'Making a Murderer' Brendan Dassey to Remain in Prison Pending Appeal
This comes after he was recently ordered to be released by another judge.
-- "Making a Murderer" subject Brendan Dassey will have to remain in prison pending an appeal involving his murder case, according to an order filed today in the United States Court of Appeals.
Dassey, 26, had been ordered to be released later this week by U.S. Magistrate Judge William E. Duffin, but today things took a turn as Seventh Circuit judges granted a motion from Wisconsin Attorney General Brad Schimel to stay Dassey's release until the resolution of the appeal, paperwork obtained by ABC News shows.
In 2007, Dassey was convicted as a teenager, along with his uncle Steven Avery, of murdering Teresa Halbach two years earlier. Dassey was sentenced to life in prison, but this past August, a judge overturned his conviction, stating that the then-teenager's confession was obtained using questionable tactics. The judge also cited "Dassey’s age, intellectual deficits, and the absence of a supportive adult," according to the official ruling.
Schimel appealed the overturned conviction on behalf of Warden Michael Dittmann and the State of Wisconsin.
Dassey's attorney, Lauren Nirider, wasn't immediately available for comment today, but had told ABC News earlier in the week that she had hoped her client would be at home with his family soon.
“We’re over the moon," she said. "Brendan and his mother have spent 10 Thanksgivings apart and the prospect of spending the next one together … it’s incredible. We’re just so grateful."
Avery's lawyer Kathleen Zellner did speak out on social media, tweeting, "Seventh Circuit just denied Brendan Dassey's release pending appeal outcome. Never easy."
