President Obama Issues “Signing Statement” Indicating He Won’t Abide by Provision in Budget Bill
In a statement issued Friday night, President Obama took issue with some provisions in the budget bill – and in one case simply says he will not abide by it.
Last week the White House and congressional Democrats and Republicans were involved in intense negotiations over not only the size of the budget for the remainder of the FY2011 budget, and spending cuts within that budget, but also several GOP “riders,” or policy provisions attached to the bill.
One rider – Section 2262 — de-funds certain White House adviser positions – or “czars.” The president in his signing statement declares that he will not abide by it.
“The President has well-established authority to supervise and oversee the executive branch, and to obtain advice in furtherance of this supervisory authority,” he wrote. “The President also has the prerogative to obtain advice that will assist him in carrying out his constitutional responsibilities, and do so not only from executive branch officials and employees outside the White House, but also from advisers within it. Legislative efforts that significantly impede the President's ability to exercise his supervisory and coordinating authorities or to obtain the views of the appropriate senior advisers violate the separation of powers by undermining the President's ability to exercise his constitutional responsibilities and take care that the laws be faithfully executed.”
Therefore, the president wrote, “the executive branch will construe section 2262 not to abrogate these Presidential prerogatives.”
In other words: we know what you wanted that provision to do, but we don’t think it’s constitutional, so we will interpret it differently than the way you meant it.
During his presidential campaign, then-Senator Obama was quite critical of the Bush administration’s uses of signing statements telling the Boston Globe in 2007 that the “problem” with the Bush administration “is that it has attached signing statements to legislation in an effort to change the meaning of the legislation, to avoid enforcing certain provisions of the legislation that the President does not like, and to raise implausible or dubious constitutional objections to the legislation.”
Then-Sen. Obama said he would “not use signing statements to nullify or undermine congressional instructions as enacted into law.”
The president said that no one "doubts that it is appropriate to use signing statements to protect a president's constitutional prerogatives; unfortunately, the Bush Administration has gone much further than that."
Another rider bans the use of federal funds to transfer detainees from Guantanamo to foreign countries unless certain conditions are met.
“Requiring the executive branch to certify to additional conditions would hinder the conduct of delicate negotiations with foreign countries and therefore the effort to conclude detainee transfers in accord with our national security,” the president wrote.
Another rider denies the ability of the Obama administration to prosecute Gitmo detainees in criminal court.
“The prosecution of terrorists in Federal court is a powerful tool in our efforts to protect the Nation and must be among the options available to us,” the president wrote. “Any attempt to deprive the executive branch of that tool undermines our Nation's counterterrorism efforts and has the potential to harm our national security.”
The president said in his statement he will work with Congress to repeal those provisions.

Oddly enough Jake, Politifact still rates Obama’s use of signing statements as a “compromise”. This makes the 6th time he has used them. I know, I fought with Politifact for 2 months over this issue.

I agree with the other posters, the fact that it was negotiated in the bill and he never said a word until after the fact is beyond what anyone else could dream of getting away with. I’m curious how many other MSM reporters will report on this.

Do we still need Congress? They appear to have been made irrelevant under Obama, as has the voice of the people. How long before we begin to hear “The Republic is dead, long live the King”?
The following corrective actions need be taken if the U.S. is to recover from the radical changes which began 100 years ago.
1. End the Federal Reserve as it currently exists, and nationalize it under total control of Congress.
2. Repeal the 16th and 17th amendments.
3. Apply term limits to all elected Federal House and Senate members, as well as pensions for elected Federal politicians.
4. Return control from Washington to the States, their governments, and their residents all functions currently overseen by the Federal government which is not explicitly authorized under the Constitution.
5. Reduce the salaries of Federal elected politicians while reducing the frequency of their convening proportionately, and related to necessity. (They should spend more time at home listening to their constituents which would reduce the funding requirement to run a reelection campaign, and place greater focus on their constituents rather than lobbyists.)
6. Reduce the size of the IRS and eliminate Federal income tax making the collection of taxes a duty of each individual State, to meet their needs and allow the Federal government to be funded proportionately based upon census by each State.
The last item would drastically reduce waste and corruption and eliminate redistribution of wealth by the Federal government. States have to be more accountable to their citizenry than does a disassociated Federal government which redistributes borrowed money using the entire population as collateral.
Freedom does not mean that everything is free, and while the Federal government may act as a provider, it does so only on the backs of the producers, who more often than not find their voices ignored once their taxes are collected by Washington.
It is highly unlikely that the citizens of all 50 states would simultaneously allow their government to act in ways that are seen as destructive and not make their voices heard, while the same is not so certain when control is exercised from a central government over which the people lose control immediately following each election.

Bush should have been impeached when he overstepped his authority likewise but Congress did nothing but sit on its butts when this happened. Will they continue to sit on them now? I am more proud of Barack Obama now than I was during those heady days of the campaign and the big win. Little did his enemies know of the true nature of this win, which was a victory for all who embrace peace, and justice for those simply want a better life.

Obama has just given the oil companies the biggest boon they have seen in years. With oil prices rising, Obama’s promise of a green future has failed.
How do we know that green future is a farce? The government has been forced to bailout green energy companies. These companies have not been able to exist without government intervention.

