POTUS on Sotomayor Flap: ‘Nonsense’ That ‘Will Be Revealed for What It Is’
NBC's Bri Wi asked POTUS about the Judge Sonia Sotomayor controversial quote from 2001 in which she said, "I would hope that a wise Latino woman, with the richness of her experiences would, more often than not, reach a better conclusion than a white male who hasn't lived that life."
"I'm sure she would have restated it," the president said. "But if you look in the entire sweep of the essay that she wrote, what's clear is that she was simply saying that her life experiences will give her information about the struggles and hardships that people are going through — that will make her a good judge. And you know, she was pointing out, in that same essay, that it was nine white males who passed down Brown vs. Board of Education, which is probably responsible for me sitting here.
"So, that's hardly the kind of statement that would indicate that she subscribes to identity politics," the president continued. "In fact, what she really subscribes to is the exact opposite. Which is the sense that all of us have life experiences and struggles. And part of the job of a justice on the Supreme Court, or any judge, is to be able to stand in somebody else's shoes, to be able to, you know, understand the nature of the case, and how it has an impact on people's ordinary day to day lives.
"And so her, as a Latino woman, part of her job is going to be to listen to the farmer in Iowa," he went on. "And you know, if he's upset about a farm regulation. And be able to understand how hard it is to farm. And what that means. And to be able to incorporate that into her decision-making. It means that she has an understanding of what a corporate CEO might be thinking. And she had those experiences as well. Having worked as a corporate litigator. That breadth of experience, that knowledge of how the world works, is part of what we want for a justice who's going to be effective.
"And I think that when she's appearing before the Senate (Judiciary) Committee, in her confirmation process, I think all this nonsense that is being spewed out will be revealed for what it is," President Obama said.

Racism is racism,no matter the race of the person uttering the poison. Martin Luther King asked that we not judge people by the color of their skin.
Sotomayor apparently doesnt abide by this code.

Name me one white male who could have gotten away with this sort of comment. Prejudice works both ways. Enough is enough. Time for the leaders of this country to stand against ANY form of prejudice! Obviously this woman doesn’t have the common sense a judge at that level ought to have – no matter what her life experiences.
Posted by: mia | May 29, 2009, 10:23 pm 10:23 pm
mia, you are right. A white male uttering a similar statement about being more qualified than a Latino woman would already be out. Equal treatment under the law. Can she make a decision without skin color entering into the picture?
Posted by: zeke | May 29, 2009, 10:27 pm 10:27 pm
I think the good judge as charming as she seems really needs to address the attitude she voiced regarding “white” people and males. I personally think it’s outrageous. And I also think that just by virtue of the fact that she has Hispanic roots does not in any way shape or form makes her any more interesting or compelling than any other American citizen.
Posted by: jennifer | May 29, 2009, 10:28 pm 10:28 pm

I’m calling BS. She said “a white male” in a way that was clearly over-generalizing race. Perhaps the experiences of “a white male” would have made her chose wiser wording, something that is essential for a Supreme Court Justice. Obama is losing political points on this one, and will continue to lose more political points the more he backs her.

If this is all the critics can find to try and hang her with then she is in pretty good shape. Who among you, in the course of thirty years of life, has not uttered something that your enemies might question or challenge. So let the committees and Senate question and challenge. That is their job. She will either be confirmed or not. Personally I think she has all the makings of a good SC judge.
Posted by: Rob | May 29, 2009, 10:52 pm 10:52 pm
Hi Rob,
I have to agree with you. She will be a good SC judge and listen to the superior logic of others on the court. She may well be the first appointed by a democrat to switch sides. She is Catholic – so eventually she will recognize the complete injustice and utter cruelty of of abortion. She may stick by other liberal ideas, but will ultimately be swayed to the logic of the founding fathers in writing the constitution. She is certainly no “Bad Girl” Ginsberg.

There has been other judges that said the same exact thing….. The fact of the matter is her nomination for SCOTUS shows HOW biased and racist this society is. How is a country ‘strong’ when it degrade one of it’s success stories, and her’ is no more less than Sandra Day-OConnor, or justice Scalia. To hear the scorn of this fine American being referred to as “latino chick, racist, being on her menastration, biased, bigoted and the other degrading comments made some of the very people who calls themselves leaders of someone or something should be Shameful to all Americans. These republicans such as Beck, Gingrich, Rush and the likes should not be tolerated by the American society, let along the Media, that are supposed to report truth and substance to it’s audience. There are some in America that will always be what they were raised as…..and America is bigger than this…..America can change, and America will change. I agree with Peggy Noonan that said the Republicans should grow up and be Adults. In all of my 59 years, I have never seen a “Leader” of anything behave in such reckless, disrepectful, irresponsible and elementary manner.

