This is a special room. I'm Michelle Franzen a New York with -- ABC news digital special report. All in the family. Kerry Kennedy walked into court for day two of her drugged driving trial. With her family by -- side the 54 year old is charged with driving while impaired. After she took the sleeping pill Ambien crashed into a tractor trailer and kept going. Kennedy says it was by accident and that she meant to take some of her thyroid medication instead. Prosecutors say Kennedy should have pulled over and should be convicted. ABC's Josh Haskell is outside the courthouse in white plains new York and joins us now for more. Well Monday it was a day that was dominated by the prosecution and the witnesses that they called -- obviously -- opening statements in the prosecution. Called two men who saw Kennedy's car that day driving on the highway. The first person Henry Myers said he saw her car accelerate up to 75 miles per hour. It one point hitting this tractor trailer that was on the highway. That's when he called 911. But Kerry Kennedy continued on and that's when another man spotted her car who was also called yesterday as a witness he said he saw her car. Back up into a guardrail which caused him to call 91 once they described. What her state was that day the second man actually went up to the car and describe Kerry Kennedy is being slumped over the steering wheel. He asked her if she was okay she said she was and then he went on to call 911. So the jury. Watched dash cam video of what happened after those 91 calls were placed. And today the prosecution continues starting this morning with a state trooper that was on the scene of that 911 call. So we're hearing from witnesses from that morning also as you mentioned the state trooper. But the big news today is also the Kerry Kennedy could take the stand in her own defense how likely is that. Yes that's correct Michelle well we do expect the prosecution to wrap up today and at this point we've only heard that the defense is gonna. Call two people to stand Kerry Kennedy. And an expert on -- so Kerri Kenney would most likely be the first person they would call specifically a chance of her testifying later this afternoon. For the prosecution would of course have to wrap and that's in the air if she doesn't testify later today it'll definitely be. At some point tomorrow. She is here we saw her arrive again with her two lawyers. Fifteen minutes before court was supposed to start. Let's talk a little bit about her defense lawyers and it seems the judge wasn't too pleased with the defense's opening arguments yesterday in repeated. Mention of Kerry Kennedy's human rights efforts. Yes as the as -- defense lawyer tried to explain a little bit about what ms. Kennedy does. In her life for humanitarian work. The judge said let's stick to the evidence -- and he he he asked the judge to just. Sort of stick to the evidence rather than. Explain about the work and why she was out of the country. And just give me an idea of course we've seen family by her side this whole time including Ethel Kennedy. Showing her support but also looking very frail. Yes Ethel Kennedy arrived yesterday she actually walked into the courthouse but then. When she -- on lunch break with the rest of the candies that were here and she left she was in a wheelchair. We just saw Ethel Kennedy a few minutes ago arrive today again Tuesday for court and she was being pushed in that wheelchair she is of course 85 years old. But she was sitting in the front row yesterday I was I was in court in at one time when there was a break. I saw Kerry Kennedy walked behind the bench she left the table with her lawyers and sat with her mom and they -- and they talked for a few minutes about. How things were going in. They they seem obviously very close she's here for support along with -- two of Carrie Kennedy's Brothers were here yesterday so far today we've just seen her brother Doug. But I was told that she has many friends that are in court today showing their support. And Josh of course you -- you've been inside the courtroom give us an idea of course this is a high profile case a misdemeanor case but it's been moved. To a larger venue in White Plains give us an idea of what's going on inside the courtroom is packed. It it is pretty packed mostly with members of the media you have all the print journalists. From the New York area obviously have. You know a Kennedy a member of the Kennedy family apples here she's the ex wife of the New York governor Andrew Cuomo so there's a lot of attention here that's whites and a pretty. Big courtroom one of the bigger ones here in Westchester County. And I've not been up there yet today but from what I've heard. She has a much bigger section today -- friends and supporters so it appears to be. Pretty packed again today and again the prosecution will be. Taking their case for the second day here possibly wrapping up today any Dana anything else that we can expect today. If this point it's really just whether she testifies that's what everyone is is very interested in to hear her. Part of the story. Why she thinks this is just an accident arm and I know that obviously the prosecution will be -- -- question her. Pretty harshly. As she explains herself what happened in July 2012.
