Democrat Ben Nelson Opposes Kagan
ABC's Matthew Jaffe reports:
Nebraska Democrat Ben Nelson announced late Friday he would
vote against the confirmation of Supreme Court nominee Elena Kagan.
In a statement released this evening, Sen. Nelson said,
"I have heard concerns from Nebraskans regarding Ms. Kagan, and her lack
of a judicial record makes it difficult for me to discount the concerns raised
by Nebraskans, or to reach a level of comfort that these concerns are
unfounded. Therefore, I will not vote to confirm Ms. Kagan’s nomination."
Nelson is the only Democrat to oppose Kagan at this
point. Five Republicans, on the other hand, have said they will support Kagan's
nomination, giving her more than enough votes to win confirmation. A vote is
expected in the Senate late next week.
Nelson has sided with Republicans on a number of votes in
the past, most recently the restoration and extension of unemployment benefits
for the long-term jobless.
Nelson did note that if a procedural vote is held on
Kagan, he will not filibuster, since he believes Kagan deserves an up or down
vote. But on the final vote, Nelson is a no.

Everyone deserves an up or down vote unless they are nominated by a Republican President… Make these Democrats “vote for her” before “they vote against her” — not qualified but I’ll allow her life-time appointment to happen…
We are reaching a point where the Congress (clearly not this Congress) really needs to start considering impeachment for Federal Judges for not following The Constitution of the United States they swore to honor and protect… What part of “the rights of the people shall not be infringed” or “Congress shall make NO law” do they not understand ???

I commend Mr. Nelson for actually listening to his constituency and having the guts to vote his conscience ( if he does). I suppose it is the usual RINOs with no backbone or sense that will cast yes votes. These losers need to be shown the door expediantly. Even a public school educated person would know that Kagan is no more qualified to sit on that bench than ObaMao is to sit in the oval office… sheese

I’d agree with the payoff comment. But realistically he looked at the landscape and thought he could probably vote the other way and let the GOP bear the laboring oar. It’s nice that he can follow his constituents wishes when it’s convenient for him.

This women is not qualified for this court, but nor was Obama qualified to become our president and you have seen what he has done.
It’s hard to believe that are so many losers in our country – Pelosi – Reid – Franks – Obama – on and on the list is just too great Republicans are on the list as well.
Our president lied to us all Dems and Independents and Republicans. Than he surrounded himself with every left wing loser he could find.
I think America is waking up to the fact, that as much as we all wanted Obama to be a success he is even worst than Jimmy Carter.
Simply put he is not a nice person and his actions have been un-american.
It may be that he is just way over his head? What ever the case every move he makes is wrong. The president of the United States sitting down to have a beer with a cop and left wing professor – That time would have better spent working for the American people – those need a job – those that need protection from the tens of thousands pouring over the boarder every month.

What a sad and pathetic country America has become. My dad fought in the invasion of Normandy, my brother and I both fought in Vietnam, but I am just ashamed and saddened by what America has become. The bottom line is that our country is now led by a band of spineless weasels like Ben Nelson and the entire GOP.
If Nelson has a specific beef with something specific that Kagan said, then fine. But he doesn’t, r else he would have articulated it. Instead, this is obviously motivated by his reading the polling data and finding it it more politically expedient to vote against her than for her.
What a sad, unprincipled, unscrupulous failure this man Ben Nelson is, and what unprincipled, uneducated yahoos Nebraskans obviously are.

This is why term limits are necessary. Kagan has openly stated that she does not stand behind either the First Amendment nor the Second. Ban books and ban guns with one SJC behind you if Kagan gets in.

When Bush nominated Harriett Myers to be Supreme Court Justice, most Republicans recognized immediately that she did not have any experience and was not qualified for the jobs.. Of course the Dems were shouting that she was unqualified, but Conservatives were threatening to leave the Party.. Bush recognized his mistake and withdrew the Nomination..
Is Ben Nelson the only Democrat to recognize that KAGAN is Unqualified.. Where are the honest Democrats?? Why can’t we find more than one who will say she is not qualified??
And why aren’t the Republicans shouting at the top of their lungs that she is imminently unqualified..
Kagan is not qualified for the Office and will be a thorn in the spine of our nation for the next 30 years.

Nelson is one of the more trustworthy Democrats in the Senate, which isn’t saying much, but I sense that his frequent siding with the Republicans has more to do with his evaluation and understanding of Blanche Lincoln’s poll numbers in Arkansas than his heartfelt political beliefs.

It always amuses me when people talk about “real Democrats” and real Republicans”. They are generally young and ignorant, with no historical perspective. From 1887 until 2005 there were no Republicans elected from Louisiana, and I never heard anyone say that Alvin Ellender or Russell Long was anything but a “real” Democrat, and either of them was easily more conservative than a Jacob Javits or Al D’Amato, Republicans elected from New York. It is only in th last 40 years that conservative Democrats and liberal Republicans have been read out of their respective parties.

