Reporter: This morning, nearly two years after Joan rivers' death her family has reached a settlement with the doctor who performed an unauthorized biopsy on her throat. The family lawyer spoke to us overnight. Their acts and omissions ended up taking the life of Joan rivers. Reporter: Rivers went into cardiac arrest during what was supposed to be a routine throat procedure. Her daughter Melissa filed a lawsuit claiming her personal doctor never should have performed that biopsy at a clinic. The suit also allegations doctored involved didn't notice her vital signs plumbing during the procedure and accuses one posing for a photo with her when she was unconscious. It caused her to have worse care. Reporter: The 81-year-old died in September of 2014 following the routine elective throat procedure at this new York City medical clinic, not a hospital. In a statement her daughter Melissa says I'm able to put the legal aspects of my mother's death behind me. Melissa rivers is walking away with a settlement that is substantial but regarding the death of her mother, it's something that never should have happened. It didn't have to happen.
