With Reservations, Obama Signs Act to Allow Detention of Citizens

In his last official act of business in 2011, President Barack Obama signed the National Defense Authorization Act from his vacation rental in Kailua, Hawaii. In a statement, the president said he did so with reservations about key provisions in the law — including a controversial component that would allow the military to indefinitely detain terror suspects, including American citizens arrested in the United States, without charge.
The legislation has drawn severe criticism from civil liberties groups, many Democrats, along with Republican presidential candidate Ron Paul, who called it “a slip into tyranny.” Recently two retired four-star Marine generals called on the president to veto the bill in a New York Times op-ed, deeming it “misguided and unnecessary.”
“Due process would be a thing of the past,” wrote Gens Charles C. Krulak and Joseph P. Hoar. “Current law empowers the military to detain people caught on the battlefield, but this provision would expand the battlefield to include the United States – and hand Osama bin Laden an unearned victory long after his well-earned demise.”
The president defended his action, writing that he signed the act, “chiefly because it authorizes funding for the defense of the United States and its interests abroad, crucial services for service members and their families, and vital national security programs that must be renewed.”
Senior administration officials, who asked not to be named, told ABC News, “The president strongly believes that to detain American citizens in military custody infinitely without trial, would be a break with our traditions and values as a nation, and wants to make sure that any type of authorization coming from congress, complies with our Constitution, our rules of war and any applicable laws.”
One official explained that President Obama does believe, however, that American citizens can be temporarily detained, and that the military has the right to capture and hold any citizen who is engaged in conflict against the United States. If various provisions in the law prove unworkable, the president could go back to Congress to ask for changes.
“The president is going to adhere to the policies that he has held over the last three years, making sure that none of these congressional provisions impede the ability of the counterterrorism and military professional from keeping the country safe,” the official said.

Nothing in the last four paragraphs of this article makes any sense whatsoever.
Haven’t we spent trillions of dollars and sacrificed thousands of lives for over two centuries to fight against this very thing?
I’ve always suspected that American politicans were jealous of, and lusted after the unbridled power of foreign dictators. I don’t suspect that anymore. I know it now.

Heartbreaking is what this is.
I am horrified and ashamed as a federal employee to see this happen. I swore the same oath as the president and all other federal civilians and military to protect this Nation and the Constitution of this United States of America.This act is in direct conflict with that oath.
How many of our citizens will be ‘disappeared’ before there is a public outcry? How long before a comment such as this is deemed ‘enough’ to indefinitely detain without charge? How long?

I used to support President Barack Hussein Obama, I really did, but with all due respect, really, “with reservations”? What does that mean, Barack Hussein, “with reservations,” what does that mean? Why don’t you just don’t sign it, Barack Hussein. I thought you had a problem with George W. Bush indefinitely detaining foreign terrorists caught on the battlefield smoking gun in hand, Barack Hussein. Even George W. Bush didn’t call for the indefinite detention of suspected terrorist United States citizens. Don’t you need a Constitutional Amendment to do something like that? You know, search and seizure, fair and speedy trial, due process, trial by jury, excessive bail… Bill of Rights 4-8! It is time we had a President who doesn’t ignore the Constitution. The article is wrong. The final bill excludes citizens and permanent residents from indefinite detention. People keep going by the bill the Senate passed, not the one that came out of conference.

While this is a terrible law that Congress passed…. and I am deeply disappointed that the President is signing it. Don’t fool yourself into think that Perry, Romney, Bachmann, Santorum, or Gingrich would have done it differently. The only candidate that might not sign something like this is Ron Paul, and the GOP establishment is hellbent on taking him apart with a pair of pliers. Honestly, we have been living under this kind of law for a decade now. Though, I am glad that Republicans are waking up to the grim implications of the Bush Administration and the legacy of their authoritarian inclinations. I always warned my Republican friends that they would live to regret supporting Bush policies…. that it was only a matter of time, probably in the context of partisan paranoia, and they would bristle at the laws they erected. Now, the time has come for them to sleep in the bed they have made for us all… and they are STILL too thick to see just what their legacy is. The same people who froth at the ACLU for being unamerican are now parroting the very arguments that the ACLU has been making for years…. The same people that oppose “liberal” judges for being soft on terror and crime…. The same people that lecture everyone on the Constitution while blaming Obama for Legislative acts that originate in Congress…. For the last month I have been posting ndaa 1031 indefinite detention without
trial. There is C-span video of this debate, human rights watch, ACLU,and the list goes
on. If he was not for it, all he had to do would be VETO IT. HE signed it. Story over,
just like most of our rights. And in the New Year his EPA will start it’s war on American
business. Anyone doubting this should Google EPA and Portland cement. I have seen
enough of this already, this man needs to go!

Voters who want wars, torture, assassinations, “humanitarian” bombings in oil rich countries, indefinite detentions, drone attacks that kill the innocent, erosion of civil liberties, domestic war on the people (drug war), out-of-control debt and spending, graft and greed, crony capitalism, pandering to special interests, bailouts, more of the same, must NOT vote for Ron Paul.
Voters who want peace, a humane foreign policy, restoration of civil liberties, an end to the war on drugs, sound money, balanced budgets, honesty, integrity and transparency in government, and a President wholly committed to Constitutional government can vote for Ron Paul.

Abraham Lincoln was the first President to have the military detain U.S. citizens indefinitely. Even before he invaded Virginia in 1861, Lincoln arrested at night and at home a number of Maryland Legislators, including the grandson of Francis Scott Key. Lincoln imprisoned Key’s grandson for 9 months in Fort McHenry, where Key earlier had written the National Anthem.
Before Lincoln’s Tax War for his Wall Street cronies was over, an estimated 30,000 Northerners were imprisoned and 300 Northern newspapers closed down by the military, because they opposed the War.
Lincoln even went so far as to order the arrest of the Chief Justice of the U.S. Supreme Court, because the Court ruled Lincoln’s arrests were unconstitutional.

