Third Top Treasury Pick Withdraws From Consideration

Democratic sources say that H. Rodgin Cohen, a partner in the New York law firm Sullivan & Cromwell LLP, and the leading candidate for Deputy Treasury Secretary, has withdrawn from consideration. It’s the third withdrawal of a top Treasury Department staff pick in less than a week.
I reported last week that Cohen was likely to be officially nominated for the Deputy Treasury Secretary position. Cohen has been a counsel to just about every major player on Wall Street, which perhaps complicated his nomination. Now, the nomination is off. Democratic sources said that an issue arose in the final stages of the vetting process. As one source put it, "it’s back to the drawing board." Cohen had risen to the top after the withdrawal last week of expected deputy treasury secretary pick Annette Nazareth. Nazareth was forced to withdraw from consideration for the deputy treasury slot because senators made it clear she would face tough questioning over her time at the Securities and Exchange Commission — tenure that overlapped with the agency’s failure to catch Bernie Madoff. And the candidate for Undersecretary for International Affairs, Caroline Atkinson, was told she had to withdraw after a "tax problem" was revealed early in the vetting process, according to officials. Last week an administration official conceded to me that "it’s not easy to find qualified people who don’t have conflicts" adding that "dozens of candidates" across the government have been forced to pull out because they couldn’t meet President Barack Obama’s ethics standards or overcome other vetting issues. Obama administration officials have pushed back hard at critics who argue that failure to fill key Treasury Department positions is hampering their response to the economic crisis. The administration has argued that they have more appointees in place than previous administrations and have done big things: housing, stimulus, and the beginning of their bank plans. But with Treasury Secretary Tim Geithner struggling to contain a national economic crisis and helming a department with vital staff positions unfilled — the latest withdrawal will give critics more ammunition. Foreign Policy reported yesterday that Britain’s most senior civil servant, cabinet secretary Sir Gus O’Donnell, claimed it was hard to find anyone to speak to at the US Treasury Department. He blamed the “absolute madness” of the US system where a new administration had to hire new officials from scratch, leaving a decision-making vacuum. “There is nobody there. You cannot believe how difficult it is,” he told a conference of civil servants. — George Stephanopoulos UPDATE: Sen. Lindsey Graham, R-S.C., ribbed Geithner today during his appearance before the Senate Budget Committee about the staffing issues at the Treasury Department. Here’s the exchange, as reported by ABC’s Matt Jaffe: SEN. GRAHAM – If you’re looking for a way to serve the country, join the Marines or go to Treasury. (Laughter.) I think they’re both very difficult — SEC. GEITHNER: I’m very glad you said that and I completely agree. SEN. GRAHAM: — very, very difficult assignments. But — SEC. GEITHNER: No more important, no more noble opportunity. SEN. GRAHAM: The few, the proud, the brave, the Treasury people. Yeah. (Laughter.) But where was I at? Oh, okay. SEC. GEITHNER: Just don’t want to say "the few." SEN. GRAHAM: Yeah, yeah. That’s right. SEC. GEITHNER: Want to say "the many" and the proud and the brave. SEN. GRAHAM: That’s right.

George, I’d like to ask if these withdrawals are becoming an embarrassment to the administration or is it a credit to the strict lobbyists rules this President and his company has put in place? I understand to some it might appear as incompetence. But I do understand that they would’ve known the economy would be top priority.

According to the story, an issue arose in the final stages of the vetting process. In light of that, what’s the matter of dumping the nomination now instead of facing embarasssment later. The biggest laugh of the election was the pathetic screening of air head Palin. If she had been vetted properly, do you hink McCain would still have chosen that empty headed joke?

That is just the nature of the business. The most we can hope for is to find someone who isn’t just too scratched up to do the job. I see a lot of glee over the latest withdrawal. I’m actually starting to get concerned about leaving Treasury positions vacant for so long when we’re facing a major banking crisis.
Perhaps it would be better to have imperfect nominees rather than empty seats.
Of course, that assumes that we want the economy to rebound. Many Republicans clearly prefer that the Administration’s efforts to pull the economy out of the recession it has been in since 2007 fail, and thus are doing all they can to make sure that the Administration is operating short-staffed. Disappointing but not surprising.

