According to California attorney Dana Cole the legal “anomaly” about presumed fatherhood that is on the books in most states doesn’t apply to Kardashian.
“It’s a law that ensures that a child has two parents,” he told ABCNews.com. “It’s used in absence of evidence to the contrary, if someone is not claiming fatherhood. In this situation, it would never be triggered.”
West proudly announced that Kardashian was pregnant with his child at a Dec. 30 concert. While Kardashian’s split from Humphries has yet to be settled — they were married for 72 days before she filed for divorce in 2011 — Cole said her marriage status is a “non issue” when it comes to her baby.
Sounds like Kardashian and West can focus on more pressing matters, like whether or not their little one will be featured on reality TV.
