We turn to that radio talk show host charged with shooting his wife with a rifle during an argument outside their home in an Ohio suburb and frantically called 911 claiming it was an accident but what are police saying this morning about this? ABC's Mara schiavocampo is here with us. Good morning. David, good morning. Police say that talk show host is trying to talk his way out of a shooting but they're not buying it and he now faces criminal charges. I was taking my rifle out of the trunk and it shot my wife. Reporter: It's a franticlea for help. Okay, where did she get shot at? I don't know -- Reporter: Local Ohio talk show host Blake seylhouwer telling a 911 dispatcher he shot his wife by accident injuring her. Okay, you said the gun accide accidentally went off inside the vehicle and it shot her in the head? No, no, I was taking it out of the trunk and it went off and I went off. Reporter: This morning police say they do and it's nothing like seylhower's version of the story. Through the investigation we determined that it was thought an depth. Reporter: Law enforcement officials claim 36-year-old seylhower and his wife misty were arguing outside their home in an upscale Cincinnati suburb Tuesday afternoon when they say he intentionally took a rifle out of his trunk and fired a shot on purpose hitting the driveway. Police say shrapnel from the bullet and concrete hit misty in the leg, side and head. All while the couple's two young children ages 4 and 13 months were inside the house. The only thing that I've been told was said by her is he shot me, get him away from me. Reporter: Seylhower hosts a Sunday morning show "Small business Sunday" on local talk radio station 55krc. The new voice for Cincinnati small businesses we've got a jam-packed show today. Reporter: His wife reportedly an executive producer at the station. Now this radio host is a defendant appearing in court Wednesday facing charges of assault and domestic violence. I'm so sorry. Reporter: Seylhower has pleaded not guilty saying the whole thing was a mistake. Sticking to the story he told dispatchers. We believe the facts will ultimately show that there was no intent to do any harm. Reporter: Now misty seylhower checked out of the hospital Wednesday afternoon and she is expected to make a full recovery. In addition to the charges, Blake seylhouwer now also has a restraining order against him protecting his wife and the kids. We should mention the kids were not hurt that incident.
