Should a Responsible Biological Parent Always Have Custody Rights?

Dec. 23, 2009 -- David Goldman has finally won an international custody battle that has now stretched for half a decade. Brazil's Supreme Court ruled Tuesday that the family of Goldman's deceased ex-wife must hand over his 9-year-old son, Sean.
Even so, Sean Goldman's Brazilian family has threatened to appeal the ruling. In a letter to Brazil's president, the maternal grandmother wrote of a Brazilian custom that, "In the absence of the mother, the raising should be done by the grandmothers."
So we ask you today: Should a responsible biological parent always have custody rights?
