Lindsay Lohan: Drug Testing, Monitoring Bracelet Ordered

May 24, 2010 — -- Lindsay Lohan avoided jail today but was ordered to abstain from alcohol, wear an alcohol-monitoring bracelet on her ankle and submit to weekly random drug tests as conditions for remaining free on bond.

Beverly Hills Superior Court Judge Marsha Revel showed little sympathy when she imposed the conditions in court and rejected arguments by Lohan's lawyer that a "bulky bracelet" would interfere with the actress's upcoming photo shoots and movie in Texas.

"The court does not intend to change it," Revel said about her ruling. "She needs to submit here, not in Texas. I'm afraid she's going to have to delay that for now."

In addition to the monitoring bracelet and random drug testing, Lohan was ordered to complete her weekly alcohol education classes. Lohan had reportedly finished 10 out of the 13 classes.

Lohan appeared in court today after missing last Thursday's mandatory hearing stemming from her 2007 DUI arrest. The actress claimed her passport had been stolen while she was in France, promoting a film at the Cannes Film Festival, which prevented her from showing up in court last week.

When Lohan failed to appear, Revel issued a warrant for her arrest. She recalled the warrant late Thursday after representatives for Lohan posted bail, which Revel set at $100,000.

This morning, it appeared Lohan would be another no-show when she did not arrive exactly on time for the 8:30 a.m. hearing. Her car pulled up at 8:34, and after some discussion with security officials, Lohan emerged at 8:37.

Lohan, wearing a black suit and white low-cut blouse, quickly took her seat, looking slightly pale and nervous.

Her lawyer, Shawn Chapman Holley, quickly explained to the judge that they were late because of a problem regarding security.

The judge responded "that part is not a problem."

While the judge listed the conditions for Lohan remaining free on bond, the actress began to tear up.

Holley told the judge that Lohan was prepared to "show by her actions" that she "intends to comply with all the court's directives." She said Lohan had already made arrangements to do the alcohol education classes daily. She also said Lohan would be willing to submit to more random drug testing if the judge would forgo requiring the alcohol-monitoring bracelet.

"She's not trying to get out of monitoring," Holley said.

Not wearing the monitoring bracelet "would allow her to also make a living," Holley said.

In order to be continuously monitored, Lohan would have to remain in Los Angeles.

"It's going to be drug testing here," the judge said, not budging on her conditions. She also ordered Lohan to attend the alcohol education classes once a week instead of three days in a row, saying the classes were more effective when spread out. Revel said Lohan's only excuse for missing a class would be if she had a random test scheduled at the same time.

"She's to follow the court's order," Revel said. "If she wants to do extra ones, she can."

When the judge asked Holley if she objected to the judge's ruling, Holley asked Revel for a few minutes to consult with her client. Looking worried at first, Lohan finally rolled her eyes.

"We accept the court's conditions," Holley said, turning to Revel.

The judge then repeated the conditions and asked Lohan if she accepted them. "Yes, your honor," she replied.

Los Angeles County Deputy District Attorney Danette Meyers also asked to see Lohan's airline tickets from Cannes as proof that she had planned to make last Thursday's hearing.

Holley responded that not only did she have the ticket that showed a May 19 scheduled departure but Lohan's replacement passport that was issued in Marseilles.

Last week, Lohan pointed fingers at her father, saying he got someone to steal her passport.

"I always said my father had someone do it," she told UsMagazine.com via email Thursday afternoon.

Lohan was ordered back to court for a formal hearing July 6 regarding her probation violation. She's expected to have witnesses testify as to why she missed completing her alcohol education classes by last Thursday's hearing.

On Sunday, an obviously worried Lohan said in an interview with Hollywood TV that she had tried to find several ways to get back to Los Angeles from Cannes "because I knew i had to deal with certain repercussions and was very scared."

She also defended her trip to Cannes.

"I wasn't partying in Cannes. I was there for work. ... I was there promoting a film," she said. "I've been focusing on my work and getting my classes done, just to be able to start a film again so I can put all this behind me."

Lohan also teared up when asked how she felt about missing her younger brother's graduation to attend today's hearing.

"It sucks," she said. "It's horrible."