Look to see WHO in the House and Senate supported it, regardless of party, and oppose them.
The article mentions that the ONLY presidential candidate to oppose this was Ron Paul. He has done so on principle, consistently, for decades. Whoever calls him “crazy”, “extremist”, “nutjob”, etc, is a liar, a fool, or both, and just got their rear end handed to them by the undeniable facts of reality.

Obama took the easy way out, chucking our civil liberties with it. Unbelievable really. And the signing sta tement is a lame cop out. He could have taken a stand and gotten his way quickly and it would have been a good stand. He was trumpeting the competency of our civil police and criminal justice system which is very adequate and does exchange intelligence with all agencys. Now he did this. We are on our own.

the president can do this to individual citizens, yet the Supreme Court says he can’t stop corporations from financing election campaigns (which could include foreign countries). To do that we need a constitutional amendment. Ok, it’s time for a constitutional amendment then.

Obama needs to be impeached and tried for treason…along with any and all representatives who signed this bill. What part of due process of law do you not understand?The constitution applies TO ALL PEOPLE IN THE USA, CITIZEN OR NOT!! A direct violation of the bill of rights. VOTE THEM OUT!! Ron Paul is the only candidate who would have stopped this and will get it repealed. Ron Paul is the ONLY one that can be trusted to follow the constitution, because he always has.

only believe that while reporting this, that it goes away like most news stories
and what a better time than New Years Eve to play a story when most people

When is America going to finally wake up and realize that the two paradigm is a set up and is used on purpose to divide and conquer the American people while the real agenda is pushed along by both parties regardless of affiliation. For those saying the bill exempts american suspects from indefinite detainment w/out charge – you. Are wrong – the wording is, “citizens are exempt from this requirement” referring to military’s requirement to detain suspects. All this means is, by law, the military is not required to detain citizens. This means, by simple logic, american citizens may and will be detained by military if the military decides it is in their interests…a sad day for us all. Please vote Ron Paul. Even if you disagree with every other thing he says, there may not be much left to fight about if we don’t save our individual liberty.

This is exactly why we need to elect Ron Paul. Even if you disagree with him on some things, Ron Paul is the ONLY candidate who opposes this. He is also the only candidate who opposes strip searches of Jewish grandmothers by the TSA. If you want to continue down this path then re-elect Obama or elect Romney or Newt and nothing will change. I say if the republicans hate him, the demacrats hate him, the mainstream media hates him and the corporations hate him then he must be good for us. As a Repub, I can’t stand the GOP’s thirst for war. Its so easy to send someone else’s son, daughter, brother, sister to go fight and possibly die and I find their act despicable.

Regarding the couple of 20 year old articles from 20 year old newsletters. Look at Ron Paul’s voting record, videos, audio recordings, books, articles, the thousands of pages of material this guy has generated over his LIFETIME. NOTHING, not one thing has Ron Paul ever said that is racist, sexist, or any other -ist. He has with others, and more often alone, fought to defend EVERYONE’S right to freedom. Black, White, Hispanic, Asian, etc. . . He believes that everyone should be treated equally under our Constitution.
But if the 20 year old articles is a hang-up,one simple thought: If you had terminal cancer and there was a doctor who could save your life would you say, “Nope, I will not accept your help because someone who you were acquainted with wrote some derogatory statements 20 years ago”?
I wouldn’t.

When this country is in a full blown totalitarian rule and We the People are in ruins, I will remind you of how important Ron Paul was as I crawl past you. People don’t understand why Ron Paul supporters are almost fanatical to a fault about their candidate. It’s certainly not because of his charisma (although he does have a grandfatherly charm to him), and it”s not because he’s young and dashing. It’s for sure not because the media is covering him fawningly.
It’s because our country has been hijacked by conglomerates that own virtually every mainstream media network, and he is the only national figure calling them out on it every step of the way. They are so desperately afraid of a Ron Paul presidency that they are throwing everything they have at him. The left is claiming he is a homophobe, while the right decry that he would not interfere with a state’s right to approve gay marriage. The right decry that he would end the racist “War on Drugs”, while the left claims that because of 10 lines in a newsletter with his name on it that was not written by him and has been disavowed completely by him in addition to bearing some moral responsibility for them, he is a racist. The Democrats hate him. The Republicans hate him. The corporations hate him. The establishment media hates him. They all freaking come unglued when it comes to him. Why? He makes them look like the hypocritical frauds each and every one of them are. Yes, the left and right hate each other, and yes, they fight over who gets control of the trough, but someone like Paul, who wants to drain the swamp, has them lock-and-step in arms united against him. Doesn’t this tell you anything?!?
Some of you agree with him on everything except his foreign policy, thinking he is a pacifist, think again. President Paul would be the most ruthless President this country ever had as Commander-in-Chief. If Congress declared war, Paul would unleash the full military power of the United States, go to war, fight the war, and win it and “get it over with” in his own words. No nation building or propping up puppet dictator governments. And a message would be sent to the rest of the world not to mess with us.
Ron Paul is the most incorruptible politician in modern American history. For the first time since Robert F. Kennedy was assassinated in Los Angeles, We the People have someone we can trust to enter the White House and act like the adult and leader that this country needs so badly, owned by NOBODY. There will never, ever, ever, EVER be another Ron Paul. I beg anyone on the fence to spend two hours on YouTube watching Ron Paul videos straight from the man’s mouth himself. Love him or hate him, you must admit that Ron Paul has already won in the sense that his ideas have become mainstream. The establishment is panicking, and deservedly so, because if Paul becomes the President, We the People will finally realize that we have been lied to and deceived by the criminals and shysters in D.C. and the establishment media was complicit in the lie the entire time. Most astounding thing about this entire NDAA stuff is that I would have never known or even cared to research it. If it wasn’t for Ron Paul vids on youtube and Rand Paul fighting it in the senate! As a Democrat voted against Bush mostly because of us flipping the rest of the world off and then passing acts like the Patriot act which like everything in Government would have been abused. If Ron Paul has done nothing else he has made me look at the freedoms that we have in this country, and on a more off topic rant the educational system that has most of us slaved for 50,000 dollars plus. With reservations? That’s rich. I wonder if I could get away with that. “Yeah, I murdered 15 people, but I did it with reservations. So it’s all good.” What kind of BS is that? ABC has zero journalistic integrity. Part of what makes the news so dangerous is that they completely ignore some huge stories, like the Federal Reserve spending $16 trillion dollars in complete secret in 2008, while the Congress passed a $700 billion bailout bill. What’s perhaps even more dangerous is to report horrendous news like this, but act like it’s no big deal, because it was done “with reservations”. I don’t care what the Congress or the President’s mood was like when this stuff passed. I care that it shouldn’t have ever passed.