Nelson continues to try to save his hide. He personally is responsible for the socialist health care plan passing. We Nebraskans will never forget. When he comes up for reelection in 2012 he will be unemployed. When the going gets tough turncoats like Nelson, Kerrey and other Dems have screwed Nebraska to side with their lib buddies every time. Until then–whether she is ideal or not–we can at least rest assured that she will be one of the better members of the court.

To *true* Americans that still believe in our Constitution, it doesn’t matter how the nomination vote even proceeds; anything that is signed by an illegal usuper is *not* valid – this includes ‘appointees’ to the Supreme Court. Until the same problem that has been on the table is fixed – the very authentication of our ‘leader’ under our Constitution – rational, loyal Americans will not recognize any laws, appointees, etc. made. Nebraskans: Just know that a vote for Nelson (when he comes up again) is a vote for Reid/Pelosi. Nelson will pile up these meaningless votes, which never have the effect of stopping Reid/Pelosi, but actually represent Nebraskan positions in the majority, and thus, “look good” when the election rolls around. But on the important ones, where his vote is needed by the coastal liberals, he falls right in line with them.

Regarding the “restoration and extension of unemployment benefits,” the Republicans (and Senator Nelson) were for it. Were the Democrats therefore against it? Must be, as objective ABC News presents the issue in those terms.
Of course the real issue was whether to pay for the extension with offsetting cuts elsewhere or even from an existing slush fund, or to simply to further burden future generations with what can only be described as an upside-down mortgage.
Meanwhile human beings continue to respond to incentives, so the long-term unemployed who find utility in non-work activities continue to eschew lower-paying jobs as the recovery stumbles.

What bothers me most about the supreme court is that all the justices on the court are documented members of religions that have strong dogmatic beliefs that could affect their impartiality in decisions: Six Catholics and three Jews. It would seem to me that Justices should not be chosen if their beliefs can in anyway bias them in the impartial work they must perform. For Example: the encyclical of POPE LEO XIII, Immortale Dei, makes a strong statement of the sovereignty of the Vatican over any temporal government, and forthrightly condemns democracy; this coupled with the infallibility of the Pope in religious matters seems to me to create a serious conflict of interest for any justice who says he is Catholic. After all, if they say they are Catholics then they wholly subscribe to its dogma and cannon laws, which means they are either lying or unable to carry out their duties impartially. Also the Jews believe they are a “chosen people” which also makes them prejudiced, and not impartial. It would seem to me only agnostics would make good candidates since they have no dogmatic beliefs. In a democracy impartiality must be strictly upheld, or there is no democracy!

Being a Democrat in Nebraska is kind of like being a progressive Republican.
As a Nelson supporter, I have visited his office to ask for help as an ombudsman. When I was there, I found their staff facing a constant stream of loud obnoxious people who have been energized by Fox news, Rush Limbaugh and the Tea Party Patriot committee.
Anyone who spends a significant time with these people might be given the wrong impression about Nebraskans. While we do have a very significant population influenced by corporate conservative media, and theologically empty corrupt churches, they don’t always represent the majority of Nebraskans and certainly not of Democrats.
But he cant ignore the Republican/Corporate machine too much. And he can’t ignore Democrats neither.
In the context of a heavy handed corporate owned media, influencing a theologically minimalist and vulnerable religious population, this is the best we can get out of Nebraska right now.
We can’t exactly lead, but we are not getting in the way neither.

Ms. Kagan will probably get more yes votes than Alito or Roberts. Where’s the logic there? A person with no judicial experience will not only receive enough votes for confirmation, she’ll receive more votes than two accomplished jurists. Sleep well RINO’s and Libs.

Well, someone figured out why Obama nominated Elana Kagan for the Supreme Court…. Pull up the Supreme Courts website, go to the docket and search for Obama. She was the Solicitor General for all the suits against him filed with the Supreme Court to show proof of natural born citizenship. He owes her big time. All of the requests were denied of course. They were never heard. It just keeps getting deeper and deeper, doesn’t it? The American people mean nothing any longer. It’s all about payback time for those that compromised themselves to elect someone that really has no true right to even be there. The USA has finally become the laughing stock of the world. GOD help and deliver us.

So, as long as it takes 60 votes to move the confirmation to the Senate floor for a procedure vote, he will vote for her.
But when they only need 50 votes to confirm, he will vote against.

She is not fit for seat as a judge. A judge should be able to answer a yes or no question swiftly to give us confidence that she can decree judgements without all the complex babble. Her inability to be blunt with a clear answer stating which direction she leans, is evidence that she is not on stable ground, and unable to make decisions with a foundation.
She is clearly just a mouthpiece for some ideological “progressive” philosophy. This fantasy that the liberals are fighting for is lofty, and foolish.
If she gets confirmed, just know that this nation with a system that thrives on honest hard work will fall into a minority elite class, and an underpaid majority working class. Think of China, Hong Kong and the rest of their country.
This clash of worldviews will surely lead us to WW3.

Senator Nelson is being given a pass to vote no since his vote does not matter. The vote that would matter would be the vote to close debate. If Senator Nelson truly believed that Kagan was not fit to be a SCOTUS justice, he would not vote to close debate. All a sham to convince his constituents that he really is one of them.

