Halle Berry's Ex Gabriel Aubry Investigated for Child Endangerment

Actress Halle Berry is taking Gabriel Aubry, her ex-boyfriend and the father of her only child, to court over charges of child endangerment and battery.

The incident involves the couple's 3-year-old daughter, Nahla, and her nanny, according to a Los Angeles Police Department report obtained by TMZ.

According to TMZ, the altercation started after Aubry decided not to take the child to school.  The nanny, who works for both parents, went to school to pick Nahla up and found out she had not gone to school.

After going to Aubry's house to pick Nahla up, the nanny asked him why he did not take her to school.  In a rage, Aubry cursed at the nanny and pushed her out of the door while she was holding the Nahla, TMZ cites the report as stating.

The nanny filed a police report afterward.  The police report, according to TMZ, documents Aubry as saying ""You're the f**king nanny. Who do you think you are? You are a nobody. You don't need to f**king know anything."

"According to her, he went off.  He just flew off the handle, started screaming at her in front of the child," TMZ's Harvey Levin told ABC News.

Law enforcement officials are investigating child endangerment and battery.  Child protective services is also investigating child endangerment.

"Halle Berry is going to court trying to block Gabriel from even seeing the child while all of this is going on," Levin said.

"people who have been around Halle Berry say she's a great mom," Levin said.  "There are people who say that Gabriel has a temper and flies off the handle.  There are others show say they've seen him with the kid and that he's very loving, so it really does depend on who you talk to."

Reps for Berry and Aubry didn't respond to requests for comment from ABC News.

Berry, 45, reportedly became engaged to French actor Olivier Martinez earlier this month.  It will be her third marriage.
