Mar. 29 -- Good afternoon.

The battle raged again today over whether national security adviser Condoleezza Rice should testify in public under oath about what the White House did or did not do to prevent terrorism in the months before the 9/11 attacks. Rice is steadfast in insisting on testifying behind closed doors. Terry Moran has the latest tonight on former counter-terrorism chief Richard Clarke's allegations that the White House did not do enough to prevent the 9/11 attacks, and the search for a compromise that could possibly have Rice testifying before the commission.http://abcnews.go.com/wire/Politics/reuters20040329_378.html

Today, judges in New York, San Francisco, and Lincoln, Neb., heard challenges to the "Partial Birth Abortion Ban Act." President Bush signed the legislation into law in November, but it has yet to be enforced because judges in these three cities have agreed to hear further evidence to decide whether the ban violates the Constitution. We'll have a two-part Closer Look on this debate in this evening's broadcast. Jake Tapper will take a look at the arguments being made on both sides of the case. Dean Reynolds reports tonight on why, as part of their case, the government is seeking private medical records of the women who've had the surgery.http://abcnews.com/wire/US/ap20040329_1420.html

Jury deliberations in the trial of Tyco executives Dennis Kozlowski and Mark H. Swartz continued today amid serious questions about whether the jury will be able to reach a verdict. One juror, who appears to be the sole advocate of an acquittal, is at the center of a dispute within the juror room, which has become, according to a note to the judge, "poisonous." Bob Jamieson has more on this lone holdout juror and the battle among 12 citizens to reach courtroom consensus.http://abcnews.com/wire/Business/ap20040329_1428.html