Since when does ‘drawing from ones life experiences” make one a racist? She is a Hispanic Latina, so I would hope that here lifes experiences would be along those lines. If she were to come up with a ‘white mans perspective’ while drawing on such experiences, then we might have something to be concerned about. I for one completely and fully agree that someone that has had rich lifes experiences, is much better equiped to make more thoughtful decisions, than someone who has not had such experience. Why is there a problem here? I would much rather have someone on that court that has seen the life and has seen the results of the rulings that get made, as opposed to someone who has read about such things in a book.

Judge Sotomayor is very qualified to sit on the SC. When the hearings start, that will be very obvious. I just find it very sad that in a country made up of people from all walks of life and ethnic back rounds, there is that small group that insists that all be seen through their eyes and experiences. Leaving no room and ignoring the varying life experiences that make us the country we are! A melting pot with opportunity for all.

If I, as a white male, made a statement elevating my decision-making above non-white males or females, one would be accurate in assuming that I am an individual who perceives truth with bias, my own bias, a.k.a my own prejudice, against non-white males and females. When considering Sotomayor as a candidate for a lifetime appointment to the Supreme Court, you cannot overlook her comments about white males having lesser decision-making, discernment abilities than a Latina woman. That she made that statement after graduating from Princeton Summa Cum Laude, after earning her J.D. at Harvard, after being selected to the Harvard Law Review, and after serving as a federal judge is absolutely relevant in any public hearing to determine her fitness to be elevated to the U.S. Supreme Court. The reason it’s relevant is her recent decision against white (and hispanic) firefighters in the Connecticutt firefighter promotional exam case, because it’s indicative of her overall philosophy in practice … as it manifests itself in a judicial action that is clearly, by any judicial standard, discriminatory towards fully-qualified, white males. What really is more telling though is the fact that she stated her opinion and acted that opinion out in a ruling AFTER earning Summa Cum Laude at Princeton, a J.D. at Harvard, inclusion in the Harvard Law Review, and serving on the federal bench. On the Supreme Court, Judge Sotomayor can never be overruled. She is a Judicial God(dess) until death, if she chooses not to ever retire. That simple fact alone, in light of perceptions stated and rendered after being educated that they are discriminatory is why the Senate must not confirm her. I am a white male, and I will not vote for Obama again after this nomination and his inability to see how offensive his nominee’s remarks are to me.
Posted by: Rob | May 29, 2009, 11:49 pm 11:49 pm
The only reason any kind of ‘explanation’ is required of what Judge Sotomayor said is because a bunch of bogus, knee-jerk right wingers chose not to, or were incapable of being able to, understand the rich depth of her entire statement – and instead attempted to flog their interpretation of one line taken out of context – and call her a RACIST!
This is high school level intelligence at its worst.
She is absolutely fully qualified, not a racist and she will appear before Congress and she will be appointed.
Then the high school boys can continue attempting to smear everything else the President and his administration attempt to do.

“The chief concern is her position in the 2009 Maloney v. Cuomo case, in which the court examined a claim by a New York attorney that a New York law that prohibited possession of nunchucks violated his Second Amendment rights. The Appeals Court affirmed the lower court’s decision that the Second Amendment does not apply to the states.
The ruling explained that it was “settled law” that the Second Amendment applies only to limitations the federal government might seek on individual gun rights.” In other words she wouldn’t tread on states rights! Geesh, do your homework! This is a red herring!

Her statement is easily broken down. Bottom line: Almost any time, anywhere, a wise Latino woman will be better qualified than ANY given white male, regardless of his experience, qualifications, intelligence, judgment, analytical thinking skills etc., based solely on the magical powers that that are bestowed upon her, simply by virtue of being a Latino woman. The wise part obviously doesn’t factor, or she would have said that a wiser, more experienced person makes better decisions. Nope, only if that person is a hispanic chic, and the opponent is a some white (read that as code for stupid) dude. Oops, was THAT somehow politically incorrect? I’ll have to get a female Hispanic judge to restate it for me. What do I know? I’m a white guy, so I’ve gotta be wrong, right?