Here is Obama’s plan. To run, he needs money and lots of it. That means motivating his far left base. However, this kind of trickery alienates the Independents whom he MUST have to win in 2102. His plan is the move left to motivate the base to raise money, then once his base is all in, move back towards the middle to win any Independents stupid enough to believe him a second time by painting Republicans as “extremists”.
However, there is a reason so few Democrat Presidents have won re-election in the last 100 years. That is because they always run as moderates but then govern as liberals. America isn’t fooled the second time. This is the only plan Obama can really go with, but that doesn’t mean it will work. As a matter of fact, if history is a guide, it will not work.

Obama is not any different than Bush – and the next President will be the same. I can see this, I know this, and I’m not surprised when I read things like this article. What scares me more than anything are the comments like this one from LoyalDemocrat. What is wrong with people today? Our government is out of control, our Constitution is completely ignored and people like this are the REASON for it. You scare me.

Obama is not perfect, but it’s amazing the things right-wingers blame him for. First of all, the recession and the aftermath are the result of Bush and Clinton’s administrations. Obama was just left trying to clean up afterward. Second, Obama tried to have civilian trials for people at Gitmo, but Congress and the states made it almost impossible. Fuel costs have nothing to do with the president (domestic production increased last year) and everything to do with world supply and demand. I could go on, but most of you have already made up your mind based on Fox News.

States have to be more accountable to their citizenry than does a disassociated Federal government which redistributes borrowed money using the entire population as collateral.
Freedom does not mean that everything is free, and while the Federal government may act as a provider, it does so only on the backs of the producers, who more often than not find their voices ignored once their taxes are collected by Washington.
It is highly unlikely that the citizens of all 50 states would simultaneously allow their government to act in ways that are seen as destructive and not make their voices heard, while the same is not so certain when control is exercised from a central government over which the people lose control immediately following each election.”

Obama is not in Constitutional bounds in his refusal to abide by certain provisions of legislation he signed into law. Specifically, he out of the bounds of federalism, a principle upon which the Constitution is based.
The executive branch is Constitutionally bound to enforce existing legislation — until that legislation is ruled on in federal court.
For Obama to say that he will not abide by a certain provision in this bill is unconstitutional.
Furthermore, the executive branch is not supposed to interpret the law. Interpretation of the law is the courts’ domain.
If he wanted to challenge the provision in a Constitutional manner, he should have refused to sign the legislation.
If Congress defunds the czars, the matter should be a done deal according to the Constitution.

The “czars” are not advisors; they are people who are not vetted or confirmed by Congress given independent decision-making authority within the Executive. Why does a President need “czars”? After all, the President has a cabinet that in its totality covers the ground. Of course, in his 2+ years in office Obama has not even met half of his cabinet, much less had any cabinet meetings.
Nixon initiated the “czar” concept with his “drug czar”. The reasoning was that there was no department that could focus exclusively on the “war on drugs”, so he needed someone who would do so. It was a bad idea at the time and has only gotten worse since. The notion of an uncontrolled center of power within the executive branch is anathema to democracy.
But regardless of what anyone thinks about having “czars” in the executive branch, the real issue here is that Obama negotiated a deal and then promptly reneged, just as he wants to renege on his agreement at the end of 2010 to extend existing tax rates. No negotiations are possible with a man who will not keep his word.

The sad thing is the right wing crazies are only hurting the country and it’s obvious they don’t care. I’ve never sen a more shallow hypocritical bunch in my life. The unfortunate thing for most of them is that the Republican policies are very detrimental to them, but they are not astute enough to realize it. They are the lap dogs of the wealthy and will do their bidding. As for me, I wish President Obama would be somewhat less political and stick more to his core principles, but otherwise, I’m proud of our president and will work hard for him in 2012, especially with the worst list of presidential candidates lining up on the other side.

What is everyone thinking? Our federal, state and local governments don’t waste billions of dollars, they waste trillions. What are we thinking electing people to jobs because they are Democrate or Republican? That makes it a popularity contest. We give people like Obama, Bush and Clinton cushy high paying government jobs and they fail. Because they were not qualified applicants. Thats why they need czars. The president should be someone who could run a large business and turn a profit, period. That’s the job. Politics, politicians and the media have all of us worring about issues that keep us divided so we think we need to pick a side. There is a middle ground that works for everyone. We need people thinking on those terms running our government, not people trying to win popularity contest.

This administration has made it clear it supports selective enforcement of the law.
Naturally, that includes selective following of the law and, by extension, selective honoring of promises.
If Obama could not abide by the agreement, he should not have signed it.

Just who does he think he is that he can ignore an enacted funding law. The signing statement is a side issue, because he can not override Congress’ funding authority.
The Constitution of The United States. Article 1. Section 7. All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.
Separation of powers is at issue here. No president has the power or the authority to spend one red cent that has not been appropriated by Congress. These fools in Congress better not let him get away with this blatant usurpation of authority. They are allowing him to shred our constitution and all we can do is sit on the sidelines and watch because Boehner doesn’t have the stones to confront him.

When those czars’ functions broadly overlap the responsibilities of cabinet members, it is a big deal.
Congress has oversight on cabinet members, but they don’t for czars. It is one thing to have a “drug” czar, and quite another to have a “Energy and Environment Czar”. What role are they performing that the EPA and DO Energy do not?
It is sad to see some people justify Obama’s czars, when there is no justification. The cabinet is supposed to be the place for the executive to delegate power, not czars that have power but no accountability.

So to the president, if it is agreed on by your house and senate, then you should just bite the big one and abide by it, if you dont like it, you certainly are entitled to your own opinion and you are more than welcome to LEAVE the White House to those who sincerely care for this country and not just their own agendas.
