I'm Michelle Franzen -- New York with the latest on the investigation into the deadly crash that left comedian Tracy Morgan hospitalized. ABC's -- -- joining us now with more on the story. Aaron that crash happened in New Jersey on Saturday June June 7 what are we learning about the trucker accused of slamming into the limo bus that was Tracy Morgan. And his entourage were the it. Michelle the NTSB is out with a preliminary report this is by no means conclusive but we've learned a couple of key things one. -- at a truck was going far too fast it was going. Twenty miles per hour over the posted speed limit which had been reduced to 45 miles per hour. So for the full minute prior to the crash federal safety investigators say. The driver of the Wal-Mart truck Kevin roper was going. 65 miles per hour slammed into the limo van that was carrying Tracy Morgan and others which just didn't stand a chance we saw three -- -- that the NTSB put together and you could -- that. That the van was just crumpled. By this and the other thing we learned in addition to the speeding. Was that the driver Kevin roper had logged nine hours. 37 minutes of driving in nearly fourteen hours of work and that's right near the maximum daily limit. That maximum is fourteen hours right what else will investigators be looking at about those -- hours taking into account what they learned from. His driving on the road what about. This time before that. Well they're gonna wanna compare that the driver logs to other information that they're able to glean from police from prosecutors. Just to see if -- all checks out because remember police have said. That Kevin -- hadn't slept for more than 24 hours prior to the crash and is so they want to know how that squares. With the driver logs sold want to check to see whether anything had been altered or whether everything had been properly entered. So they can get to the bottom of what caused the crash there were posted speed limit signs about a half mile. Before the accident site and general for most of miss those because they said that due to construction. The speed limit on the New Jersey Turnpike along that stretch about an hour outside -- New York City had been lowered to 45 miles per hour he was still going twenty miles per hour over that. Yeah let's talk about that a little bit too posting that point nine miles before that construction -- and another. Point four miles give us an idea about the construction in that area what witnesses have told. Authorities as well we've learned from this -- preliminary report. Well it had shut down a lane and at least one lane if not too and so traffic can really come told a bottleneck and had to slow down and here comes the Wal-Mart truck going 65 miles per hour. And in the 3-D scans that the NTSB showed us not only is the limo -- and we're Tracy Morgan was riding. It was not only was that crumpled. You saw the the Wal-Mart truck also sustained a significant amount of damage and so the collision. Was certainly severe. It killed a man James McNair Jimmy Mac on the on the comedy circuit as he's known enough a writer for Tracy Morgan and a friend and mentor Tracy Morgan. And and others were taken -- the house. And -- sixteen people -- all involved in that but no one else needed to be taken to the hospital of course. Give us an idea oh what's wal mart's response from the beginning to this and how might that. Impact the investigation. Full Wal-Mart has said from the start that they would take responsibility. But they also said that the driver Kevin roper. Who is facing criminal charges now was operating within the limits of of the federally mandated workday and the NTSB's preliminary report appears to support that again. Nine hours 37 minutes of driving in a fourteen nearly fourteen hour day. And and drivers are allowed eleven hours of driving in a in a full fourteen hour -- so he if he was close to the maximum daily limit. But not over it according to the NTSB's preliminary findings. So Wal-Mart is going to stand behind their driver even as Kevin roper is facing charges of of vehicular homicide. And and causing the injury to a number of others including Tracy Morgan. And -- with a preliminary report showing that there was possible speeding going on before this crash how might -- an impact. The court case as it moves forward. Well I think that the -- -- -- only support that the prosecutor's. Case to have to say that look he was going too fast and and why wasn't fatigue was there's something else going on. A prosecutors believe they -- have enough evidence to charge him. With vehicular homicide and those other charges to which he's pleaded not guilty by the way. And the other thing it does Michelle I think is so perhaps give ammunition for civil cases should it go. Come to that by some of the victims. It if they move in that direction to show that the driver was simply going too fast he was speeding -- negligent and in causing death and causing injury. And of course Tracy Morgan has been in the hospital this entire time since that accident on June 7 give us an idea what's the latest. That we know about his condition. -- went into the hospital and fairly grave condition seemingly lucky to be alive and if you do you see those that the pictures in the 3-D scans from the NTSB you understand the severity of the crash. It's a bit of good news in recent days he has been upgraded to fair condition. And has been more responsive according to his a publicist and so he continues to -- Again the expectation is that he will make up a full recovery but. It is also expected to be an arduous recovery.