OMG. How did this even make news? Obama is right. This is NONSENSE! We’re in an economic crisis that is affecting the whole world. We haven’t figured how we’re going to close Gitmo yet. GM is going bankrupt, we haven’t found a vaccine for Swine Flu, and we now have troops stationed in North Korea because they refused to stop their nuclear program. I’m offended that this ridiculous story ever made headlines.
For all the conservatives who are looking for something else to complain about, here is the hard truth that you all love so much. We live in a country full of people of all races and elasticities that is still governed by wealthy white men. How can we expect the Good Ol’ boys to understand the true needs of our nations inhabitants? The fact that anyone would argue that a Hispanic woman would have new valuable insights to bring to the table that a white male lacks is absurd. As a white male myself, I can easily say that she’s right and WE ALL KNOW IT. You know it, I know it, and Newt Gingrich knows it. Now can we all stop wasting everyone’s time and let the people who have real decisions to make go about their business?

Your reason for backing her is because Latina girls are usually cute?
Posted by: obama=socialism | May 30, 2009, 12:27 am 12:27 am
I believe that the comment is entirely relevant. We have too much legislation from the bench as it is. The court is supposed to make rulings based on constitutional issues and intepretation of the laws original intent. Personal beliefs or, agendas have no place. Political alliances, race, and gender should not be any type of barometer. These types of statements are clear indication that personal beliefs and interpretation based on circumstances, not the Law could take precedence.

Playing victim when Justice Alito alluded to the same thing. Sad for you, I and many on this site and in the country choose to go through life informed. Not told what to think and say. Not a ditto head! We have the ability to access the information. If you don’t start thinking for yourselves, sheep you shall become. Judge Sotomayor will be confirmed. If you notice, the only talking heads opposing her right now are Newt, Rush and now Liddy, what a great crew. Watch the confirmation hearings when they take place. Learn something.

President Obama is telling us how to think? I would rather listen to an intelligent, articulate man and analyze what he has to say, then come on a blog and post what Rush, Beck, Hannity, O’Reilly, Dobbs, et al., rattle on about. The difference between you and me is that I do research on the Net, read newspapers and articles, books, think about what I have heard and read and then make my decision. All I’m saying is that as a minority, she has a different point of view to bring to the table, one that your typical white male would fail to bring. It’s not that being a Latino woman makes her better at being a judge, but the more differing points of view there are on the supreme court, the higher is the quality of the decisions that are made.

zeke: There is no guarantee when a justice takes the bench, they will vote as one may hope. Look at Souter – he was appointed by Bush 41 – a sure “in the conservative bag vote” – it didn’t happen – Souter turned out to be very moderate.

Moreover, if the supreme court was made up of all Latino females, I would argue that a white male would be a better addition to the team. And a statement of such would not be out of line.

Gabe & Sandy,
This “typical white male” is signing off for the evening. Good luck to you both. Diversity makes our country great!

Zeke,
Worry about the judge. She has a “sharp tongue,” remember. Not a one of those “bitter conservative old white men,” or some bloggers that think in the same frame of mind as they do, could hold a candle to Sotomayer’s accomplishments. Mnay of these “old” men FEAR intelligence and rationality that has them running off at the mouth. Sorry – a strong WOMAN on the Supreme Court – tough – they are going to have to live with it.

Terry: I have been collecting social security benefits and Medicare for two years now. Both filing experiences were upbeat, friendly, I never felt threatened or intimidated, the waiting room was colorful and full of plants, I talked with several people in the waiting room, and even met a couple who were retiring to New Mexico like I was because they had kids living here. I had great experiences; I am very sorry that you did not.

And, no, I do not hate men! I have some great male friends that I would not change for the world. I love to date and have great conversations with them. The time has come for more diverse representation on the Supreme Court that reflects this country’s growing diversity other than just white males, Thomas being the exception, but then he never ventures an opinion so I often wonder what good is he.