Can we please stop with the misleading headlines about “top pick forced to withdraw”? None of these people were offered any job with the Obama administration. They were people who MIGHT be offered such jobs IF they met the Obama Admin’s ethical standards during vetting. Not making that important distinction clear makes it sound as if Obama’s team is offering jobs to a bunch of crooks and then getting caught with its collective pants down because no one bothered to vet properly. In fact, the opposite is true–all this was caught during the vetting process.

Rodgin Cohen is one of the best lawyers we have and has detailed knowledge of all the players in finance across the country. He is a good guy to boot, perhaps too good to understudy Geithner. Other than that, I am sorry he is not going to help out in DC where is he needed most.

‘Critics’ will complain if people drop out or if they accept and have the smallest ‘issue’.
Complaining is what attracts viewers. It is why George S. and practically everyone on TV these days is not worth the time to listen. PBS and the net are about the only places to listen to well-reasoned reporting / analysis. Just get back from Canada and I can’t believe how much higher the level of public discourse is there.

President Obama never said he would get rid of every earmark. John McCain said that and he lost. He said he would reform the process. If someone drops out before they are nominated, that is not the POTUS responsibility. If it takes a long time, he is responsible.

So all these failed nominations are happening because *Obama’s ethics standards are so high*. Sure. If that’s the case, then how is it that they made it on to Obama’s radar screen in the first place? Is there no vetting system in place until *after* people get nominated?

WASHINGTON – An employee of the D.C. Office of the Chief Technology Officer and a private contractor were arrested Thursday in a federal bribery sting, sources tell WTOP.
Yusuf Acar, 40, an employee of the D.C. Office of the CTO was taken into custody by FBI agents at his home in Northwest D.C.
Sushil Bansal, President and CEO of Advanced Integrated Technologies Corporation (AITC) was also arrested, sources tell WTOP.
In 2008, Bansal’s firm received .Net Development Support and Peoplesoft Consulting Support contracts from the D.C. Office of the Chief Technology Office totaling $350,000.
AITC has also received contracts from the D.C. Department of Motor Vehicles. In 2008, Bansal received the Entrepreneur of the Year Award from the Association of Indians in America, according to AITC’s Web site.
Government records show Bansal is not a U.S. citizen and holds an H-1B visa, which is given to foreign workers in specialty occupations.
Last week, D.C. Chief Technology Officer Vivek Kundra resigned from his post to take a job in the Obama administration as the federal government’s chief information officer.
AITC has been working with the D.C. government since 2004. Once Kundra took over as D.C. Chief Technology Officer in March 2007, AITC’s contracts doubled to more than $5 million in 2008.
Kundra has also worked for Science Applications International Corporation (SAIC). During his time at SAIC, Kundra provided consulting services at the U.S. Department of Health and Human Services (HHS).
On AITC’s Web site, Bansal lists SAIC as one of AITC’s strategic partners and says his firm has performed contract work for HHS.
Kundra has not been linked to Thursday’s raid.
White House press secretary Robert Gibbs said the Department of Justice told the White House on Thursday morning of its planned raid, the Associated Press reports.
However, Gibbs declined to comment on whether the White House was aware of the investigation before Thursday, the AP reports.
Channing Phillips, a spokesman for D.C.’s U.S. Attorney’s Office, tells WTOP that two people in custody will appear in federal court later Thursday.
On Thursday morning, the FBI served a search warrant at the office of D.C.’s Chief Technology Officer.
FBI Washington Field Office spokesperson Katherine Schweit would not comment on the details, but called it “a continuing ongoing criminal investigation.”
More than a dozen FBI agents – including evidence technicians – were at the office, located at 1 Judiciary Square on 4th Street in Northwest.
Most of the employees were told to go home. Other employees were put into a waiting room.
The FBI later expanded its search from 9th floor offices to 10th floor offices.
The 10th floor has been closed to the public while the FBI searches the offices that house the Administrative Services Modernization Program.

It is just a sad state of affairs that, arguably the most important state department, Treasury still has gaping holes in its staff when the country needs it to be running full out to deal with the economy. We are quickly becoming the laughing stock of the world. Geithner was appointed in November, he was already involved in TARP before then, so he had 2 months to hit the ground running. Almost 2 months after inauguration we still have nothing. Too many asleep at the wheel.