This article is just wrong, incorrect, mistaken. There is no right given to arrest and detain US citizens without trial.
Quoted from the bill “(e) Authorities- Nothing in this section shall be construed to affect existing law or authorities, relating to the detention of United States citizens, lawful resident aliens of the United States or any other persons who are captured or arrested in the United States.”
Meaning you have you have all the rights and protections you always had. Calm down people. And ABC needs to do some research before they write a story.

The NDAA is the single worst piece of legislation passed in American history.
The Republican House, Democratic Senate and Barack Obama have just “reached across the aisle” to annihilate any remaining semblance of liberty and justice in this country. And of course, like the Federal Reserve Act and every other nakedly fascist bill before it, the NDAA was passed over the holidays. What could they be afraid of?
My compliments for finally mentioning the NDAA, ABC! I know you’ve been too busy tearing Ron Paul apart limb-to-limb to even *question* the actions of the House, Senate and Obama in this assault on American citizens, but better late than never.

Both parties are at fault for this disaster of a bill. Don’t be fooled, they knew what they were voting in and President Obama knew what he was signing. I don’t want to hear about his ‘reservations’, he was not forced to sign this act, he did so willingly. Now he just has to save face because he is up for re-election. I am not placing the blame solely on him, as I stated, the Republican party is as much at fault for this as well.
I hope that my fellow Americans are now awake enough to realize that we cannot keep voting for these establishment, treasonous criminals. Although the Left and Right hate each other and fight for the right to retain power, they also work together to keep us under their control by stripping us of our liberties.
Please understand that those of us who so passionately support Ron Paul, do so because we have thoroughly researched this man and see him as the only politician who is willing to put the American citizens interests before special interests. He is the only one who’s 20+ yr record has proven that he wants us to remain a free and prosperous people. I am not asking anyone to take my word for this. Please research Ron Paul for yourselves. The media and the establishment politicians on both sides hate him because he is a threat to their power and their bank accounts. I already support Paul, but I can now say without a shadow of a doubt that if you are voting for any GOP candidate or were a believer in the change Obama preached about, send him and the establishment a strong message.
Register now in your respective states as a republican and vote Paul in the primaries. Do not for one second believe any other GOP candidate would restore our civil liberties, freedom and rights… Paul has been warning about our road to ruin for 30 years, as far as I’m concerned Osama won, and we lost. The media constantly cast aspersions on Ron Paul’s claims about having never read the offensive newsletters that were published under his name.
The ironic thing is that 95% of House and Senate members DO NOT READ THE BILLS THEY PASS, but are not called to task for this. Ron Paul even wrote a bill that would mandate a certain time period between the introduction of a bill and its vote so that, you know, more than he and five other Congressmen might actually read it.

The MSM has not been saying much about this bill for a couple of months. The original Senate Bill part to include indefinite detention of American Citizens was introduced by Sen. John McCain (R) and Sen. Carl Levin(D) behind closed doors. There was a little amount of debate about changing the language in the final bill, but it was reported the White House would NOT sign the Bill WITHOUT the Detention clause. A veto meant no money to continue our current war strategy, so the final Bill passed easily. Only ONE candidate for President has been outspoken about this Bill because it is a CLEAR VIOLATION OF OUR CONSTITUTION. That candidate is RON PAUL.

We desperately need to send a message to both parties – by supporting Ron Paul. THE MAJORITY OF BOTH parties signed this into law.
And they repeat over and over that Ron Paul is dangerous? He is only dangerous if the Constitution and rule of law is dangerous. He IS dangerous to the establishment tyrants who support this.
Change your registration now and vote for him in the primaries. At the very least it would put pressure on Obama to move toward peace and civil liberties. Romney, Gingrich, Santorum, Perry will all move Obama toward more wars and police state policies.

I understand that people have concerns about Ron Paul being racist and homophobic, but when the current president and other GOP candidates approve defense acts like this I, in all honesty, think stuff like his newsletters should take a back seat. If Ron Paul turns out to be a racist, I’d rather have a racist President that would end the war on drugs and free non-violent black drug offenders from prison instead of a non-prejudiced president that allows for indefinite detention of Americans without lawyer or trial.

The reservations are the places where people will end up who dare find fault with the state, or associate with people who do, or give them the time of day, or look sneaky.
The Constitution is very clear. The congress only has the power to instigate suspension of Habeas Corpus, and only during times of invasion or insurrection. Recently the New York Times asked the presidential candidates about the power they believe the president has. Only Ron Paul cited the Constitution’s rule about suspension of Habeas Corpus. Obama declined to answer.

NOTE WELL. Obama objected when the senate removed the language which would exempt US citizens. Last I heard, they had not put it back in.
It is a red herring anyway. “First they came for the foreigners.” Mr. Obama, the “Constitutional scholar” should know that the organic laws of this country say “all men are created equal,” and that the rights which the Constitution specifically bars the government from abrogating belong to all, not only US citizens. Before the passage of the 14th amendment there WERE no US citizens, only citizens of the several States.

The fact is Ron Paul has a 30 year record of upholding individual freedom, rights, liberty, based on the Constitution. He opposes the corrupt over-powered Federal government with things like the privacy invasion of the TSA, the evil Patriot Act, the 4th amendment killing NDAA bill, the internet censorship bill SOPA, the racist and corrupt War on Drugs, and the unjust wars in the middle east.

Meredith you are wrong. The paragraph excluding US citizens does preclude the military from detaining US citizens but rather removes the requirement that they MUST be detained by the military. If you read it (the stuff signed by the President) you will find that this citizen provision merely allows the President to make the determination as to whether someone originally taken can be tried in civilian OR military court whereas a non-citizen MUST be tried by the military court.
“The requirement to detain a person in military custody under this section does not extend to citizens of the United States.” -NDAA signed by Obama
The NDAA REQUIRES that the military detain persons. the citizen paragraph gives them the flexibility to send civilians to regular courts IF THEY WANT TO!