If you want to do something lead a movement to restore the Constellation project or extending Shuttle Flights. We are dying down here. You want economic stimulus, space is an answer. A Congressional Reform Act of 2010 has been proposed recently. I believe it should go through. it is:
1. 12 years only, one of the possible options below;
A. Two six-year Senate terms or,
B. Six Two-year House terms or,
C. One Six-year Senate term and three Two-year House terms.
2. No Tenure/No Pension?No Retirement pay/No Retirement Office or Staff/No retirement perks.
A congressman collect a standard salary while in office which must initially be approved by a general vote of the American people, and receives no pay when they are out of office.
3. Congress (past, present & future – including all members and staff) participates in Social Security.
All funds in the Congressional retirement fund move to the Social Security system immediately. All funds flow directly into the social Security system, and Congress participate with the American people.
4. Congress can purchase their own retirement plan, just as all Americans do.
5. Congress will no longer vote themselves a pay raise. Congressional pay7 will rise by the lower of CPI or 3%.
6. Congress loses their current health care system and participates in the same health care system as the American people.
7. Congress must abide by all laws they impose on the American people.
8. Any and all contracts with past and present Congressmen are void effective 1/1/11.
The American people did not make this contract with Congressmen, Congressmen made all these contracts for themselves.
SERVING IN CONGRESS IS AN HONOR, NOT A CAREER. THE FOUNDING FATHERS ENVISIONED CITIZEN LEGISLATORS, SERVE YOUR TERMS, THEN GO HOME AND BACK TO WORK, OR TO WORK AS THE CASE MAY BE.

Kagin has publicly admitted, during the hearings, she presented her persona opinion as coming from the American College of Gynecologists. Therefore, Kagin lied to the court. She should be facing a bar disciplinary hearing, not elevation to SCOTUS.
I am astonished any Senator, or president, would overlook this lie and vote to confirm.

Ben really needs to switch parties. He will better represent his constituents as a Republican, and can avoid the constant betrayal of his current party. Plus, we will then have a better picture of the real Sen. Nelson.

My comments…To Doug: Don’t worry, I am going to personally go door-door to campaign for whoever runs against Uncle Ben in 2012. To B Smithe and SB: I’ve lived in NE all my life. Traveled to many places around the world. NE’skans are not “unprincipled or uneducated yahoos” or “stupid”. NE’skans are some of the finest people in U.S. Hard-working, ethical, patriotic, and family-oriented. We, like all states, have our issues, so…stop being a couple of smug, elitists. You worry about your own states…this rural state will take care of business in 2012.

The three Rino’s should be voted out of office next election. L. Grahan, O. Snowe, and S. Collins need to go! Can’t count on them for anything, but to support the other side. I’d love to know if Graham knows what advise and consent mean, since he thinks the President deserves to have his nominees on the court. If that were the case, there would be no need for the senate voting at all, and a very good man would be on the court, with experience as a judge, named BORK.

Sad that only 1 Democrat is voting against Kagan and 5 Republicans are voting for confirming her.
She is not qualified and highly biased. She WILL be legislating from the bench, like Roberts, like Sotamayor.
Why would even consider her for the highest judgeship in the land when she has NO EXPERIENCE AS A JUDGE?
In what other place would a person with NO EXPERIENCE end up in the top position of anything?
CA’s governator has proven to be a dismal failure and anyone that thought a celebrity would be a good governor has been proven dead wrong.

Is he still considered a democrat…I thought he left the party for the way he has been voting lately. This is not the first negative vote by Nelson. By the way…this generation has more freedom than any other and you need not fear of it going away. Look at all the garbage that is allowed on the radio and talk shows …if that isn’t freedom, I’ll eat my hat. Everyone has the freedom to say and think what they feel and it will always be that way. Each generation gets smarter and more vocal so you need not worry Jukin…freedom is here to stay. Unless the republicans get back in…then you need to sign a pledge and do what they say…funny isn’t that what they accuse Obama of doing. Nothing could be further from the truth. They are the ones trying to control everything with their negativity…so I still say…freedom is still here.

There must be a poll in Nebraska, showing that Nebraskans understand the danger of putting someone as incompetent, with Marxist tendencies, onto the SCOTUS. So – as others have said, Nelson GOT PERMISSION from His superiors, including Harry Reid, to pretend to be principled. Voting AGAINST, when he knows that, if the candidate comes out of committee, Reid has enough votes to confirm Comrade Kagan.

I dont know why conservatives “assume” that the majority of people would not like Kagan to be confirmed.
I dont assume either way – and I cant until a vote is put to place. I do know that each senator was voted into place by a majority of their constituents. I do know that Obama was voted into position by a wide margin of Americans.
Unfortunate or not. The Constitution put forth this process to nominate and confirm a Supreme Court justice.
Every bit of the procedure put forth by the Constitution was followed.
We can argue that we personally do not believe Kagan is qualified and does not deserve to be a supreme court justice. BUT to make blanket statements that “democrats or republicans” is doing something that “majority” of Americans do not want is simply untrue and intellectually dishonest.
