Sarah Palin’s family attorney John Tiemessen has written a letter to Maya Mavjee, the publisher of the Crown Publishing Group, a division of Random House, that Palin may sue her, the company, and the book’s author Joe McGinniss “for knowingly publishing false statements” in his book released last week, “The Rogue,” ABC News has learned.

The book was widely panned by critics for using unnamed sources to criticize Palin and her family. Tiemessen cites an email they have access to in which McGinniss writes that attorneys from Crown Publishing told him “nothing I can cite other than my own reporting rises above the level of tawdry gossip. The proof is always just around the corner, but that is a corner nobody has been able to turn” and that McGinniss “ran out of time” to sufficiently source the book.

A source close to the Palins tells ABC News that the “Palins are fighting back and demanding answers from Random House.”

“Random House is at the top of the food chain and published a book based upon acknowledged unsubstantiated gossip,” the source said. “The revealing email is key as evidence of this defamatory approach to politics through proxies.”

Tiemessen writes in the letter that the email “clearly describes the fact that Mr. McGinniss researched and investigated many false and scurrilous allegations, and concluded that there was absolutely no evidence anywhere backing these allegations.”

Palin’s attorney writes that it is “malicious” for Crown to publish the book when it has proof McGinniss and Crown “were fully aware the statements in the book were false, intended to be false, and were intended to harm.”

“The final work that was published contains most of the stories that Mr. McGinniss complains were nothing more than ‘tawdry gossip’ that amounted to the wishful fantasies of disturbed individuals,” Tiemessen writes. “Since both your company, and the author, clearly knew the statements were false, admitted they had no basis in fact or reality, but decided to publish in order to harm Governor Palin’s family, you and Mr. McGinniss have defamed the Palins.”

Tiemessen ends the letter by warning the publishing house not to “delete emails or destroy records” that may be used in the suit.

The email Tiemessen cites in his letter to Mavjee came to light last week when conservative blogger Andrew Breitbart posted an email between McGinniss and liberal Alaskan blogger, Jesse Griffin. In the email posted on Breitbart’s site without explanation for how they got access to it, McGinniss writes, “Legal review of my manuscript is underway and here’s my problem: no one has ever offered documentation of any of the lurid stories about the Palins.”

This isn’t the first legal scuffle for Palin and McGinniss. A media firestorm erupted when McGinniss moved next door to the Palins in Wasilla when he was doing the research for his book. When he was featured in Palin’s reality series in Alaska last year, he sent TLC a cease-and-desist order demanding they not air footage of him sitting next door. The clip aired on the first episode.

Neither Crown Publishing nor Joe McGinniss immediately responded to requests for comment.

Stuart Applebaum, the spokesman for Crown Publishers sent ABC News this statement:

“We are confident that the reporting in THE ROGUE is solid, reliable, and well-substantiated. We stand by our publication and our author.”

People are tired of Sarah Palin being the bully and hysterically running to her attorneys and demanding legal action because she is so thin skinned. Time to grow up, Sarah, if you want to be treated like a grown up, you can’t whine and cry and say that you are being picked on. You have been spreading lies about a lot of our elected leaders, and none of them fell to pieces and couldn’t handle their own problems. You are repeatedly showing the world why you had so many legal bills while you were Governor–you couldn’t even set up a visitation schedule between Bristol and Levi without running to your lawyers and calling the tabloids. I don’t think the publishers or McGinniss are afraid of your threats–you act like a bully or a pitbull and wonder why you don’t get any respect from the voters. Duh!

She’ll never sue; a libel suit brought by a public figure is almost impossible to win. To win, she will have to show “constitutional malice” on the part of the author. That means that she has the burden of proof to show that the allegations are false.

That means she will have to sit for a deposition and answer all kinds of questions that she does not want to answer. First and foremost, she would have to release her medical records regarding the phony Trig pregnancy and birth, which she does NOT want to do.

Try to imagine the response if Obama’s family was salaciously attacked in a similar way. Unless you can seriously decide that tawdry attacks on the Obama family are A-OK, you are nothing more than a leftist hack. If you can conclude it is actually OK to publish this sort of stuff, then you have far deeper problems.

A civil society doesn’t endorce this sort of attack, nor will it blame the victim of the attack when they try to defend themselves. This sort of attack must be resisted, regardless of the political persuasion of the victim.