Couple this new NDAA Act that the President tyrannously signed into law with the “domestic terrorist” list that the Dept of Homeland Security has been compiling since 2009 and folks…we have a problem. YOU could be arrested WITHOUT any rights, hauled off, and never heard from again, WITHOUT a trial if the Government feels that you’re a threat for such heinous violations as:

Eva Gold,3;04 AM. I did not vote for Obama mainly because he has never done anything to convince me that he was ready to run this country especially during hard times. Many people did. Some were just swept away with his empty speeches and some thought he was sincere. Now that we the people have found out what this is all about hopefully these people will not be suckered in again. Lets not blame the ones that put him in office but now that they see the proof lets hope they don’t make the same mistake twice. This is a serious situation and if we do have another election it needs to be shut down. Ron Paul looks like the only choice to do that.

I was listening to C-SPAN the other morning and they had senator Tom Harkin from Iowa on. There were a few different people who called in and reamed him out about this bill. His explanation was that the supreme court had said it was constitutional after Roosevelt had arrested German conspirators (some US citizens) in the usa during WWII, because they were supposedly planning to blow up US infrastructure.
I wanted to tell Mr Harkin, the difference between now and 1943 is that, that was a “Declared War” by congress, against a sovereign country. Not an unwinnable war against a form of strategy (terrorism). Thus the difference being that this time it is a never ending war!!
These politicians know that if Americans really knew what they were doing that we would never go for it, but they depend on our ignorance to keep pushing through their police state agenda.
I hate to say it, but 90% of americans have no clue what the NDAA is, or what it did, and that is something that we need to change. We need to change the ignorance of our population when it comes to political matters, or else we are all doomed.

I disagree with the method and message of OWS, but I believe that should be able to peacefully assemble and they should be able to address the government with a list of their grievances. Did any of you commenting here actually read the final Bill HR 1540 (not previous versions or senate versions, but the final version signed by Obama) and the president’s signing statements? Clearly you didn’t. You’re all reacting to this sloppy ABC piece and nonsense repeated by the uninformed. If you’d read the final version, those of you harping about Section 1031, would know that the former section 1031, regarding detainees, is now Section 1021. In the final version, 1031 is about the Defense Secretary’s requirement to brief congressional defense committees.
Subtitle D Counterterrorism, starts with Section 1021, which primarily codifies authorities grated to the executive branch and the military in the Authorization for Use of Military Force, passed in 200, under Bush. Let me repeat that – Passed in 2001 under Bush. Obama’s signing statement about this section reads “This section breaks no new ground and is unnecessary. The authority it describes was included in the 2001 AUMF, as recognized by the Supreme Court and confirmed through lower court decisions since then. Two critical limitations in section 1021 confirm that it solely codifies established authorities.” For those of you who need help with translation, than means “Nothing New Here”.
For those claiming “No one is speaking about this. No one is against this but Ron Paul. Obama forced this provision on congress… blah blah blah. Read Representative Henry Waxman’s statement on HR 1540, where he says “I commend President Obama for insisting on a number of changes, including a prohibition on military detention of U.S. citizens and lawful residents, the removal of language that would have banned the use of civilian courts to prosecute Qaeda suspects…” Also read up on Diane Feinstein’s attempts to pass amendments to absolutely exclude US Citizens from these provisions, ending with the compromise to include in section 1021 paragraph (e) AUTHORITIES.—Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States.”

This isn’t really a stretch: if you don’t want to be held indefinitely, don’t engage in terrorism. This is far more humane that what I would do to terrorists. It’s far better than they deserve.
And I am so sick of hearing Ron Paul’s name that I would NEVER vote for him. I would vote for David Duke if it meant preventing me from having to hear his name every day of my life for 4 more years. Obama, Holder, and Napalitano are already referring to the Tea Party as “terrorists” DoHS put out a report a year or so ago that anyone with a Ron Paul sticker on their car might be a terrorist, or someone opposed to abortion, or someone that supports the NRA.
This bill is not good. Our founders never intended for the federal government to have this kind of power. The even wrote a document called the Constitution to prevent them from having it, yet our politicians today do not care about this document.

And those of us who cried foul then were labeled “traitors” and “terrorists” by the same short-sighted folks whining about this bill now. Research the history of the bill, Obama’s efforts to eliminate and temper the totalitarian provisions and his signing statement. The act was signed because of the abundance of positive necessary measures it contains, and the totalitarian portions pushed by McCain and congressional republicans were hobbled enough to be dealt with. Hopefully, the administration will be able to get those eliminated permanently or diffused in the courts before we have another republican in the WH declaring war on “anybody we don’t like at the moment”

You might want to research this a little more. The President’s main role was to take the decisions regarding indefinite detainment out of the hands of the (unelected) military.

It’s about time that we do something about the nut jobs we have let into this country. The nut jobs that come in from Mexico and Canada need to be picked up we all know it. This is a good step to defending this country from people the government have let in and now regret it. I can only think this is a good solution for many years of protecting criminals that only want to destroy this country. This is a good start but more needs to be done, public hangings should follow for the guilty. Death penalty for lessor crimes should follow and have it completed within a resonable time not ten years.

i do not think taking law into our own hands is a good idea, please don’t do this. is this bill a good idea? hell no. i am also what you might consider being part of the left and i wish more people would realize that these ideas that the right and the left differ so greatly are mostly created by the political media. i absolutely oppose this bill and really hope that someone defeats it by calling it into question. this is very bad people. we need to defeat sh*t like this by banding together, not splitting our differences. i’m pretty sure most people want to have the freedoms promised them by the constitution and the bill of rights, right or left. this bill is an attack on those rights.

