On Jonathan Gruber and Disclosure
The New York Times has an editor's note today:
"On July 12, the Op-Ed page published an article by Jonathan Gruber, a professor of economics at M.I.T., on health insurance and taxation. On Friday, Professor Gruber confirmed reports that he is a paid consultant to the Department of Health and Human Services, and that his contract was in effect when he published his article. The article did not disclose this relationship to readers.
"Like other writers for the Op-Ed page, Professor Gruber signed a contract that obligated him to tell editors of such a relationship. Had editors been aware of Professor Gruber's government ties, the Op-Ed page would have insisted on disclosure or not published his article."
In November this blog, too, cited Gruber's work with no disclosure (and no knowledge) that he had nearly $400,000 in lucrative contracts with the Department of Health and Human Services.
Gruber has been a go-to voice for reporters seeking a respected academic view on health care reform costs — and as far as I can tell, few if any knew that in March he was awarded a $95,000 contract with HHS and in June a $297,600 contract with HHS for providing "Technical Assistance in Evaluating Options for National Healthcare Reform."
A Dec. 28, 2009 Washington Post op-ed by Gruber made no such disclosure. The piece, titled "'Cadillac' tax isn't a tax — it's a plan to finance real health reform" makes that case, strongly opposed by labor unions, that the Senate health care bill's proposed "40 percent assessment on insurance plans with premiums of more than $8,500 for singles and $23,000 for families … would reduce the incentives for employers to provide excessively generous insurance, leading to more cost-conscious use of health care and, ultimately, lower spending."
This is the same "Cadillac tax" proposal that President Obama is pushing House and Senate health care reform negotiators to include in the bill — and yes, it's the same one he opposed on the campaign trail, noting in October 2008 in Newport News that some workers have "given up wage increases in exchange for a better health care."
Gruber's nearly $400,000 contract with the Obama administration seems to have first been noticed by a citizen-journalist-blogger, Mote Date at Daily Kos.
Ben Smith of Politico then jumped on the case.
Gruber told Smith:
"I do indeed have a contract with HHS. Throughout this year I have provided technical assistance to the administration and to Congress with my micro-simulation model, as well as based on my experience as a member of the Massachusetts health connector board. But NONE of the work I have done in public, or any public declarations I have made, has been in any way funded by the Administration. That funding was strictly for internal work that I did for the administration and, via the administration, for congress. All externally visible work and comments, such as my editorials or public reports, have been done on my own time.
"Moreover, at no time have I publicly advocated a position that I did not firmly believe — indeed, I have been completely consistent with my academic track record. On the two issues this article raises:
"1) I am known in economics as one of the leading experts on the impact of health insurance costs on wages — indeed, I wrote my thesis on that topic and have written extensively since on the fact that health insurance costs are fully translated into wages. I was asked by the editors of the Handbook of Health Economics, a review of literature in this area, to write the review article on this topic.
"2) In my role as a member of the MA Health Connector board, I had to help decide what were affordable subsidies for our citizens. I was surprised to find how little work there was on this topic so I undertook a study to help lay out what might be considered affordable. I have since replicated that analysis at the federal level. Every position I have advocated on this topic is completely consistent with these reports."
Gruber noted that in November he disclosed his relationship with the administration in an International Committee of Medical Journal Editors disclosure form he filled out before the New England Journal of Medicine published his story.
But the issue, as Smith and FireDogLake and others have noted, isn't Gruber's New England Journal of Medicine story, it's that he's been so frequently cited by members of the media as an expert — reporters who didn't know the Obama administration was paying Gruber nearly $400,000.
Such as Ron Brownstein's influential piece on health care reform in the Atlantic. Democratic senators such as John Kerry continue to push his work, likely just as oblivious as the rest of us as to Gruber's HHS contract.
None of this of course means that Gruber's arguments are wrong. But without question the relationship needed to have been disclosed so that the public could independently make that assessment for itself.

Thank you for publishing this. Sadly there was a time not long ago when anything negative about Obama was ignored, minimized or simply hidden. It’s how he got elected and it was irresponsible and unprofessional. Unfortunately I think it’s too late. Congress and the administration are so convinced that they know what is right for all of us that they are no longer listening and don’t care if these policies actually help people. They are particularly dismissive and contemptuous of those of us who actually pay the bills. All they care about is winning; the hell with the consequences. Sad and scary.