It took three years for her emails as Governor to be released, even though they were supposed to be public records, and now her attorney is telling Crown Publishing to make sure to keep all of their emails related to the book? all the subjects in the email were not in the book. If you read the book you would know that. what Joe said was that these Other stories could not be proved and would not be in the book. there was plenty of proven stories and those did not make the final cut because they could not be proven.
She is only thretening because she needs to get out in front of it. It will only be a story if she does sue, and my gues is she won’t because she could not go through discovery>

Funny how she had a problem with Joe next door in THAT house as well. The former tenants were some convicted criminals in sort of a half-way house. There was even a meth lab in the basement at that time.

1. Palin has threatened to sue multiple times before and hasn’t.
2. Palin would have to cite specific passages and provide proof they are lies or fraudulent. The burden is on her. She would fold under cross-examination.
3. The email in question refers to rumors which were not included in the book so its existence is moot.

As a legal attorney, I would love the opportunity to cross-examine the Palins in regards to the book. She would cry mama after the first 10 minutes.

It’s pretty much impossible to prove that the writer (in this case Mr. McGinniss) “clearly knew” the published information was false…and it is REALLY impossible to prove intent. Good luck. Now, maybe they can come up with some angle in civil court to hurt the author financially as a warning to anyone else…we’ll see.

I certainly hope that she and her husband follow through with the law suits. Just because someone’s a public figure shouldn’t mean that anybody can print anything, because they don’t want them to succeed politically.

Sarah is even smarter than I thought. First by threatening to sue, she garners interest in the book. More books are purchased. The more books sold the greater the damage and hence the damges to which she’s entitled. If a jury awards her 10x in damages on a book selling for $25, (more likely she’ll get closer to 4x or maybe 5x the damages) then she gets $250 per book sold. A million copies equals $250Million. Even at only 4x in damages she’ll make a cool $100Million. You go Sarah. Imagine have a $100Million on which to spend to hound McGinnis for the rest of his miserable life. Gotta love it. And the precedent will be established that some conservatives actually do fight back. I think I’ll go buy that book just because every dollar invested returns 4 to 10 dollars in returns. America! What a wonderful country. For the first time in my llife I’m actually proud of America’s trial lawyers.

One unnamed “friend” (the book is jam-packed with them) says, “I can’t say I know they had sex,” while a different “friend” proclaims, “The thing that people remember is her freak-out, how completely crazy she got: I [expletive] a black man! She was just horrified.” To his slight credit, McGinniss gave Rice a call to check these claims, but he fails to record a point-blank answer to the straightforward question of whether the player and Palin slept together. Instead, McGinniss asks, “So you never had the feeling she felt bad about having sex with a black guy?” to which Rice politely answers, “No, no, no, nothing like that. . . . I think the utmost of her.”

Why Sarah Palin won’t sue.

There’s a little thing called discovery. If she sues she can ask discovery of McGinnis. But, don’t forget. He can ask discovery of her, concerning what’s in the book. By court order she’ll have to turn over he Trigg’s (or is it Tripp?) birth certificate. And the lawyers can go into details about how her water supposedly breaks in one part of the country and she flies all the way back to Alaska. How many women do that, unless, of course, they weren’t pregnant, but their daughter was.

Will the tea party accept that not only did she have sex with a black man, but it was just a one-night stand. Imagine her on the witness stand having to detail that incident and answer a question about other one-night stands. Teabaggers are against women having sex, and particularly one-night stands with black men. There go all those speaking engagements.

She has more to lose than McGinnis. She can be questioned about everything in the book and her personal records subpoenaed. Not a chance she’s going to let that happen.

So right now it’s all huff and puff, and then she’ll decide not to sue. She loses everything if she does. No more speaking engagements. Loses Faux News hosting. She won’t sue.

Out of curiosity if you belong the the Tea Party if you found out for a fact and with her under oath having to answer, that she had had many one night stands, with lots of men. Will you think she’s that much of a Christian. If you found out her true academic record, would it matter to you?

I love how she demands that the publishing how doesn’t delete any emails! Isn’t she the person who took 997 days to release her emails after they were requested via FOIA–a longer wait than the time she served as governor? And after all that time, thousands were still never released. Meanwhile, much of her state business was conducted on personal yahoo email accounts. No wonder why she and Gov. Nikki Haley get along so well.