Who writes this stuff? The bill does not authorize detention of US Citizens. READ THE BILL, YOU IDIOTS. It states clearly, if not buried deep therein, that the provisions for detention do not apply to US Citizens or permanent residents, and it doesn’t even apply in the USA. We’re $15 trillion in debt, people are losing their houses while big banks are being bailed out, the REAL unemployment rate is closer to 20% than it is to 10%, we have troops stationed in over 900 military bases in over 120 different countries, the government is promising entitlements from cradle to grave when they know there is no money for it, the central bank prints our money like a counterfeiter with someone else’s checkbook, all I hear on tv is “global financial collapse” and the president thinks it’s okey dokey for him… or any president after him… to indefinitely detain or assassinate American citizens without a trial. But don’t worry because we’re having an election…except that the only man on stage who would put a stop to this madness is the one considered a kooky, unelectable racist homophobe. This is right out of the Hitler playbook… go check it out. We had a Reichstag Fire (9/11), and an Enabling Act (Patriot Act), the removal of church/religion from the public square, the SS (Homeland Security), and let’s not forget concentration camps (FEMA camps). I could go on, but most people don’t give a damn. They think it could never happen here. Guess what… it IS happening here. They label us as conspiracy theorists, but you can verify all of this stuff on the web…well, until Obama signs the SOPA bill giving him control over the internet.

It is no coincidence that this comes as the Occupy Movement has refused to go away. Timing is everything. SUSAN, if you’re worried about Ron Paul’s opposition of Civil Rights legislation, take a look at what Walter Williams say about the subject. You can get a good idea on it if you Google Walter Williams and his opinion of Rand Paul’s comments on the Civil Rights Act. Basically, What Dr. Williams says is that under the Constitution, our federal government has no legal authority to prevent discrimination. He goes in to several eloquent examples of socially acceptable discriminatory acts practiced even today, and follows through with the idea that, with with government’s intervention of forced integration, it has actually hindered voluntary integration.
That is also Ron Paul’s position. Ron Paul believes that if we had just allowed the free market to work, businesses that discriminated based on race, religion, sexual orientation, etc, the market would have punished those establishments and we wouldn’t have the bitterness we have today over things like affirmative action, which, by the way, Walter Williams is against.
I disagreed with a few of Dr. Paul’s positions when I first learned of him, but on those issues, I looked in to why he believes what he believes and found that I had to change my mind on several of them.
A vote for Ron Paul is not voting for the lesser of two evils. It is a vote for an honest man with more credibility than any politician I’ve seen in my lifetime.

I want the press to put the pressure on this issue. the military better have some real evidence against a person before they lock someone up indefinitely. This is the Constitution! This is the LAW. This is not merely “tradition.” This is the founding document of our country, the one that acknowledges that our rights come NOT from government (which WE created), but from our Creator (God, for those who need it spelled out), by virtue of our birth. We have these rights exclusive of any government. What the Constitution does is GUARANTEE those rights (that we already possess). They are “inalienable.” That means that they can’t be taken away. No matter how many illegal (unconstitutional) laws this federal government passes, WE THE PEOPLE are sovereign OVER our government, which is the servant of the PEOPLE (not the other way around). Anyone attempting to arrest or detain us without a proper and legal warrant is themselves the “enemy combatant,” and should be treated as such. Obama has (once more) violated his Oath of Office, violated the Constitution, and committed treason against this country, as did every Senator and Representative who voted for this “Obamination.” The states should ignore this “law” (nullification). Everyone who voted to pass this bill, and the president who signed it should all be voted out at the next election, and charges should be strongly considered against them.

(b) Covered Persons- A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

This is astounding in its implications. The mere allegation of a belligerent act, or having “aided” the interests of Al-Qaeda is enough to hold an American citizen incommunicado and without review, over-site or trial (!) until ‘The end of hostilities.”
The treasonous danger here is not from Al-Qaeda supporters, but from our government that has clearly “suspended” the Constitution out of senseless, feigned, necessity.

To “Jim” and others that claim this bill does not apply to American Citizens: YOU ARE CLEARLY WRONG. You are reading from Section 1022 (which has NO IMPACT on Section 1021.) This does not cover its preceding section, 1021.
Section 1022 was modified in the enrolled bill to distract the citizenry into misunderstanding legislative sectional provisioning. The devil is within the details of Section 1021. This does, in fact, grant the authority, by mere allegation, for unlimited detainment and even rendition of U.S. Citizenry to foreign countries!
Section 1021(c) (4) Transfer to the custody or control of the person’s country of origin, any other foreign country, or any other foreign entity.
(Further from the protections of our Constitution. ) Our government clearly is out of control.

For all you people who are frightened I hope this motivates you to take a serious look at Ron Paul and disregard the media smears. I have only started supporting him in the last 6 months and I understand why people are so passionate about him. He is the only one who cares about our liberties and taking care the American people’s problems first here at home. In my lifetime I always questioned and am extremely frustrated with the fact that we give our money to everyone else and ignore our own people’s needs. We pay our taxes and the government does nothing to ease the problems we have at home. It is not isolationist to take care of our country first with our hard earned money and then help others if we can. That is Ron Paul’s policy. Please check him out in this own words. He is not a kook. He is and honorable man who seems kind of mild mannered (not your usual extroverted b.s-ing politician) but would fiercely defend our country from any credible threat without taking away the freedom of the people. He is 100% in believing in the sovereignty of nations (including Israel) and thinks that each nation should be able to make their own decisions regarding their defense without having to get other nations or the U.N. approval. I am a staunch supporter of President Obama, but this will doubtless go down in history as his greatest, and most serious, mistake. I can in no way justify this action. He should have vetoed the bill. My father’s cousin’s wife spent part of her childhood in Tule Lake, for the “crime” of having Japanese ancestry. This opens the door for this to happen, again, in the United States. I fear, with this legislation, Obama has handed a future president the tool for the country’s destruction. I can only hope this was a political maneuver designed to pull the issue into the Supreme Court, where, one hopes, it would be rendered unconstitutional. Regardless, it is a slap int he face to Obama’s supporters.

How anyone with a conscience could continue to support Obama after this signature is beyond me! Furthermore, the Senators and Representatives who voted for it deserve their chance to stand up and be recognized for their part in this. What does the Constitution allow for traitors? Anyone with an approval vote or signature on this bill (that’s all it is to me) deserves that fate. We’re soon approaching the day when we can vote out these traitors and vote in people who will stand up for the People and the Constitution.

