Justice Department Sues Arizona for Immigration Law — But Does Not Make Charges of “Discrimination”
As widely anticipated, Attorney General Eric Holder today filed a lawsuit against Arizona and Gov. Jan Brewer over the state’s immigration law. The suit seeks a preliminary injunction to stop the law from being implemented.
The court filing states that Arizona law is pre-empted by federal law and therefore violates the supremacy clause of the U.S. Constitution.
The filing makes no assertion that the law is discriminatory or risks being applied in a discriminatory fashion, as the president and other officials said they feared would be the case. Interestingly, this suit makes no civil rights charges against the Arizona law.

“The State of Arizona has crossed this constitutional line,” write Assistant Attorney General Tony West, United States Attorney Dennis K. Burke and others. “In acknowledged disagreement with the manner in which the federal government has regulated immigration and in contravention of these constitutional principles…The states are not permitted to set their own independent immigration policies, with varying and potentially conflicting enforcement systems and priorities. Were a number of states to act as Arizona has and strike out on their own, federal immigration policy and enforcement efforts would be crippled.”
The suit states that the Arizona law pursues only the goal of “attrition” while ignoring other objectives Congress has established for the federal immigration system.

UPDATE: Senate Minority Leader Mitch McConnell, R-Kentucky, released a statement saying: “Suing the people of Arizona for attempting to do a job the federal government has utterly failed to execute will not help secure our borders. If the President wants to make real progress on this issue, he can do so by taking amnesty off the table and focus his efforts on border and interior security. It is long past time for this administration to prioritize solving a crisis over imposing an agenda and the first step is to recognize that attorneys and amnesty are not acceptable alternatives to border security and job creation.”
Gov. Brewer, meanwhile, is soliciting donations to help defend the state from the Justice Department lawsuit, tweeting: "We will be very aggressive in defending our law. Donate to help keep AZ safe.”

Actually I view this as a chess move by the Federal government – a move to make sure ALL the aspects of the 1986 Immigration Reform and Control Act are enforced, not just border security.
The bill was originally crafted by a Democratic representative from Kentucky, and a Republican senator from Wyoming. They knew an immigration reform law would require a bipartisan effort, so they held joint House-Senate hearings all over the country – they heard from all sides and points of view.
They quickly realized that if immigration reform was to work and be fair it had to be a “three-legged stool.” If one leg failed, so would the entire bill.
“Leg one” was improved security against illegal crossings at the border with Mexico.
“Leg two” was the H-2A temporary worker program for agricultural workers, designed to ensure minimum wage. It imposed penalties on employers who knowingly hired undocumented workers and it also requested funding for a simple, reliable and tamper-proof identifier using cards or biometrics. This has never been funded or enforced.
“Leg three” would allow some, but not all, undocumented aliens then living and working here to regularize their unlawful status and begin the long process to earn temporary residency and, eventually, if they chose to continue, to earn permanent residency and citizenship.

A police state? Have you read the federal law? You know, the one that’s decades old? ANYONE can be stopped at ANY TIME for NO REASON AT ALL and be asked for immigration status by federal authorities.
The Arizona law is actually more lax than the federal law since law enforcement must first have “lawful contact” with someone before they can attempt to determine immigration status.
The problem, of course, is that the federal government refuses to enforce its own laws, putting US citizens at risk. So states are doing what they have to do.

This legal action will only divide the nation. The ‘justification’ for the federal lawsuit against AZ is that the interests of the state are in conflict with federal interests. That is condescending at best, self-destructive at worst — but it is by no means constructive.
AZ is not an example of a rogue state, and as a result this lawsuit is a test of the constitution. The supreme court cannot arbitrarily strike down a law just because the feds are against it. So far, the only conflict that exists between the feds and AZ is that the feds believe that AZ is not acting in its best interests — hence there is is no legal basis.
This serves as a reminder that under Obama’s rules, he is the only one smart enough to know what is in everyone’s best interests!

Remember only a few months ago, AG Holder made a formal announcement that the captured 9/11 related terrorists will be subjected to civil trial in lower Manhattan. This civil trial is now permanently delayed or canceled after there is huge objection among New Yorkers, including the Dem. politicians. The current AZ law enjoys 70% approval rating in AZ and over 60% nation wide in spite of the wild accusation and attempted boycott from the liberals. If the law suit by Holder goes to the Supreme court, it may well be rejected by 5 to 4.

Yeah, that struck me as odd as well. Their main complaint for months didn’t even get a mention?
Well what do they mention as more severe than discrimination?

