I didn’t need my job, I’d quit and move far away, even though I love California with all my heart.
So here I sit, waiting for my income tax return to come…I should have enough money to to buy a gun to put to my head, should I lose my job which is about all a 60 year old man who has watched hi modest 401K plan dwindel lower and lower and supports his disabled partner on a single salary can afford to do if that should come to pass.