I would like to address a couple of things.
1. There were many posts here saying that American people were excluded in the final version of this bill. This is FALSE! I had seen it stated on several news sources that they ARE included.
2. Anyone who believes that any of the other candidates running for President would not have signed this, You are fooling yourselves.
There is only one man who for the past 40years has been fighting to keep all of your liberties intact, to try to keep congress in check, and limit the size and scope of government.

This is an outrage. There is no excuse for this violation of citizens rights under the constitution of the USA. What has this country turned into. This gives the military police powers. The USA seems to be turning into a military dictatorship. Why do citizens elect people to the congress who write and pass such legislation. There was not excuse for your president to sign this. He could have rejected it and then congress would have to pass this without the part that eliminates all citizens rights. It does not matter whether you are innocent or guilty, all they have to do is say Suspect – and you disappear forever. People of the USA you had better pay more attention to what your government is doing. This legislation is unconstitutional and illegal, yet you do nothing to protect what few rights you have left.

Article 1, Section 8, Clause 15 says it is the job of the Militia, who’s officers are appointed by the States, that is authorized to suppress Insurrections. The military has no authority to “cross the Rubicon”. This is especially troublesome to Army officers and men who would be following illegal orders of a tyrant acting under color of law (if such a thing was to happen in the future).

What about the people who are surrounded by danger everyday that are not affiliated with the army? Some of us have never been in the army but we all see the possible car bombs and the dead birds fallling out of the sky probably caused by carbon monoxide poison! Our fellow citizens who have been involved in terrifying car accidents or lost a loved one due to a tragic accident have not had peace since the sad day especially if they live or travel by foot because they do not want to take a chance being in or causing an accident theirself have feelings of fear, devastation, feelings of being invaded by these monsterous killer cars that are slowly and almost invisibly taking our childrens fresh clean air . I feel we should all have a nature type trail , a safe haven , a safe path to school helping the plan of new jobs that the whole world will benefit from out of all the missing children in the wiorld how many of them were driven away, windows up, doors locked, music blaring and no way for anyone out of the car to here the child screaming in fear for their life I wonder how many cars can be called crime partner and no body suspends the driving of the cars that have ruined so many peaceful low stress days and are noise polluting and gross polluting the entire world !!! we need to worry about that we should have made sure our silent night was this last CHRISTMAS MAYbE GOD WOULD OF HAD MORE MERCY ON OUR SOULS AND MADE SURE THE CAR SALES AND PRE MATURE DEATHS started decreasing in stead of increasing carbon monoxide is worst than a bomb here in Fresno and every road is a fire hazard along with most garages full of flammable paints car cleaners and the kitchens with gas stoves that are usually attached to the garages where is our special privledges?

I am saddened with the poor quality of the debate ensuing from such an important piece of legislation. Much of the banter matches what one would hear from drunken opponents after listening to a Sean Hannity Radio Hour. It seems that our friends on the right have set the bar for a successful presidency at the number of times a president visits a war memorial. Sadly, my friends on the left wish to argue the point.
As someone who supported, donated to the campaign and voted for Barack Obama, I did so as a response to 8 years of disastrous military and economic policy characterized with eroding civil liberties under George W. Bush. I wanted change. Substantial change. More change than that offered by Hillary Clinton. John McCain, as with most nominated Republican national candidates, offered very little “change.” They tend to represent the interests of those that presently have great wealth, power or position. If “change’ comes about, then a Republican constituent likely loses something vis a vie a replacement policy or technology. The durational length of their physical capital or political power is shortened by competitive or intellectual change. Someone new or something new replaces that which is established. That very simply explains why the Republican Party is so often identified with ‘no”. “No” means . . . “no change from the status quo.” However, the world is moving forward. With or without the U.S. The ramifications of 8 misdirected years followed by 3 years of President Obama’s weak and reactive amelioration has left this country rudderless. As of January, 2012, only a fool could call this an American Century. The treasury has been squandered on two wars that failed to explain themselves. The recent end of Bush’s Folly has quietly passed without the citizenry offering ticker tape. The end of great wars are usually celebrated by the victors. The silence of the policy makers and even the 3 star generals that mismanaged the U.S. military presence in Iraq, show that even the “flag waving” neocon patriots can’t put lipstick to this pig.
Where do we go from here? President Obama having saved the country from eminent economic disaster and having put an end to the Iraq adventure, has failed to provide the direction “out of the bag.’ His willingness to continually compromise on issues of substantive philosophical importance shows that he really does not have a vision of the future and a plan to get us there. I believe that 4 more years of directionless leadership will seal the fate of this great country for the next 50 years.
That said, we are still faced with the prospect that the 2012 presidential election has a long way to go to reach even a level of modest mediocrity among the various existing choices. I prefer my presidents to be at the ethical level of a Washington, the intellectual level of a Jefferson, the stamina for the good fight of a Teddy Roosevelt and the crisis leadership of an FDR. I guess it’s not happening. As of now, there is not a single announced candidate that I can support.
The biggest impact on the election of 2012 is not here yet. I believe that the possibilities for a very noisy and potentially violent uprising from within the citizenry next spring to redirect the focus of the nation and perhaps a new and as yet unannounced candidate to come forth. One can only hope the the heavily tranquillized populace may rise to the occasion. Who was it that said, “A nation gets the government it deserves.”?

