Kucinich Suing Congressional Cafeteria for Unsavory Olive

ABC News’ John R. Parkinson reports:

It’s not necessarily because the food sucks there, but Rep. Dennis Kucinich is suing four venders that supply the Congressional cafeteria because he bit into a sandwich wrap containing an unpitted olive, resulting in a cracked tooth for the Ohio Democrat. 

When asked whether he could confirm or comment on the suit, a spokesman with Kucinich, D-Ohio, told ABC News “no comment, sorry” and abruptly ended the phone call. 

A complaint filed in the Superior Court of the District of Columbia says Kucinich suffered “serious and permanent dental and oral injuries” in the incident and asserts that the tainted wrap was “unwholesome and unfit for human consumption, in that it was represented to contain pitted olives, yet unknown to plaintiff contained an unpitted olive.”

The complaint further states that Kucinich “could not visually detect” the unpitted olive prior to consumption. 

Kucinich, who ran for the Democratic nomination for president in 2008, bought the sandwich from the Longworth House Office Building cafeteria on April 17, 2008, according to the complaint. 

The complaint also says that Kucinich “sustained serious and permanent dental and oral injuries requiring multiple surgery and oral procedures”  and claims Kucinich has sustained other damages, “including significant pain, suffering and loss of enjoyment.”

Kucinich is seeking $150,000 in damages, plus interest and costs, from Restaurant Associates, which manages the cafeteria, and three other businesses that stock and help run the operation. 

Andrew Young, Kucinich’s lawyer who filed the suit, said that the firm – Nurenberg, Paris, Heller & McCarthy in Cleveland, Ohio - is not releasing any immediate comment except to say that this is a personal matter and that the firm does not want to have the case litigated in the press.

Years ago there was a similar case involving an unpitted olive / cracked tooth.
The plaintiff lost the case because the courts said the pit is natural to the olive and the company had implimented all the correct pitting processes.
Doesn’t Kucinich have anything better to do than sue vendor(s) over a freakin’ cracked tooth? It isnt have if he isnt being overcompensated with privileges and perks and lifetime benefits for doing much of anything.
Now I’m wondering if taxpayers will pick up the additional tab for his on-the-job injury.

I guess someone needs to point out to Rick McDaniel that he doesn’t know what he is talking about. All containers of whole olives are printed with a disclaimer that they may contain pits or pit fragments. If you are going to order an item with whole olives; you need to be careful.

What a baby……..I am embarrassed by him as this goes out on national news. He’s just such a “wonderful” example to us all. My husband lost his tooth from biting too hard on a pretzel. Didn’t realize that he could sue the pretzel company. We went and paid a dentist……..well, at least we can live with ourselves.

Wasn’t there mention of Frivolous Law Suits in the Presidents Speech last night? Yeah yeah, I know it was in regards to Medical Malpractice suits…. But couldn’t this be going down the same path? all I know is I was hit headon by a woman and broke my tooth off so that I had to have the tooth surgically removed and then the tooth next to it partially disentagrated and I had no transportation for my livelihood, the only transportation my husband and I have, lost $300 worth of groceries for a catering job the next day, was taken by ambulance to the hospital because I kept passing out sitting up, broke my glasses, broke my cell phone, black and blue from the neck down, oh yes and this was one week after I had had surgery. All I could get was 3000 for the tooth which wasn’t enough and I still have half a tooth giving me problems along with an empty space since I didn’t have enough to get a bridge or implant….and this fool wants 150,000 for an olive pit… Get real…if our wonderful congressional leaders had to pay social security, their insurance and have Obamacare instead of you and I paying high dollar for their medical bills along with every illegal person that walks also they get their paychecks for life, what a retirement plan, and they get to vote their own raises and take away from the elderly’s social security…get rid of ALL of them….they are destroying our country…….

This is the only time you ever hear about the congressman from Ohio because they want to slander his name. They do the same thing to Bono. Dennis is the one who should be US President, not that wanna be republican.
The dems and repubs wanted to remove dennis from office so the dems ran someone against him and dumped in all kinds of $$ to that race. The people of his district swamped the polls and reelected dennis by an enormous landslide margin. So now that Obama has marched with the right wing and the progressives stayed home from the 2010 race and let the repubs win congress, the reeps will now re-district dennis out of office. Unless you have had this happen to you, you have no idea of the pain involved in something like this! When it happened to me, I not only cracked ONE tooth but TWO, one on each side of my mouth! I also ended up with TMJ (displaced jaw) which causes me intense pain from time to time even after 15 years. Also the two teeth had to be capped which was NOT a pleasant experience and the color never matched the rest of my teeth. Now I have to have some extensive dental work done which is going to involve replacing the caps. If I had the chance to sue, I definitely would have and for a lot more than $150,000…Go Dennis!!!!!

What I would like to know is why a representative from the state of Ohio feels it necessary to sue while he has more than adequate insurance to cover dental expenses (more insurance than most of his contituents). Shame on you Kucinich!! And you don’t want the case litigated in the press… well it is!

I have a suggestion for the congressman,,,,,,,,,,,, BUTCH UP!!! I bit into a piece of pizza and had a woodchip cut through my dental work and had alot of complications then six years later same company bit into a piece with an olive pit in it. I went to the company and let them know what happened and they took proper steps to correct the problems.
Now, I’m a steel worker who has been laid of for almost two years.If I can understand that stupid lawsuits like these are clogging up our courts then I say BUTCH UP and let the company pay the fair price for your dental problem and move on.

I’ve eaten in the Longworth cafeteria and the food was pretty good, lots of variety. The congress-people are really spoiled with all the pampering. Kucinich IS a baby and one olive short of a pit, pardon the pun. I think he should be an example to all us little people and withdraw the frivolous lawsuit to show that he will be the first to start with tort reform. Oh, and it was a conspiracy by UFO’s that beamed the olive pit into his sandwich.

This is disgusting that a “public servant” is trying to get rich by suing like this. Clearly the 150K goes above his expenses. The most a busted tooth costs is 10K – that would be an almost understandable suit. I’m a physician who has had to pay for a broken tooth for a patient and it was 3K for an implant. This lawsuit is just an abuse of the system.
PS – the suit was likely delayed so it came after the elections, b/c he knew how swarmy he looks by doig this.

Who eats whole olives in a sandwich(wrap) anyway? For $150k a dentist could rebuild his whole mouth. Taxpayers take care of his coverage so why sue and if he feels the need to sue then why not just for the damages to cover his costs if he even had any. Can’t believe his lawyer took almost 3 years to decide on a suit, wonder if he’s the one who is needing money.

Was that part of a script or collectively do they actually not know any better?
Meanwhile thanks for linking the actual complaint. It clearly states that the $150,000 is the TOTAL mount of the lawsuit against ALL FOUR defendants and not the amount of the suit against jsut the cafeteria as the media is purporting. You may disagree with the lawsuit itself, but at least be accurate and honest in your criticism.

How sad to see a lawmaker set an example of courtroom resolution to a matter best reserved for civil business remedy. It’s this kind of thinking that diminishes the effectivess of the court system and causes the painful delays in the ‘due process.’ It would appear that this person has no friends or influence in the building that houses this business. How effective can someone be in a role that should be making good use of government? I suppose we’ll see zero support for malpractice limits that are driving our insurance costs through the roof.

I can’t legally marry my same sex partner, yet he is allowed to pull some assanign stunt like this? And why is it taking him 3 years? Has government work really deadened his nerve impulses that much?
