The double standard which allows her to get away with such a blatantly racist statement as this would make Martin Luther King very sad. It is indisputable that any such statement made by a white man and stated about any other race and gender would automatically disqualify any such person from consideration for a place on the Supreme Court.
But, even if that weren’t enough, she admits, in her comments at Duke University in 2005, that she sees her role as one of policy making, and when she realizes she has done so on tape she tries to cover it up. And, obviously, by her bemusement at unintentionally revealing her belief about a judge’s role in regard to the law, such implicit derision of the constitution is bit of joke to her. Notice that she doesn’t disqualify her remark, but only regrets stating it on tape.

it was fine for the 1st Pres. Bush to suggest that nominee Clarance Thomas having ‘empathy’ would be a benefit..
where was all the republican condemnation ?
how come they’re not condemning ‘Bush 1′ right now?

Your post is sad. Take some time to find and read the entire talk at Berkley titled ‘A Latina Judge’s Voice” and hopefully you will see the larger point she was making.

Policy making is different from law making. Legislature makes the laws, but the role of the court is to interpret law when controversies arise.
Hence, the courts do “make policy.”
This is a whole lot of outrage over nothing. But, I am not surprised that these kinds of attacks seem really outrageous to ignorant people.
She’ll get approved. She’s a strong nominee. But it is sad that a lot of people are going to look down on her for her ethnicity by calling her an “affirmative action hire.” It feeds into the extremist fantasy that there is a conspiracy against white people in this country.
This rhetoric fits well with the larger propaganda offensive that is being deployed against Obama.
After hearing Newt, Rush, and other leaders feed the race-war narrative, I am really ashamed of my former party.