The ethical level of Washington – Dr. Paul has been unwavering in his beliefs since the first day he held office. He has more lone “No” votes than all other representatives… possibly combined. He is a family man, having been married for 54 years to the same woman.
The intellectual level of a Jefferson – Dr. Paul is often referred to as the Thomas Jefferson of our time. He accurately predicted the housing market crash years before it happened. At a time when most economic scholars were praising the housing market and the opportunities it was creating for the middle class, Ron Paul was tell us that the housing bubble would eventually help to shrink the middle class when the bubble bursts.
The stamina for the good fight of a Teddy Roosevelt – Ron Paul has been fighting the good fight for 12 congressional terms. He has held steadfast and unwavering in his message of prosperity through peace, a thriving economy through sound money and maximum liberty for all Americans.
The crisis leadership of an FDR – I’m no fan of FDR, but Ron Paul calls for though changes to get our economy back on track. We got ourselves in to this mess by borrowing too much, spending too much, and removing too many of our personal liberties. Honestly, our current mess is an exact parallel of the FDR administration. More government, more borrowing and more spending will make the problem worse. History is clear on that. Ron Paul calls for a $1 trillion cut in federal spending during his first year as president. He plans to balance the budget by his 3rd year. That’s crisis leadership.
Search for the video titled “The Two-Minute Case for Ron Paul” to start with. I think if you give him a chance, you’ll find that he’s exactly what you’ve been looking for.

A good President would be sure to retain some power for his part of the Executive Branch. Take back the power from the military Kennedy’s assassination. I feel ashamed for supporting this man back in 2008. The signing of this bill was the last straw for me. I’m done supporting him. His rhetoric from 2007-2008 didn’t mean a thing, very disappointing. I have defended him from the moment he was President elect and Republicans were against him on every single thing then, but this is indefensible. His “reservations” about this bill apparently wasn’t enough for him to NOT put pen to paper. I keep hearing and reading “Ron Paul 2012, Ron Paul 2012″ as being the answer and the “savior” America needs. Yet, to me that sounds eerily similar to the song people (including myself) were singing in 2008 with Obama. Until there’s a real systematic change in Washington (removal of monetary influence in politics among others), there will be very few politicians whose rhetoric will impress or persuade me. Right now, I cannot place my support with any of the candidates. But at least Ron Paul has some comprehension that much of the world doesn’t like us because of our meddling, and not for our perceived democracy and wanning freedoms.
Spot on, R.R. Richmond, Obama is too weak, too compromising, and really things are no different than when Bush was President, if not worse on some things. I’m mean, seriously Obama appointed much of the same people for his “economic team” (Geithner, Summers, etc) that bailed out the banks in 2008 with no one held accountable, and with some of them being able to prevent it. Now this. It’s been disappointing. And the Republicans appear to be completely out of touch with actual Americans (those of us who are not exceedingly wealthy) and have an insatiable appetite for war. The big deal is that no one should have the power to detain a person, especially an American citizen, without charging them with a crime and a quick trial. The detainee has a right to dispute the charges and face their accuser. Have you never heard of Habeas Corpus?
Article 1 Section 9 of the US Constitution says “The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”
We are not in a rebellion or invasion. Perhaps think of it in the criteria of what justifies someone being deemed a terrorist suspect.
- Visiting the wrong web site
- Donating to the wrong front group that happens to have hidden ties with a terrorist organization
- Being a Tea Party or Occupy activist
- Paying hotels in cash instead of credit cards
- Traveling to a middle eastern country, including Israel
- Homeschooling
- Expressing libertarian views
These and other ridiculous offenses don’t necessarily land you on the terrorist watch list, but they could, according to the Department of Homeland Security. So what if you decided that a few things on their “watch list” were things that appealed to you? What if you didn’t have a credit card and went on vacation to Israel, taking a break from home schooling your children and accidentally browsed the wrong web site while looking for tourist info before you left? That’s 4 things on the list. Would you be comfortable with the military coming to your house and taking you to “prolonged detention” because you were a suspect?
This is a very slippery slope we are headed down. Those who would sacrifice liberty for safety deserve neither.

Just another example of questionable provisions being attached to vital legislation in an effort to force the President into a politically volitile position.
“The president defended his action, writing that he signed the act, “chiefly because it authorizes funding for the defense of the United States and its interests abroad, crucial services for service members and their families, and vital national security programs that must be renewed.”
Exactly. He signed it rather than veto it and allow the vital components to go unauthorized and funded.
He clearly states that he has serious “reservations” about the detention clause (but let’s be real, people…this has already happened and is already the law…this preceded his administration.)
And yes, he CAN go back to Congress and ask then to overturn this element (I wouldn’t hold my breath waiting for the Republicans to go along with this; this provides great SPIN, and they are not about to give it up without a long, protracted, highly visible fight).
OR he can overturn it through executive order (or do so once he gets a NEW Congress that actually has an interest in working with him/doing the work of the nation instead of making him one-term President at all costs).
Much ado about nothing, ultimately. He simply (reluctantly) renewed something the Right has been supporting for years to prevent vital authorizations from lapsing.

P.S. the fact that even the LEFT is up in arms about this and the Right is running with it with such giddy abandon should be all the proof needed to conclude that this was an orchestrated act intended to inflame the electorate with fears of “tyranny” and “martial law”. It just plays so perfectly to both sides.
This President knows and respects the Constitution more than any in our lifetime…the Bush boys argued that this sort of thing (and torture) was A-OK and slandered anyone who disagreed as a traitor/unpatriotic. At least THIS administration has “reservations” about it.
He has repeatedly shown himself unwilling to sacrifice the interests of the people or national security in the interests of his own political ambitions (agreeing to the extension of the Bush tax cuts for the top few percent rather than throw the long-term unemployed and 9/11 first responders under the train, for example).
And I will bet that some of the very people responsible for ensuring this provision made it into the final bill are the same ones who then proceeded to push it as a story.

Derrick, Ron Paul voted against the NDAA. He has said flat out the he would veto such a bill without reservation. His voting record is clear evidence that he means what he says. Let’s also not forget that we have an opportunity to elect good, liberty minded replacements for many of our elected officials this Nov. Let’s get Ron Paul in the White House and then get him some help in Congress.
Raven, that’s some serious political yoga you’re doing to try to support your man. There is no question that Obama could have grown a spine and vetoed the bill, telling Congress “Bring it back when you remove the offending language.” Congress wouldn’t have had the votes to override. So either Obama is a coward, ignorant of how to work the system or he’s lying. Given his track record of lies as laid out at Politifact, I’d bet it’s a truth impairment problem.
Let’s also not forget, as reported by several news agencies, including the left leaning Jon Stewart, Obama’s original threat to veto this bill was not based on civil rights violation concerns, but rather that the executive branch wouldn’t have total rights to violate civil rights.