It was highly inappropriate for Gruber not to disclose his contractual relationship with HHS, but let’s be clear: the Obama administration didn’t pay him to write the op-ed piece, nor is there any evidence that President Obama himself, or one of his staffers, ordered him to write the piece and deliberately conceal the relationship.
We can rightfully criticize inappropriate actions without making accusations for which there is no basis.

One interesting note: It is only after Mr. Gruber found himself on the other side of BigUnion that he is finally exposed.
To the extent that the herd of experts serve that Democratic Party Special Interest, hands-down the biggest money donor for them, we’ll all be kept in the dark about how badly the nation is being ransomed away by the tyrants now in power and their hirelings.

Why hasn’t anyone dissected the $10,000,000,000 in both versions of the health care bill that is going to pay-off the critically underfunded Union pension plans?
These over-promised plans for union workers are in much worse shape than other pension plans because they are over-promised and poorly managed. Somehow, though, the plans for Union officers are doing just fine, hmmm.
Looks like the tyrants in office are further empowering Big Union Elites by covering the bills for their failures, to the detriment of all the rest of us.
Anyone want to cover this issue? Anyone at all?

Why should anyone be disillusioned? Sure, the masses dripped tears of joy at the New Chapter of American politics with Obama, the soaring rhetoric…and totally discounted his meager, meager resume for the top job. Mere trust, faith reigned. Astoundingly (after a campaign of lofty moralistic rhetoric) one of Obama’s FIRST acts was to nominate THREE tax cheats in a row for top positions. Geithner got through Congress. But Daschle and a woman nominee withdrew their nomination the day the New York Times posted an editorial on the issue. The reaction of Americans scared me–the masses were ASLEEP and non-critical even after knowing this and I feared Obama changing the landscape of America with virtually no legitimate criticism or checks on executive power. Again and again he would push an agenda, only to find that those he was foisting it on would not buy it. At which point he would salvage what he could or “re-frame” the agenda to look better. I had no problem with a black person in the White House–but I feared Obama’s rule would set back the chance of a truly great black holding the post down the road. He was “the Uniter,” but America may be more divided now than ever.

Since when do reporters go to a “go to guy” to get their reporters.
Reporters Used to do Real Investigation, dig up everything in the process. Reporters used to do their Own Leg Work.
Now a days, Reporters go to some guy, whether Republican or Democrat, and take that person’s word as Gospel.
I am still waiting for the real answers on a large number of Saudi Detanees from Guantanimo in 2007, some of who were in the Terrorists Rehab Program at Guantanimo, and yet Bush and Cheney stated on National TV that none of the detanees they were releasing in 2007 were Not terrorists.However reports are comming out that soon after they flew back to their Saudi Homeland, they then slipped into Yemen and rejoined Al Qaeda.
Well detanees in a Terrorists Rehab Program are in the program in the first place because “Those Detanees Are Terrorist”. It also Proves that Republicans are worse at Security than Democrats.

The MSM never bothered to vet Obama when he was on the campaign trail, so why would we expect them to do any better with the people who speak on behalf of his policies now? Nobody wants to believe Obama is what he is. A typical politician. A typical liar. It’s starting to come out only because of a few people out there willing to dig in (as reporters USED to do) and find out the facts. let’s see. our government gives a professor $400,000.00 of our money to consult with them on health care reform. he then writes editorials supporting the administration’s policy proposals but does so with no intention of letting any of his readers know that he’s actually a tool of the government he works for. sounds like propaganda to me. so, how’s the obama administration going to explain away this one? as if we’re to believe that no one in the white house press office was aware of this? and if they aren’t aware that a government employee is do stuff like this, they should all be fired. people need to wake up about what’s obviously going on with this administration.

Gruber is unfortunately a victim of the corrupt mainstream media culture. Sensing no agency to do the most minimal of investigative reporting, Gruber was at ease breaking all ethical and legal requirements. He fully expects to get away with it; one look at more than half of President Obama’s administration confirms the fact that abject corruption is the pathway to success.
Corruption is and unchecked, it becomes pervasive. Democrats have the media to blame for their failure to expose unethical and criminal practice and increasingly, their desire to be involved in that practice itself. Hopefully no journalist will be surprised that professionals in the private sector will neither hire nor associate with their type. When I see a journalism degree or like experience on a resume, it’s thrown in the trash. Nobody from such a corrupt institution can be trusted in any role where ethical conduct is necessary.