It’s against the law to ask the government to do the job they’re legally mandated to do if it would be hard? Really? That’s one of their arguments, that you can’t make them do hard work they’re expected by law to do?
Well consider me persuaded. Asking the government to do anything hard, or burdensome, or difficult is clearly illegal. And letting other people do that work might make them look and feel bad; so ban that too… the work must stay not done if it is difficult.

All the Arizona law does is enforce an old Federal Law signed into Law by President Clinton. If AZ laws in unconstitutional, so is the Federal Law which is still in the books.
People might want to read up on things rather than spew talking points which they have been handed down by websites, talking heads, etc.
AZ has a right, Constitutionally, to protect itself if the Federal Government fails to do so. Furthermore, AZ has the right to enforced Federal Laws. If people have a problem, it should be with the Federal Law signed into Law by Clinton and kept in place by President Obama. But the fact is that this is NOT about helping anyone, this is about the Obama administration playing politics and attempting to get some cheap Hispanic votes.

I hope that every American, regardless of where he lives, will stop and examine his conscience about this and other related incidents. This Nation was founded by men of many nations and backgrounds. It was founded on the principle that all men are created equal, and that the rights of every man are diminished when the rights of one man are threatened. All of us ought to have the right to be treated as he would wish to be treated, as one would wish his children to be treated, but this is not the case.
I know the proponents of this law say that the majority approves of this law, but the majority is not always right. Would women or non-whites have the vote if we listen to the majority of the day, would the non-whites have equal rights (and equal access to churches, housing, restaurants, hotels, retail stores, schools, colleges and yes water fountains) if we listen to the majority of the day? We all know the answer, a resounding, NO!
Today we are committed to a worldwide struggle to promote and protect the rights of all who wish to be free. In a time of domestic crisis men of good will and generosity should be able to unite regardless of party or politics and do what is right, not what is just popular with the majority. Some men comprehend discrimination by never have experiencing it in their lives, but the majority will only understand after it happens to them.

You say just because you exist that’s all it takes, and what reasonable is? If you are an animal perhaps that’s correct, the strongest then become the alpha leader, but we are human, not animals.
Reasonable humans, especially citizens of the United States in this case, would differ from your interpretation and description.
In reality, “theory of natural law holds that there is a certain order in nature from which humans, by use of their reason, can derive standards for human conduct.” This truly means our LAWs are what have been derived as our standard for this country. Why such hatred for illegal immigrants republicans? Most of you hire them so you can avoid the taxes and use them as cheap labor.

From a blue-dog DEMOCRAT: You think all democrats approve of illegal immigration and its burden on US citizens AND legal immigrants? Wrong. I don’t. Republican and Democrats alike don’t hate anyone who wants to come to the US, we just don’t like our government ignoring its own laws in order to buy votes. If you have a problem with that your arguments are empty; based on ignorant, race-baiting, socialist principles. Personally I’m sick of being a Democrat because it has become apparent that our party is destroying the country by steadily eliminating bedrock principles of hard work and self-sufficiency. The Republicans are no better since profiteering has taken control of most of them as it has with many Democrats. I’m going independent. Bottom line this country is on the decline and we are all in line for some unhappy days unless ALL politicans who have been in office for more than one full term are put OUT. The purging needs to be repeated until they learn we won’t allow them to use us as pawns in their game.

He wants to sue AZ, but Eric went ahead and dropped the charges against the black panthers. I thought we all were worried about peoples Civil Rights.

It is odd that there has been this big spike in right wing idiocy coming out of Arizona though. Texas has a higher background level of crazy and right now Arizona is like a supernova taking the attention. I wonder how long it will last.
Actually it isn’t that strange. Arizona has been moving gradually towards the middle over the last twenty years. The population has doubled in that time and a big part of that spike wasn’t old retirees who tended to be conservative, but a lot of younger families moving from blue states, etc. In 2008 McCain only received 53.4% of the vote here in Arizona, his sixth lowest vote total among the states he won. Now think about that, his home state was one of his least supportive states. Had McCain been from Texas, Florida, etc., he likely would have lost Arizona.
This state has a long history of very conservative, often racist politics and the supporters of those policies aren’t happy that they are consistently losing ground to moderates and liberals (simply termed as liberals in their tirades). Because of how the state legislature is set up conservatives still have a major majority in both houses but, when Napolitano was governor, she vetoed a lot of their stupidity. In fact she set the record for vetoes in the history of the state. You take her away, bring in Brewer who is a wing-nut’s wing-nut, and you see incredibly stupid legislation that was shut down by a reasonable governor make it out of the state house. At the same time you see an increase in non-conservative population as well as an increase in non-white population and the far white err, right is freaking out.
