Lindsay Lohan Sent Back to Rehab, Not Jail

Oct. 22, 2010— -- Lindsay Lohan will remain in lockdown until next year, but not in jail.

At a probation violation hearing today stemming from a failed drug test, Beverly Hills Judge Elden Fox ordered that the 24-year-old actress remain in rehab at the Betty Ford Center until Jan. 3, 2011. She may elect to stay there longer. Fox also said that Lohan can take off her alcohol monitoring ankle bracelet, but must continue to take random drug and alcohol tests.

Lohan arrived at the Beverly Hills court house just after 8 a.m. PT today. She was dressed conservatively: black blazer, white t-shirt, hair pulled back. She has been at the Betty Ford Center since Sept. 28; she left the center at 4 a.m. today with her mother, Dina, who accompanied her to court along with lawyer Shawn Chapman Holley.

Lohan was markedly less worked up than she was at the court hearing that preceded her most recent jail stint, when she displayed fingernails with decals that read "FU." During today's hearing, Fox referenced a handwritten letter that Lohan wrote for him.

"I appreciated it," he said. "I'm new to this rodeo. I think there's nothing better for the media than a Hollywood celebrity in a train wreck. You are going to complete the program. I cannot emphasize enough that I will not be manipulated."

"You are an addict," he added. "You have to change the lifestyle."

After decreeing that Lohan remain in rehab until January, Fox asked Lohan, "Do you understand exactly what I'm saying?"

"Yes, sir," she replied, her voice quivering. When Fox asked if she had anything else to say, she reponded, "No, your honor, I understand, thank you."

Though rehab is keeping her out of jail, a probation report obtained by TMZ.com states that being at Betty Ford is damaging Lohan's career and finances. The report claims that Lohan's 6126 clothing line "is falling apart because she is not available to monitor the product" and that rehab is preventing her from starting work on a movie in November.

Rehab Breeds Quieter Lohan

The often-loquacious actress has avoided big statements since checking into rehab. (Her Twitter account hasn't been updated since Sept. 26.) But that hasn't stopped celebrities -- and members of her own family -- from weighing in on her woes.

On the red carpet of his AIDS Foundation fundraiser in New York earlier this week, Elton John told reporters that Lohan needs to swap "pampering" rehab centers for a no-holds-barred "boot camp" course of treatment. He also urged her to ask for help and "get rid of the people who are around you ... and by that I mean her family too, they're enablers."

Lohan's estranged father, Michael Lohan, is helping her do that -- kind of. Earlier this week, the born-again Christian and former addict released a statement saying that he will no longer be making statements about his daughter.

"I want to make a public statement that I will not be commenting on ANYTHING relating to my daughter Lindsay, or ANYTHING my ex-wife Dina, or any 'sources' related to her, might say," he said. "NO MATTER what accusations, lies or conjecture are disseminated to the public about me, for the sake of the ones I love and with hope of creating peace, I WILL NOT respond, in ANY way, to what is said or done, to me. For the sake of those I offended, I apologize and ask their forgiveness. ... So please refrain from calling or contacting me."

Lohan was freed from her latest jail stint on Sept. 24. After one judge ordered her held without bail until a court hearing next month, a second judge cleared the way for her release on $300,000 bail on several conditions -- including that she be fitted with an alcohol-monitoring bracelet within 24 hours of her release and refrain from drinking alcohol or possessing controlled substances.

Lohan's return to jail came after her admission that she failed a court-mandated drug test.

"Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before Judge Fox next week as a result," Lohan wrote on her Twitter account on Sept. 18. "I am so thankful for the support of my fans, loved ones and immediate family, who understand that i am trying hard, but also that I am a work in progress, just as anyone else. I am keeping my faith, and I am hopeful....Thank you all!!!"

The stint behind bars was Lohan's third round in jail for a three-year-old drug and DUI case that followed two highly publicized 2007 arrests. Lohan left a rehab program at UCLA Medical Center on Aug. 24 after 23 days of treatment. Earlier in August, she was released from jail after serving just 13 days of a 90 day sentence for violating her probation.

At an August hearing, judge Fox ordered Lohan to go to weekly psychotherapy and behavioral therapy sessions, in addition to 12-step dependency program meetings and mandatory drug tests. Fox said if Lohan was found to be in violation of the terms of her probation, she could go to jail again for 30 days.