This isn’t the first time JOE MCGUINNESS was sued by a subject for publishing unsubstantiated information. Look up the case of JEFFREY MACDONALD–the green beret who was found guilty of murdering his wife and two daughters. McGuinness published a book about the crime called FATAL VISION, later made into a movie with GARY COLE. Macdonald–while serving a life sentence for triple homicide–SUED MCGUINESS and won.
That said, it isn’t surprising that Joe finds himself again served with papers based on his shoddy writing practices.

Hopefully all the attorneys can take the time to ask Mrs Palin to verify and prove her many accusations about the President. The letter she is basing this on was dated nearly a year ago and any questionable items were fact checked or omitted before publication. Some of you defending her must think that Random House doesn’t employ a very adept team of lawyers who do insist that authors prove their points before publication. But, it will be nice to get her on the stand for once. And side note to ABC “News”, Mrs Palin is no longer entitled to call herself a governor.

I am an avid reader….usually I buy the books but now anything published by Crown Publishing will be from the local library. I urge others to do the same. Put them out of business which we can. McGinnis sounds like Dan Blather who so much wanted his fabricated story about Bush to be true that he refused to accept that it was a load of rubbish. McGinnis and Random house deserves to be sued. Creepy guy puts out a book and has no way of showing any proof.. McGinnis was a little sloppy that an email falls into the wrong hands showing he has no proof and the publishing company was aware of it. I don’t think Palin would have any problem winning a lawsuit. It is about time someone took these creepy writers to task. If they are going to write about someone make sure it is the truth. OK, so Palin gets her day in court. So what happens there? The entire book will be examined and cross examined in detail, phrase by phrase for irregularities or false statements by both plaintiffs’ and defendants’ lawyers. Out of the hundred or so references to the Palins’ dirty dealings, lies, affairs, threats, etc, in JM’s book, how many falsities, lies or innuendoes would Random House legal experts have missed? If any, maybe a couple, or a few that weren’t properly vetted. I doubt if there are any but in order to find those couple or few there’s dozens and dozens of incidents, personal stories, references that will be brought up and analyzed to the nth degree. I’ve no doubt that will have $arah Payme curled up on the floor, blubbering like an idiot, wishing it would all go away. I would feel some sympathy for the woman but after three years of her vicious lies and ugly personality, I can hardly wait to watch her melt down into a raving idiot. Go away, you hag!

Unlike most of the posters here, I’ve read the book and I’ve read the email in its entirety.

The Rouge is not a hit job. Joe McGinniss is an experienced and well respected author. His work was examined by his publisher’s lawyers with a fine tooth comb. The email isn’t about stuff that he put in the book; it is about the stuff that he wanted to put in, but couldn’t because he didn’t have enough evidence. It shows how diligent he was, not how negligent.

If you read the book, you’ll see how it makes it very clear why it is difficult to get people on record for the things they say and know are true about Sarah Palin. She and her husband are horrible bullies and run roughshed over nearly the entire town of Wasilla. Documentation is only one type of evidence. McGinniss has stated that he double sourced everything in the book. Obviously, he has covered his ass.

Palin felt pressured to sue because everyone was saying if she didn’t sue, the book was true. She now has threatened to sue, but that is not the same as actually suing. She won’t do that because she would have to prove her version of events is the truth, and there is no way that she can do that.

I hope she sues and they air the entire proceedings on TV. Heck, I’ll schedule my vacation days for that hootenanny. She can’t handle an interview that isn’t conducted by her co-workers at Fox News. Her debating skills were poor in 2008, and since she won’t ever announce her run for President, we’ll probably never see her debate again. Watching her do that “folksy talk” in a courtroom would be hilarious!

I’m going to get that book. I wasn’t that interested before (not that keen on gossip), but if it’s caused this much of a ruckus, it’s gotta be good… even if it’s fiction.

In the movie version, I picture Roseanne playing her… or perhaps Kathy Griffin (assuming Tina Fey isn’t available). Todd could be played by “Larry the Cable Guy”.

