All coming up. Right now the midnight rider trial, the young crew member killed by a train the first day of shooting and the director and others facing possible prison time. ABC is tracking the case. Good morning. It is extremely rare for a filmmaker to face a criminal prosecution for something that happened on a movie set. This scene was being filmed on a Georgia train track. Was this crew allowed to be there? This video taken from a freight train barreling toward a terrified movie crew. Not all of them got away in time. Sara Jones, a camera assistant on "Midnight rider" was killed. And now more than a year later, a jury will decide if her death was a tragic accident or a crime that the movie makers could have prevented. They messed up real bad. Director Randall miller and his wife and the movie's executive producer all charged with involuntary manslaughter and criminal trespassing. They weren't supposed to be filming when the train sped by at nearly 60 miles per hour. I heard and I saw the train and you just immediately started running. It happened on the first day of shooting. Actor William hurt playing almond in his older years was onset and the crew was filming a scene about a dream when it instead turned into a nightmare. A crew member telling ABC news they had only seconds to run for their lives. Sara was the first person I saw. She was lying on the side of the tracks dead. The railroad company that owns the bridge says it twice denied the film makers permission to shoot on the tracks. The most challenging aspect is to be able to prove who did what and who is legally responsible for this tragic accident. In a statement miller and his wife said we would never know knowingly or intentionally put anybody's safety at risk and in civil court miller said it was not his job to get permits. I'm not the one that has permits. I was in the middle of the track and I almost died. Miller and the others pleaded not guilty facing up to a decade in prison if convicted.