Maybe you would like to know who stuck the so called unconstitutional wording into a defense appropriation bill, and why. Turns out this is just more GOP House “gotcha” politics. This type of legislation is just one of many incremental steps taking the Federal Government further and further away from the Constitution. Eventually the result will be armed insurrection. Ron Paul may be the last chance we have to peacefully transition back to a Constitutional government without large scale civil unrest and violence in our cities and streets.

A lot of comments that say the bill doesn’t actually allow for detention of American citizens when you read it. I’ll take it for granted that the four star generals cited in the article know what they are talking about. It is ridiculous watching right-wingers up in arms about this, when they all defended the hell out of the assault on liberty when Bush did it. A balanced approach to citizenship means a balanced response to threats both external and internal. Alas, we have neither.

Do we need to point out that Republicans voted for and authored much of it? 93 of 100 senators voted in favor of it, the nays were evenly split. Some of you folks are sad. You are commenting on a bill that you haven’t even read. You take the word of the media and blindly accept it – all of it. From what I read, the president signed a bill with important provisions for our defense and related programs. Congress – not the president, included this detention related wording. As usual, congress ties the hands of the president, leaving him no choice but to sign a bill thathe would have preferred not to, but had to in order to successfully pass the other good things in it. Congress wrote the bill, not the president. If you don’t like it, vote out congress because unlike the president, they don’t have term limits.

It was the Obama administration who insisted on removing that language least it “severely restrict their ability to fight terrorist. Obama’s veto threat was if the language was not removed. Finally, do you think it’s gonna be the first black president of the USA that’s gonna become a tyrant? He has no “roledex” worth speaking of. He’s a puppet for the real powers that be. He’s the face of the person that destroyed this country’s freedom. Subsequent Presidents will surely lock us down in a corporate dictatorship. Just imagine a power player like Newt Gingrich as President with that power. In a way, this is left over residue not only from OBL, but from Timothy McVeigh as well.
Folks like Schumer were arguing for these powers way back then. As well, increased power to go after offshore Cayman Corps.
Lurching state power just like this is McVeigh’s only actual legacy, ironically, 180 degrees whatever intent he thought he had. It is a lesson in impotent yet destructive hlaf-way megapolitical acts. The state that survives such half-way attacks responds by giving itself more power.

I believe that every member of congress has to take an oath that they will uphold the Constitution. This law is unconstitutional. If every time the Supreme Court declares a law unconstitutional all of the congress members who voted for it would immediately lose their job (forever) I bet that a lot fewer unconstitutional laws would be passed.

He should have never signed that bill. Even though I lean left I definately think that the powers of the government should definately be limited in certian areas. A republican would have signed the bill too and I still think that the democrats are the lesser of two evils, but honestly, he should have not hesitated to veto it as soon as it touched his desk. Politics is B.S. and giving the ability to indefinately detain citizens to a politically elected figure is a terrible idea.

I’ll ask the same question I asked when Bush did the same thing. What is so bad about our justice system that it can be used for everything else but not terrorism? There is no basis for dealing with some crimes outside of the existing justice system unless that system is too broken to deal with anything.

The answer is simple, our lawmakers have BROKEN THEIR OATH AND FAILED the country and it IS OUR DUTY, to fire (through election) anyone involved in this bill.
IT IS UNCONSTITUTIONAL TO DETAIN AMERICAN CITIZENS WITHOUT REASON AND DUE PROCESS OF LAW!
President Obama failed as commander in chief, by signing this bill into law. The “reservations” are a joke of an excuse. He should have veto’d the law and scolded congress for sending it to him.

King Obama continues to take away our rights and others. No due process, assassination of uncharged American citizens and Gitmo still open as a recruiting tool for terrorists, all actions Obama and Democrats were to end.
Remember the outcry against Bush and GOP over Patriot Act. This is real violations of our rights, not the made up worry of FBI looking at our Library records.

I am not voting for Obama but this really only applies to people suspected of terrorism. If you think it is such a big “change” and its an awful idea, we did the same thing on a much larger scale to the Japanese in WWII. Our nation has a history of doing this in times of great conflict. We are on the verge of WWIII, and if you don’t have any reason of being a suspected terrorist than you have nothing to worry about.

Matt, you are basically aying that you are OK with detention of US citizens without charge or reason, typically, like you say, during WWII, based on race. If you think what happened during WWII was OK, you are dead wrong. And if you do not realize how this bill poops on our constitution, you should go read it. Much ado about nothing. When did Republicans go soft on terrorism? They applauded when GW signed similar legislation. If you are not a terrorist, you don’t have to worry. If you are, you don’t really care about some stupid law. Either way, much ado about nothing.

The bottom line here folks, … is this:

Once our beloved President Obama took the oath of office…the dark powers behind the scenes made him a puppet whom dances to their agenda. The spooks are jockeying for position.
It will make no difference in any debate as to the how or why in this process. The question really should be; who drafted this document to terrorize the citizens who ignorantly support the present way they secretly do business that makes us all suspect. The FEMA camps are a reality.
…is this really what we want for our sons, daughters and their families. It is an outrage, and not what my father fought for in the past and noble engagements. (wars!) Look around when you drive. You will see the big blue signs telling you where to get emergency information in one of these fabricated emergencies. They are going to pull our proverbial teeth by cutting internet/phone service when it goes down. Coupled with Marshal Law, citizens will be ripe for the picking just by going out to speak to their frightened neighbors.
” We have no rights under the present system that is in place at this moment.” …and you didn’t even get a chance to be heard! You would be foolish to ignore the facts and no one will be able to hear you in the detention camps.

For the love of God, why in the hell is this guy not being impeached. How can even the African-Americans support this guy anymore when he’s violating their Constitutional rights left and right. I think he believed he had to sign it before the Supreme court could over turn it. Although it is a little scary I think the detention thig is a little over blown. In order to qualify somebody has to be a member of Al-Qeada. It’s not like they are going to be rounding up people they don’t like and shipping them off to gitmo.