Everyone, and I say EVERYONE, should be po’d when someone writes a book about any public figure and admits that they have no evidence for their allegations about the person they are writing about. For those who hate Palin and cheer against her, ask yourself how you would feel if a conservative writer penned a book about Bill Clinton or Obama and admitted that they had no evidence for any of their allegations which were the selling points of the book. Liberals cannot have their anger at such a scenario and yet not be angry when the same standard is applied to someone they do not like.

I wish Mrs. Palin well. McGinniss looks like a stalking slimeball, and now that he has admitted that his book is without sources, perhaps he can dole out millions to the people he screwed.

This would not be the first time McGinniss has found himself in trouble over accusations of unethical journalism. In 1987, McGinniss agreed to pay $325,000 to settle a lawsuit brought by the convicted murderer who was the subject of McGinniss’s book Fatal Vision.

Did McGinniss really think that after 50+ books about Palin, tens of thousands of articles, and hundreds of hours of air time, plus the release of 24,000+ pages of emails, that he would actually find some kind of scandal about her?

It will be extremely difficult for her to win a suit against Crown. If laws have not changed since I took Business law, it is next to impossible to prove malicious intent against a public figure. In agreeing to run for Vice-President, she became a public figure. Also, the truth is a defense against libel; therefore, if what has been printed is true or if evidence can be presented that one cannot determine whether or not the printed material is true, she will lose on these charges as well.

It’s interesting how journalists often write stories without giving you any background about the story. At the very least, the writer should have mentioned what rumors were mentioned in the book. How can you have a story whereby the writer simply talks of rumors and does not elaborate at all on them? How does it spark the readers interest? No assumptions should be made that the reader already is aware of everything about the story.

Wasn’t Sarah supposed to make her “big decision” by the end of September? Is she waiting for 11:59pm on September 30th to finally tell her worshipers that she’s backing Bachmann or Perry or whoever isn’t afraid her support will tank whatever hopes they have of winning the GOP nomination?

The day she makes that announcement, we’ll see her fans scramble — will they abandon hope of a Palin presidency? Will they do as she orders and back whomever Sarah tells them to support? The story about Sarah Palin threatening to sue has some big holes in it starting with the letter you refrenced by the law firm that supposedly supports her. Not only is the letter not written by lawyers, After doing some simple google searches on the internet, I’m not sure that is a law firm that is authorized to represent her.

My doubt is fueled by the fact that just this year the law firm in question tried to submit a patent to trademark her name without her consent. It was of course denied, and the office said if Palin’s consent was obtained then they would resubmit it. Which was not done.

My fear is that ABC is spreading false information, and this is looking more like a publicity stunt by Mcguiness. The corruption of the media jades us all to see the media as untrustworthy. I hope you research and repair this story. I will make sure people know the information I have, and hope you do the same.

Why are the self proclaimed “tolerant liberals” so hateful and intolerant? Just read through the comments and see the nasty intolerance coming from the left. You’d think Palin had sex with a 20 year old intern or something.

I think it would be very unwise of Sarah Palin to pursue this lawsuit:

- Since she is a celebrity in the public eye, freedom of speech considerations imply that the onus is on HER to prove these allegations false. Even if they are all false, it’s not going to be any fun to prove that: a lot of witnesses and depositions. Neither she nor anyone else in such a position is going to come out looking particularly good from such a process.

- Even if she wins, what are the actual financial damages? Arguably, NONE. In that case, she won’t get much back.

It reminds of the old story about Senator X: He was incensed because a newspaper printed an article calling him “the dumbest legislator in Washington, D.C.” He called a press conference explicitly to deny being the dumbest legislator in Washington, D.C.; thereby proving that, in fact, he was.

If Palin pursues this lawsuit, I think she will out-do Senator X.

McGinniss reminds me of Dan Rather just after he got fired for making up that story about G W Bush’s National Guard service, resorting to obviously phony documents. When questioned, Rather claimed that the story was true. It was the ‘evidence’ that was false.

I thought Sarah Palin was delusional but her supporters are even more delusional. Sending a letter threatening a lawsuit doesn’t mean anything unless you actually follow through with a lawsuit. This is nothing more than an empty threat attacking people for telling the truth about her that she doesn’t want the general public to hear. It’s always lies, gossip, and innuendo unless she controls the narrative. The woman is to thin skinned to be in the spotlight. She really needs to go away since it’s so obvious she just can’t handle the criticism!