I wonder just how much Wal-Mart is pouring into these campaigns filled with outright lies??? Big business is scared sh*tless they’ll have to pay decent wages and provide some decent healthcare. The secret ballot will remain an option for those wanting to form unions, but the union busting campaigns don’t want YOU to know that. The jig is up folks!

You apparently don’t know that the American Cancer Society, Easter Seals, Susan G. Komen for the Cure Advocacy Alliance, states for highways and bridges (that actually lead somewhere) ALL receive EARMARKS. I implore people to stop allowing themselves to be spoon fed bullsh*t. NEVER take anything at face value. Learn to ask questions and do your own research.
The earmark debate is the perfect example of how the GOP effectively manages to shift the focus off of real issues (for which they have no solutions) by declaring war on something that accounts for less than 10% of the total budget. Interesting how they never mention the earmarks they’ve slyly slipped into the budget.
I guess when you have no viable solutions, your best bet is to create distractions.

I’ll give you an example. We’ll make it personal so you may “get” the point.
Say, your daughter was born with spina bifida, foe which there is no actual cure. So you go to a representative and ask for help. Then, that rep puts an earmark in a spending bill that adds spina bifida research to your local hospital district.
That!! earmark helps more than one taxpayer.
POINT: they aren’t all wasteful and ridiculous, some earmarks are good for a district and some reach out from that district into the population as a whole.
And yet… it is too [sadly as in all human nature] true, some of them are self serving total crap!

When Al Qaeda killed 3000 Americans at the WTC we sent 150,000 men and trillions of dollars running after them all over the world. The American born financial terrorists I bet killed many more than 3000 (thru stress and heart attacks)after saving and investing for over 30 years and losing 50% of their hard earned money. Imagine if the SEC had a 150,000 thousand man army and unlimited trillions to go after the American born internal financial terrorists. This huge financial collapse had to involve huge amount of illegal activity. In Fact the head of SEC enforcement was so embarrassed by the Bernie affair she quit. Fiduciary responsibility seems to me, to be a ancient English term that should be removed from the language. We will never restore confidence in markets without rounding up and JAILING the culprits of which there are many.

The failure to appoint someone in this position is a failure by Obama. It isn’t stricter rules. He screwed up in the beginning by not vetting tax cheats and got embarrassed, because of that he has to be extra careful not to continue looking stupid.
It doesn’t help the fact that he has taken a bad economy and made it worse. Or the fact that He was given an F on his handling of the economic problems by Wall Street. This guy has no clue and it is showing! Also keep in mind that the majority of the Financial community think that Obamas plans are wrong. That alone will make it difficult to fill some positions.
Judd Gregg is making these guys look like silly little kids trying to play with the big kids on the play ground. Sad really.

While I did not read every single post before this, I have something a bit different (i hope) to offer up on this.
They are having difficulty filling a lot of positions at Treasury. I think its time to loo at this problem from a slightly different angle.
Perhaps many people who would readily accept positions in Treasury at any other time are now staying away because they don’t want to be a part of this. Let’s face it, if Geithner’s plan (whenever it gets released) does not work, being a part of it is not going to be a great thing to have on your resume.
Geithner WAS “the wonder boy”. Now he looks like “the little lost boy”. He does not inspire confidence at all !
Lets remember, its not like they are looking at people who are seriously unemployed to fill these positions. The people they are targeting are very well off, or at least in a very good current position.

I was not an Obama supporter but we all need to work together in fixing the banking system.
It would be helpful if blowhards such as Lindsay Graham (R), Schumer (D) and Frank (D) stayed the h*ll from out in front of TV cameras. They are more concerned with face time than with making a contribution. We don’t need comedians and talking heads. We need results. They add nothing but hot air to the dialogue.
Geithner may be not be perfect but he’s what we have. Let’s get behind him.

This is really becoming a laughable issue except for being such a serious problem. Being a Washington or political “insider” does not make you a “best qualified” candidate. Being able to see a tree or two when looking at a forest would help. Being able to figure out your taxes and not having an illegal alien “Nanny” would be a hugh plus++. On second thought…it is laughable.
