Souter Out – Sotomayor In?
Even though White House officials won’t say anything on the record until Justice David Souter formally notifies President Barack Obama of his retirement (he hasn’t), they knew this was coming. One White House official told me on Wednesday it could happen soon. There is no pick yet but the White House will definitely move quickly enough to have the new justice in place when the new Supreme Court term begins in October
Earlier I wrote that Judge Sonia Sotomayor is likely the heavy favorite for Souter’s seat. That’s still my bet. Here’s the rest of my analysis on GMA.

J. Souter is already one of the left-leaning judges on the SC- nothing should really change now with the President’s new appointment. On the other hand- J. Souter was appointed by Senior Bush when he was President because he was predicted to be a reliable conservative. There is never any way to predict how a Justice will turn out when appointed.

HILLARY CLINTON. That could be the nominee. She is a lawyer. She has vast legal experience (everything from landdeal fraud cases to Presidential impeachment). Not many have that vast amount of legal experience. She agrees with Obama on most issues (Saul Alinsky, anti-gun, pro-abortion, UN control of US, environmental taxes, etc). And I’m sure she wants the job. Plus she’s a woman and, despite “standing by her man”, a pretty militant feminist. She is strong on childrights (children sue your parents. And agreed with setting terrorists free before that became fashionable. And, I think, the Clintons have “something” on Obama. Recall the Clintons were expert in getting dirt and information. Why else did Obama appoint Hillary SecOfState after that devisive and bitter campaign? Its Hillary.

Whether Obama’s pick is Sonia Sotomayor or someone else, the Center for Reproductive Rights urges him to name a candidate who will affirm recognized constitutional rights, including women’s right to choose an abortion.
With Justice Souter’s retirement, we lose someone who has been a consistent supporter of abortion rights. His departure provides a critical opportunity for the President to nominate someone who has a strong understanding of and voice on the realities of women’s lives and to deliver on his stated commitment to nominate justices with ‘empathy,’ who understand the real life experiences of people.
The last Supreme Court decision, Gonzales v. Carhart, diluted the protections previously afforded to women’s reproductive health. Yet since Justice Souter joined the bench in 1990, there’s been a substantial shift in the acceptance and protection of reproductive rights worldwide. More countries, courts, and human rights bodies around the world have recognized that reproductive rights are human rights. Even countries that have historically neglected women’s reproductive health and freedom have affirmed that women’s health is vital to their societies’ health and committed to justice.

The courts are to protect the minority from the majority; down to the minority of 1. The President needs to remember this when he makes his pick.

Actually there are no Constitutional Rights. The Constitution merely protects our God-given rights from abridgment by an intrusive government. Do you think a woman has a God-given right to kill her baby in her womb? Somehow I doubt that He intended that.

Our founding fathers created a constitution that explictly states that the U.S. Supreme Court was not created to have empathy and not created to protect the minority from the majority. It is to interpert the law. What scares me is that the Supreme Court has become a place where politicians have to pass a litmus test to get elected to further a political agenda. Obama is not interested in the rule of law or the constitution. His goal is to abandon the constitution or change it to meet his wants and desires. We are headed to a one-party system where disenting voices will no longer be tolerated. To the liberal media, the ‘ends justify the means.’

Judith Kaye, until recently chief judge of the NY Court of Appeals, is HOT. Sonia Sotomayer is NOT. . . .
Obama should noodge Roberts to resign as chief and appoint Judith Kaye to that position.