She certainly did not ask that a book full of lies be written about her. This issue is out there not because of Palin, but because of the actions of a lazy reporter and his dishonest publisher. When you print a bunch of unsubstantiated claims about someone, you should expect to be sued, and I’m sure they expected to be sued because by publishing this book that even the NY Times said was all gossip, they invited this suit. Palin would actually look weak if she did not sue.

It certainly sounds like defimation of character to me, the question is that many of the courts want proof of finacial injury. don’t ask me how they come up with those kind of rulings. but if we consider that spent on a Presidential Campaign, the loss of wages while in the Whitehouse, the loss of speaking engagements.

for example lets look at a true proven criminal William Jefferson Clinton and his wife Hillary,
entering the Whitehouse they were nearly penniless, but now from out of nowhere they boast of a net worth of $200 Million Dollars, most likely from the $600 Million Haitian earthquake funds unaccounted for.

so it would not be unreasonable for Sarah Palin to sue Random House Publishers for $200 Million dollars for defamation of character, and another $100 Million for punitive damages, and certainly another $150 Million Dollars in damages for Pain and Suffering to her family and friends.

He makes an unfounded claim that the Clintons “most likely” siphoned funds from the Hatian relief effortand that Clinton is a proven criminal. What planet is he from? For his edification and enlightenment, Clinton is not a “proven” criminal and their wealth came from book deals, speaking engagements and consulting fees (Bill’s).
Fezzy’s email is indication why dingbats such as Palin,Michelle Bachmann, Christine O’Donnell and Sharon Angle make such outrageous statements and thus display their abysmal ignorance.

To the putz who brought up Dan Rather, Dan was misled that the data he was working with was true and accurate by his staff and producers. When he found out it might not be accurate, he stated, “If I knew then what I know now, I would not have gone ahead with the story as it was aired, and I certainly would not have used the documents in question.” Dan Rather thought he was working with good data, Crown Publishing and Joe McGinniss on the other hand appear to be knowing before they printed this book, some of the information might not be true. There is a huge difference between being mislead and what appears to be intentionally printing unsubstantiated information.

I am 3/4 thru reading this book you all call “trash” and “gossip”. I follow politics very very closely. I kept an open mind. It is my opinion now that my instincts about her and her family were dead right: she and her husband are school yard bullies that will stop at NOTHING (literally!) to get what they want from who they want and as much as they want. Mr. McGinniss did NOT stalk her; her neighboring house, formerly full of drug addicts and alcoholics, became available for rent just as he was looking for a place to rent to his research. Funny how the book doubled in size because all the nasty remarks from the Palins, the threats of violence against writer’s Joe M. life, etc. by the Palins directly gave Joe another 100 pages to work with thus doubling the size of the book!
I’m from Michigan. SARAH PALIN IS NOTHING MORE THEN A WHITE FEMALE VERSION ON DETROIT’S FORMER IMPRISONED MAYOR, KWAME KILPATRICK! If you need to look it up – then do it. If you didnt’ read the book, I guess you can’t really have an opinion other then the garbage you see on TV.

P.S. the reason for many of the “un-named sources” published is because those folks still live in Alaska and are afraid they will be targeted in some way by the Palins. It’s a proven fact. No one can/could afford to risk there jobs or having there kids beat up or house vandalized by allowing Joe to publish there names. I don’t blame them!!

The discussions on here are classic. Everybody talking bassed on what their hero has said, not about what they have read. I do not give Ms Palin credence after listening to her rants, nor will I pay for Mr McGinnisess’ book. I would find it interesting to be in the depositions as the questions go forward to both Ms Palin and Mr Palin. It would also be very interesting if some of the sources, if they are real, to come forward in the depositions. An interesting legal discussion I heard the other day was that Mr Palin would have a much greater chance at the suite than Ms Palin as she is a public figure while he, regardless of how she has made him part of her team, is still a private figure therefore the rules slander differ.

The e-mail admitting that he could not substantiate rumors relates only to stories that never made it to publication. It has been taken out of context in the “threat” to sue. This is a typical lawyerish trick to attempt to make the author look bad. In the end, she will NOT sue, and if she does she will lose. The author can substantiate everything that made it to print. As he has often said… he did not print 90% of what he heard because it could not be substantiated. The Palins have no intention to do anything at this point but discredit an honest author who is simply doing his job.
