Official Rules: Nikon Coolpix Pride and Joy Baby Photo Contest

Jan. 26, 2004 -- -- Nikon Coolpix Pride and Joy Baby Photo Contest (the "Contest") begins at 12:01 AM Eastern Time ("ET") on October 17, 2004. All entries must be received no later than 11:59 PM ET on December 31, 2004.

The Contest is open to legal U.S. residents who are newborns to 36 months old at time of entry whose parents or legal guardians have online access. Employees, officers, directors and members of Nikon Inc. ("Nikon"), Best Buy Co., Inc. ("Best Buy"), Starlight Starbright Children's Foundation ("Starlight Starbright") and Parenting Group, Inc. ("Parenting"), their respective parents, divisions, affiliates, subsidiaries, agents advertising and promotional agencies, including immediate families and household members of each are not eligible. Void where prohibited by law. All applicable U.S. federal, state, and local laws and regulations apply.

To enter, you must complete an online Official Entry Form, available at prideandjoybaby.com, and submit along with a current photo (as specified below) and $9.95 nonrefundable processing fee payable in U.S. funds only. To make payment of $9.95 nonrefundable processing fee via Visa, MasterCard, or American Express, complete appropriate section on online entry form. Online entries must be completed and submitted by a parent or legal guardian. With each entry, submit one color or B&W photo depicting entrant's personality, photo composition and photogenic quality. Photograph must be entrant's original, untouched digital photo and photograph must be submitted in a JPEG (.jpg) or TIFF file format and cannot exceed 1 MB in file size. Entry materials consist of completed entry form, photograph and fee. You can submit entry materials online at prideandjoybaby.com.

Entrants may enter one time only. An entrant's first entry will be such entrant's only eligible entry in the event of an entrant's multiple entries during the Contest period. Incomplete, inaccurate, damaged and/or illegible entries will be disqualified. Entrants are entered once they submit all required materials.

Nikon shall have the right to disqualify any entries that it deems to be obscene or otherwise not in good taste, as determined by Nikon in its sole discretion. Entries must be in keeping with Nikon's image and may not defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any third party's personal, intellectual property or other proprietary rights. Entries and photos become property of Nikon, can be used by Nikon for any lawful purpose, and will not be returned. By entering, parent or legal guardian of entrant agree to be bound by the terms of these Official Rules and the decisions of the Nikon and judges which are final and binding on all matters relating to this Contest.

Twelve Baby Finalists and three Alternate Baby Finalists will be selected on or about January 6, 2005 by qualified judges (agents of Nikon) based equally on personality, photo composition and photogenic quality, as determined from entrant's submitted photo entry. In the event of a tie, an additional, qualified, "tie-breaking" judge shall determine the twelve Baby Finalists from such tied entries using the criteria herein. Baby Finalists will be notified by e-mail or telephone. Only Baby Finalists will be notified. The parent or legal guardian of each Baby Finalist must execute and return an Affidavit of Eligibility/Liability and Publicity Release (unless prohibited) and Model Release within 7 days of issuance of such documents. Failure to properly and/or timely execute and return such documents and/or failure to comply with any portion of these Official Rules will result in disqualification, his/her place as a finalist will be forfeited and, at Nikons' sole discretion, awarded to the next Alternate Baby Finalist. The return of such documents within the allotted time shall be the sole responsibility of each respective parent or legal guardian.

Each Baby Finalist will receive a Nikon Coolpix digital camera package which includes: one (1) Nikon Coolpix 3200 digital camera, (1) camera case, and (1) rechargeable battery and charger; a 1-year subscription to Parenting Magazine; and, in Nikon's sole discretion, a 3-day/2-night trip to New York City for Baby Finalist and one (1) parent or legal guardian (who must be at least 18 years of age) to appear in a nationally broadcast television program and/or website in January 2005 (specific dates to be determined by Nikon at time of notification). Failure to attend and/or travel on the specified dates, to agree to appear in a nationally broadcast television program and/or website and participate in other promotional and advertising activities may result in disqualification. His/her place as a finalist may be forfeited, and at Nikons' sole discretion, awarded to the next Alternate Baby Finalist. Total estimated retail value of Baby Finalist prizes is $2,775.35 with trip, and $275.35 without trip.