Your (Jake Tapper’s) remarks on the Diane Rehm show regarding Judge Sotomayor’s comments were dishonest.
She clearly said “I would hope that …”, not that “she thought” as you stated. She was clearly speaking about issues concerning discrimination based on race or sex. It was a distortion to assert, as you did, that any further explanation is necessary.
If someone said, concerning the Americans with Disabilities Act, “I would hope that a wise person who uses a wheelchair, with the richness of their experiences would, more often than not, reach a better conclusion than an able-bodied person who hasn’t lived that life”, would there be any argument?
I’m not implying that one’s race or sex is analogous to a disability, but that one’s personal experiences in life can enhance one’s understanding of an issue. That’s so obvious it shouldn’t need to be said.
But the right had already decided to oppose by any possible means whomever Obama nominated.

How dare Obama call discussion about her suitability to be a judge “nonsense”? Who does he think he is? Why hasn’t that man any respect for Americans who disagree with him? He certainly pretended to be a quite different person on the campaign trail, didn’t he? Mr. Obama, you bring disgrace to yourself. You cannot damage the office of president, which will last long after you are gone, but you insult Americans when you try to be a despot. If you want to be a despot, go somewhere else. You don’t belong in America if you cannot abide by our rules of respecting others.

A slogan of MEChA is “Por La Raza, todo. Fuera de La Raza, nada” which means “For the race, everything. Outside the race, nothing.” I would love to see a Latina on the bench – woman or man – but not Sotomayor.
As for Social Security and Medicare – separate taxes for both have been confiscated from my earnings throughout my working life, so yes, I will collect it and no, that doesn’t mean that I’m for communism, socialism, marxism or any other ism. Liberals desperately need some new talking points!

If this isn’t about identity politics, why does he feel the need to keep reminding us of her gender and race? What’s next? She doesn’t look like the rest of the judges and has a funny sounding name just like what was said by the president during the campaign?
Also, how exactly is being a latina woman better equip her to be able to put herself in the shoes of an Iowa farmer?

Tanarg wrote: “He (candidate Obama) certainly pretended to be a quite different person on the campaign trail, didn’t he?”
Did he? This is the same person who said: “We cannot continue to rely only on our military in order to achieve the national security objectives that we’ve set. We’ve got to have a civilian national security force that’s just as powerful, just as strong, just as well funded.”
Why do you think he wants a “civilian national security force” that has at least 1.2 million members with a budget that exceeds half a trillion dollars? He needs them to suppress and enforce HIS agenda on those of us who oppose him.
For those who scoff at this, we may have already seen this in play. When it was made public that AIG gave some of their employees multi-million dollar bonuses, following President Obama’s outrage ACORN bused in people to harrass some of the employees. And then just a couple of weeks ago, President Obama called for the closing of 5,000 of our failing schools and then reopening them with new principals and teachers. He knows that he has no constituional authority to implement this. However, with a “civilian national security force” he can set them loose in their own communities and from the grass roots actually accomplish this. This is true thugocracy in the making!

Sorry, I meant to say: “…suppress the opposition and enforce HIS agenda on those of us who oppose him.”

Let’s hope people can find enough things that Ms. Sotomayor stated and find plenty of flaws in the cases she has judged. The current Supreme Court has a case on her version why Whites and Hispanics can’t get promotions to a higher jobs even though they passed their tests for the New Haven Fire Department. Her logic is that there were Black firefighters too and none of them passed the test.
Judging how this Latina has no logic at all and the schooling she has passed didn’t make a difference at all to her.
Take your time all of you Senators need and take a long look at what you might put in to play for the American public for decades.

John Roberts has been running over everyone for the last few years. We need someone who can stand up to Roberts and his insensitive approach to everyday people .

James Danley,
Well, I meant all that sweetness and light stuff. Of course, I saw through him within the first 15 minutes I listened to his droning on and on. He love the sound of his own voice and the intelligent eyes of TOTUS, his soulmate.
However, he did masquerade as a person who would have some class, and I saw fools who bought his act.

“President Obama is telling us how to think? I would rather listen to an intelligent, articulate man and analyze what he has to say, then come on a blog and post what Rush, Beck, Hannity, O’Reilly, Dobbs, et al., rattle on about.”
Actually it’s whoever is writing the drivel that goes on the teleprompter. People will always listen to a smooth-talking con-man than look at facts and results.

Jake, why don’t you mention the part of the speech where she said:
SOTOMAYOR (2001): I am reminded each day that I render decisions that affect people concretely and that I owe them constant and complete vigilance in checking my assumptions, presumptions and perspectives and ensuring that to the extent that my limited abilities and capabilities permit me, that I reevaluate them and change as circumstances and cases before me requires.
