A judge has allowed the lawsuit against YouTube and Reddit filed by survivors of the Buffalo Tops shooting and a family member of a victim to move forward.

In a first for the Biden administration, the Department of Justice is seeking the death penalty for the Buffalo supermarket mass shooter.

The Justice Department said Friday in a court filing it will seek the death penalty for Payton Gendron, who killed 10 people at a Tops Supermarket in Buffalo in May 2022.

The Justice Department cited the shooter's intentional infliction of bodily injury, intentional participation in an act resulting in death, and blatant racism associated with the shooting.

Payton Gendron has already been sentenced to life without parole in the state case, but he still faces 27 federal counts and for those the Department of Justice says he's eligible for execution.