All trips awarded under this Contest are subject to the following. Trip includes ground transportation to New York City or round-trip coach airfare from the major U.S. gateway airport nearest Baby Finalist's/Grand Prize Winner's home, ground transportation to/from airport in New York, standard hotel, single occupancy for 3 days/ 2 nights, and a stipend of $100/day for food. Actual value may vary based on Baby Finalist's/Grand Prize Winner's point of departure and dates of travel. Certain travel restrictions and blackout dates may apply. Method of transportation to be determined based on Baby Finalist's/Grand Prize Winner's proximity to New York City.

All details not specified herein are at Nikon's sole discretion. Parents or legal guardians of Baby Finalists/ Grand Prize Winner are solely responsible for all trip expenses not specified herein as being awarded, including but not limited to all taxes, gratuities and meals and/or beverages in excess to the $100 per day specified above. Travel must be made through Nikon's agent, on a carrier of Nikon's choice. Parent or legal guardian of any Baby Finalist/ Grand Prize Winner must travel together on the same itinerary with Baby Finalist/Grand Prize Winner. Parents or legal guardians of Baby Finalists/Grand Prize Winner are responsible for obtaining travel documents. Parents or legal guardians of Baby Finalists/Grand Prize Winner must sign, notarize and return an Affidavit of Eligibility/Liability and Publicity Release (unless prohibited) and Model Release prior to issuance of travel documents. Except for digital camera, which carries Nikon Inc. one-year Limited Warranty, prizes will be awarded "as is" with no warranty or guarantee, either express or implied. No transfer, cash equivalent or substitution of prize is permitted, except by Nikon who reserves the right, at its sole discretion, to substitute any prize (or portion thereof) for one of comparable or greater value if prize (or portion thereof) cannot be awarded as advertised.

Grand Prize Winner will be selected by online vote based equally on Baby Finalists' personality, photo composition and photogenic quality. Baby Finalist receiving the most online votes will be deemed the Grand Prize Winner. Online voters may cast one vote during the contest period. In addition to Baby Finalist prizes, Grand prize Winner will receive a $25,000 savings bond ($25,000 value at maturity; matures in 17 years), inclusion in a Nikon advertorial to appear in Parenting Magazine; a 3-day/2-night trip to New York City for Grand Prize Winner and one (1) parent or legal guardian (who must be at least 18 years of age) to participate in a photo shoot with Nikon in January 2005 (specific dates to be determined by Nikon at time of grand prize judging). Total estimated retail value of Grand Prize Winner prizes is value of Baby Finalist prizes specified above plus an additional $27,500.00. Grand Prize Winner may also be featured in an additional issue of Parenting Magazine and/or other print media, and/or on a nationally televised broadcast program and/or website, and/or in other promotional and advertising activities including promotion of future contests.

The parent or legal guardian of each entrant (including the Baby Finalists and Grand Prize Winner) grants Nikon and their designees the right to use the entrant's name, hometown, voice, photograph (including any photograph submitted with entry) and likeness without additional compensation in advertising and promoting future Baby Photo contests conducted by Nikon, and also in promoting and advertising Nikon and/or its products, except where prohibited. By entering this Contest and/or accepting any prize in connection herewith, entrant's parent or legal guardian releases and agrees to indemnify and hold harmless Nikon, Best Buy, Starlight Starbright and Parenting, their respective parents, subsidiaries, affiliates, divisions, advertising and promotional agencies, and the directors, officers, members, agents, successors assignees, licensees, shareholders and employees of all of the foregoing (collectively, "Releases") from and against any and all claims, actions, and liability for any injury, losses, liabilities, damages, costs and expenses (including without limitation, reasonable attorneys' fees), disputes, and/or disability resulting from participation in this Contest and/or acceptance of any prize (including, without limitation, any travel related thereto). Releases are not responsible for lost, late, incomplete, stolen, misdirected, or illegible, entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network; or the incorrect or inaccurate capture of entry or other information or the failure to capture any such information.

Releases are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Releases are not responsible for injury or damage to entrants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Contest or website, as solely determined by Nikon, will be disqualified. Should any portion of the Contest be, in Nikons' sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Nikon, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Nikon reserve the right at their sole discretion to suspend, modify or terminate the Contest and select Baby Finalists and one Grand Prize Winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Nikon. By entering Contest, entrants' parents or legal guardians agree to receive promotional mailings from Nikon. Prizes will be awarded based on full compliance with these Official Rules.