As a retired union employee who barely scrapes by on a near poverty pension, I am now told By Mr. Obama that I will soon have a 40% tax on the only real benefit I have, namely my health insurance. I remember as Obama stood up during the campaign and condemned John McCain for having the audacity to suggest we tax middle class health coverage and how nobody making under $250,000 would ever have to worry about a tax hike. But Obama did McCain one better. He lied to us about not taxing our health coverage and is about to impose a tax that will be even greater than what McCain suggested. At this stage in my life I have seen plenty of deceit by politicians, but few who have conducted such purposeful bait and switch tactics as Obama. I have voted Democratic for most of my life, but you can bet that I am anxiously awaiting November when I can vote these people out of Congress.

It bothers me that they proclaim the bill health care REFORM,,,,there is NOTHING in the bill that is being reformed,,,this bill legalizes GREED to EVERY sector of health care,,,If the industry KNOWS that the final bill will be paid for by the income taxes of the people,,,,they will not stop their greed at all….as it is now a trip to the emergency room is thousands at the very least,,,,what will it cost then?

By the way as a mass resident, whether Mitt Romney signed the bill or not was irrelevent. Massachusetts has long had a veto proof democratic majority. Whne we had a republica governor, occassionaly, he would veto something and the dems would just over ride it. When it suited the dems, they would let the veto stand and then blame the governor for stopping something,(which they didn’t want all along) That is just the typical corruption we have in massachusetts.
So to those who bring this up, I don’t criticise them for their ignorance.

I’m AMAZED I’m reading this on ABC’s site, especially with all of your comments!! For awhile I thought I had entered Fox News’ site, but NO… ABC. It seems the rest of the media has finally woken up from the Obama Kool-Aid and is now realizing what’s been happening during their nap!

I agree. Note that the one good thing, not mentioned in the article, is that the tax is only on the portion above $8500 per person or $23,500 per family. And if you contribute to your insurance, I think the tax only applies to the portion your employer contributes to your premiums.
I am also a retired union member on a small pension with mostly-employer paid first-class health insurance for life. The active union members basically take a pay cut to make sure a certain portion of the payroll is set aside to fund retiree health benefits. Their incentive is knowing they’ll be retirees one day, just as we retirees did when we were working and did the same thing.
My policy is “cadillac” quality, but it costs only about $6000 per person – about $4600 paid by the employer – total both because I worked for a very large company (a school system insuring over 20,000) and because teachers generally take better care of their health than average so I think BCBS is willing to charge less to get our business. Additionally, the excellent prescription plan is self-funded separately by the school system and isn’t part of the premium costs.
Perhaps urging your union to find clever ways to keep the value of the insurance but lower the premium cost would be worthwhile – if this cadillac tax goes through.

Will someone PLEASE point out that this health care debacle is in the forefront of the many reasons why privately held businesses are in a financial panic. I am a 44 year old business owner. My wife and I will be dropping health insurance for our family this month. I am in a fight for my business life and if things don’t change in the next 3 months we run a high risk of being added to the terrible statistics. I have been in business almost 15 years and all I want is the politicians to shutup, sit down and let the free economy happen. If GM has to file for bankruptcy, so be it. We have laws for that. We won’t stop buying GMC trucks for our business just because they hit rough times. Tell everyone in Washington to look at themselves and cut their own pay, stop lifetime pensions, provide their own retirement, buy their own health care and get us the hell out of debt! Governments are like businesses, they are a reflection of the highest position. If you are fiscally broke at the highest level it will eventually show all the way to the lowest. (It is the same with general character) Get our government out of debt! It will hurt and some will scream but it is in everyone’s best interests that this take place as soon as possible. Stop all grants that are not intrinsic to the national interest. Give Washington a 25% pay cut across the board. We spend almost as much on pensions in Washington as we do security and military. The Republi-Crats are killing us…

Gruber testifies as an expert. Reporters and lawmakers turn to him because he is an expert. A department of the government needed to consult with an expert, and hired Gruber. Duh – you want that they should hire Joe the Plumber?
What critics want you to believe is that he’s being paid to deliver the administration’s message. The problem is, there is no evidence of that. He’s got a long track record on the issue, of saying the same thing he says today. So people will just point to the contract and hope you will make the inference own your own, so they themselves won’t get caught in making false accusations.
Gruber has a problem of transparency, true, but there is no evidence of corruption or deception, hence no scandal.
Unless you are very easily scandalized -
